FTJ needs more medical tests, court told

FORMER president, Frederick Chiluba needs more medical tests and has extended his stay in South Africa.

This came to light yesterday before a Lusaka magistrate’s court adjourned the case involving Chiluba and two others, to January 13 next year.

High Court registrar, Jones Chinyama, sitting in the magistrate’s court, adjourned the case after Chiluba’s lawyers applied for an adjournment because their client needed to undergo further medical tests in South Africa, which might take long.

Defence lawyer, Robert Simeza informed the court that Chiluba required to do more tests and therefore it was inevitable that he extended his stay in South Africa for another week and the Government had approved his stay.

This is in the case in which Chiluba is charged with Access Financial Services Limited directors, Faustin Kabwe and Aaron Chungu of theft of public funds from the ZAMTROP intelligence account.

Chiluba and his co-accused were scheduled to continue with their defence this week.

Chungu and Kabwe were present in court.

  28. I think Chiluba is tired of these cases, our justice system has failed to make decisions on these cases and every one is just guesing. For those of you still following these cases i must commend you for your perseverance. If we applied such perseverance to Maize farming now that its rain season in Zambia our brains would surely get out of the stomarchs on its way to the Head for reasoning exercises.

How do we forgive some one who is as innocent as Chiluba? personally, im content with Love, forgiveness and practicing what i preach to a person who shows remorse. by the way my grand father is serving a 4 year sentence slaped on him because he wanted to secure us a piece of land that only cost 500,000.00ZK. Why shouldn’t this happen to Chiluba? [-(

Now to make a simple trip from Kabulonga to High Court, he needs to go and get clearance from SA. What nonsense is this?

  39. I totally condomn what the plundering of our resource by Chiluba.And although am pf,but i wish to state here that i think Chiluba has suffered enough. As much as we condemn what chiluba did,lets also have a human heart.Just look at how the past 8 years have been for Chiluba.The only foreign country he has been going to is South africa,for his medicals.He has been sick and only going to court.I he can apologise and show remorse,for me i think it wouldnt be bad to let him free.

  44. Can someone let us know exactly what tests this man is being subjected to? By the way people, South Africa ain’t a cheap place to seek medical treatment of any sort. It is very expensive! Of course this means that we the people are picking up the bills for someone that messed up the systems in the first place. Secondly can someone reach out to the parliamentary committee responsible for such matters to get to the bottom of this issue. Then lastly I propose that from now on he be referred to UTH instead. Current leaders please take note and start using UTH and other local medical facilities. Zambia will go broke soon!!! :((

  46. Chiluba was celebrating when he heard that Mwanawasa had collapsed. This man deserves no forgiveness because he keeps treating Zambians as people he can still manipulate with impunity. I feared for his delaying tactics and would not have allowed him to go this time round. When LPM collapsed, Chiluba was busy laughing that I can drink a cup of tea without any worries now. So let him face the law and prove to the world how innocent he is, Richard Sakala suffered because of being loyal to this ka man and he has not helped him at all. Send the ka man to Mukobeko and let him confess.

  55. Governance in Zambia since 1991 has been a ‘funny’ game.
    Chiluba, SATA and his friends made laws to victimise the preceding govt and opposition parties; unfortunately some of these laws have caught up with SATA who is very bitter because he knows very well the intention of some of these laws.
    Mwanawasa also from the Task Force primarily to deal with Chiluba and his accomplices. The whole campaign against corruption was not a wide story but very targeted towards known individuals. This diluted the fight as should have befited its description. As a result corruption rose to very high levels during the same period as people knew there was a weak system that was not all encompassing.

    So Much money has been lost due to the same process without much result due to a weak legal system.
    It is not necessarily that politicians manipulate it but the laws themselves make it very difficult for lawyers of these suspected plunderers to lose cases in courts of law.
    The entire civil service system including the private sector has become so corrupt that correct things are now treated wrong and wrong treated right.
    This is why aprt from mere good will there is need for total surgery to our laws and the entire professional system.
    We can not have institutions charged with sentive matters but with no powers to proscute.

    Court cases are a function of courts.
    And courts are a function of laws.
    And SATA has been making these laws for a long time.
    So where do you draw a line between SATA and the current laws zambia has.
    SATA remains a factor in these issues whether you like it or not.
    I cannot just enoy a gift delivered to me by DHL/Swift without asking about where it has come from.
    So as long as SATA remains part of the source of these problems regarding our legal system we will continue to mention him.
    There is no way I can only remmeber SATA when it comes to the fly-over bridges without linking him to the current laws of Zambia.

SATA worked with Chiluba closely and not only that but he was one of the senior members of MMD who made sure Chiluba was in power both in the party and the nation. My water-logged head still remembers that while PF today is trying to stone Chiluba at funerals, their leader SATA fought for this same so-called thief to rule for a third term.     The POST Newspaper started this story long before 2001, and SATA was still in govt. SATA defended Chiluba both on radio and televion and today he becomes innocent. He may not be found guilty by the courts of Law, but that does not mean he did not approve of Chiluba. So did SATA approve Chiluba in the interest of Zambians or in his own interest to remain in power. SATA left the MMD in 2001 to for his PF; was it not because his personal interest was threatened. Immediately he changed language and yet a month before he praised Chiluba and wanted him to continue ruling. Did he do all these things in the interest of Zambians or his own.

    If I mention SATA’s support and fight for Chiluba’s third term I dont see how Chewe should be provoked. Chewe should have been provoked the time SATA was championing ‘third term’.

Enriching Nchito is a crime on its own especially when the government should have trained its own prosecutors by now. What is the role of leadership if it is not to build national capacity in all areas in need of skills?     Before you decide to take someone to court for prosecution , please do your homework well, get your facts right and obtain water tight evidence for you to secure a conviction.

    The judicial system is not about what you have heard outside court or what you have read in the newspapers. It is about what is presented in court by both parties.

    A prosecutor who takes over 5 years prosecuting a case, either does not know what he is doing or has other personal motives.

  121. How very sad, my only wish now is to have primary & secondary curricula changed to include intense civic education (or whatever is relevant). I am not too sure that Civics or any other related subjects taught at schools currently prepare us Zambians to engage with leadership. We just do not know what to hold these leaders accountable for!     It is all about what happens in court, nothing else. Perhaps we should now start questioning the huge amounts of money that the Zambian government have paid to the task force “prosecutors” and whether it is worth it.

    Are we getting value for money? This is a very simple principle of life. Even at household level we window shop because we want to get value for money.

    A more serious Government will expeditiously look into these case when that time comes. otherwise, the MMD GRZ has failed to bring these cases to a close in 8 years now and so it is time to move on . :d/
