SECOND Republican president Fredrick Chiluba has said he will claim his money, which he kept in the Zamtrop account now that he has been acquitted of charges of theft.
Dr Chiluba said that he would go to Luapula Province to tell the people to vote for President Banda because the incumbent has shown that he is a uniting force in the country.
Speaking at the celebratory church service for his acquittal at Bible Gospel Church in Africa (Bigoca) yesterday Dr Chiluba said he would ask for his money because he had been cleared by the courts of law.
Dr Chiluba said he was advised to keep his personal money in the Zamtrop account meant for the construction of the Institute of Democratic Studies because some of his friends who donated towards the project could have given him money laundered from drugs.
He said even before he was taken to court, three financial institutions – the Bank of Zambia, Grant Thornton and Price Water House Coopers audited the Zamtrop account and told the Government that there was private money in it as well.
Dr Chiluba said he wondered why he was accused of stealing the same private money when it was a known fact that he was undertaking a project to construct the institute for democratic studies using the money that he sourced from his friends and well wishers.
He said the US$500,000 he was accused of stealing was equivalent to petty cash for State House.
Dr Chiluba said the reason he was taken to court was a spiritual warfare and not legal because of his decisions to declare Zambia a Christian nation.
He said it did not make legal sense for the courts of law to find his wife guilty first of receiving stolen goods and not the person accused of stealing.
“How could all the three institutions that audited the Zamtrop account conceal theft if at all I stole the money? Why find a person who received stolen property guilty before you do so to a person who stole,” he said.
Dr Chiluba who quoted the book of John Chapter 8:32 from the Bible said true to the scripture in the verse the truth had come to pass adding that truth did not come from newspapers or television but from the Holy Book.[quote]
Dr Chiluba told a packed church that included Matero Member of Parliament Faustina Sinyangwe and visiting American pastor Ralph Snook that he had received offers from Angolan and Zimbabwean spiritualists who wanted to assist him win the theft accusation case but that he declined because he knew that the truth would come to pass that he did not steal.
He said there was no way he could accept spiritual intervention in his case because he is a Christian who believes in God.
“Shall we decide to leave the one who created the man who administers charms made from trees or taken from underground when there is a supreme being who created all these? No ways. We chose to honour God and put the matter in his hands,” he said.
And Dr Chiluba said Zambia as a country was getting back together under President Banda’s rule.
He said he would go to Luapula Province, whether they like it or not, to tell the people in that province that President Banda was the right man for Zambia.
He said first Republican president Kenneth Kaunda left the legacy of One Zambia One Nation but that when he left a new era of tribal politics emerged.
He said Zambians were beginning to practice politics of regionalism that was now fading away under President Banda’s leadership.
Dr Chiluba urged Zambians to help President Banda create an environment where everyone was free to express their different views.
He said the declaration of Zambia as a Christian nation had set the country apart in God’s favour and was certain that other African leaders were rejoicing with Zambia.
And Bigoca overseer, Peter Ndhlovu said Dr Chiluba’s victory was not only for his family but the Church as well.
Bishop Ndhlovu said God saved Dr Chiluba from dying because He wanted him to live and see change in the country.
“Sir, the devil wanted to see you in jail but God said no. At the day of judgement of your case, people were saying this case is difficult but in my heart, I was saying nothing is impossible with God,” he said.
And New Generation Party (NGP) president, Humphrey Siulapwa has urged Zambians to accept and respect the court’s judgment on Dr Chiluba.
Mr Siulapwa said at a Press briefing yesterday that Zambians had no choice but to accept the court’s verdict on Dr Chiluba since they had waited for the judgment for more than seven months.
He said that his party had accepted the judgment and that people should not be misled by the media on the issue.
He said the Government should not appeal against the judgment, adding that the Task Force on Corruption should also be dissolved while the Anti-Corruption Commission (ACC) and the Drug-Enforcement Commission (DEC) should be strengthened.
He said Dr Chiluba had a right to claim his immunity since the court had declared him clean of all the allegations.
Mr Siulapwa said the London High Court judgment should not be registered in Zambia because there was no way a Zambian president could be tried in a foreign court.
He also said his party supported the Government’s idea to regulate the media if it failed to regulate itself because it also had to be checked.

well, since the court aquitted Chiluba, it’s only fair that he gets his money back, there is nothing anyone can do about it. the main culprits in this whole saga are Max Nkole together with Nchito who meserably failed to get a conviction, there should be made to account for all the moneis they recieved for a case they knew where bound to loose. There are the thieves, There have stollen billions by pretending to prosecute when infact they knew there had no case.

I am agreeing with Dambisa Moyo in her call for all governments to stop aid payments to Zambia immediately (our foreign debt is now $2m. Did we learn nothing from the HIPC episode!!!). We claim to be hungry, but when someone takes advantage of us we sit on our a$$es, we are surely the dumbest people on earth. Zambia is headed for civil strife, I’m certain of it, our present path is not sustainable. The political landscape is becoming more and more polarised and soon the only recourse to try and even the field will be violence. I feel myself being drawn to acts of vigilantism.

ESU Nursing School director commits suicide

ONE of the directors of ESU Nursing School in Lusaka, Joshua Ushibantu Simpaya, has committed suicide.
Simpaya, who was an employee of the Ministry of Health, committed suicide on Saturday around 09:00 hours and the funeral is at his home off Chilumbulu Road near Looters in Lusaka.
Police spokesperson Bonny Kapeso yesterday confirmed Simpaya’s death.
Kapeso said Simpaya is believed to have drunk a poisonous substance.
Simpaya was being investigated over billions of public money which were paid to the nursing school housed in Chudleigh, Lusaka.
The school is reported to have received over K7 billion just in 2008, on the pretext that it was training government nurses, midwives and clinical…
I am shocked that there were no demonstrations this time over Chiluba acquittal, remember the demonstrations we had going to parliament to make sure this guy would go to court. Unless they say they are appealing the case, then they can still hold personal items that they took in. If they are not showing signs of appealing the case, some questions might beg to be answered. What do they intend to do with the items that are his? With regard to money in Zamtrop, I think Freddie should forget about that money. I remember the use of ‘donations’ to Chiluba’s projects from the Vulture Fund saga, in which he helpfully pointed out outanding debt to vulture fund ‘investors’, so they could buy them up and sue the Zambian government for the full amount.

Even I’m no lawyer but I sure can convict him just based on this nonsense he is spitting out in this article. Surely Chiluba is daring and asking ‘legitimate’ questions, albeit poking fun ata our judiciary system. He is bragging and trying to tell us he stole more than $500k (I equally wowndered why he was charged with such a ‘small’ amount). He is also saying he actually should have been convicted because the recipient of his loot was convicted. And finally he is saying RB had had a hand in his acquittal. And his excuse for storing money in Zamtrop doesn’t make sense, and is he saying the money was donated by drug…
Rather than appealing, I reckon the entire Task Force must disband and fire itself for failing to convict this outright thief. How else will they justify their existence when they have failed to nail to the cross the very target they were set for in the first place? I don’t care whether the judge or the President had had a hand in this acquital but the Task Force should have provided an overwhelming evidence against Chiluba, evidence that should have withstood any form of manipulation! After all these long 8 yrs they ought to be ashamed of themselves. If really there is corruption involved in their entire system and process, then appealing is a sheer waste of time and money – 2 valuable scarce resources in Zambia at the moment!

What Zambia needs more than anything, more than morality in public office, more than privatisation, more than foreign investors, is good governance. Zambia needs to have strong checks and balances on anything from public financing to donations to politicians.
The way to achieve that, is to have very strong, independent civil service organisations that can easily stand up to political pressure, and can easily bring cases that get politicians convicted when they stray from the law.
We need a professionalisation of the civil service and parastatals, a strong reduction in the number and depth of political appointments to the civil service, and legal powers for civil service organisation, and constitutional protection.
We need to strengthen democratic institutions.

2. Pay all the taxes on this same money as all income including gifts and contributions are considered taxable in Zambia.
3. Pay all fines and penalties on the same income if he did not pay the taxes on the same income.
4. Clearly identify and produce proof of the source of this money. They say if he is innocent and the income is genuine not stolen heshould do the right thing and pay hs taxes like all upstanding citizens. Reasonable request don’t you think ?
