Court clears Magande of graft charges

maga.jpgThe Lusaka High Court on Monday cleared Finance Minister Ng’andu Magande of corruption charges levelled against him by two losing candidates in last year’s parliamentary elections.

Magande was facing 62 charges of graft which Priscilla Kamanga of the chief opposition Patriotic Front (PF) party and Cosmos Moono of the United Party for National Development (UPND) brought before the court in Zambia’s most contentious and highly publicised parliamentary petition.

Economic analysts had feared a serious economic management backlash if Magande had lost the case.

He is credited with the fiscal discipline which has seen a turnaround in Zambia’s economic performance, with GDP growth averaging 5 percent in the last five years in Zambia, where mining is the economic lifeblood.

High Court Judge Marvin Mwanamwambwa threw out all 62 allegations that Magande and his election agents bribed voters to win the vote in an opposition stronghold. The court said he was duly elected as a legislator.

“I have found that there was no bribery and corruption as defined by the Electoral Act,” Mwanamwambwa said in his ruling.

He said the few irregularities which had been proven did not warrant the nullification of Magande’s election victory.

“In my view honourable Magande won the election because the opposition (candidates) split the vote among themselves. He did not win because of (allegations of) rampant corruption and bribery,” Mwanamwambwa said.

Magande said Zambia should put the elections behind it and focus on serious challenges.

“We can now forget about the elections and this will help me to focus on making sure we work hard to address the most pressing issues of poverty alleviation and finding improving the economic environment,” he told Reuters after the ruling.

  2. The case has been thrown out with costs with Magande declared dully elected. The bill for UPND’s Captain Mono and PF is now prohibitive. Kindly coordinate your friends and send the currency to help liquidate it if you are true patriots and supporters of Democracy.Could you answer to the question of what can i do for my country instead of what my country can do for me.PF and UPND are in desperate financial needs. Channel the money on Sata and HH’s personal accounts per their donations procedures.

  3. Magande has skills? My foot! Magande does not have a an impressive track record let alone skills. He worked for Lima Bank it collapsed,ZANACO, nothing to write home about. When he went to the regional job, they could not give him the second term, a friend of mine who was working for the same insittitution at one point wondered why he was such a big villager! Before his appointment as a minister, he had a consultancy job with UNDP Zambia, todate he has not submitted the results but he chewed the money. Infact, UNDP were about to take him to court that is when he was appointed as a minister! What kills are you talking about?

  4. it would have been quite a disaster if he lost his seat and ministerial position.To cry foul would be folly as MMD has lost a number of seats due to nullifications.I am hoping the judge is no relation to the Speaker.I am NOT suggesting ANY undue influence but it would have enhanced the apparent impartiality of his ruling.It wouldn’t surprise me if the opposition use the judge being related to the Speaker as a possible reason for their petition loss.(my comment is on the assumption they are related!!)The economic revolution of Zambia would never be complete without the mention of Magandes’ proven competency and obvious contributions.

Magande is VERY well respected at home and abroad both as an intellectual and principled person.Nothing you have said in your contribution will change this perception.There are plenty others in cabinet who deserve your attention and more meaningful comment.

  12. Two Approaches to Managing Your Money

    An investor is long-term oriented and therefore ignores short-term fluctuations, except to see whether anyone in the market is offering to do anything foolish, like selling too cheap or buying too dear.

  13. Since we want to uphold the rule of law and since we believe in our judiciary’s competence and its independence thereof, we welcome the ruling by the Lusaka High Court. Just as we have seen the Courts nullify some elections, upholding of others appear to show some impartiality. Undoubtedly, some people may not of course agree with some rulings but we have to go by the judgment, put it behind us and continue to work together for our Zambia. That is democracy that we have chosen friends. This reminds me of the O.J. Simpson that the courts in the U.S.A. acquitted of murder but many people still treat him as a convict. No, this should not be the case let him enjoy his victory!

Anyway, i believe Magande was duly elected judge Mwanamwambwa said it and i believe it. I know most of you PF zealots dont believe the judgement was fair. Sometimes you have to give these guys a benefit of a doubt. I know the stakes where high. But you cant always have it your way like bugger king. For you MMD fanatics you have dodged a big one. For the rest of us who are just Zambian citizens lets focus our energy on what we can do to help our friends back home make those economic gains start going to rural areas and not just in Lusaka.

  16. #19 Yes my friend I read the topic and found it clear for any comment.I always trust our judicial system and cant despute what the findings are but since they have been marginalised and rendered useless by Chuchu everyone has just developed this this loss of trust in them.All I can wish for is total restoration of the great trust our judicial system once enjoyed when Annel Silungwe almost caused a similar stir before fleeing to Namibia.The judge gave reasons for all those 63 fabricated cases but like Mabenga most of these guys are doubting thomases until the final nail is done by Supreme shall their hearts rest.

  19. If you really follow Zambia’s history well. I think you will agree with me that our judicial system more especially the judges have come a long way. In kaunda’s era there were no court petitions because the judiciary was a mere rubber stamp. thats why Judge Musumali caused a stire when he sentenced kambarage to death. But Silungwe ofcourse let him walk. I a gree there are still challenges in the walk to judicial independence. But looking at the fact that our democracy is only 16 years.. we have come a long way. There is always going to be contravesy whenever judgements are being handed down on high profile cases. Even in USA Bush V Gore is still being talked about today. But as a people we have to learn to accept some of these judgements and move on. If this judgement was handed down by judge smith, well that is a different story. But when judgement is passed in the Zambian courts by Zambian Judges we should respect the judgement. Lets have some faith in our own system.

But in your case I have seen the need to add the rebuke spread. Like Hon.Magande, my first tertiary school Degree is in Economics. Thus, I appreciate what it takes for him to Graduate with honors in Applied Economics.
    Like any other rigorous professional disciplines, surely Magande a senior economist has professional skills and proven brain power with a strong Resume sellable across the board. That said, professionals with objective personality and equal achievements will find you hideously malicious, cheap and invidious in your tirade herein. For many years under different Finance Ministers including the late Gibson Chigaga one of Zambia’s Finance professional sages.
    Magande served this Country well as National Treasury Director of Budgets at MoF. At the same ministry Magande served for years as Permanent Secretary in his capacity as a technocrat with outstanding economics studies profile before he went to UNDP and Lima Bank Zambia. Throughout his professional career Magande has done some phenomenal consultancy works that until his entry into active politics, he was being overwhelmed with consultancy contracts to sign up.
    Operationally his strict fiscal discipline and econometrics have turned our economy around on a growth dimension. Inflation held at 32% in 2000 is now on a 1 digit inflexion point steadily on the decline. On aggregate the Zambian economy is on what I would call a steady stay ideal for businesses. Remember that previously, the kwacha lost its value against the dollar beyond acceptable intrinsic value on the market. Not mentioning the waste 80s economic abyss or the haphazard Penzanomics on privatization void of smart safe guards, in the mid- to late 2001 Emmanuel Kasonde tenure, Zambia’s fiscal management was still volatile until Magande came in and steadily fostered his more fiscal conservative measures.
    With his strict Magandenomics, from the 2001 year-end inflation when it was below 20%, its best result in decades, starting last Quarter of 2002 inflation was under arrest way into a down spiral. Today, we can attest the consistent surplus and balance-of-payment support giving us dependable resources for capital investment bearing in mind our previous quagmire when thieves reigned.
    Not saying that what is at hand is the best or expected optimal performance in line with our respective expectancy theories. But earnestly, there have been some positive macroeconomic signs, rooted in reforms started in the early 90s but fiscally implemented with strict disciple under Magande.
    Today Zambia’s floating exchange rate and open capital markets have provided useful discipline on the government, while at the same time allowing continued diversification of Zambia’s main stay sectors such as mining. There are results in the export sector, exponential growth in the tourist industry previously below 200,000 visits to the present 660,000 with a 1,000,000 visits vision under heavy support.
    Also there are procurement of inputs for growing businesses and farming support incentives. Some parts of the Copper Belt, NW, Southern and potentially the Luapula have experienced a significant revival as spin-off effects from the massive capital reinvestment are experienced. There is no magic bullet to our predicament but discipline, consistency with our vision and collective efforts at driving economic change in a realistic way.

Good judgement and hope Magande can now concentrate on creating a tax policy that would encourage investors like us who are involved in heavyduty equipment and directly impact the manufacturing industry.He`s yanking alot of tax on such imports and this is becoming too prohibitive to invest in Zambia by indegenous Zambians.Why can`t he just give us a tax break,coz he`s going to recover any lost revenue when we boost the manufacturing sector.Already,he should realise that we`re creating employment and as a result broadening the tax bess and not forgeting the corperate tax we would be paying.

    Go for it and rock your vision into tangible prosperity. There are many incentives at hand that the ingenious are cashing in millions. Zambia will only be developed by Zambians. Too much of unregulated rhetoric will not do. Man shall not live on bread alone. Build your prosperity in the days of your youth.     When God speaks to you it’s not always wise to rush out and tell people yet to be soaked in his touch or have never walked the ways of victory. Actually, it can hurt you! When God gives you a word of direction it’s often followed by a season of preparation. Who wouldn’t want to talk about the amazing experience Paul had with God on the Damascus Road? And there would be a ‘right time’ for doing that – but not yet.
    Don’t go till God gives you the green light. Why? (a) Because God may need time to prepare the hearts of those He is sending you to or blessing you with. (b) You need time, maturing and equipping, so that the word you’ve received can take root and be fulfilled in the way God wants. Paul writes, “Immediately after my calling – without consulting anyone around me and without going up to Jerusalem to confer with those who were apostles long before I was – I got away to Arabia…it was three years before I went up to Jerusalem to compare stories with Peter…Then I began my ministry” (Gal 1:16-21 TM). Paul had the wisdom to know that people would find his calling unbelievable. So he waited. He allowed God to go ahead of him and arrange the circumstances in his favor. And while he was waiting, he allowed the word he had received to grow in his heart and make changes in his life.
    Then, and only then, did he start doing what he was called to do. Paul didn’t try to convince anybody, he let God do that. And the result? “Their response was to recognize and worship God because of me” (Gal 1:24 TM). So don’t be bothered or act on peer pressure of getting ahead or against God’s plan for your life through malicious behavior. Be sensitive to His timing! God has it all for you coming. Life and death are in our tongues. What God has blessed no malicious tongue or heart will curse it. Let you answer be Yes or No always. Endeavor to align your motives right and avoid popularity ambitions at the expense of trapping yourself. Life has too many vigilant men to cover document your failures and susceptibilities in future role. Unlike God teaching the 70*70 rule, before man’s files these can never be deleted unless compelling evidence of a radical change is validated in layers.

Addressing jubilant MMD cadres after Lusaka High Court judge Marvin Mwanamwambwa dismissed the petition of UDA’s Capt Moono and Patriotic Front’s Priscilla Kamanga against him, Magande – who could not hide his joy at the judgment – said as the High Court had stated, he won the elections without cheating anybody. “Let me take this opportunity to thank all of you who made time to come up to the High Court to hear the judgment on the petition raised on your decision that you made on 28th September. We have come out of the High Court, one of the highest legal institutions in the land, and it has been declared that your decision, your action on the 28th of September was indeed without bribery, without corruption and that you chose me to be your member of parliament,” he said. Magande assured the cadres that he would continue doing the job that President Mwanawasa gave him.“I promised to help you once you elected me. I want to assure you that even while the High Court case was going on, I have been in the constituency working. So now that this is over, I want to go back to the job that President Mwanawasa gave me. My job is to make sure that I bring development to Zambia. All that I want to ask of all MMD members is that we must now work hard so that even those who wasted our time coming to the High Court and wanted us to be their enemies, we show them that they need us and we can look after them,” he said. Magande said he intended to ask President Mwanawasa to start touring and seeing the projects in the various parts of the country where money had been released.“I want you to work with me and work with President Mwanawasa so that the next four years we bring development,” he said. Judge Mwanamwambwa ordered the petitioners to pay costs of the proceedings that would be taxed in default of agreement. Hon Mangande, late Penza, Emmanuel Kasonde and Nawakwi did their best and we envy their contributions.Without dedicated men and women at MOF all the best things we are seeing wouldn’t have been possible to acheive.All the flowers of the tommorows are in the seeds of today.     Take it; personally I hold no umbrage against you or any pundit from the flow of debates hereon. I presume we are all passionate and mean well in our own ways for mother Zambia and nothing personal. Of course diversity has no shortage of the mentally challenged folks ever flagging up their psychological issues yet right in their own way with belief that they are mentally complete.

    Strongly I believe in a cross-cutting diversity be it in public affairs discourse. That explains that I will neither downplay the role of diversity or inhibit logic of anyone in business or the democratic process. At a personal level, What I detest and instantly cut ties with is a lying or malicious spirit. So on your platform join some of us in moral driven advocacy holding your grounds during public discourse with knowledge, wisdom and tolerance for the good of a better Zambia. Development is a process of continuous improvements by a country’s own consecutive Generations of patriots.

    ZAMBIA Episcopal Conference (ZEC) president, Archbishop Telesphore Mpundu says the Catholic Church needs a strong Government for it to smoothly carry out its denominational endeavours.Archbishop Mpundu of Lusaka said the Catholic community cherished a strong Government like that of President Mwanawasa whose vision was oriented on going forward.He was speaking in Solwezi on Sunday at the ordination and installation ceremony of the Reverend Dr Alick Banda as Bishop of Solwezi at St. Daniel Cathedral.”There is nothing that Government can fear from us since we are non-partisan and seek no political power,” he said.He said Catholics believed the healthier way to solidify dialogue at times was to be frank by agreeing to disagree.Archbishop Mpundu said the church did not have any provision to allow its members to vote for specific political leaders.”We protect the polarity of the political opinion in the church,” he said.He said a situation manifested by a weak government would spill over the malaise into the spiritual coordination of the church.”When we criticise the Government, we just want the best to come out of its leadership, and we surely acknowledge positively where good things are done,” he said.He advised Government to work with priests as partners in the crusade against corruption as their fight had a direct audience in front of the pulpit.He also complained that the media was not doing a good job to bring Government and the Church together.He advised President Mwanawasa to be flexible and listen to the views of the Zambian citizens on the constitution-making process.”The President is our father and we have he right to talk to him accordingly about the constitution,” he said.”The voice of the people is the voice of God.So please bring as many representations on board by including the representatives of the people in the Zambia Centre for Inter-party Dialogue instead of bringing them in the final stage of the process.”And Bishop Banda said the diocese was ready to work with investors to develop the country.

  35. BOZ FORECASTS BRIGHT ECONOMIC OUTLOOK

    THE Bank of Zambia (BoZ) has forecast a bright economic outlook for the third quarter of 2007, which will be buoyed by increased food reserves, high copper export revenue and a stable exchange rate.But high global crude oil prices and the effects of lower money supply growth in the past six months would exert inflationary pressures for the next three months or beyond.Governor of the central bank, Caleb Fundanga said this at the bank’s second quarter media briefing in Lusaka yesterday.“In the ensuing quarter, inflationary pressures are expected to ease on the basis of the build-up in strategic food reserves and improved supply of food items from the 2006/7 agricultural season, particularly maize following the commencement of the marketing season,” Dr Fundanga said.He attributed the relative stability of the Kwacha against other convertible currencies to the increase in foreign exchange earnings arising from high copper prices on the international market.Apart from the price of oil and delayed lower money supply growth, the ban on livestock movement resulting in high price of beef would contribute to the rise in inflation.He also said domestic credits declined in the second quarter, mainly because of reduced Government borrowing. The president said without such interventions many children would have dropped out of school, hence urged the church and government to continue working together for the benefit of people of Zambia.

The parents said over the past two weeks they had protested and sought audience at the District Education Offices (DEBS) to address the anomaly but to no avail. One of the parents, Karen Kalumba, who is a mother of twins at the school, said one of her two children had surprisingly been omitted despite her paying for the examinations on the same date. “How is it that the other child is not enlisted since

  88. point of correction the millions of kwacha spent by contractors was not 4 justice to account.contracts just go there for legal scrutiny then the implemetation is done by the client ministry.there are no modalities in place to stipulate that ministry of justice shd monitor the performance of the contracts.they are grz lawyers remember.the controlling officers at works and supply and finance should answer coz moj is not privy to the contract they just offer legal services

Such indexes have 100 as base value in a given year(or period), the base year. Other values of the index are relative to the base year. An index value of 40 indicates that the cost of living is 40% lowe than in the base year. Thus, the index provides no unit-free measure of the cost of living.
