Michael Sata gives speaker 7 day ultimatum

Patriotic Front President, Michael Sata has given speaker of the National Assembly Amusaa Mwanamwambwa a seven day ultimatum in which to declare the seats of 16 expelled party MPs vacant.

Mr. Sata said if the speaker fails to act by January 12th, the opposition party will have no alternative but to seek judicial redress in the high court.

He told ZNBC news in the Zambian capital, Lusaka, that there is no court order that stops the speaker from declaring the seats vacant following the discharge of the MPs injunction on December, 22.

But Matero MP Faustina Sinyangwe who is among the 16 expelled MPs said there is a notice of appeal in the Supreme court.

She said until the supreme court determines the appeal, the speaker cannot declare the seats vacant.

Mr. Sata however said his party and its lawyers have not been served with any notice of appeal.

Most of the MPs have been expelled for defying the party’s directive for them not to take part in the National Constitutional Conference.

  3. Just an observation. Why is it that some of the useless comments are from people in America and people from other parts like SA don’t post useless things like number 1 and insult. Is it because we the good policies of the MMD make it possible for dunderheads to find their way to the US. I guess you don’t need a brain win a green card but you need a serious qualification to come and settle in South Africa.

He has no power to order the speaker and as I earlier suggested the speaker may choose to ignore Sata’s directive until PF holds a membership register and organises a convention that would formally expel the MPs from the party. Otherwise, the Mps shall remain so until 2011. Tough luck Mr. dictator Cobra Sata, you won’t have it your way.

It is unfortunate that he does not even understand that the MPs are supposed to represent all people in the constituency and not PF (poor finishers). Did he ask the people whether they gave a go ahead for the MPs to participate in NCC? To me the NCC is an opportunity for Zed to at least come up with a better constitution. History tells us that there has never been such a group to look at all our past conctitutions and so let us be objective . This man must retire. The Speaker should not even move by his threats!   29. First things first guys. Those MPs crying foul agreed to be governed by the PF code of conduct and constitution, whatever it says. Therefore, they are bound by that. No two ways about it. I guess Sata is in order to deal them a dose of his venom. Secondly, Sata is very well-versed in local governance matters. When he talks, chances are that he has his facts correct. And this is one such a case where he is absolutely right. That is why he can even be seen to be ordering the Speaker around. Mumbwe ukulila ninshi pali uko ashintilile ama bums.   35. Whether anybody likes it or not, a bye – election is inevitable for the 16 constituencies.One can not below to an organisation and flout its tenets. If the 16 MP’s had the country at heart, they could have been the first to be contrite and resolve their differences amicably with their leadership and save the nation the expense of a bye – election. But as the matter evolved, they openly sided with the MMD and openly compained against “their” party in public in defiance to their president, party and it’s structures. Why should PF keep them? I hope some of them will be adopted by the MMD and see whether they will ever return to Manda Hill!Viva PF! Abash 16 MP’s!

  36. The NCC currently sitting must as a matter of urgency address the issue of by elections due to MPs defecting from one party to the other or indeed for whatever petty reason may be advanced. I foresee a situation where the MMD might be tempted to adopt as parliamentary candidates the rebel MPs being expelled from PF. This is the one unfortunate thing with Zed politics. By eleections must only be allowed to be held under very extenuating circumstances such as death of MP or if the constituents so decide by means necessary. What do think felow bloggers.

I write to differ with others talking about the expense of the by-elections without looking at how much money the gorvernment has wasted on the NCC without important issues such as the powers of a president,50+1 for a winning president and many others being addressed.The fact is Zambians will not benefit from the money that will be saved even if by-elections were to be avoided,instead VJ,Mpombo,Mulongoti,Shikapwasha,Rejected Banda and other MMD dons their girlfriends and families will benefit.That is why friends and family ni Pabwatoooooooooooooo chabe!

  45. By the way did you guys see Mulongoti on the 1900 hours news of Monady Jan 5, 2009 as he was inspecting the Chinyunyu bridge at night? Icould not understand why he had to go there at night. Secondly, Mulongoti shocked when me when he wanted to have a feel of the instability of the bridge by jumping up and down on it. What was 58kg going to do to that bridge when it was designed for loads in the range of 30tons. Shame because such is the calibre and mediocrity of MMD leadership. By the way, isn’t Kapembwa Simbao an engineer? Why did RB move him.

  50. #29 NINE CHALE, thank you for your contribution. The law passed in Zambia’s Parliament and voted for by PF says that all MPS are members of the National Constitutional Conference. Those MPs who are taking part are obeying the law. Mr. Sata is breaking the law and should be arrested for making MPs break the law.

    The NCC is a legal body established under the law and it has been following the law. What is more the NCC is trying to redress a discriminatory constitution which was created by Chiluba and Sata. WHY ARE INTELLIGENT PEOPLE STILL FOLLOWING A MAN OF CONFUSION. THE MPs HAVE DONE NOTHING WRONG!!!!

Sata was in govt for several years & am sure he should know that as long as a matter is pending in court,it cannot be disposed off by anyone else,those MP’s may have been expelled by PF or is it just him alone expelling them but as long as they took the matter to court & the court has decided their fate,the Speaker would be wrong to declare the seats vacant.Surely Sata could use a lil bit of common sense & doesn’t he get any advice from his fellows especially Guy Scott who i presume understands English very well,at least you don’t need to master law to understand some things,basic English & history helps.

    I have noticed that whenever there is a story on Mr. Sata, there is so much misconduct in this discussion forum. The language of some bloggers gets dirty and their insults become even stronger.

    If you carefully observe the forum, you will find that it’s the same offenders over and over again. Such disrespect towards our leaders or against each other is uncalled for on the web.

  53. The High Court Judge was right, because the MPs did not show how they will be injured if they were removed from NCC. The Supreme court will up hold the decision from the High Court.
    But this is the end of the most talkative of all, Faustina Sinyangwe, who is a teacher by professional, now she has found the new pasture in the PF and she has decide to bite the finger the feeds her, learn from Gladys who not only did she lost her ministrial position, but also the law was after her.

    Much as I am not in favour of indiscipline of any sort, I think that people closest to Mr Sata ought to advise him that this is not the best route for him to take. What are the chances that PF will retain all of those 17seats? what are the chances that PF will retain even half of them. Never mind the costs of the by-erections. The fact that the NCC has spent so many billions does not justify Mr Sata’s need for the massive by-erections. These people closest to him should tell him of how this money can best be used in improving the very lives of the people that these rebel MPs are representing.

    It is not an injunction. It is a notice of appeal that they have filed at the High Court.

    You see my fellow bloggers, popularity is a very transient phenomenon. Mr. Chiluba was popular once. Where is he today? It is always good to use popularity to advance a nation.
    I would advise Bashi Chilufya to use his popularity to support a new and better Constitution for Zambia. He should not use it to destroy Zambia’s chance to produce a durable Constitution and LPM’s legacy. When his popularity is finally gone he will be insulted like a dog for damaging the country’s future.

  64. Case in point, this is a coutry that stood before the whole of Africa & the world saying we will host the next AAGs yet had no clue what was involed despite participating in several games. Had no clue even where to start from coz we had not even facilities fit enough to host school games let alone international ones, we spent two years opening tenders to construct a grandstand at independence stadium…problem in Zambia is we lack discipline. We don’t hold erring officials be it in civil service, politics or private, accountable and they think they can just mess up and still live life as usual…at least this is a start, lets have those by-elections!!

  69. Collective decisions make it easy to govern political parties. These are the unwritten rules in politics. You cannot have a political party with players scoring in their own goal post.

    If the rebel MPs really disagreed with the decision of the party, they should have just resigned. We could have respected them for standing strong for what they believe in.

  71. IMWE MWE BANTU, the National Constitutional Conference Act No.19 of 2007 which was passed by the Zambian Parliament and supported by PF says that all MPs are members of the NCC.

    The PF MPs are supporting the law which they passed and Sata is asking them to break the law by staying away. When the law was passed Sata was supporting the Zambia Centre for Interparty Dialoque which supported the ACT. Sata only boycotted when the Catholic church pulled out. WHY ARE YOU PEOPLE NOT SUPPORTING THE MPS when you were supporting Muteteka who was not even going to be expelled.

  77. These MPs are governed by the PF constitution, I dont know if anyone has seen it but SATA knows it best. Why should they be allowed to ablogate their own belief (PF constitution). I want to support SATA on the expelsion of his rebel MPS, the only caution is that he should let the law finish these characters.

  80. By-elections will only be held if an MP dies of natural causes. Not just because some old man with a deflated ego wants to show who is boss. Forget it. I don’t support PF and am not interested but I will not allow people to be bullied like they are aliens in their own country.     May be we need to enshrine in the constitution that an MP should not change parties within the term of parliament(5 years). This will be fair to voters, who expected the MP to represent them in Parliament, and fair to parties. By-elections are expensive too.

Also at primary school, we would schedule several fights to take place at the end of the term. Sometimes we would have street fights – real kambongolo!!     The weather is horrible. It rarely gets below here but this time it is getting below zero especially at night. Snow and ice have not melted for 3 days now. When you pour out water on the ground, you can see it freezing up and stopped like a frozen river. Man this climate is not for an African.

    I had some expatriate teacher at secondary school. When the mines changed policy and recruted locally, a lot of the whites lost jobs.   150. He should have consulted on the possible consequences before expelling MPs with a knee jerk reaction. Instead of running to the press with meaningless threats he should, if he is so convinced of the strength of his case, proceed to the high court. His continuous threats of all manner of petty issues are becoming tiresome. Rather than ranting at the people on the shores who have little interest in his fishing trips, Mr Sata should concentrate on paddling his boat to its destination, wherever that might be.

  167. A political party is like a club. When you join there are rules that you accept to follow. If you do not agree, you either leave or you are expelled. These MPs chose to disagree, so they should leave. They are self and only serving their own interests. All they want is to enrich themselves. If this had happened in the ruling party, the matter could have delt with no court rulings. Let’s get really, let us have these bye elections, only then we will know where these MPs belong. Trust me most of them will end up being adopted by the MMD.
