MMD party presidential aspirant Enoch Kavindele’s plans to win the party’s top job have suffered a setback after a Lusaka company sued
the former vice president for breach of contract involving K31million.

In a statement of claim in the Kitwe High Court, NASLA cement limited,who are the plaintiffs have sued Mr Kavindele has a defendant in the matter for breach of agreement.

NASLA cement, through their lawyers Katongo and company have sued Mr Kavindele as a defendant in the matter for damages of breach of agreement.The company claimed that it entered into a written agreement with the defendant on rental of a bull dozer D65E and excavator 320C on February 2 this year.

NASLA cement noted that in terms of Article 1 of the agreement, the rental charges for the bull dozer was K3,500,000 per day while for the excavator was K3,400,000 on a daily basis both excluding Value Added Tax (VAT).

They further noted that under the terms of the agreement, both mobilisation and demobilisation costs were to be borne by the defendant.

Obligations of the defendants were spelt out under the agreement and that the defendant would appoint a supervisor to give the operator instructions.

The plaintiffs claimed that the defendants would pay the charges for the rental of excavator 30 days in advance and that they would return the excavator upon completion of work to plot 9469 off Kafue road in Makeni Lusaka.

They further claimed that the defendants would pay for the day irrespective of the work done and that an execution of the agreement, the defendant paid a deposit of US$ 2000 on February 2 this year.

On February 14 , the plaintiffs issued a tax invoice in the sum of K41,876,000 and that after deductions a balance of K31,876,000 remained.

They claimed that despite numerous requests to settle the amount, the defendants have failed to pay the plaintiffs.

The plaintiffs claimed that they have suffered loss, damages and claims payments of K31, 876,000, damages for breach of agreement and
interests.

    • This kind of writing is pathetic to say the least. There is no link between the candidate being sued and how its a set back. If there was mention of a clause in MMD constitution, national constitution or any law that bars person in this situation from  standing then, saying his plan has suffered a setback would have been news worthy.

  2. Bushe 31 Billion or Million. Or may by id the claim the Rebased PF kwacha or the unrebassed MMD kwacha. Please clarify so that we know if its money or not

  3. The amount looks ridiculous small to drag EPK to court. As usual, zealousness by some lawyer who will obviously make a killing out of this case. Take it to the small claims court where it belongs.

  4. K3,500,000PER DAY? THATS MADNESS! I AM PRETTY SURE THATS ABOUT £500 IN BRITISH POUND STERLING PER DAY-TOTAL MADNESS.

  5. This is the same guy who claimed he had money, and that the MMD needed a presidential candidate with money. Mr Kavindele…….show us the money!!

  7. This story does not make sense vis-a-vis Mr Kavindele’s candidacy. Not surprising because most Zambian stories nowadays do not make sense to normal persons.

  8. what are the terms of the contract, maybe EK is not satisfied with the works done so he wont pay. but as asual our raw journalists want to sensationalise the whole issue

    This is just sensationalist. There is absolutely nothing in it to bar EK from his political pursuit.

  11. I have dealt with EK in the past the man hates paying , he has made a lot of small firms go bust cos he just does not care about the next mans problems

    Ba Kavindele akaso when you even have money, now what embarrassement you have brought on your self.
