LAP Green demands $480 million in Zamtel compensation

LAP Green Network, the Libyan Investment Authority’s international telecommunications arm has challenged the Zambian Government’s action to seize its 75% share in Zamtel.

In the petition filed in the Lusaka High Court today, LAP Green outlines it right to financial compensation for the value of the asset at the time of seizure should the shareholding not be restored to it, which is calculated to be US$480 million.

The Libyan firm is additionally claiming for substantial losses it has suffered as a result of the seizure of the shares.

LAP Green Network disputes the legality of the Zambian Government’s claim that LAP GreenN’s shares were taken for ‘public purpose’.

Wafik Al-Shater, Chairman of LAP Green Network, contends that it is very clear that the seizure of LAP Green’s shareholding in Zamtel by the Zambian Government was illegal and unconstitutional, and to the detriment of both Zamtel and its customers.

Mr Al-Shater in a statement released to the media says in the 18 months that Zamtel was under LAP Green’s management, it increased its total subscriber base by 600% to over one million at the start of 2012 and significantly increased the company’s market share, leading to a 50% increase in revenues.

He adds that the growth and prosperity that Zamtel saw under LAP Green’s management was unprecedented.

He explains that through major improvements and upgrades in systems and infrastructure, including a 100% increase in the number of base stations, LAP Green Network improved network performance and established a far superior service for Zamtel’s customers.

Mr Al Shater says LAP Green took a bankrupt company and developed it into a strong telecommunications provider able to deliver real value to all shareholders, to serve the Zambian people and to contribute directly to the Zambian economy sustainably into the future.

Mr Al-Shater says LAP Green is compelled to take this course of action as dictated by the procedure set out in Zambian law.

He adds that it is sincerely hoped that reason can prevail, and that LAP GreenN can resume making its important contribution to providing telecommunications services to the Zambian people.

Mr Al-Shater however, states that to recover the company’s significant investment in Zamtel, LAP Green will consider any and all legal options available, if necessary, whether in Zambia or in other jurisdictions.

No one had rights except if you were PF!!! But it’s the TAXPAYER who will pay for this looming CONTIGENT LIABILITY; maybe Sebastian Zulu and company should be surcharged post 2016???

We should have been strategic in handling Zamtel. The problem with the majority of people in Zambia is that we cannot analyze things beyond NSHIMA and unfortunately even some ministers and any politician will lie to us. WE SEE how it goes………………..

    When two elephant have a fight, it’s always the Grass, Insects & Ants that suffer on the ground. The tax payer will surrender up the bills in millions of US dollars in this fight.

    We knew this was coming. The agreement was not with MMD but with sitting government.
    The transaction was injured and Lap Green will have to be compensated for the future forecasts by the government.

    Sata knew this was coming and he appointed Wynter Kabimba to be on the Board of Directors, to run the show and become the spokes person to the public when the case kicks off.

    The irony is that Sata still believes Wynter is a pristine lawyer that can give him sound knowledge on this mater. Well, he is wrong.

    This case will prolong and it will cost the tax payer millions of dollars. So far LAP Green has hired 4 London Law Firms to guide them on International Law which Sata completely ignored to listen from. The government has to match with good lawyers and at a cost of the tax payer. This is a reverse of more money in the pocket for the tax payer.

    It’s the manner in which Sata grabbed back this company. He should not have manufactured a Commission of Inquiry to suit his agenda, but rather followed the due process. When all is said and done. PF will loose this case.

    They did not only get ZAMTEL FOR FREE, they received an extra $75 million from the Zambian people for their troubles.

    The entire episode was marked by intransparancy and CORRUPTION. The Zambian government has an EXCELLENT case. They will win outright, and the new ‘Libyan government’ will have to pay expenses.

    As far as I am concerned, they are not the legitimate government of Libya, they came to power through murder, including the murder of their head of state, and they have a horrendous human rights record.

    Let those rats compensate the people of Tawargha first.

      First Quantum are not being paid by DRC. The figure is $1.25 bn and it’s being paid by ENRC, the company that bought the DRC assets.

LAP GreenN has lodged a claim to the High Court that will teach and expose Zulu, Musa Mwenye and Mutembo Nchito as worthless lawyers on such real legal battles involving an international company. Just for the sake of getting positions in Govt this clique of lawyers went on rampage to mis-apply the governance corporate laws that revolve around the management of international companies. It will be interesting to note how this case will unravel a lot of dirt that the PF Govt has been sweeping under the carpet. The livelihood of Zamtel workers is at stake. And the youths anabagwilisa mwala – shala lapa minabuya manjemaje. The 90 days x2 = 180 days no jobs yet.

    Second of all, there are serious doubts about the legitimacy of the present Libyan government itself. They do not even control more than the capital. There is an Al-Qaeda flag flying over official buildings in Tripoli. They murdered their head of state. They massacred the people of Tawargha for being Black.

    Thirdly, the seizure of Zimbabwean property in South Africa has been reversed. You are talking about those losers from Afriforum, a group of BOERS. That is who you are defending.

    So don’t tell me that the Zambian government will lose when you do not have the facts of the case.

  31. I agree that most of us are commenting on the subject without proper understanding of what the real issue is all about. To me the issue is about frauding the tender procedure which understandably took place without knowledge of Lap Green. Had Lap Green known about the over all tender procedure and associated bench marks, I am pretty certain they would have wanted to get things done properly. Now that they realize that a mistake was made, they would like to recover their investment and some of the projected revenue. There is nothing wrong with Lap Green taking the matter to the court for mediation. What we all have to do is be patient for whatever outcome will come out of it. I am certain a lesson will be learnt by most us regarding what to do and not do in future.

    LAP Green has challenged the Government to the High Court and we know that this will end up in International Courts.

    Mugabe did this in Zimbabwe. He grabbed Commercial Farms, Food Processing Companies owned by the commercial farmers and gave all the proceeding to his ZANU_PF Cadres.

    95 %of the farms that Mugabe grabbed have not produced any thing since then. The end result was the collapse of the Agriculture Export Industry and forex earner for Zimbabwe. It reached a point where even hotels could not get enough food for tourist and it killed Tourism Industry as well.

    Those are all lies. Zimbabwe’s production has bounced back from 2008, when the *currency* was stabilized. Maize production has more than tripled, and tobacco production has more than septupled.

    Zimbabwe last year imported 1 Millions tones of maize costing $250-270m US Dollars.
    This year they will need to import an estimated about 1.2 Millions Tonnes of maize and the country has no money to buy the maize. They will borrow money to buy food for human consumption. Zimbabwe had the same favourable weather conditions to produce maize like Zambia in the last two years that gave us a bumper harvest. But it failed to produce enough maize because the Agriculture Infrastructure is still crimpled

    In the last 3 years, Zambia has received 45 among the top Commercial White Farmers from Zimbabwe who are now settling in Mukushi, Mbala, Chipata, Lundazi, Chama and Patauke. Botswana has more that 100 Cattle Farmers from Zimbabwe, Angola is booming with oil and more than 200 white farmers have moved into Angola in the 24 months. The exodus is till happen right now. The thing that has delayed most farmers to leave Zimbabwe was the compensation money from the government. Those that had money just zoomed off straight away

  43. I am not a lawyer but for LAP GREEN to demand that amount they need to tell us the amount that they invested in ZAMTEL. They know that it was fraudulantly sold to them and the best they can ask for is refund of what they paid and any other costs they incurred.     I am not sure where you are getting your facts from. Can I advice you to keep an eye on the London Commodities Exchange Markets where you can get up to date info, minute by minute about who is producing and selling commodities on the Global Markets

And MMD cannot be blamed for PF’s action to repossess without thinking of the consequences or even to carry it out in a legally acceptable way, with all those big name lawyers at its disposal Musa Mwenye, Kabimba etc. PF is an “adult” able to make its own decisions and take responsibility for it, ask Guy Scott or Wynter Kabimba.

  49. #62, the legal weakness in your argument is that you have to prove that Lap Green knew that the transaction was fraudulent. Whether there was fraud or not by government (note that I deliberately don’t mention MMD government, as government is government whether PF or MMD or ADD) in that transaction is immaterial. The bottom line is that the Zambian government sold Zamtel and the same Zambian government now “realises” that the transaction was ‘fraudulently” sold by itself and decides to grab it back.

  50. USD480M (K2.5 Trillion at today’s exchange rate) plus loss of business is a steep amount to pay Lap Green. Just prepare to sell the family treasure and compensate Lap Green.   53. I have read about some ‘intelligent’ people on this forum talking about Lap Green being able to sue Zambia in ‘international courts’. Please let us not mislead ourselves, LG can only sue in a court where the court has jurisdiction over the case. Zambia was able to sue Chiluba in London for example, because the a significant proportion of the transactions and some assets were under UK jurisdiction. LG is a Libyan company owned by Libya Investments Authority, which is in turn domiciled in Libya. I am not sure which other court would have jurisdiction over this case other than the Zambian and Libya courts. You however, have to note that Libya has no functioning judicial system.

  60. Just let the law take its course. The contracts signed at time of sale must have stipulated teh law jurisdiction governing the contract especially during disputes like this. Lap Green says they will explore the case in Zambian and foreign jurisdictions. they must know what they are talking about.

    If Zed Govt loses the case, it will be cheaper to give Zamtel back to lap Green than foot the full cost.

    Leave this issue to lawyers. Just get your pop corns out and watch elephants fight.

  65. @ 74 spot on, we are the only country that have such a sheepish attitude; we cannot defend what belongs to us because majority of Zambians are selfish people that don’t thing or respect their fellow citizens. It is High time we woke up, stood up and challenge some of these companies. ZDA, CEEC should empower Zambians so that we can own these companies. A sickening Attitude. 

  66. many people who post their comments on this blog know very little about the issues under discussion. They say, “Silence is golden”. Many who are writing in support of the Libyans are stupid in their thinking and their comments stinks like their mouths. Guys, did you know that communication is a security issue? How can you allow a foreign company to to control the communication in the country? You mean, it was okay for those Arabs to get the upper hand in as far as communication is concerned? Can those Arabs allow Zambians to do business in their country?No matter how much it is going to cost the Zambian government in law suite, I am happy for the action to get back the Zamtel from the Libyans. Those guys didn’t come to help Zambias communication sector but to steal from Zambians.

  67. All Zambians would be expected to robustly defend the take-over of Zamtel. Sadly one only reads about a good many nationals exhibiting weasle mentality, not proud of their nation’s wealth & assets.

  69. @Guardian what if we call you donkey and thieves who sell their property and then get back with force. Your cabinet approved the sale and Cabinet represents Government and the people of the country. The MMD was also selected by people of Zambia and they were the representative of the people of Zambia at the time of sale as PF is today. We never knew that we are dealing with thugs.
