The Registrar of Societies steps in, Chishimba Kambwili’s appointment as NDC President is illegal

The Registrar of Societies has declared as null and void the appointment of Mr. Chishimba Kambwili as National Democratic Congress(NDC) President.

And the Registrar has advised Mr. Kambwili not to conduct NDC Party activities as its President to avoid being in conflict with the supreme law of the land.

In a statement to media today, Ministry of Home Affairs Public Relations Officer Nephas Chifuta said the process of appointing Mr. Kambwili as President of the NDC was not in accordance with the provisions of the Party’s Constitution.

Mr. Chifuta has reminded the NDC to adhere to its party Constitution and avoid short cuts in order to maintain order and remain compliant to the Societies Act Cap 119 of the laws of Zambia.

He said according to article 18 of the NDC Constitution, the National Party Congress is the supreme policy making organ of the party comprising one thousand members drawn from all the provinces of Zambia.

Mr. Chifuta said the National Party Congress is the only Party organ with the mandate to elect the Party President at its national congress, adding that it is only the National Party Congress which can amend, approve and adopt the Party Constitution.

Mr. Chifuta has stressed that these steps where not followed by the NDC and has since declared as illegal Mr. Kambwili’s appointment as party leader.

I wish to confirm that the Registrar of Societies is in receipt of a letter dated 18th April, 2019, from the National Democratic Congress Party (NDC) Secretary General Mr. Mwenya Musenge.

In the letter Mr. Musenge is requesting the Registrar of Societies to intervene and provide guidance in a matter where an alleged illegal meeting was called by the Deputy Secretary General of the Party, which endorsed Dr. Chishimba Kambwili as president of the NDC, contrary to the provisions of their Party Constitution.

The Registrar of Societies in her guidance letter has highlighted that the NDC Party Constitution deposited at the department upon registration of the Party, has clear and elaborate provisions regarding the appointment of the president of the Party.

According to article 18 of their Constitution, the National Party Congress is the supreme policy making organ of the party and comprises 1000 members drawn from all the ten provinces of Zambia.

The National Party Congress is the only Party organ with the mandate to elect the Party president at its national congress. In addition to that, it is only the National Party Congress which can amend, approve and adopt the Party Constitution.

Furthermore, their Constitution stipulates in article 23(g) that “in the absence of the Secretary General, the Deputy Secretary General shall preside over the activities of the Party and give a comprehensive report to the Secretary General upon his/her return to the office. ” To the contrary, the meeting proceeded despite the substantive Secretary General being in the office.

In view of the above, the process for the appointment of Dr. Chishimba Kambwili as president of the National Democratic Congress Party was not in accordance with the provisions of their Party Constitution and therefore, it is null and void.

I therefore, wish to advise Dr. Chishimba Kambwili not to conduct NDC Party activities as its president to avoid being in conflict with the supreme law of the land. The Party is further reminded to adhere to its Constitution at all times, avoid short cut in order to maintain order and remain compliant to the Societies Act Cap 119 of the laws of Zambia.

  1. That is the problem with Cut and Paste Doctorates. You get a cut and paste Doctorate, and you go on to form a party and then CUT and PASTE a constitution as well, without even reading it or understanding its implications.

    Being Kambwili, he just probably plagiarised his constitution and never even though he would have to follow it.

    Am sure he plagiarised a PF constitution, which was also plagiarised by SATA from ZANU-PF

    • This is the difference between MMD and PF…in MMD they would have let the Chief Registrar himself/herself take lead on this matter BUT in PF we have dull ill-educated overzealous ministers like Kampyongo who phone this junior officer at his ministry and direct him to issue statements…instead of updating us on the man-hunt of that officer on the lose.

    • Hahahahh…… These theatrics are typical of comedians. Kambwili like his rival GBM only makes sense to HH as VP material. These are rascals of zero leadership abilities not to mention their intellectual disabilities. Perfecting in derogatory speech or settling for backyard degree mills to be called Doctor is not synonymous with national leadership. Their participation in politics is, by all means, a reproach to democracy and civility.

      Musenge is constitutionally standing on firm ground and NDC whatever its called is in a catch 22.

    • We had the same problems in Kabwe and our then vice president acting as president Mr Guy Scott fight without the Register of societies getting involved. so what’s so special about NDC. This is where we going wrong, CK will ride on our mistakes and we will create something out of him. Just leave NDC to fight there own battles. NDC is not a threat. The Zambian people are a threat.   3. The Registrar of Society has now assumed the role of the judiciary. Once a party is registered it is not the role of the Registrar to arbitrate intra -party misunderstandings and legal issues.That is the role of the High Court.Even the demotion of Mwenya Musenge should have been referred to the High Court but the the Registrar has chosen to be entangled in politics instead of being professional.It is evident that he is operating under the guidance of an invincible political hand. Mwenya Musenge knows who is financing the disturbance in the NDC and who is directing him to the Registrar of Societies instead of suing in the courts of law.

      In addition, just like the Registrar of Companies can sanction a Company that goes against its memoranda and articles of association, so can the Registrar of Societies.

  5. Expel Musenge from the party to end the confusion. Invite him to the meeting and then expel him for bringing the party into disrepute by failing to participate and promote the party during the Roan Parliamentary bye election. The will be a very good reason for the party to get rid of him and move on without any further damage. That will leave the registrar wrong footed.

  6. BaJames you re right and that the right way of getting rid of wanting members. Let them be part of the decision to have themselves expelled from the party. Dont make a mistake of not inviting them – make sure that they are present and crack the whip. But its like the Doc CK is just a Doc without thinking.

  7. CK may have erred in firing Mwenye Musenge but really it is not the role of the registrar to interpret that. This is an embarrassment for the office of the Registrar to come out like that. That is what happens when you have evil motives and frustrations of losing a Roan Parliamentary seat. Leave that to the courts of law. This is an indication that Mwenye has been working with PF in the past to go for Kambili. If I were Kambwili I would ignore that directive and wait for Musenge to go to court. Akafumbu their Vice President is lawyer and must know these things better. I would rather wait and eat more popcorns first before making a decision over this saga.

  8. The Registrar’s role is to register organizations, not to interpret the law. That is the duty of the court. The election of Kambwili is the party’s internal matter. The aggrieved people should go to the court.

  9. Purchased degrees do add much value to their owners. In contrast the Honorary degrees are given in recognition of substance. But in the case of GBVM and CK these degrees are actually purchased but with guised honourary tone which do not add value to the owners. If anything, these people are an embarrassment to the academic fraternity and do not inspire anyone other than those with very low understanding and those picking crumbs from under their (GBVM and CK) tables. What we need to know now is who is registered as president of this party? or who is the care taker in the absence of the party president? The ROS has errored and has shown that it is acting on impulse in that it too took a very contemptuous step of bulging into a member’s private documentation to them and publishing them without due permissions from their particular member.NDC SG should have grieved through the Court as they are the ones mandated with the interpretation of any law.CK continues as president until Court rules.

    • @watchman. You mean Illegally continue, which means nothing CK does is recognised by law, so why would NDC continue with a President not recognised in law? I don’t think your interpretation is correct. The registrar of societies has a powerful role in law, it IS the body that ratifies Party legality. As it stands the law does NOT recognise CK, even without a court case, which is strictly not necessary. Question is if Musenge can raise a grievance in court for unfair removal, and ask for substantial damages for public humiliation by the party and CK. Mmmm could be interesting especially if he sued CK directly as well as the party, that way court awards him cash from CK’S personal PURSE as well…..!!!!!

  14. A minor inconvenience; you get treated the same way you treat others, Musenge has proven this in this coup de grâce, ….well maybe not fatal but like a mosquito bite, blooming annoying!

    Musenge has got his own back for CK’s summary dismissal and humiliation. Very satisfying, indeed. Evening he leaves in the end after they follow procedure, Musenge can walk off into the night with a broad smile of cat got the cream!

    In the meantime, he can really annoy CK, by undermining him at every term, like….he don’t care he’s leaving soon!

  15. This is utter pants. How does the registrar of societies involve himself in the internal affairs of a political party? These are machinations of the scared PF. They want to destabilise opposition parties. The loss in Roan is so painful.

    • If the registrar does not clear the air you UPND chaps will be the first to point fingers at PF. Please take note also that the legitimate SG of NDC wrote for the to the registrar of societies to give direction in terms of their constitution. The hallucinations about PF being involved are mis directed. We need reasonable and balanced issue based debates not polical comentry.

The Registrar of Societies, as a Department under the Ministry of Home Affairs, is charged with the responsibility of registering, regulating and monitoring of Societies in the Country in accordance with Registrar of Societies Act Chapter 119 of the Laws of Zambia. The Registrar is mandated to effectively and efficiently register and regulate societies in Zambia and to enhance good governance in the nation. These societies include political parties like the NDC. Thus, what the Registrar of Societies has done is within her mandate. Period.

    Bloggers here must learn to read and to reflect on what they read rather than indulge in needless speculation and pointless arguments.

  19. The so called National Dialogue law or bill is nothing but a sham. They people who will be attending this dialogue will be told to put in law that a political party president can only contest presidential elections twice and he fails on those two occasions he can’t remain a party president. This aimed at HH. PF is pushing hard to have this in the constitution like yesterday. When you hear them saying HH will not take part in the 2021 elections that’s what they are talking about. PF are always busy scheming to find a way of making sure HH is eliminated to take part in 2021 at any means. So all the independent & opposition MPs should be aware of this and don’t get fooled. Remember Musenge’s project has all the DNA of PF behind. It’s also 95% possible that PF is behind GBM’s fiascal…
