The Cabinet has moved to pass a vote of no confidence in Acting President Dr Guy Scott and have with immediate effect asked him to resign his position.
Reading a signed statement on behalf of all Ministers gathered at the Ministry of Foreign Affairs, Harry Kalaba flanked by other key Cabinet Ministers said that the actions of Dr. Guy Scott are now a threat to National Security and they have since informed the Central Committee of the PF on their decision.
The cabinet has since directed the Secretary to Cabinet working together with the Attorney General to ensure that an urgent Cabinet Meeting is immediately convened with the agenda to discuss the possibility of replacing Dr. Scott as Acting President.

SUBJECT; AN EXPRESSION OF VOTE OF NO CONFIDENCE IN DR. GUY SCOTT AND PROPOSED REMOVAL FROM OFFICE OF ACTING PRESIDENT
We have called this Media Briefing to make profound pronouncements to the nation.
Following the death of our beloved President, His Excellency Mr. Michael Chilufya Sata, the subsequent transition has been led by Dr. Guy Scott, in a dangerous and haphazard manner without due regard to the peace, security, unity and stability that this country is renowned for.
We have noted with deep concern that since Dr. Guy Scott assumed the office of Acting President, he has carried out his duties without regard to the law, to the principles of collective responsibility, and without consultation with his Cabinet colleagues as is expected in such a transition.
He has taken numerous actions that endanger the peace, unity and security of the country. Dr, Scott has persistently taken advice from known private individuals disregarding established institutions and bodies such as Cabinet.
With hindsight, it has become apparently clear that it is for good reason that President Michael Chilufya Sata never gave Dr. Scott an opportunity to act as President.
Because of the above-mentioned matters, the Ministers unreservedly take responsibility and tender their strong apologies to the Nation for selecting and affirming that Dr. Guy Scott should act as President on its Cabinet Meeting held on 29th October 2014.
Clearly the confidence and trust we reposed in Dr. Scott was totally misplaced and he has since abused our trust and confidence repeatedly.
And as Cabinet we have noted that Dr. Scott has persistently worked against the interest of the party that sponsored him as a Member of Parliament and allows him to be Vice-President of the country and subsequently as Acting President.
Dr. Scott’s actions have clearly been inimical to the interests of the nation. His actions have the potential to stoke instability in a nation that has been anchored on peace and profound human fellowship.
We urge Dr. Scott to immediately resign from his position as Acting Republican President on moral grounds.
As Cabinet Ministers, we have decided to express a clear Vote of No Confidence in his leadership and in his ability to carry out the remaining duration of the transition.
By virtue of this statement, the Ministers are informing the Central Committee of the Patriotic Front of the Vote of No Confidence against Dr. Guy Scott and are advised to take notice of our decision.
Further, we direct the Secretary to Cabinet working together with the Attorney General to ensure that an urgent Cabinet Meeting is immediately convened with the agenda to discuss the possibility of replacing Dr. Scott as Acting President.

Lungu wants to use govt machinery to campaign and he cannot do so as long as Scott is president. This decision must be rejected by all members of the Opposition. And that maybe true but that has nothing to do with what is going on in this matter. Infact, MANY of us are not campagning for Lungu or the PF (because they are all failures). Had the Ministers taken time to consult the Attorney General, they would not have ventured to make such an embarrassing statement which just amounts to idle talk. @chosen one, but yesterday he wrote a letter where he mentioned his position as Acting Republican President ordering the Chief Justice not to accept any PF nominations till there matter is settled. He broke protocol and possibly the law by failing to recognize the separation of powers and wanting to use his Acting Republican Presidency position to twist the arm of the Judiciary. That is NOT presidential! He needed to recognize the presence of court procedures rather than what he thinks. He writes a letter to the CJ as a President of a Party and, he is Acting Republican President to show that he cannot be cited for contempt of court. Then he puts the same letter in public domain!! In short he is daring courts,exercising impunity and failing to follow procedure- a lawless person indeed!

Guy Scott’s letter to acting Chief Justice was written on a PF headed paper. So, he wrote it in his capacity as PF vice president not as Republican President. Guy Scott has many flaws and may have breached the party constitution but he has NOT breached any part of the Zambian Constitution.
Kalaba and group should also do well to tell us which article of the republican constitution mandates them to remove an acting President. When we debate, we should not do so with partisan spectacles on. This vote of no confidence can only be applied in a Parliamentary system like Israel or Italy not our system. It’s also disappointing that Lungu and Simbyakula, eminent lawyers appended their signatures on such a flawed piece.

The basis for a President or Acting President to step down can only be on grounds of him or her having breached the National Constitution. Impeaching a President actually requires a vote by Parliament not a PF Cabinet. The constitution does not have a clause entitled “resigning on moral grounds”. If these Ministers were any wise, they would have focused their energies at dealing with the case before the courts of law on the legitimacy of Lungu as PF President. If they ignore this and go on a tangent chasing Guy Scott around town, they will fail to file their nomination and will be looking like fools on Monday. Are these people fools? Guy Scott stays until January 20, useless as he is. That is the Constitution of this Country.

1. Suspend Edgar and Kalaba as ministers and direct the Secretary to the Cabinet to institute investigations into their reported trip to Zimbabwe without official permission from a sitting president.
2. Suspend Alexander Chikwanda for mass embezzlement and abuse of public resources.Scott should direct the Auditor General to immediately move into the ministry and conduct a thorough audit of the appropriation of public resources including loans obtained in our name as Zambian citizens.
3.Suspend Nsanda as Chairman of RDA and direct both ACC,DEC and Auditor General to investigate him for massive abuse of public resources, corruption and theft of sensitive RDA documents.

I don’t particularly like the PF as a party, but I loathe the actions of Guy Scott ever since he became acting President of our dear Republic. His actions have been UnPresidential, dictatorial, probably even racist, but Obnoxious is probably the correct description. It’s like he is revenging on innocent Zambians for the embarrassment that he suffered in the eyes of the world for being made to report to his juniors every time Mr Sata left the country.
The issue here is not one of law but of morality to continue acting as President when your own Cabinet has passed a vote of no confidence in you. If he really hails from a civilised culture he can do either of two things: resign or dissolve Cabinet. But the latter is not feasible as he is not allowed by the Constitution.
That is the very reason why cabinet is misbehaving because they know they cant be fired by the acting president. No more hooligans in politics.

I wish to advise the opposition parties especially the UPND who may see this as an opportunity to score points off the PF. You must show patriotism on this particular issue and side with the Cabinet. On a serious note, with hindsight I now put the blame on whatever has happened in our country since the demise of Mr Sata squarely on the shoulders of Guy Scott, including the PF chaos. He has shown dictatorial tendencies which has led his colleagues and many citizens to resent his attitude. More importantly he has shown no leadership skills at all, failing to bind his own party together and trying to disguise his failed leadership as hunger for power by one Edgar Lungu. But that is what happens when you take instructions from the cartel, the Past in particular. Zambians will hate you the way they hate the cartel. I have never seen a person so resented in such a short space of time.

I am aware that there are some individual members of Cabinet who have called upon me to tender my resignation.
However, there is no provision in the Constitution for such a demand.
The Supreme Court decided in the case of Anderson Mazoka versus Levy Mwanawasa that in times of transition, Article 38(2) of the Constitution should be followed. My position as Acting President is purely by operation of that law. There is no provision in Article 38(2) for removal of an Acting President.

I have always been wary of Guy Scott and have posted time and again warnings on this man. This is not because of rejecting him as a white man, but because of his character which is not a serious one nor one suited for Office of the President. I once said he should be sent to Outer Mongolia on ‘diplomatic’ mission…..obviously that was a Fruedian Slip revealing my innermost intended wish that he should be removed from Public Office and kept out of sight.
Let me tell you who Guy Scott is. Our dear former President, whom we all adored for his newsworthy ‘cringiness.’ Much as he was that, Sata was on a more serious side a very Passionate politician. He truly wanted to serve Zambia and Sata was more than capable.
The problem was a flaw in his character which I have put down to mis-education by the Colonialists that came to ‘civilise’ but instead left us with a lack of confidence in our own culture. We were indoctrinated to believe White is Good, Black Bad. Somewhere along the line White Colonialists decided to take advantage of our rich lands for their personal use and became callous, enslaving us as the weaker species. We rose from that, but unfortunately the psyche of some people like Sata was turned against his Colour leaving them with deeply buried psychosis. Hence their need to be approved by ‘whites’ (sorry, not using that in a racial way).

I have followed these events with sadness. Clearly there is a gulf between EL, with his overexcitable supporters, and GS. What EL forgets is that every action he takes becomes part of his legacy. GS will cease to be acting President on January 20 and will have done all he could do under the circumstances to shelter the country from a group trying hard to predetermine the course of our country. MCS seems to have miscalculated in his choice of characters to surround him. Although hounded out of government, Mr Kabimba might have been the best person to leave alongside GS. One has to examine the backgrounds of the others in terms of academic, professional and social achievements to be able to have an informed view. To control them needed a very strong and decisive character. God help us!

4. He is advised by Central Committee that it would be reasonable for the C.C to decide on the Presidential Nominee if such a person would command in Parliament more than 80% support. This would save money and logistics. Guy Scott is actually reminded that the C.C had on two occasions before actually chosen MSC as Presidential nominee this way. Guy Scott insists on a General Conference.
5. At Mulungushi Guy Scott goes AWOL apparently citing security as reason for not attending the GC. This is the President of the Country with the all the security forces at his disposal.

I expected Hon. Kalaba who is supposed to be chief diplomat by virtue of him being Foreign Affairs minister to use maximum diplomacy in solving the issue of Guy Scott. Alas the minister came out very immature and emotional when he appeared on TV the other day. For Scott to write to Acting CJ, it means there is something more to the issue in court than what meets the eye. Reading between the lines you can tell that there was a plan to bring forward the filing date for PF candidate to try and beat the process of law. This and other reasons could have prompted Guy to write to the learned Acting CJ. If PF have a problem with Scott, we have statesmen in this nation like Dr Kaunda, Mr Simon Zukas, Dr Vernon Mwaanga and others who could be approached to sit down and advise Dr Scott.
Apparently, the genesis of this PF fracas is the lack of respect exhibited by the cabinet ministers especially Mr Edgar Lungu, Mr Kalaba and Prof. Nkandu Luo towards the Acting President. For instance, how do you go to meet a president of a foreign nation without informing and getting clearance from your head of state. This is pure indiscipline and insubordination of highest order. If Dr Scott was respected and recognized as Acting President, I do not see a situation of him being so hostile towards the cabinet. We need level headedness in handling issues of running the country not the kind of arrogance displayed by this PF cabinet. Its unacceptable and a shame to be ruled by these characters.
These useless minister should have done this to Sata when they realised he has failed the nation. Why waste time with Guy who is simply in transition period and has got no powers whatsoever to deal with them even when they error. Stoopid low sinking cabinet who have totally failed to live up to the expectation. Indeed time for HH and his crooks sponsoring him to take over Zambia. We can really go on with this kinda behavior from people who should be trusted to take care of the affairs of the country.
How myopic o fellow bloggers. Is it so difficult to note the impunity with which this GS is taking the issues of this country. We debated at length the case of him taking over the Presidency and many among you were against the idea. With good intent Cabinet has apologized for allowing this colonialist take the reins on Zambia. Should we in all honestness sit back and watch our great Zambia go to the dogs (known individuals). I believe so much in the capable hands of Cabinet and any well meaning citizen to do the right thing at this time of trial. It matters less who ultimately wins come 20 Jan 15, what we need is a leader (Zambian) to guide us out of ‘Egypt’, and that transition fellow Zambians is what matters.
