President Mwanawasa commutes death sentences for 97 prisoners

President Mwanawasa has commuted to life imprisonment the death sentences of 97 prisoners who were on death row.

And President Mwanawasa has also released 823  prisoners serving various sentences for various offences across the country.

The prisoners are being released on condition that they do not commit similar
offences during the period up to the respective dates when they would have completed
serving their sentences.

If they should so commit any such offence, then they shall in addition to the
sentence imposed for such offence serve the sentence which is unexpired on the date
of the order of release.

This is according to a statement released to ZANIS in Lusaka today signed by
President Mwanawasa’s Special Assistant for Legal Affiars Darlington Mwape.

President Mwanawasa said in the statement that he had been concerned about the
congestion and the bad state of detention facilities in the country.

He said his government was actively considering ways of making conditions of
detention in prisons humane and bearable.

Mr Mwanawasa  added that the commutation was without prejudice to the right of the
prisoners to appeal for further clemency.

The President  further said government will continue reviewing cases with the view
of recommending them for presidential pardon as a way decongesting detention
facilities in the country.

President Mwanawasa recently asked the Zambia Prison Authorities for a list of
prisoners that he would consider for pardon in line with the provisions of the
republican constitution.

  3. I hope Captain Steven Lungu (Solo) is not among those to be hanged. His actions were justified. He wanted thieves to leave office with their stinking govt. By the way I’ve the recordings for Solo. I wonder why he’s still in prison up to now. The man was against the corrupt stinking govt of FTJ. Oh! I can still smell it. I hate it.

Am not sure I appreciate the thinking behind these pardons….murderers and hard core aggravated robbers pardoned while those that stole, a bag of mealie meal, a bicycle, K2m, those accused of “stealing” $400,000 still languishing in prison or being persecuted on their “death” beds….or indeed why not pardon Capt Solo and others?

I know you think that he can do the same to you, capital ‘NO.’ please you have his life in your hands, do something. If I were in your office, I would have done that the day you lifted Chiluba’s immunity. We all love our mother Zambia.

    Some Zambian people agree with Captain Solo’s claims that his actions, although illegal, have been vindicated by the recent unearthing of massive corruption alleged to have been committed by the previous Chiluba regime.

  8. #15 Easy! Having lived in those days of FTJ in Zed. On Oct 1997, came a messiah to redeem us from the sinful and blasphemous regime. He may have not been the messiah though. He came with the message we all desired to hear. FTJ’s govt was filth and smelling of corruption. Solo should be pardoned.

Gluco corruption is still going on at a rampant pace in many govt institutions but there is total selectiveness of arrests by Levys’ govt law enforcement machinary, eg Chitoba, Mabenga, Koyi, Kalumba are still untouchable because they are closer to Levy or tribal mates.Some are used as lamb of sacrifice in the name of fightcorruption, Rev Nyorongo, director of land sichone,ect. The magnitude of you guys who are learnt can read, listen and judge whether the zero tolerance on corruption is there? Gluco don’t just condemn FTJ you dont know how corrupt Levy is till after he leaves office that is the time we will know the truth because those surrounding him will be no longer answeerable to him and they will feel it is time to say the truth to protect their interests.When one finger is oiled the all fingers will be oiled. So open up your eyes and ears. pipo who commit simple cases in many cases can do community work with supervision by local govt and not sending them into prisons.

The principle behind LPM fulfilling his prerogative is good except that there`s no system in place to intergrate the ex offenders back into our society.The problem is that with the high unemployment levels in Zambia it would be absolutely difficult for such individuals to stay away from crime because of the simple fact that they need something to do in order to survive.In developed nations such as the USA,they refer to prisons as Correctional Facilities.The whole purpose is that when a person committs an offence there`s a system in place that helps such individuals to reform and become of value to society.When they are released back into society,they make use of the skills they learnt while in these facilities and easily get employed because jobs are readily available.

Chapi what diffrence do those facilities make in the U.S, not to say your argument is useless but dude common you and i know that most robbers even in the U.S a repeat offenders.Its as hard for any convict any where in the world to fit in after prison unless they themselves are working on bettering they selves, in most case it does not work that way.

  14. Mbozi! I do agree with you that LPM fight against corruption is selective. Some are untouchable like Chitoba. Some are scapegoats like Rev Nyirongo. As you said, you never know LPM cases after leaves office. As for FTJ, even a child could see that something was wrong in State House. He demeaned the presidency. Vendors desk in state house.

  15. #24 HEY.Young man,do not just make a career in shooting down progressive intiatives without even offering any solutions to the existing problems.Do you really think that these prisons in their current state are functioning to expectations?Prisons are so overcrowded that sleeping on a bed is such a luxury,prisoners spend their nights standing and just leaning against each other while some haven`t even had their day in court but have been locked up for years.I gave an example about the USA and their correctional facilities.In any system,it would be folly expecting 100% success rate when you`re dealing with a diverse group of individuals.I am sure you wouldn`t deny that the percentage of repeat offenders in Zambia is far higher than that of the USA based on the reasons I stated in #23.

    For not heeding to the counsel of the wise and the experienced, you have indeed killed this medium of open discussions. It had the potential and value, but your passive leadership has evidently initiated some fierce acts leaving the privacy of debaters compromised. Impersonations, insults on debater, public officials and such illegal acts void of tolerance have been increasing condoned in your eyes. Now it’s no secret that the LT server data base has been compromised beyond exception. The million dollar question is; why Zambian blogs don’t serve the purpose long enough with decency, tolerance and responsibility?   26. I dont understand a word, what is commute? dangerous criminals have been let off on loose? rapists, murderes, armed robbers etc., I need extra locks yet I can’t afford one. JUSTICE? I am so bitter and angry because I have lost friends/relatives through murderes and rapists. God forgive me for my not understanding this. PARDON?

  27. #43 Pamela who told you that the president has pardon murders? to commute is to change or enforce a something in this case dangerous criminals have given life imprisonment instead of death sentences. I think you are christian and you dont want to go tat for tat.
