‘NCC chairman must be elected’

THE Zambia Episcopal Conference (ZEC) has submitted the chairperson and the vice-chairperson of the proposed National Constitutional Conference (NCC) should be elected by the members among themselves.
In a presentation to the Parliament watchdog committee on Legal Affairs, Governance, Human Rights and Gender Matters, the ZEC stated that electing a chairperson and his vice for the NCC from amongst members would be the right thing to do.
“This is important in order to remove all suspicions of Presidential interference as there is always a feeling that where one is appointed by the President, then allegiance is owed to the appointing authority,” the submission stated.
The ZEC called on all participants to the NCC to be patriotic and serve on the basis of sponsorship by their own organisations so as to reduce overall costs.
“We thus propose that a mechanism be worked out so that respective organisations sponsor their candidate as a way of saving costs,” the submission states.
The ZEC was of the view that any interest group like political parties, civil society organisations or Government officials, must not dominate participation in the NCC. Control by a single group would not produce the desired Constitution.
“We therefore urge a clear public scrutiny of the participant list before it is approved,” the ZEC states.
The position of the ZEC on the roadmap was that of the recommendation by the Mung’omba Constitution Review Commission (CRC), which provided that, a popular body, the Constituent Assembly (CA), should adopt of the Constitution.
The composition of the NCC was one of the cardinal issues to the ZEC.
The ZEC felt that the NCC ignored the three step process recommended by the Mung’omba Commission namely adoption, approval by the people through a referendum and enactment by Parliament without further debate.
“In addition, we reiterate our strong view on the need for a proportional representation of all interest groups in the constitutional conference.
This is to facilitate balanced debate and objective resolution of matters that will be brought before the conference,” the submission reads in part.
Zambians wanted to have a Constitution that would be people driven and the ZEC stated that there was still room for the Government to positively engage all stakeholders and adopt a more progressive road map towards the enactment of a new Constitution.
The ZEC hoped that the creation of the constitutional conference if drafted in the spirit of accommodating all views would give a new window of hope that should give birth to a renewed sense of dialogue and peaceful negotiations.
“We therefore call upon the Government to keep its doors of consultation open.
All stakeholders, in short all Zambians need to seize this opportunity to work in harmony for a better Zambia,” the statement says.
The Citizens Forum in its submission to the same committee called for the withdrawal of the NCC bill so that it could be redrafted in accordance with what Zambians said through the submissions to the CRC.
Meanwhile, Zambia Congress of Trade Unions (ZCTU) has reiterated that the National Constitution Conference (NCC) bill should be withdrawn from Parliament to allow for more consultation.
ZCTU president, Leonard Hikaumba said the NCC might appear good but the perception that it was a product of one group would make it illegitimate.
This was because it did not matter whether the bill had answered people’s concerns or not but the people needed to feel part of the process.
He said the ZCTU had talked to Government and other concerned parties on the importance of consensus and the need to be open minded with a strong unity of purpose and inclusiveness.
Mr Hikaumba has said the OASIS Forum should have stuck to it guns over the planned demonstrations at the Southern African Development Community (SADC) Heads of State summit which will be officially opened this week.
“The chickening out by OASIS Forum will make people doubt the extent of the movements commitment,” he said.

    You are truly confused. I am sure you are failing to tell the difference between ZCID where Katele Kalumba was elected Chairman by other board members and NCC which has not yet come into being.

    The issue here if I can simplify it for you is that Government proposed that the chair of NCC be appointed by the president while most members of Oasis forum propose that he be elected by the delegates themselves from amongst them.

    That cheap chamba you bought at Chibombo on your way from Kabwe seems to have turned whatever had remained of your brain upside down.

Lets put aside our blogging differences and for once bring out good and progressive ideas on this subject. If you remember one of the contencious issues to be addressed in the new constitution is presidential powers. If LPM appoints the chairman and vice of NCC , they will cartail the whole process. look at how Mwanamwambwa frastrates debates in parliament. We dont need a repeat of that.

  19. #21 SAGE.The reason I `ve personally lost confidence in this Constitutional proccess is the political manipulation that I foresaw coming into play at such a crucial stage.LPM knows what needs to be done in order to have a constitution that would stand the test of time but unfortunately wouldn`t risk that for obvious political backclash.Why there`s so much upheaval is just on a few contentious issues such as 51% majority vote for the President,FOI and Presidential Powers.If that can be tackled then it wouldn`t even matter who would Chair the NCC.

  20. pandit, most people fail to connect economical development to political freedom. Constitutionaly Zambia is an autocratic state. The president has too much power to do anything he wants. i must say we have come along way looking at KK’s era but we still have long way to go. We have institutions like the police, Op, Courts, that citizens have no faith in because initially they where designed to serve one person. The president. When people where fighting the one party state, the biggest enrmy was the police. That remains so today. I believe the office of IG should be abolished and have each provice elect its provintial police chief. who should be elected every five years by the people. The point is you have to make officers answerable to the citizenary. In The US the president addresses ordinary people as sir and mem respectivelly, why? because he knows who the boss is. A police man addresses people as sir, if he doesnt its a firable offence.We have to get politics out of service delivery

Besides one of his major tasks he has been given by the people is to protect the constitution. If we expect MMD to step aside while we make the new rules, You are one sandwithc short of a picnic, it wont happen. We have to understand incumbancy and the powers and privilages it comes with. Right now there is no law that can stop LPM from appointing any one Chirman or vice of the NCC. dont forget we have given the responsibility to protect the cons.   27. Chapi the biggest contention to the new constittution and its mode of adoption is article 79 which is self protecting cluase. It calls for a referendum in order to be amended or replaced. All these manuvoring has to do with finding a way to amend section 79 without a referendum. which in itself is floating the constitution. the alternative is floating the constitution regardless of what you call it.

  29. Hello Iam here but SAGE I have not seen any problem in the process the Constitution roadmap has taken. Its just yesterday or a day before when the president asked people tp dialogue. If you remember when I protested about the O.S demo I mentioned that instead of going on the streets and cause problems the NGOs should collect information they want to be included in the constitution. This ZEC has just done the right thing and we want more to come. There is noway we can run out one one another, we need everyones representative and contribution. Pilz bear in mind as you talk about the CRC the costs of CA is very huge and unbearable. This is also a critical thing. Learning to spend wisely is one thing we have to learn. Over the election of the chairman of NCC or appointment what is important is to have competent pipo who can drive the vehicle forward. On referendum it Part 3 and article 79 which should go this way. For instant CRC provides that a non Zambian who have lived in Zambia for 12 years can stand for president. Which country on earth is doing this.   35. Ba Jose welcome back, how is inters? Chapi, There are clauses in the cons that can be changed by a mere majority vote in paliament. Self protecting clauses like article 79 are designed to prevent autocrasy and abuse of power. The referendum requirement imposed by section 79 is a way of finding out what people want. right now no one know what people really want. the cons is debated in Lusaka. I hasnt been explained to the blocs in kasama or mongu. The main reason we are trying to avoid the referendum is the money assoc with the same. I have said we should grow up and start spending money of important issues. People look @ K500BN estimated as a lot of money. compare the cost of a flowed cons its not. If you mess with the cons you risk a civil war which could cost us trillions in terms of human life and political turmoil. We should invest in a good const. monking with the cons is not an alternative. what we know is what polititians want but we dont know what people want.

  37. on demos. A demo is the only way the powerless and the voiceless can voice out. Its practice that is a very important tenet of democracy. What we need education on the part of the masses so that they understand what the purpose of a demo is. There is a differency between a demo and a riot. we should condem in the strongest terms anyone who turns a well meant demo into a riot. Organizations like oasis should not be organising demos because they have a platform. They can secure a meeting with LPM any time.They can even walk into parliament and state their case. so what are they trying to archive through demos? demos are people who have no way or opportunity to hair their views in a manare that can catch the eyes of the powers that be.

  49. Chapi you are right… yes we can have a constitution that can stand a test of time. But we should be ready to invest in the constitution. What is going on right now looks like politics , but in actual sence we are trying to find common ground which should be the foundation upon which the constitution can be formulated from. Remember after this constitution we should not talk about the constitution for the next 20 years. Stake holders shoul stop looking at camps and start looking at where do we really want to be in 20 years. look at it as a road map.

  50. EASY to answer your question, i think we need to point out rentals are a factor of supply and demand. And as the Americans say value is perceived. Zambia is a free market economy. That means the economic forces determin the price (supply and demand). At constitutional level all you can do is guarantee affordable housing to the citizens. Thats how councils start building houses which are rented at far much lower rates than privately owned howses. If i’m not mistaken we have that in our current constitution. Anyway i’m not an expert this area i will let Kuku and you EASY expound on this issue.

Upto now none of the most vocal politicians on the street has ever gained some credibility to rebuttal my argument.

    President Mwanawasa said dialogue pre-supposes a give-and-take approach where the outcome must be a result of consensus. He said the debate over the constitution had been a healthy discourse in the democratisation process of Zambia.

    President Mwanawasa said as was customary the world over, security during summits such as the current one was pitched at the highest level.He said some road users would be inconvenienced on certain occasions and he called on Lusaka residents to exercise patience, respect and courtesy during the summit.
    President Mwanawasa said he was humbled to take over the SADC chairmanship.
    “Zambia assumes the chairmanship of the SADC region against a backdrop of numerous socio-economic challenges being faced by the member states,” he said.

    “On the economic front, member states continue to face the challenge of accelerating real Gross Domestic Product (GDP) growth to a level not less than 7 per cent by 2008, the target set by SADC.”

    He said all member states were required to attain a single digit inflation rate, attain a budget deficit of less than five per cent of GDP, reduce public debt as a percentage of GDP below 60 per cent and attain a current account deficit of less than nine per cent of GDP by 2008.

    President Mwanawasa said to achieve that, SADC was establishing a development fund, developing the protocol on trade in services and developing the protocol on mining aimed at harmonising mining policies within the region.President Mwanawasa said SADC continued to face numerous challenges including in the areas of education, health and the HIV/AIDS pandemic.

    He said the region must continue to develop and implement policy measures and strategies to combat HIV/AIDS, which threatens the very core of existence.President Mwanawasa said he had assumed the SADC chairmanship at a very critical stage in the grouping. SADC was established on April 1, 1980 in Lusaka with nine members, which has now grown to 14 with the attainment of independence among some member states.

    PF’S MUSONDA LOSES ELECTION PETITION

    Lusaka High Court judge Thomas Ndhlovu yesterday dismissed the Lupososhi Constituency election petition saying the allegations of electoral malpractices had not been proved.

    This is in a case where losing Patriotic Front parliamentary (PF) candidate for Lupososhi Emmanuel Musonda had challenged the election of MMD’s Albert Mulonga as member of parliament for the constituency.

    Musonda among others had accused Mulonga of engaging in corrupt practices prior to the election in wilful contravention of the electoral laws in a bid to secure his election.
    He asked the court to nullify the election results for the area saying the election was not held in a free and fair atmosphere.

    But Mulonga denied all the allegations against him in his defence before the court.
    After analysing the evidence, judge Ndhlovu dismissed the petition saying there was no evidence to support the allegations against the respondent.
