Justice Minister Summons Dora Siliya to answer allegations on the sale of Zamtel

The Commission of Inquiry tasked to investigate the sale of Zamtel and Finance Bank has asked Former Communications Minister Dora Siliya to avail herself before the commission and answer the allegations leveled against her over the sale of Zamtel.

Mr Zulu, who is also Justice Minister, said that the rule of natural justice demands that Ms Siliya appears before the Commission to give her side of the story on the sale of Zamtel.

This follows allegation by Transparency International Zambia(TIZ) that the sale of Zamtel was illegal and that there was blatant disregard for the law when disposing off the company.

TIZ Executive Director Goodson Lungu alleged that former Communications Minister Dora Siliya usurped the powers of Zambia Development Agency by signing a Memorandum of Understanding for the sale of the telecommunications firm.

Mr Lungu was speaking when he made a presentation before the commission of Inquiry set up to investigate the sale of Zamtel, which started sitting in Lusaka on today.

He said that the former Minister did not get consent from the Zambia Procurement Authority to go ahead with the sale of Zamtel, which was blatant disregard for legal advice on the matter.

Mr Lungu also said that the former Minister over committed herself by agreeing on a five percent sale commission to RP Capital for the evaluation of Zamtel assets.

Meanwhile, the inquiry into the sale of Finance Bank to First National Bank will delay because the matter is in court. The Commission of Inquiry tasked to investigate the sale of Zamtel and Finance Bank, says it cannot investigate the sale of the Bank until the case is disposed off in the courts of law.

Commission Chairperson Sebastian Zulu made the ruling after Finance bank Chairperson Rajan Mahtani and his Lawyer John Sangwa has told the commission that Finance Bank Shareholders have instituted three legal suites against the Bank of Zambia over the transaction.

Mr Zulu has asked Mr Sangwa to avail the commission the details of their legal suite against the Bank of Zambia.

    • isnt your comparison of the fall of the dictators in the MENA and to that of Mahtani a bit far fetched? Those dictators where heads of states and apparently above their local legal systems. In a worst case scenario they had Presidential immunity. Mahtani is a private citizen, with no immunity from prosection or the legal system. There is no need for a revolution to bring him down as anyone who is aggrieved as recourse to the legal system.So where does the internet come in in this case? You also need to take into account the proportion of the population who have internet in Zambia as compared to how many have access in the MENA that which made it possible for it to be used as a means to mobilise the masses

  6. Dora Siliya again and again in the limelight of corruption and abuse of office. No wonder your ” Man” RB peed on this clause. All that baseless noise you have been making was just a defensive mechanism. You have failed in marriage and so is politics. I pray that justice prevails and that you get what you deserve. I think after serving your sentence you will be ripe enough to feature in “ready for marriage” programme. Good luck!

Selling to the Angolan firm as my eastern wisdom stated earlier was the best move. Firstly Africans would benefit as we develop together secondly an oil pipe line all the way to beautiful Luanda.   10. This is good for our country. Justice should prevail. Let Dora go and exculpate herself so that she doesn’t accuse our president or PF for witch hunting. If this was a genuine transaction,no need for her to worry and all of us will be happy. But if it involved corruption such as children of RB getting zamtel flats as someone has stated above, then someone will start appearing in court soon.

    Reading through the gazette one comes to the conclusion that;
    1. Matahni was guilty. Otherwise the other shareholders would have contested the BOZ takeover in court.
    2. It is so complex that President Sata could not read it nor understand it.
    3. There is nothing political there. Insider lending has a paper trail. If it didn’t happen, it would have been disputable.
    4. It looks like we are back to the Pre Meridien days where the state interfered with banking business and allowed banks to break the law with impunity as long as a few politicians benefitted.

  17. As for Miss Siliya, I am surprised that what went through due process of law including tribunal can now come to be dealt with through a commission of inquiry! There was an appeal and there is a higher court judgement in this matter. Is not this commission of inquiry in contempt of the court? Or are we developing parallel judicial structures?

  18. RB sold Zamtel and gave Provident Hse in Ndola to his son Henry Banda. This Provident house used to be Zamtel Head Quarter.

  28. #31 THE SAINT, I have similar thoughts on the matter. Lifuka has raised exactly the same arguments which were thrown out by both the tribunal constituted by parliament and the supreme court. Remember that the tribunal actually did not find a case against her based on the allegations by the gang of TIZ, Harrington, Post etc, instead they found her guilty of a charge which the tribunal itself crafted and she was not given a chance to defend herself against those new charges. That is what won her the appeal. Anyway, shouldn’t the commissioning of inquiry be directing their inquiry at the court which cleared her?

    Those questioning the relevance of an inquiry into the matter again need to know that the previous ruling in favour of Ms. Siliya can always be annulled if the new Commission comes up with (previously withheld) evidence that reveals that she indeed did not comply with Procurement laws on the sale of Zamtel. That is why it is only fair to give her a chance to tell her side of the story. Let’s hear what she has to say and wait for the findings of the new inquiry before we speculate any further.

      You are wrong here. A commission of inquiry is below a high court and is not a judge. The mandate is not to ascribe wrong doing but to learn lessons from the situation to make recommendations as to how the State should proceed in like matters in future. No one can be criminalised from a COI. The doctrine of double jeopardy precludes retrial for the same offence.
      2. No new evidence can be acquired as it is not an investigation.

  37. THIS ZAMTEL CASE SHOULD SERVE AS A LESSON TO ALL OF US ABOUT THE DIFFERENCE BETWEEN WHAT BELONGS TO YOU AND THAT WHICH BELONGS TO THE STATE (AND THE PEOPLE OF ZAMBIA). THERE ARE RULES, POLICIES AND LAWS THAT GOVERN THE ACQUISITION, MANAGEMENT, USAGE AND DISPOSAL OF WHAT BELONGS TO THE STATE. PEOPLE WHO DO NOT KNOW OR UNDERSTAND THIS REGULATORY FRAMEWORK SHOULD NEVER TAKE ANY OATH OF OFFICES THAT REQUIRE THE OBSERVANCE OF SUCH FRAMEWORK.   39. Indeed let the sale of Zamtel be revisited. However, Zambians should be worried over Mahtani and Finance bank activities. Finance bank used to eperate in Malawi and was closed after it was involved in money laundering and non compliance with bankig regulations. The same reasons were established by BOZ and appropriate steps were instituted that led to the alledged sale. Infact Mahtani was found holding huge cash that affected the cash circulation in the economy. Remember KK searched all Asians who were holding cash that hurt Zambia economy. BOZ have all facts. The sale of FNB was doubious and Sata was right to reverse it though should have been BOZ to do it wth ZPA and not Sata issuing the reversal in person. The handing over of bank to Mahtani is wrong because of money laundering by FNB.

The usual “empty tins” see this as an indictment of Dora Siliya on charges of corruption and stealing from the Zambians, rather than a constituted Commission asking Dora to give an account of her role as the then Minister. No concept whatsoever, that the Commission could and may in the end conclude that her part, wrong or right, did not break the Law nor did she benefit financially in anyway. Then what?     • Sometimes, it would important to look at the whole thing and not from a particular angle of your choice. Let us be honest, did Dora according to the Dennis Chirwa or indeed our context exonerate her from wrong dealings? Zppa, the mou, RP and the rest, were they done correctly by Dora? Our judiciary, you and I know were compromised. Do you think Judge Philip could have given RB/Dora a conviction? Let us not feign like we are saints. The all deal stinks! She needs isolation and punishment

  50. I have serious doubts about this government. It appears the government will act first and then think later after many things are spoiled. I expect a big disaster economically and later politically. Within this short period unconstitutional pronouncements have been made and in some cases corrected.   53. An inquiry is not a prosecution but rather a fact finding mission, therefore Dora has a choice to appear or not. But after the inquiry finds that rules and laws were broken, then her acquital by the High Court can be appealed at the Supreme, then she will have no choice but to appear. This is not witch hunting nor is it prejudicial as no one is on trial.
