NCC launches Draft Constitution

The National Constitutional Conference, NCC, has today launched the long awaited Draft Constitution.

Speaking during the launch at Mulungushi International Conference Centre this morning, NCC Chairperson, Chifumu Banda, said the launch has been done in accordance with Section 23 of the National Constitutional Conference Act, No. 19 of 2007, which states that the National Constitutional Conference should publish the Initial Report and the Draft Constitution adopted by the Conference and facilitate public debate and comments.[pullquote]Mr. Banda said the governance of the country will not improve by how much citizens quarrel among themselves.[/pullquote]

He says the public should spend much of their time to study the document instead of issuing unworthy criticisms of the NCC.

Mr. Banda launched the three documents which the NCC produced which include the Initial Report of the Conference, the Draft Constitution, and the Summary of the Resolutions of the Conference.

Mr. Banda has since appealed to the general public to take time to study the documents during the 40 days period starting today for the public to make their contributions, observations and other responses to the draft constitution.

He says the documents will be made available to the general public through the office of the District Commissioner in all the districts across the country, through the NCC Secretariat at Mulungushi International Conference Centre, as well as through the three websites which have been provided.

He named the Websites as the governance Secretariat under the Ministry of Justice on www.governance.gov.zm; the National Assembly website on www.parliament.gov.zm; and the National Constitution Conference website on www.ncczambia.org.

Meanwhile, Mr. Banda said the governance of the country will not improve by how much citizens quarrel among themselves.

If the public feel like criticising and in their judgement their criticisms are valid, then they are free to do so. Now that i have had my rant, let me just say that its about bloody time! I hope that issues raised by the public /have/will be taken on board . We need a robust constitution which will stand the test of time and galvanise our people.

  3. Advice to PF/UPND blind followers of Ichilema and Satan. The draft of the supreme document of the land is made public. If you can read please participate and contribute to the constitution otherwise you shall cry foul. Kaponyas need to learn how to read.

    Mr Chifumo Banda must not trigger apathy in the public. The Zambians have the Right to air their views regardless from which ever cadre.

  9. Why is this man so protective about the so called draft. Let people air their views freely. He knows there is a lot of rubish in the draft because it was written by the MMD and not the Zambians wishes. If you are not ready to be criticized get the hell draft away from us.

This draft constitution is so draconian and backswards.Imagine having a damn constitution that denies citizens right to basics such as food,housing,health etc. It goes steps further in denying people a good voting system by disallowing the 50+1.This is a screwd up constitution that allows one bastard or so called president to have almost godly powers,in that he appoints and dissapoints everyone and everything.Am amazed that some baggers are already praising it.With so many “wamuyaya praise singers” Zambia is surely doomed!

  13. this dirty document must be rejected by good citizens because of the following reasons
    1) only 5% of grade 12 school leavers go to university (mostly children of those same guys in this so called NCC) to get degrees because of limited space hence we can’t deny 95% rights to become presidents.
    2) we need a president accepted by half of the citizens. put in 50%+1 clause in the constitution to avoid riging.
    3) water, food and other human basic needs are citizens rights. government must provide
    4) we need independent appointing bodies/committees for major positions in government to avoid political interference.eg judges, inspector general of policy, DPP etc.

    Do we really need to even change the constitution considering the contents?

    How come the IP address for the new MMD Bootlicker in the USA is the same as Veteran Senior Citiizen BK?

    Fired South Africa High Commissioner is no longer on the web. Sad scenario. For continuity their chief Spokesperson BK at Washington has taken up the duties of blogging for everyone that is recalled.

  15. Is there a constitution anywhere in the world that guarantees food and shelter for all citizens? If it was enshrined in the constitution, would I then be able to sit on my arse and expect the govt to feed and house me?

    I wonder how this will affect the pact seeing that UPND sat on the NCC which means that they have in fact endorsed the document?

    I will however begin to work on producing a better constitution for a political party to be borne in the future which hopefully will form GRZ Administration and then provide all Zambians with an altered Zambia Republican Constitution that will reduce the still excessive powers a sitting President of Zambia holds.

  17. The reason behind not allowing access to food and shelter in the draft constitution is meant to stop the devastating African trend of begging all the time. This will help our people to work hard and make ends meet without relying on one breadwinner who gets up every morning go to his ‘Kantemba’ makes his money and goes home in the evening with ‘dry kapenta’ and a small bag of sugar for ‘porage’. His wife is unemployed, his children cant read, his nephews are kaponyas. We need to learn to work hard and do whatever it takes to make it otherwise Ichilema and Satan will continue insulting everybody.

  18. # what is there to read. These cadres rejected our submissions through Mun’gomba commission. Our comment is simple. Let us replace this rubbish document with the Mungomba draft in its totality. 50+1, Degree Clause, Social Economic rights, Elected Veep, (co-runner), right to Education upto vasity, reduction of presidential powers, Non appointing of ministers from members of Parliament. All these good things are not their in this junk they want us to read. We are not dull to be reading this junk. We followed the deliberations of this fradulent NCC. It is quite sad that we must read this document becouse it is a bad teast.

  19. MMD is very comfortable with any constitution amendment. Its up to the Zambian people to say what they want after fully understanding their constitutional right. Our sovereign government will do the will of the people because its the same majority of Zambians who voted for our government. What we do NOT want to see is a bunch of kaponyas in Lusaka and Kitwe who think they are the majority. Zambia has nine provinces and MMD enjoys a cool majority of members and voters. When 2011 come you will remember my words. MMD can afford to forgo 2 or 3 provinces and scoop the rest! This is what is troubling Satan’s mind and his young brother Ichilema with no wings to fly by himself. Join MMD today otherwise you will remain miserable

  22. The Circus continues…..Since Dr Kaunda vacated State house we have failed to do a sensible job all because we donot really know what we want. First the NCC rejected the key expectations i.e 50+1+right to education,shelter and food etc and now they asking us for comments within 40 days when it taken years,allowances to come up with this draft. What a waste of time and money!

In as mush as you think you will contribute to this document or produce your own in the future adminstartion(whatever that means), it all starts with 2011 & i bet aganist ma finger MM has to go for convention to choose a presidential candidate but already GKunda has said its only RB. How can you give citizens of a country 40 days to read and consider a document, when the document is only available on-line ( I have not found it on any of the websites mentioned), in a country where internet access is severely restricted and expensive to most citizens. This level of consultation is disingenuous and shows a lack of respect for the general populance.

  29. #36 I did not realise that there were any rebel MPs from the UPND camp sitting on the NCC. I am aware of rebel PF mps led by Machungwa but the UPND sat on the NCC and were reportedly happy about inclusion of the degree clause. Perhaps you have more information regarding the matter. I appreciate your ability to argue a point without resorting to insults and any other childish behaviour as we live in a country where divergent views are tolerated. Question is: Is there any guarantee that what the citizens will submit after going through this document will be taken into account by those who think because they currently occupy privileged positions, then they have the monopoly on intelligence and wisdom? Or is it a case of going through the motions and wasting time? Someone, please, assure me.

  33. #42 I personally am not afraid of the 51 plus clause as I dont think Sata would get it. If it was to go to a run off between Sata and RB, Western, Southern, and NW are more likely to vote for RB than Sata as PF usually a poor third in those provinces. The point I am trying to raise and which some of you are avoiding to answer is what does this new development mean for the pact because UPND have been sitting whereas PF except for the rebel MPs have boycotted the process? This means that whatever document is finally produced will have been endorsed by UPND, how then will they work with a party that has been totally opposed to the whole process?

  35. The final report has over 900 pages but the constitution draft has 291 pages. one doesn’t need to read all things anyway…Choose what is close to your heart…..
    as for Dual citizenship.. article 21. (1) A citizen, by birth or descent, shall not lose that
    citizenship by acquiring the citizenship of another country.
    (2) A citizen, by birth or descent, and who, before the
    commencement of this Constitution, acquired the citizenship of another
    country and as a result ceased to be a Zambian citizen shall be entitled to
    apply to the Citizenship Board to regain that citizenship.
    This is good for national development.

I hope the public will still be given a chance to change things they think should be done differently. 40 days is quite too short but concerned citizens should surely read some clauses close to their hearts and let the NCC know that the public disagrees to certain points stated in the draft. This will also let politicians know that we are “not DULL ZAMBIANS” as stated by one of the Ministers.

  37. I am proud to be MMD Chief Boot Licker and my contribution to my country and government. For yall information, I have 3 kids, Two at University in South Africa and 1 at UNZA in Zambia. Im sure my children are more on a good path to success than half of kaponyas here. It is important to have facts before you open your poor and uneducated mouth! With or without MMD I will remain The Chief Boot Licker! My salary alone has served 19 street kids from Lusaka! Yes there is a reason people call me MMD Chief Boot Licker!
