By D.Banda
I read with dismay at the style of leadership that President Sata is exhibiting especially with regard to the suspension of the 3 judges. We have no problem investigating the 3 judges and the judiciary as a whole, but the manner in which Sata is doing it, leaves so much to be desired.
Firstly the suspension of the Judges came as a result of the judgement that was given in the K14 billion issue that his friends Nchito and Mmembe are involved in. Suppose the judgement was in favor of his friends, would he have gone ahead to suspend them and set up a tribunal? I don’t think so.
If he wants to show the general public that he is allergic to corruption and he is in there for the overhaul, why can’t he first suspend Nchito and then investigate the issue with the K14 billion and tell the nation that he will recover the money from the duo. It does not make sense to us to investigate the judges when his partners are refusing to pay back tax payers money.
Let him deal with Mmembe and Nchito before dealing with the judges and that will give us confidence that he is in there for the job and for the
poor ordinary Zambian. He should not even lie to us that he wants to clean the Judiciary, he wants to hammer them because they gave judgement not in favor of his buddies.
Look at the number of tribunals, if they make submissions not in his favor he hammers them and tells them that they don’t know what they are doing. Sata is ruling Zambia with preconceived ideas and if you challenge his authority then you are in trouble. No wonder those in his camp are so afraid of him and its only online papers who can provide checks and balances and report on real issues without government pollution.
I used to follow other news medias a lot because they used to be objective in their style of reporting and now it looks like only online forums can provide us with that objective role of alliance for what’s going on in Zambia.
Secondly the setting up of so many tribunals is a waste of tax payers money at the expense of the poor ordinary Zambian. The fight against corruption is so selective such that people like Nchito and Mmembe are free to do what they want because they are untouchable now. The
mounting pressure to have the Chief Justice resign is an indication that they want people to shift the attention from the K14 billion to
issues that are not at hand.
If we want to have the Chief Justice resign, lets call for the resignation of Nchito and believe me Nchito will never resign on moral grounds and Sata should be made aware that if he does not do the right thing with the issue of the K14 billion,he is putting himself in jeopardy and one day these mistakes will visit him because no government stays in power forever.
Even the single sourcing and awarding of contract to Chikwanda’s company to renovate state house is an issue that will visit him one day. I wonder why Guy Scott has even tolerated the PF this long with the mistakes they have made so far, I thought he was a gentleman who would address
those issues with the PF or even resign to protect his name. The mistakes, intimidation and shortfalls we have seen so far in the present government is a clear indication that the government has no idea what they are doing and they have lost direction which they did not have in the first place.
Political campaigns are different from reality and it is very easy to say that will perform outside of realism and when given the reality of platform, performance is deterred by conceptualism of the fact that it takes a different position to comprehend what we promise. We do not appreciate the new concepts of intimidation and selective fight against corruption being brought in the political arena and into he country by the PF government, we need to enhance the livelihood of our people for a better tomorrow and know that what we do today will come to haunt us tomorrow and that is something that the government of the day need to be made aware of by the media.
Crap
This makes a lot of sense and if you think this is crap then you are an.***** who needs help. We are talking of.big time tax payers cash here and
all.you can say is nyo. Be serious and reason.withbthe rest of.the county!
You PF cadre you honestly think that moeny will be given back? We all know Chiluba stole and was guilty but was he ever found guilty? This is government my friend. Sata and his goons are not giving anything back. After he is gone we will be saying he was a thief too but will he ever be found guilty and pay back whatever he could have stolen? THINK LIKE A ZAMBIAN AND WORK ONLY FOR YOU TO BE CONFORTABLE!!!
ata nonsence
BULLU SHIT!!!!
True!!!
Is this bwezani banda?
Good observation D.Banda.We want our K14 billion full stop
you are useless ,what is K14BILLION compared to K200 BILLION that was chewed at the ncc.
But Mmembe is Vice President isn’t he? LOL!!!!!
True true abanda, only gullible cadres think this opinion is crap.Nchito should leave that office as well .
Well spoken Banda, Its time to call a spade a spade and not a big spoon. These issues are very clear and straight forward as Banda has pointed out, let us not protect the criminals and victimize the innoncent judges. I feel the K14 billion should be paid back and there is no need for a tribunal, its just a waste of tax payers money.
the guy you call president does not engage his brain before opening his mouth that`s another problem.
we want our money back, i mean 14bn kwacha!
My understanding of this issue is not that Sata is against Mmembe and Nchito paying back the K14Billion of public money they owe DBZ, but the conduct of these judges in the process of dispensing justice. The complaints against these judges also came from LAZ, a professional regulatory body among others. Its therefore prudent that judiciary is cleaned in order to restore confidence.
I am interested in seeing that the K14Billion is recovered in full
D Banda’s article has mischaracterized what necessitated the formation of the tribunal. He does not understand how judges’ misconduct and incompetence can be a source of anarchy in the country and it had to be truncated forthwith.
LAZ has been complaining about other Judges and not these three for corruption, late or non delivery of judgments, laziness and sheer incompetence for a long time now and nothing happens. Two people complain and boom we have a tribunal.
This article makes a lot of sense because it reflects the truth and nothing else.
This article sounds like its one from the opposition, merely trying to oppose Sata. In the first place, investigating the ills of a former regime is something everybody does to clean their house, if the MMD was not corrupt, all these tribunals wouldnt have been set up. Even Mwanawasa had to set up the task force which consumed a lot of tax payers money but indeed certain things changed and some funds were recovered. The tribunals are even a cheaper method than Mwanawasa’s task force which never utulised the already established govt structures to fight white collar crimes! Lets learn to criticise constructively, and not just because you are not the one in the drivers sit.
D. Banda has hit the nail squarely on the head. Debtors refuse to pay, they appeal to the supreme court and before the case is heard they run to the president to complain. There is something fishy here. The day of reckoning will certainly come.
Please Please please……………… Mbwana Prsidentor we need that money back, I mean the K14 billion Kwasha period
Eastern wisdom baby, never on schedule but always on time. Let’s not be cadres but legit Zambians and study all things done, by president government or judiciary. Common sense helps.
simple logic
# 13 well said, Sata has never said he does not want the 14 billion to be paid but rather the misconduct of the judges regarding the judgement of the 14 billion. i wish Banda could enlight us more on the tribunals which have not achieved the intended purpose. The problem with Zambians we intend to be ahead of ourselves without reading carefully and understanding situations. All tribunals go through to cabinet and its up to cabinet to make recommendations. we need to understand that Sata as an appointing authority could have easily just fired the 3 judges without a tribunal if he really wanted to protect his friends
The tribunal makes recommendations and it is then up to the appointing authority (which can be cabinet or in this case Sata) to implement.Â
can any one show us proof that Mmembe has blantantly refused to pay the 14 Billion? my belief is that there is a dispute of how the figure arrived at 14 billion.
The author of this article has even forgoten that this country lost K200bn plus through the failed George Kunda(MHSRIP) led NCC which gobbled billions of tax payers money due to a corrupt judiciary! Majority of the NCC participants were from the legal fratenity – Judiciary! So why not sort out this ailing judiciary and let Nchito/Meembe be liable for what they owe DBZ as a purely business trancastion they entered into? Lets move away from personalities like Nchito and concentrate on sorting the Judicial dispensation in this country which all poor Zambians depend on! Shame on you haters!
13 &19, What difference does it make if Sata has not said he does not want the 14bn paid back? The action of suspending the judges involved speaks volumes about his motives. What has Sata fed these Kaponyas who defend him no matter the attrocities he’s doing or are they just extremely dull??
I agree with aBanda 100%!the wise men from the east indeed!
# 21 Nalu….Are you then suggesting that judges can abuse the law and the justice system to fix certain individuals they don’t like? Is this the justice we want in our country?
We all want the K14Billion owed paid back in full with interest but it has to be done within the provisions of the law.
In fact what is at issue is not the judgment handed down but the exploitation and perversion of the judicial process by the suspended judges.
How can we as a people put a stop to this slaughter on the Judiciary and help Govt put proper Judicial system reforms with clear guidelines (NOT ONLY JUDICIARY BUT THE WHOLE JUDICIAL SYSTEM IN ZAMBIA) .Unlike the way these reforms are allegedly being done in this 14billion DBZ Chipoka tribunal whose mission is clearly not judicial reforms but protecting Mmembe-Nchito) .Also the Mmembe- NCHITO company are becoming so dangerous to Zambia& the society…. When it suited them they used Justice Sakala to sort out Chiluba after removing Justice Ngulube who refused to dance to their tunes to sort out their enemies& Chiluba. Now that Justice Sakala has stood his ground after discovering how Mmembe&company blackmail authorities, Justice Sakala has now become an enemy of these crooks especiall
Doomed Banda lets not oppose for the sake of misleading the general readers.
If your judges are innocent lets wait for the outcome from the set tribunal which is not as costly as you claim compared to the set commissions during your regime and if the two guys you are disrespecting have something to answer prove it since this issue started in your MMD regime.
CLAP!
This is an bjective truth. We are concerned with the manner in which this government is running the affairs of all of us. In one way or the other watever the head of the state says or declares it affects us whether positively or negatively. And for this one, it really affects us negatively. Fight corruption has now been seen as a mere talk or witch hunt no difference with the MMD. At least with the MMD RB had to lose the case certain cases ie Kabwele of which we thought she was going to be jailed for that report now with this govt any case against it or its allies when its not in favour that means trouble in the judiciary.May the govt do this with the right attitude and mind. Any way God is our ultimate in all things.
What shocks me is the Cobra beside Sata’s head, at One time when I watched TV a private station when they Lifwekelo acuused Sata supporting homesuxual, i thot my eyes did see clearly. Now I believe. Why having the snake in his office at the farmers house, has that snake moved to state house,Is he practicing satanism, we need to know as the nation.
Comments raised in the article are of profound importance if PF government is going not only to be HEARD, but to be SEEN to be effective in its governance of national affairs. Currently, there is fear created by the president in his administration to effect administrative procedures in implementing tasks for the nation. Almost every move has to be cleared by head of state. The cleaning of the judiciary is a welcome move as the fight against any corruption. However, the modus operanda is ineffective. It does not convey seriousness on the part of Mr Sata for two reasons: 1- Institutional tools exist for him to make use of but has picked wrong personnel to do the job. Most of them have issues in the same fight Sata has made as his object(corruption) to reduce. 2- His words dont match with
This is very simple… you borrow money you pay back…
I do not see any unfair judgment which has been passed. Nchito and Mmembe stood surety for the debt. They need to pay up. Thats how business are run. If they did not stand surety DBSA would have never given them the loan.
Indeed thieves have regrouped…. Â and people were saying RB stole money.
WITHOUT PAYING 14BN…….Corruption talks useless. Membe Must pay,Nchito Must resign while Chief Justice retires very soon in August. You can investigate those three judges but 14BN MUST BE Given special attention FIRST………..
Bottom line is you have a grade 7 president who thought because he could manage Kabwata, Zambia was going to be easy. Did he not tell us he had experience? You do not get experience by being a Chola Boy.
Once a policeman always a policeman you need a senior Policeman to manage you. Had the MMD not left a solid foundation, this country would have already been on its knees. Its just a matter of timeÂ
2- Words of Mr Sata do nt match with his aims and objectives. He has so far remained mute over how and who carried out renovations to state house. Openness and transparency demand that this would have been his bench mark on how he was going to proceed with every similar case. Even Vice president Guy Scott made a scarnty comment in form of a promise to the house..end of story. He too is afraid like all civil servants. Suspension of judges on allegations of corruption is good move for fair delivery of justice in a nation. The question is when was this move to be made? Certainly not after delivery of judgement that seem to be against Sata or his friends. In any case, mood of the nation is that judiciary was untoucheable and needed reform, not because of some judgement passed
There’s no profundity in the article whatsoever, only illogical assumptions, as is to be expected from his ilk.
but demonstration of political will so far missed by Mr Sata. Last, Mr Sata’s silence over K14billion owed to DBZ that came out of that judgement betrays his very belief of being allegic to corruption. How does he dismiss judges on allegations of corruption who presided on a case that boarders on corruption or failure by his own officers to repay the loan to Zambians? His silence over Nchito, Mmembe on how and when they will pay K14 Billion to Zambians has amazed many in the country. We hear efforts are/were being made for DBZ to write it off as bad debt. Surely, does this convice Zambians Mr Sata can fight corruption? The big issue is stuck with Mr Sata. An elephant in the Zambian’s living room. Get rid of it or keep it?
Give chance Sata to rule the country, Zambians want thieves it seems because there are just criticizing everything even issues which are straight forward.
Pay back please !!! 14bn will make a difference in buying panados.
I find articles like these intriguing. It is amazing how much time Zambians waste on discussing irrelevancies. The issue of Zambian Airways and their lenders has to be dealt with according to the Laws related to the Companies Act. If that Act is inadequate, it surely cannot be the fault of Mmeembe and co. The current government played no role in lending monies to Mmeembe and co. I would also like to point out that companies collapsing and being unable to repay lenders, is commonplace in Zambia. Look at CEEC and you can clearly the trends and culture pertaining in Zambia. It is sad that people can ignore facts and continue to mislead. On the issue of the judges, I agree with MCS. People in the judiciary, or any other arm of government, cannot continue to be as corrupt as they are.
CRAP ! COZ THE *****S DONT UNDERSTAND THE ISSUE BUT ,ARE FILLED WITH HATE! GREED ! LOSS OF ERECTION LAST YEAR! KNOWLEDGE OF THE FACT THAT HE WILL NEVER RULE EITHER BY HIM OR HIS TRIBE CLAN!
Nchito should resign before the chief justice does. Nchito’s corruption and subsequent attemp to avoid repaying are matters that are easy for anyone to understand and see the wrong, now can someone tell what wrong the CJ committed?
Who the hell is this this D. Banda??????
And who the hell are you AMAYAMA or whatever you are called.
Ths nation has gone to the dogs and these Homos are nw dancing happily.I cnt nt understand why some embaciles are so blind what ths govmnt of Sata and his minions are up to,these are satanist Homos and no good 4 mother beautful Zambia. The Question 4 these Gays to pay as our money is non contestable D Banda thumbs up wel articulated article 4 a wel meaning Zambian Readership
What pisses people off is the way Mmembe and Nchito flashes their ‘wealth’ around.
Nchito meets this known car dealer with the latest of his brand in the car park of a known hotel. Nchito falls in love with the guys’ vehicle and writes a cheque for it there and then…a cheque of around K300m. Mmembe imports over 100 vans for his paper…he is charged duty in billions and pays it without any qualms. Then people hear these two jointly owe the government K14b which they’re refusing to pay…and they are there mapping the route for the country….
Let justice prevail!
#15 – Observer
What we are going is checks and balances on Bo Sata.
Mr Banda , continue pumping some sence !!!! We need our 14bn please.
It must be very tough for those kids studying social studies these days.for instance
Q1.who is the president of Zambia
a) Nchito b) Mmembe c) Sata
Q2.There are 3 independent arms of the government.True or False?
I feel very sorry for the Zambian kids of today. It was pretty straight forward in my time
I have noticed that those who are for this issue are deemed to be MMD or Anti-PF aka hater.Im neither MMD nor anti-PF bt im in full support of this issue.Mr president has to relinguish Nchito off his duties if he really is allergic to corruption,we can not have a person as DPP who has issues in court and not only that bt a crook and unruly aswel. The ruling of the case between DBZ vs JCN Holdings,Post Newspaper & mutembo nchito by Judge mutuna was just perfect.M’membe and Mutembo Nchito must pay back the k14 bn period.
Im advising all those that support whatever Mr president does to be objective and analytical.not jst because u are PF then everything is correct.I dont think theres any cleaning of corruption here.u cant clean leaving dirt behind,u have to sweep thoughly.
Someone needs to help us here. What exactly did the judges do that amounts to misconduct to attract the wrath of the President? Is it issues to do with their execution of the profesional duties? Who deals with and how should issues of any professional misconduct of judicial officers be dealt with?
The are allegations of Corruption which the three Judges have to answer before the Tribunal of Lovemore Chikopa. The other allegations is that the Two Judges jumped on the case which was being handled by Judge Wood. The Judicial procedure is that since Judge Wood had recessed himself from passing Judgement, the case must have started afresh instead for going straight into Judgement. The Judges did not follow the procedure which is laid down in the Judiciary.
Dollar
Why should the President do A to appease you, so that he then can do B, why do you have to hold him to ransom.
Let him carry on with the tribunal then you can make noise about DPP later, no one is going anywhere. All this is costing the Tax payer, let common sense prevail you halfwits.
Judge Albert Wood should also resign. His integrity has been brought into question by the fact that he is the preferred Justice of Mmembe and Nchinto. Something smells bad here.
If Sata never said mmembe and nchito won’t pay then why has he instructed minister of finance to write off the debt thru the new DBZ md? Worse without board approval. That’s why shareholders in DBZ from Econ, norweigans and dbsa want answers.
” Let him deal with Mmembe and Nchito before dealing with the judges and that will give us confidence that he is in there for the job and for the poor ordinary Zambian ”
– Someone sounds like they are very ‘concerned’ about the effectiveness of the anti-corruption efforts of the PF.
– Where was he with his ‘concern’ during the MMD years?
we need to enhance the livelihood of our people for a better tomorrow and know that what we do today will come to haunt us tomorrow and that is something that the government of the day need to be made aware of by the media.
well said. its simple, deal with the mmebes 1st
Mwe bena Zambia….I mean those that can speak sense not abo abawelewele. My question is,the K14 billion you are talking about did it happen 8 months ago,if it is true do we all understand how the money was gotten???na kwasamuna fye no mulandu wa kalijo Sata aleteka???You chaps ba MMD who were in power tell us what about the so called K14billion???What about it,and who are you to start dictating on what to be done what powers do you have iwe mutunta bunga, kankuni to tell the president what to do?we nsamba we,we sabi.
Bwezani Banda did a lot of projects so if Ba Sata continues to mingle around the courts manipulating the Judicial system he will be caught off-guard… 2016 is so near  Â
It is impossible for Sata to fight corruption. Mark my words
These will be the worst corupt fools zambians have ever had for leaders. Surely how do u suspend a judge for passing a judgement against ur friends.j
It amazes me how you zambians want to discuss/debate issues you dont have data on. The bible says be swift about hearing, slow about speaking. All these issues you are talking about including the 14bn will come out in the tribunal and more. Why not wait? You think the tribunal will be banned from mentioning the 14bn issue? oatience other than talking loudest only to look like fools two weeks from now.
Here we are not talking about the 14 billion that Inchito and Membe or the 200 Billion that UPND stole through the NCC, but the rotten judicial system in Zambia which must be cleansed. The judiciary in Zambia must be cleansed period.
Yes all thieves including UPND who stole the 200 billion through the NCC should pay back. We want our 200 billion from UPND then Nchito and Membe should also give us our 14 billion. If the UPND cant give us our 200 billion, then Ichito should not pay back as welll…yes so simple.
# 59… I feel so sad for you that you no understanding of how justice is supposed to be delivered. Please understand that the issue is not about the judgement handed down or that Mmembe & Nchito should not pay back the K14Billion they owe, but the perversion of justice and abuse of the judicial process by the judges.
#60… You are only looking at one side of the coin. Why are you failing to see the whole picture??? If the president is going to deal with corruption, then let him deal fairly and follow the rules. Some pipo are trying to hijack the judiciary. They have been compromised by their debt and are busy scratching each others backs at our expense. Am sorry to say, but you sound retrogressive and fedural.
there is a mix up by the president somewhere.this is not a genuine concern.anyway we are WATCHING PF.MMD rule For 20years what about PF?
#61… your view on the administration of justice is unavailing. When these issues of corruption and other cases are taken to court, we all want them to be handled judiciously and in accordance with the law and not because the head of state is calling the shots in the background.
Corruption cases are all decided in courts of law and not by the president. No one must be allowed to usurp the judiciary and use it to fix others, it’s a recipe for despondency and anarchy in the country.
Therefore the judiciary has to be put in good order ab-initio
Come on don’t be a retard and just shout we want our K14Billion… Yes we do… but there are laid down legal procedures to be followed even by judges.
Thank you for all your comments, you are one of the few who shows a true understanding of the issue at hand
Zambians you can be forgiven for making a grevious mistake by electing Sata to the highest office. this is what you get when playing “russian roulete” with your lives and those of your children. Make it a point to correct the situation in 2016.
I’LL ONLY JUDGE THE PF’S PERFORMANCE AFTER 2018.AFTER ALL KAUNDA HAD 27 YEARS AND MMD 20.BE ASSURED 10 WONT BE BAD WITH PF.
Okaaay…All those who have borrowed money from DBZ should not pay BACK….If Mwembe used UKWA to shield him against honouring this debt, I am available for anyone who needs protection. The services offered are free insults, beatings, n thugs for hire.. ******************
The level of ignorance among Zambians is apalling. The author of this article and those who support his views just show that they missed the whole point!
We need change in totality with things which defines us, such us our constitution, our beliefs, school syllabus, their is need for our elector board to look on how political parties source their revenue, because this is the genesis of all corruption, if we regulate the source of funding of political parties will lessen corruption, because most of our politicians are the biggest culprit, they don’t have proceeds out side politics, they have never governed any private firm apart from being in government or awaiting to be in government so that they plunder our resources.
so sata is allowin corruption in short
