Chipimo demands the immediate dropping of HH case

Leader of the opposition National Restoration Party Elias Chipimo has demanded that government immediately drops charges leveled against UPND President Hakainde Hichilema

Addressing a news conference this morning, Mr. Chipimo stated that the charges against Mr. Hichilema are unwarranted and meant to intimidate political opponents.

He observed that the manner in which the case has been handled suggests that President Michael Sata had a strong hand in the arrest of Mr. Hichilema.

“We therefore demand that the state immediately drops the charges against the UPND leader and engage in constructive dialogue that will help reduce the levels of political tension. As NAREP, we believe that the statement on which Mr. Hichilema’s case is based has long been forgotten by many Zambians.”

“If at all the statement on Sudan as allegedly made by Mr. Hichilema was going to cause unrest in the nation, we surely could have seen the unrest by now.” Chipimo said.

Mr. Chipimo said the levels of political intolerance exhibited by the PF government have left many Zambians disappointed.[pullquote]“If at all the statement on Sudan as allegedly made by Mr. Hichilema was going to cause unrest in the nation, we surely could have seen the unrest by now.” Chipimo said.[/pullquote]

“Today, many Zambians have come to a painful conclusion that the high hopes they had placed on this leadership was misplaced.”

He said it is clear to see that the charges that Mr. Hichilema has been slapped with are political and had nothing to do with threatening peace and order.

And Mr. Chipimo has charged that Director of Public Prosecutions erred when he requested for an apology and a retraction from Mr. Hichilema if his case is to be dropped.

Answering questions from journalists at the news conference this morning, Mr. Chipimo said the DPP or anyone does not have powers to discontinue a matter unless via a nolle or in a case of a pardon after a conviction has been secured.[pullquote]“By asking Mr. Hichilema to retract and apology before he is convinced, the DPP was being irregular and his actions were not supported legally.”[/pullquote]

On PF Secretary General Wynter Kabimba’s attendance of late Ghana President Prof John Atta Mills funeral, Mr. Chipimo said the PF government needs to be reminded that Zambia is no longer running a Party and Its Government (PIG) system of running government.

“PIG was dismantled in 1991 when Zambians ushered in a new dispensation; we are not interested in the party SG meddling in government business. Our protocol, demands, that it’s the President, Vice President and Cabinet Ministers as it follows,” Chipimo said.

He however stated that NAREP does not have a problem with Mr. Kabimba attending any other international events provided he is not doing so as a representative of the Zambian people.

  1. The aficionados who have been coming to LT for the last 5 years like I have been respect and value my comments, because they know I have stood the test of time. It is these diploma Zambian natured illegal immigrants who keep refusing to accept my analytical insights and quite frankly I should stop wasting my time on them
    I have MBA, MSc, CIMA ACCA and PhD soon, they don’t give those papers away, they don’t sell them, you work and stand out from the crowd once you have them, and I believe I do.
    I do not know why I am not accepted and respected and adored as I am Zambian, that doesn’t mean I have to like Zambia. Zambia to me is like public transport I use it but I don’t want to have it at all, it’s there for my use and I would hate to be refused to use it.

Just because you have those papers, which many have, does not make what you say gospel truth. If you have ever defended a thesis, you know what I mean.

  6. Very good observation. This guy is sharp. Wow. But Elias has realised at last that it was just a way of making him dive in the mad with them when he was taken to Rio. Sata was just up to diluting his (Elias’) integrity. Nawakwi will also ressurrect from that sleep. They thought they now belonged to Sata’s inner circle and just waiting for ministerial appointments. That statement has the “potential to breach the peach and order” in the nation. Then the DPP would instruct the Police to advise Chipimo to retract the statement and apologise or face arrest.

The PF through the state machinery are claiming that the interpretation, by HH, of the article that appeared in the Post Newspaper on the 6th May 2012 is “likely to cause breach of the peace”. Now “likely to cause breach of the peace” is what is criminal. If you are able to think, you will now understand what Chipimo is saying. if is was likely to have done that, then the peace would have been broken by now and since it hasn’t their is no need for trumpeted up charges.

  12. Chipimo travelled to RIO on Government expense and he is now criticing a senior official of the ruling Party travelling as representative of the ruling party, does it make sense honestly. Political leaders should not make wild statements just to score points.HH refused to retract his false story what does he expect the Government to do to letting loose for making false allegations against the legitimately elected Government.     • He is not criticizing the inclusion of Kabimba in the delegation but Kabimba being the delegation leader on a government trip. On the other hand Sata castigates the MMD as the party that ruined the fortunes of Zambia and it being a corrupt party not forgetting that he was part of it for11 years, what’s your take?

    • If MMD arrested Sata for all the allegations he made, he would not be president today. He has just come from opposition and knows how it operates and I expected him to show a bit of tact when dealing with such matters. All PF needed to do is to publish the MoU they have with Sudan’s ruling party, which I hope specifies what training our children are being given. It would have made HH look like a fool but the approach they have taken just makes him look like a hero who is being persecuted

    Ok this is new to me and if it is indeed true, then it follows that a case of abuse of power or corruption can be made here.

    Can somebody please sue Mr Nchito for corruption. Looks like he was trying to bribe HH and he broke the law by making that offer.

    • You do not appear to criticise Chipimo for defending HH. Infact his view is very similar to the views expressed by many other bloggers with an objective view on articles related to the same.

      Does this suggest that it is the Person, HH, that you distaste and therefore willing to support any injustice against him. It will be HH today, Mumba tomorrow and Chipimo when the other two are incarsarated.

    • Making a statement that is true or false is not a crime in itself. Bob Sichinga made a statement claiming that China printed fake kwacha notes for the MMD Govt. That was a false statement and with similar if not worse consequences (coming from a cabinet minister) but he hasn’t been summoned to the Police for questioning. The PF are claiming that crime committed by HH is that his interpretation of the article that appeared in the Post Newspaper on the 6th May 2012, is “likely to cause breach of the peace and order” in the country. Now Chipimo, like many of us, have rubbished that claim and accused Govt of intimidating political opponents using state machinery. How is Chipimo’s statement different to those you have been condemning so far?

    I am not for PF and will never be … a UNIPist, I will die. If we have to turn Zambia into a civilized nation, the first pillar is total respect for our laws no matter who the culprit is. That’s why I rebuked Sata right here at LT when he erred at law. Zambia is greater than any single one of us.

When the case goes to court, you will find that what Mr Hichilema said and what he was quoted as saying are two different things. But even given that he said what you purport him to have said, there is still that big word that you Zambians don’t seem to understand and that is Freedom. If what you are proclaiming is the law in Zambia, then it is a stupid law and we should let it volit of its own volition. We wan’t a country where we are free to criticize our government.       I have been following your contributions on various articles and quite frankly, I think you need to ask more questions than make essay accounts that are often misguided, lacking depth or simply nonsensical and this one is no different. We are all capable of that but I think yours stand out more often. Chipimo is not quoting the Law. He is simply applying logic, as a court would, to a charge that is, on face value, a frivolous one and by all accounts an act of intimidation by the PF lead Govt. Yes, we all agree that a crime is a crime and the Law should be applied irrespective. However, a statement alone is not a crime. Otherwise Bob Sichinga should just about be coming to the end of his trial for falsely stating that China had printed fake Kwacha’s that were in circulation.

  37. Since PF came to power, do you remember how many cases have been disposed off before the courts determine them? One of the beneficiaries is DPP himself who had his cases which were before the courts quashed by the president, the Barotse rioters were pardoned even before they were convicted by the courts, Finance Bank saga to mention but a few. So it is the new order of doing things now. This is why DPP was asking HH to apologise and have his case dropped before the court could hear it. The state entering nolle prosequi or presidential pardon after a person is convicted is an old way of doing things.

  40. Chipimo’s observation is accurate. I too held him with suspicion for known reasons but one day I happened to listen to his HOT Issue program on radio and liked his ‘checks’ on PF and Sata. On that program, Chipimo wondered why Sata has never had a press conference since he came to power and also agreed that PF had no development agenda for the nation of Zambia. It is clear the against Mr HH’s case, will not be struck off the row.Therefore, the onus is upon the accused to apply to the presiding judge for the state evidence so that his defense team can study the entire charge. I take it that any defense attorney would really want to conduct a credible work and puncture the state evidence. The rationale behind . As it stands, they are so many clauses which have been contradicted which creates an impetus for the defense. Notice that major contradictions bring about huge benefits for the accused in the case. HH must put together a formidable defense team including top psychologists who can play a pivotal role with top attorneys.

Hakainde was accorded a chance to help close the case by simply retracting his statement, but he opted to be stubborn as always like a bull with a boil on its us. Now he has to prove his innocence after being charged. Instead of singing tantrums like some people are, why don’t you go further and sue the DPP about this matter and see where it takes you. As it’s, HH is a criminal in the eyes of the government until he can prove otherwise.

    It is normal for oppostions to have different views, but if in voicing those views, diplomatic relations or peace and order are seen to be jeopardized, then it is equally normal for the opposition to get reprimanded by the law.

  75. With all due respect, I find Chipimo’s reasoning on this one shallow and stupid. What he is in fact saying is that HH’s charges should be dropped in order to firstly diffuse political tension and because the said comments did not cause the chaos and panic that the charge seeks to address.

    The basic question really is whether HH uttered a falsehood, and whether that falsehood has the potential to generate political chaos in the country. The onus on HH is very simple. Prove that the government is training militia’s in Sudan or eat humble pie, retract the statement, apologise and deal with the political fallout. To say, well, the comments never caused chaos and so should not be pursued is as stupid as saying, someone was overspeeding but should not be charged as noone died.

For the first time Elias has really sounded dull; #1: H.H issued a statement he could not substantiate out of his own volition and refused to retract; #2: We as a country have the rule of law and don’t have to wait for Violence to occur as a result oh H.H’s alarming statemnt for him to be prosecuted; #3: What if next time he said the Gvt is sending street kids as child soldiers in war torn Congo and have an M.O.U with the Congolese Gvt, what should happen then?
