The laws of the land are very clear, homosexuality is not allowed in Zambia-Government

Government has finally come out to give its position on the on going debate on gay rights ignited by UN Secretary General Ban KI Moon. Chief Government Spokesperson Fackson Shamenda has told a media briefing in Lusaka today that the laws of the land are very clear that homosexuality is not allowed in Zambia.

Mr Shamenda says Zambia will therefore not entertain the amendment of the law to allow for the recognition of gay rights. Mr. Shamenda wonders why the issue of homosexuality has become an issue when the UN Chief raised a number of important issues during his visit other than the issue of gay rights.

Responding to questions by journalists Mr. Shamenda said government will not waste time on an issue that is not of importance. He says there are a number of important developmental issue government can concentrate on instead of debating an issue that is guided by the law.

And the information, broadcasting and labour minister says the allegations made by former vice president George Kunda that the country has become undemocratic under the PF government are calculated at attracting sympathy from the international community on former leaders being probed.

Mr. Shamenda says it is evident that Mr. Kunda is panicking and using the baseless accusations to divert attention from the ongoing crusade against corruption. He says the PF government is committed to upholding human rights, the rule of law and constitutionalism, contrary to Mr. Kunda’s accusations.

Mr. Shamenda has since challenged the former republican vice president to cite a case where former leaders have been harassed and arbitrarily charged with offences outside the due process of the law.

Meanwhile, Mr. Shamenda has advised Mr. Kunda to go ahead and involve the Southern African Development Community (SADC) on the matter. He says the PF government will have nothing to hide to SADC because it has all the facts right.

The issue of homosexuality is a big thing esp if you are poor country placing a begging bowl before the pipo in your current nation. And by the way, laws are not cast in stone. I will give you an example of how your good president has overlooked such laws-the firing of the DG of ACC, hiring of unqualified Deputy DG of ACC and the appointment of BOZ governor etc… you know them and we all know them. The best time for any government to have come out was when Ban Ki Moon was still in Zambia. I did not realize Sata was such a coward. Any way the truth remains that Sata supports gay rights but he is hitting against the wall of Zambian resistance. That is why he asked the committee on constitution to postpon the constitution draft coming out to June so that they try their level best between now and then to buy as many people as possible to support their pro gay rights position.Fellow Zambians open your hearts and don’t be fooled and decieved again by this Sata and his team like they did before elections.

  36. Not so long ago, people thought that black people were less human. Yes, that was the case even here in Zambia. They even used the word of God in the Bible to support it. Today this has not changed much, but legally black people have been given their rights on paper.
    It is interesting that we are denying each other our rights and being disrespectful to each other. We even used God’s word to support our bigotry. If we continue on this path it will give substance to those people that do not believe that we are humans. Let’s give up discrimination, tribalism, xenophobia and many vices that we do.   51. Someone should explain the relation of the laws on the Criminal Code, with respect to the Zambian Constitution (of 1996), which has an extensive anti-discrimination clause in article 23:

    23. [Protection from discrimination on the ground of race,etc.]

    Homosexuality is wrong because it is SIN, and should not be allowed in Zambia.
    Shcking to see some people argue that religion should not be used on the issue; well suppose all zambians were all non-christians. Homosexuality would still be wrong because it is jusk like other wrongs like adultery.
    Human rights tell you that if two people agree to do something and it does not affect anyone, then it is OK. From this point of view homosexuality can never be right, because it will always, just like adultery, affect someone.

    If you wife agrees with some man and the two decide to commit adultery, why are you as husband offended, when the two have agreed – why are you affected?
    This question is the same as, if your daughter or son or brother, or sister is involved in homosexuality why are you offended as parent or brother or etc??
    These two questions are the same – i.e. if it is justfiable for a husband to be offended with his adulterous wife by virtue of his relationship with the wife, then the father entitled to be offended by his homosexual son by virtue of his relationship with his son.
    Therefore, in the context of africa (and probably everywhere in the world) it is not possible to prove that there is no single person offended by an act of homosexuality committed by someone.

    This means that if a person commits adultery it is not impossible in court to prove that there is atleast one person offended ; the husband of course (who is the closet relation will be offended). Therefore the act is an infringement and an offence.
    The same, if a person commits homosexuality, it is not impossible in court to prove that there exists atleast one person offended; the father/mother or children or siblings etc (who are closet relatives). Once this is established, then according to law, it is an infringment and therefore an offence.
    Can anyone here tell me that if two people committed homosexual acts and were discovered, they would prove that no single person would be affected or offended?

    If the husabands are entitled to be offended by their adulterous wives because of their relation, then parents and relatives are equally entiltled to be offended by their homosexual relative because of the relation they share.
    My conclusion is that even when you choose to be weaked and remove God in the picture, society still condemns the act of homosexuality in the same way, with the same effects as adultery.

  60. As much as I understand PFs position on this issue, we should ALL look at it from a bsaic and general perspective. True, the constitution is very clear on gay rights and all. But at the same time, there’s also something called HUMAN RIGHTS people. Like it or not, every human being has the “right” to do and be whatever they (whether intentionally or not) choose to be. Anyone gay should have the same rights as the non-gays. I for one don’t mind gays, as long as you don’t bring that sh*+ to me. Let’s respect and value individuals’ rights…human rights at that. This issue deserves a thorough and open debate from both sides. MY OPINION!

    • The issue of human rights i find to be very complex indeed. What next are we going to have animal rights too. I think one should come up with some sort of bill of rights which would specify the rights of the citizens. The issue of human rights is too general. We cant have it all otherwise no one would govern. I am very puzzled your piece; whether intentionally or not????????? It means we have the right to do wrong, rape someone if possible. Thats the problem with the concept of human rights its too generalised.

    How can Shamenda whom we hold in high esteem ask why people are not discusiing developmental issue, poverty etc. Shocking to hear him pretend he does not like use of logic when we know he is a wise, logical and reasonable man all along.
    All Zambians are agreed that we need development, including poverty alleviation and all other good things Ki-moon talked about. What Zambians do not agree with is the issue of homosexuality and that is where the contraverse is. We speak the blood of Jesus over the draft constitution and we declare that there will be no evil clauses introduced to the constitution.     If i were you i would never tell anyone to feel free to use a path where i know that there is a dangerous wounded buffalo.
    In my opinion it is wrong to tell other people to be free to do what I know is not good.
    if you know the food is bad, why would you tell people to feel free to eat under the pretext that it is their choice to do so???
    I realise that the reason why we will never agree on many things is the way we reason.
    I reason that if I know something to be bad i will not advise other people to feel free to get it – and i am convinced my reasoning is OK.
    Another person reasons that even if you know something or food is bad, you can go ahead and ecourage or advise others to eat it as long as they have made a choice. They too feel they reason very well. Oh my!

  89. This is a blow to democracy. The only other school of thought that this can be compared with is Fundamentalist radical Islam. We have proved ourselves to be rather hypocritical.   90. It’s okay now! We need not raise dust unnecessarily! Right reasoning with a cool mind and a peaceful heart will direct to the valid truth sought after. Wisdom is made manifest by one’s speech. And someone’s integrity is measured by the score of, at least, some consistence in self-expression in in day-to-day living. This does not mean the score should be 100%. But there are degrees in integrity to each one.  (Some food for thought.)
