The Commission of Inquiry tasked to investigate the sale of Zamtel and Finance Bank has asked Former Communications Minister Dora Siliya to avail herself before the commission and answer the allegations leveled against her over the sale of Zamtel.

Mr Zulu, who is also Justice Minister, said that the rule of natural justice demands that Ms Siliya appears before the Commission to give her side of the story on the sale of Zamtel.

This follows allegation by Transparency International Zambia(TIZ) that the sale of Zamtel was illegal and that there was blatant disregard for the law when disposing off the company.

TIZ Executive Director Goodson Lungu alleged that former Communications Minister Dora Siliya usurped the powers of Zambia Development Agency by signing a Memorandum of Understanding for the sale of the telecommunications firm.

Mr Lungu was speaking when he made a presentation before the commission of Inquiry set up to investigate the sale of Zamtel, which started sitting in Lusaka on today.

He said that the former Minister did not get consent from the Zambia Procurement Authority to go ahead with the sale of Zamtel, which was blatant disregard for legal advice on the matter.

Mr Lungu also said that the former Minister over committed herself by agreeing on a five percent sale commission to RP Capital for the evaluation of Zamtel assets.

Meanwhile, the inquiry into the sale of Finance Bank to First National Bank will delay because the matter is in court. The Commission of Inquiry tasked to investigate the sale of Zamtel and Finance Bank, says it cannot investigate the sale of the Bank until the case is disposed off in the courts of law.

Commission Chairperson Sebastian Zulu made the ruling after Finance bank Chairperson Rajan Mahtani and his Lawyer John Sangwa has told the commission that Finance Bank Shareholders have instituted three legal suites against the Bank of Zambia over the transaction.

Mr Zulu has asked Mr Sangwa to avail the commission the details of their legal suite against the Bank of Zambia.

  1. let the games begin. Ba LT in the same article you call Siliya Communication minister and again former comms minister. Chizungu futi ati ” sitting on Lusaka on today”.

  2. this is what is called kaponya style, following the laid down procedure.rule of law and giving the opportunity to the otherside of those who were involved in the sale, respecting the legal fraternity by not overlooking the courts.and it seems to me that the kaponya way is far much better than the paper educated who overlook the legal procedures in FNB.lets us gain EDUCATION OF NORM AND EDUCATION OF HEART(conscience of original mind) in our daily lifes.

  3. Yes let exculpate her self how she stole Zamtel. We know that they shared Zamtel properties scatered over Zambia. We know that RB’s child got some Ndola flats….really Zamtel is coming back to Zambians.

  4. Mahtani got the bank without a court case. The law was broken because the bank was supposed to be given bank to BOZ since it was in possession of BOZ. The findings of BOZ were gazzetted http://www.boz.zm/BOZGAZETTE/Government%20Goazette%2031-Dec-2010.pdf
Good old Sebastian maintains a loan with FBZ in the Kalomo branch so how is he Chairman of the commision?
Mahtani since you did nothing wrong and it was political persecution then WHY ARE YOU BLOCKING THE PUBLIC FROM KNOWING HOW YOU WERE POLITICALLY PERSECUTED? LET THE PEOPLE KNOW WHY BOZ MOVED IN YOUR FILTHY BANK.
MAHTANI LET ME WARN YOU THAT YOU CAN DELAY THE COMMISION WITH THE HELP OF YOUR GOONS BUT YOU WILL NOT BLOCK THE INTERNET. ASK YOURSELF WHAT BROUGHT DOWN GADAFFI, BEN ALI, MUBARAK ETC? IT WAS THE INTERNET.
    LET THE ZAMBIANS KNOW

    • isnt your comparison of the fall of the dictators in the MENA and to that of Mahtani a bit far fetched? Those dictators where heads of states and apparently above their local legal systems. In a worst case scenario they had Presidential immunity. Mahtani is a private citizen, with no immunity from prosection or the legal system. There is no need for a revolution to bring him down as anyone who is aggrieved as recourse to the legal system. So where does the internet come in in this case? You also need to take into account the proportion of the population who have internet in Zambia as compared to how many have access in the MENA that which made it possible for it to be used as a means to mobilise the masses

  5. PF so soon and yet so corrupt. yes corrupt; presidential idvisers are getting the salaries minus advising the president, sata honours his cadres at a national event, sata says he is sorry to angola because zambia supported an oppositon leader and yet the same chap is busy supporting an oppositon leader in malawi.

    • Sata is not stupid. Apologizing to Angola is strategic so we can be getting cheap oil from there which will be way below the price of middle east oil. Bringing down the cost of doing business. Sata is way ahead most of you, just watch and wait. He’s actions will bring more money in the pockets of everyone. Give Sata a chance. he’s not damn!!!!!

  6. Dora Siliya again and again in the limelight of corruption and abuse of office. No wonder your ” Man” RB peed on this clause. All that baseless noise you have been making was just a defensive mechanism. You have failed in marriage and so is politics. I pray that justice prevails and that you get what you deserve. I think after serving your sentence you will be ripe enough to feature in “ready for marriage” programme. Good luck!

  7. Okay MMD, so you didn’t have foresight wise educated people that forsaw that mideastern countries are highly unstable trade partners or investors. Selling to the Angolan firm as my eastern wisdom stated earlier was the best move. Firstly Africans would benefit as we develop together secondly an oil pipe line all the way to beautiful Luanda. Hope it’s not Maputo I lol. Let the law prevail.

  8. I have just been offered a job at Bank Of Zambia for £400million a year. Should I take it? How much is that on average please? I love Scotland, what is the average salary there please. My father sent my CV there

    Thanks

  9. # 1 you are right. I have spotted lots of similar mistakes by LT.
LT, mutisebanya please, don’t you have proof readers honestly to refine the work before posting for public consumption?

  10. This is good for our country. Justice should prevail. Let Dora go and exculpate herself so that she doesn’t accuse our president or PF for witch hunting. If this was a genuine transaction,no need for her to worry and all of us will be happy. But if it involved corruption such as children of RB getting zamtel flats as someone has stated above, then someone will start appearing in court soon.

  11. I HOPE THIS HARD BUM DORA GET CONVICTED AND GETS A LONG SENTANCE BEHIND BARS FOR PLUNDERING ZAMTEL MONEY. CAN ANYONE TELL ME WHERE IS SHIKAPWASHA THESE DAYS? IT LOOKS HE HAS GONE INTO HIDDING.HAVING A BIG MOUTH NEVER PAYS ANS HE HAS LEARNED IT A HARD WAY.

    • If you have enpireexce with web hosting then try to sell web hosting. Purchase reseller hosting from a good company like www. hostgator. com, www. webhostingjack. in, www. godaddy. com etc and start your own hosting business within a day or two.

  12. I feel pity for Dora. When she asked Rupiah for help, she was shocked the answer she recieved…”Dora its hi time you realised that we are all on our own and that MMD days are gone,”answered Rupiah.
What a pity, just swing you bums into action, maybe they will work again.

  13. Nonsense ! I thought Dora was cleared by some other Tribunal or high court. . . . Give give them a copy of the last tribunal or high court ruling and go home and chilllll

  14. Those of you complaining about LT reporting should always read the bottom line. LT just copies and pastes from Zanis, ZNBC, Times of Zambia, Daily Mail or FM etc, but NEVER from The Post. Recently it has added Zambia Watchdog as its source. LT does not have journalists.

    • I am glad you have clarified that coz I could not believe the ignorance exhibited by our colleagues. I was wondering if they appreciate research or is it the readong culture they lack?

  15. Now, coming back to the matter at hand.
Thank you @4 (Calculated Change) for the pdf document.
    Reading through the gazette one comes to the conclusion that;
    1. Matahni was guilty. Otherwise the other shareholders would have contested the BOZ takeover in court.
    2. It is so complex that President Sata could not read it nor understand it.
    3. There is nothing political there. Insider lending has a paper trail. If it didn’t happen, it would have been disputable.
    4. It looks like we are back to the Pre Meridien days where the state interfered with banking business and allowed banks to break the law with impunity as long as a few politicians benefitted.

  16. Dora is a survival obviously her bottom power will be applied to the fullest to escape this seemingly tight net cast around her. Her bums are specifically conditioned for such occasions and trust me she will put them to good use.

  17. As for Miss Siliya, I am surprised that what went through due process of law including tribunal can now come to be dealt with through a commission of inquiry! There was an appeal and there is a higher court judgement in this matter. Is not this commission of inquiry in contempt of the court? Or are we developing parallel judicial structures?

  18. RB sold Zamtel and gave Provident Hse in Ndola to his son Henry Banda. This Provident house used to be Zamtel Head Quarter.

  19. Dora just submit the Tribunal Fidnings to Sebasatian Size Zulu he can study that and then draw his report for his boss. He has 29 days to submit the report.

  20. Mr president go to the supreme court since this issue was handled by the high court instead of ur commissions of witch hunting

  21. Dora should follow RB to Jail, and sell all there properties in RSA and Malaysia.
We all know how Dora and RB where  in a relationship sorry Tandiwe you where too blind .

  22. Dora just go & say wat you know including mentioning the names of all those involved otherwise you will be chocked by a big bone while others will continue eating the meat!

  23. She is just answering and explaining how the selling was done. There are still calling it allegation. It is just the start. She can run away before they conclude. run Dora ruuunnnn! they shall get you.

  24. All cases went MMD`s way when they where in power. Infact I would be reviewing almost everything if I was President.

We saw Bootlicker, Capitalist and Aussie Engineer calling Kabimba the worst lawyer they had ever come across. Lets see how many cases Sikota wins.

I have said squeaky bum time Dora!

  25. I thought one Bill Haringtone has alot of information no need to waste time, he took the matter to court; check with Ba Zulu. By th away Hiringtone is a former min of comms.

  26. , ZAMTEL is performing better than it was run by government, there is new technology at zamtel which the government would not have managed to put in place.NGN, ISDN, 3G, just to mention but few…WHAT DO YOU ZAMBIANS REALLY WANT?? ZAMTEL WAS COMPLETELY DEAD.:”>

  27. We want jobs deliverying bills even if it is pre-paid ah! ah! more money in our pockets for driving a load of managers. We dot want a lobor tight company. thats why Dora should be jailed for creating lapgreen they dt want excees lobor? Our friends who remained tell us that there no time of lunch and attending funurels.

  28. #31 THE SAINT, I have similar thoughts on the matter. Lifuka has raised exactly the same arguments which were thrown out by both the tribunal constituted by parliament and the supreme court. Remember that the tribunal actually did not find a case against her based on the allegations by the gang of TIZ, Harrington, Post etc, instead they found her guilty of a charge which the tribunal itself crafted and she was not given a chance to defend herself against those new charges. That is what won her the appeal. Anyway, shouldn’t the commissioning of inquiry be directing their inquiry at the court which cleared her?

  29. its pay back time all bedroom deals need to be exposed now, dora ule you are exposed now, explain your self dear.

  30. Sata is not stupid.

  31. Good evening

Those questioning the relevance of an inquiry into the matter again need to know that the previous ruling in favour of Ms. Siliya can always be annulled if the new Commission comes up with (previously withheld) evidence that reveals that she indeed did not comply with Procurement laws on the sale of Zamtel. That is why it is only fair to give her a chance to tell her side of the story. Let’s hear what she has to say and wait for the findings of the new inquiry before we speculate any further.

    • Nine
You are wrong here. A commission of inquiry is below a high court and is not a judge. The mandate is not to ascribe wrong doing but to learn lessons from the situation to make recommendations as to how the State should proceed in like matters in future. No one can be criminalised from a COI. The doctrine of double jeopardy precludes retrial for the same offence.
      2. No new evidence can be acquired as it is not an investigation.

  32. Have we forgotten how mmd and Rb ran our affairs as some unpatriotic-traitors here want us to believe so soon? It is like you are mocking the genuine Zambians. Let them go to jail. Just so soon you want to turn Rb and his minions into angels? This is unacceptable. We demand justice . Every corners of our country must be cleaned. We want a Zambia where hardworking and honest will rule. We want people to excel on account of merity. Viva pf!

  33. #1 AND # 17, Your observations demonstrate just how poor the level of education has become in Zambia. If these journalists can write so poorly, what about our children who look up to them as role models? I feel like crying sometimes because poor English/grammar has become order of the day in almost every publication in Zed….

  34. worry not Dora! zambia’s corruption cases go nowhere, especially that RB your former boss ,are good friends with the current president.

  35. Fellow Zambians in the so called diaspora, most of you are a total disgrace instead of bringing tangable, progressive issues to the interest of faithful readers. You are busy off loading your delusions, hallucinations about what you have, your white lady wife so what?we have our black ladies also.#16 you are one of those I call aba WELEWLE…Some of you chaps you are just a bunch of liars here, tondolo musuma keep whatever you have,do to your self.Through my experience in diaspora, if you see a very expensive car, just know that it’s a foreigner driving abene tabaposako namano kuli fashion abapushi ni banione.Mulekwatako nensoni ubuwelewele fye mucimutwe.

  36. Post pliz dont leave us alone. report the way u have been doing the president was swearing someone with questionable deals remember the house of chiefs curtains he is back in pf govt

  37. THIS ZAMTEL CASE SHOULD SERVE AS A LESSON TO ALL OF US ABOUT THE DIFFERENCE BETWEEN WHAT BELONGS TO YOU AND THAT WHICH BELONGS TO THE STATE (AND THE PEOPLE OF ZAMBIA). THERE ARE RULES, POLICIES AND LAWS THAT GOVERN THE ACQUISITION, MANAGEMENT, USAGE AND DISPOSAL OF WHAT BELONGS TO THE STATE. PEOPLE WHO DO NOT KNOW OR UNDERSTAND THIS REGULATORY FRAMEWORK SHOULD NEVER TAKE ANY OATH OF OFFICES THAT REQUIRE THE OBSERVANCE OF SUCH FRAMEWORK. TO HAVE TAKEN OATH OF OFFICE AND LATER BREAK THESE RULES IS A BETRAYAL OF THE CONSTITUTION AND SHOULD THEREFORE BE HEAVILY PUNISHED. APPOINTING AUTHORITIES MUST ALSO BE CERTAIN THAT PEOPLE THEY HIRE HAVE THE CAPACITY TO UNDERSTAND, APPRECIATE AND UPHOLD THE ETHICS OF HIGH OFFICES, COME ON COMMISSION HAMMER!!

  38. Ba Dora if you had some extra change in this issue am sorry mwalaingila. We are tired of asking for aid when we can easily manage our affairs in Zambia.
King Cobra spare no one who has stolen.Look at street kids and other poor people in our nice Zambia. We deserve the best in our country.I am in diaspora not that cause l like it.GOOD CONDITIONS HAVE TO PREVAIL IN OUR ONLY LAND.NEXT IS GUNASE IN THE EMARALD MINES.BA SATA BWESHENI ICHALO CESU PANTANSHI WHERE POUND WAS EQUAL TO KWACHA.

  39. Indeed let the sale of Zamtel be revisited. However, Zambians should be worried over Mahtani and Finance bank activities. Finance bank used to eperate in Malawi and was closed after it was involved in money laundering and non compliance with bankig regulations. The same reasons were established by BOZ and appropriate steps were instituted that led to the alledged sale. Infact Mahtani was found holding huge cash that affected the cash circulation in the economy. Remember KK searched all Asians who were holding cash that hurt Zambia economy. BOZ have all facts. The sale of FNB was doubious and Sata was right to reverse it though should have been BOZ to do it wth ZPA and not Sata issuing the reversal in person. The handing over of bank to Mahtani is wrong because of money laundering by FNB.

  40. Siliya you thought this day will never come. Get ready for questions were is your boss noss now by the way have you called judge musonda

  41. The usual “empty tins” see this as an indictment of Dora Siliya on charges of corruption and stealing from the Zambians, rather than a constituted Commission asking Dora to give an account of her role as the then Minister. No concept whatsoever, that the Commission could and may in the end conclude that her part, wrong or right, did not break the Law nor did she benefit financially in anyway. Then what? We wait and see!! It is easy to see how easily lead and blinded some people can. It is as though the mind never takes in anything other then the headline out of any article.

  42. Just waiting for the chief honcho RB to wear his new silver bracelets, the evidence is overwhelming against these crooks even a new ZP recruit from Lilayi can break the case in a minute…this is just politics at play behind he scenes!!
My whiskey and cohiba cigar are on the ready and will only be content when BUFF00N RB is in cuffs!!

  43. A Dora, wenyo! Now that the cover has been removed, the real music must begin. They thought they could just steal with impunity and get away with it, boma yakana. Show these thieves that crime never pays. The MAN and his SONS must quake in their boots at the turn of events. “Fimangeni fakuya”!

  44. Mushota we pay in   ZMK not £, by the every zedian is now on blak berry. There is a fast train from chelstone to town. Tall buildin have been clad in sr glass and digital billboards..You can chill out at 1am for hot coffee.at shoping malls which now exceed 50, We have macdonalds.  and KFC at the cairo mall. Zambia is new place you cant believe it

  45. Sad for a young intelligent lady like Dora, who you would expect to contribute to development of our Country, being involved such silly Nonsense and Corrupt acts. We need a % of Female Leaders representing our women in parliament. Dora has just robbed them the chance as she will be prosecuted. She took the law in her own hands because she thought she was untouchable, RB you spoiled the young lady…
Here comes a bye-election for Petauke Central.

  46. Lesa ni Malyotola, the way Dora got excited over Mpombo’s bounced cheque? What is Dora going to do now since she threw all her nickers during her campaign?

  47. Am a good lawyer, doro siliya come and hire me. Nomba first, bushe mwalileka ukusunda? Awe cabipa mwe. I love u dora come and marry me and u wil be safe

  48. Sata is guilty of corruption here. How did he give the FB back to RM? RM has some serious issues to answer for according to the SI. We need to see fairness in the way Zambia handles all issues, plse Sata let the law take its course on RM

  49. Toothless commission though well intended. Dora was already cleared and this appearance is just a request. 90 day promise has its drawbacks including pressure to launch half baked but costly exercises…vozi funila

    • Sometimes, it would important to look at the whole thing and not from a particular angle of your choice. Let us be honest, did Dora according to the Dennis Chirwa or indeed our context exonerate her from wrong dealings? Zppa, the mou, RP and the rest, were they done correctly by Dora? Our judiciary, you and I know were compromised. Do you think Judge Philip could have given RB/Dora a conviction? Let us not feign like we are saints. The all deal stinks! She needs isolation and punishment

  50. I have serious doubts about this government. It appears the government will act first and then think later after many things are spoiled. I expect a big disaster economically and later politically. Within this short period unconstitutional pronouncements have been made and in some cases corrected. What will happen in five years if ever we will go that far.Can you imagin !

  51. GENTLEMEN ZAMBIA IS OURS, WE NEED TO SHARE OUR WEALTH EQUITABLY. SELFISH PIPO LIKE DORA, RB, MENTION THEM SHOULD LEARN THIS.

  52. guilty or not guilty – How do you give Finance Bank back to BOZ when it sold the bank without following any law on sale and even sold the Bank without approval from Competition Commission to the another Bank contracted as caretaker. stinks

  53. An inquiry is not a prosecution but rather a fact finding mission, therefore Dora has a choice to appear or not. But after the inquiry finds that rules and laws were broken, then her acquital by the High Court can be appealed at the Supreme, then she will have no choice but to appear. This is not witch hunting nor is it prejudicial as no one is on trial.

  54. Every dog has its day. Dora u re the wosrt manipulator amongst women ever lived, worse off than Delilah. U took we Zambians for a ride. Well this time around, we shall take turns in riding your bums in jail!

  55. It’s actually a great and useful piece of info. I am glad that you just shared this useful information with us. Please keep us up to date like this. Thanks for sharing.

  56. Ala Ba Dora will you please contact RP to evaluate yours diapers,Chishikapwasha tacimoneka, ngaka Chanda Chimbwii kayakwi?I suspect Bana Boma can be on the run, anyway let justice prevail.Threz a lot to come out.Can someone tell me who sold the Mpelembe building at Ndola Broadway roundabout,at what cost, who are the true owners, was it done in good faith?

  57. Heya i am for the first time here. I found this board and I in finding It really helpful & it helped me out much. I hope to offer one thing again and aid others like you helped me.
