Govt says there is no Constitution making process stand-off

Chief Government Spokesperson, Mike Mulongoti, has dismissed First Republican President Kenneth Kaunda’s assertion that there is a stand-off  between government and the civil society over the ongoing Constitution making process.

“Government will take this opportunity to tell the former president that that it is
not true that there is a stand off between government and the civil society over the
process in which the majority wants a National Constitutional Conference to adopt
the new Constitution,” read part of Mr. Mulongoti said.

Mr. Mulongoti has since informed Dr. Kaunda that the process, which saw the
establishment of a National Constitutional Conference, is supported by most civil
society organisations and majority Zambians.

Mr. Mulongoti, who is also information and broadcasting services minister, told
ZANIS in a statement that government is ready to meet Dr. Kaunda with the view of
getting his opinion on the ongoing constitution making process debate and help him
understand the process that led to establishment of the national constitution
conference Bill, which is currently in Parliament.

“Government is ready to meet Dr. Kennth Kaunda, former republican president, to hear
his views on the ongoing debate on the Constitution making process in the country
and help him understand the process that led to the national constitutional
conference Bill now in Parliament,” Mr. Mulongoti said

He, however, explained that the process of establishing national constitutional
conference is a consequency of dialogue involving government and other stakeholders.

He added that the outcome was a compromise between a Constituent Assembly, with
legally binding powers as proposed by  the Constitution Review Commission, CRC, and
the publication of government White paper under the Inquiries Act.

He named the Citizen’s Forum, Foundation for Democratic Process (FODEP), Evangelical
Fellowship of Zambia (EFZ) Council of Churches in Zambia (CCF), Oasis Forum, the Law
Association of Zambia (LAZ), Transparency International Zambia (TIZ) and the Zambia
Episcopal Conference (ZEP) as having made submittions to the Parliamentary Committee
on Lega Affairs over the process.

“It can not be true therefore, that there is a stand-off when many civil societies
have come forward to submit to the parlkiamentary committee on legal affairs. These
include the Citisens Forum, Foundation for Democratic Process, Evangelical
Fellowship of Zambia, Council of Churches in Zambia, Oasis Forum, The Law
Association of Zambia, Transparency International Zambia, Zambia Episcopal
Conference and Saccord,” He said.

He said the Bill can not therefore be withdrawn, to appease a few individuals
opposed to the process.

“Many consultations have been taken place resulting in the ZCID roadmap and the
submissions to the parliamentary committee opn legal affairs. The Bill can not,
therefore, be withdrawn to appease a few people who wish to things to go their way
and so precipitate a stand-off,” Mr. Mulongoti added.

The so called stand-off only exists in the heads of some blind PF cadres cowardly masquerading as members of the so called Oasis Forum a supposedly civil society grouping unskillfully turned into their political front. The so called stand-off is an imaginary one by those alien to democracy but traditionally fantasized to count on battles of imaginations.

    Sincerely dig deeper on the so called Edith Matale the prime beneficiary of the 1992-2001 slash fund and arch protester of the anti-Grafti drive. Look at Mwewa Mwene, a desperate economic traitor with full PF patronage, life time failure and of obscure achievements. Look at Mususu like Matale, another failure barely surviving on charity funds meant for the needy. He has failed to provide leadership in his stagnant Chilenge small church but busy dressing himself with useless tittles from arranged ordinations.

    In short, they are a legion of disillusioned but harmless compromised dreamers of political assignments. In all their self confusion they are hoping to immorally earn some breadcrumbs over the blood of peaceful and democratically independent thinking Zambians. Unwittingly they have been ruining themselves at the behest of their political liners pumping them the fantasy they signed to stomach.

    All he has done for you is empowering you with useless pangas and insults against the unwavering pro-democracy Zambians.

    Could you go to the convention in 2008 to usher in Democracy and bring sober people into the fold of your circus party? Surely 7 years of allergy to elections is diabolically tyrannical? There is nothing peculiar about man but the Greater Grace takes us all in the next day. Political allegiance should not supplant the human soul for the animalism you seem to be accommodating in your behavior.

    For this reason, I feel its time our believing saints were called upon to engage in some intensive Spiritual Warfare Prayers to help you get back to the basics with the lost first love. These prayers must involve mentioning your name to God atleast 3 times in a day. We should pray that you
    find the person god meant you to be and discover your real and practical destiny instead of the thuggerly one you are on!

Lusaka, August 21, ZANIS – Speaker of the National Assembly Amusa Mwanamwambwa today seriously reprimanded Nkana Patriotic Front (PF) Member of Parliament Mwenya Musenge for breaching parliamentary etiquette and privileges through his unparliamentary behavior at the National Assembly Motel in January this year. The Speaker has also severely warned Members of Parliament to desist from using riddles, innuendoes and insinuations during debates in the house as they risk being misunderstood. Mr. Mwenya’s admonishment by the speaker follows a report by the committee on privileges and absences for threatening violence on Namwala Member of Parliament Robby Chizyuka on January 18, this year. Mr. Mwenya allegedly physically assorted Major Chizyuka and poured a glass of alcohol on him at the National Assembly Motel on the material day after accusing him of calling Patriotic Front leader Micheal Sata a ‘Dog and that Mr. Sata was a ‘mad person’.

  28. Equinox contracts Ausenco to manage uranium resources

    EQUINOX Minerals has contracted Ausenco Limited to manage and implement the Uranium Feasibility Study (UFS) on the uranium resources that occur within the Lumwana Copper project in North Western Zambia.

    Initially, Equinox completed a Bankable Feasibility Study (BSF) in 2003 at Lumwana, which included work on the extraction of the Uranium mineralisation to produce uranium oxide (yellowcake).
    Equinox president and chief executive officer Craig Williams yesterday stated that Ausenco Limited has been engaged to carry out a four-phased programme designed for the UFS.

    “Our first objective is to review the 2003 BFS uranium study including resources, metallurgy and process plant design and conduct a further metallurgical test work that will include the designing of a processing plant and infrastructure to produce yellowcake on site,” Williams stated. “And an infill drilling programme would be conducted as part of the UFS to facilitate mine design and develop proven and probable reserves.”

    He stated that the positive long-term outlook for uranium has the potential to enhance the economics of the Lumwana Project if a uranium by-product is economically viable.

    “The Company is evaluating this potential and considering alternatives for realising any uranium development option. This Uranium Feasibility Study will however not impact on Equinox’s current construction schedule for the commissioning of the Lumwana Copper Project in the second quarter of 2008,” stated Williams.

    The Lumwana Uranium Resources lies within the Malundwe and Chimiwungo copper deposits and occurs as discrete uranium-enriched zones that will be separately mined during the copper mining operation.

    Lumwana Uranium Mineral Resources have been estimated to be at 9.5 million tonnes and is consistent with international requirements.
    Currently, Ausenco Limited, in a joint venture with Bateman Engineering, is engaged for the construction contract on the Lumwana copper project.

    And in preparation to execute this new contract, Ausenco has assembled a team with considerable uranium expertise that would work in parallel with their construction team already on-site at Lumwana

    I don’t need to go into the mining business just because there is a boom there. That is impulsiveness that has been failing you at worst. Good businessman ship and ingenuity call for planning.

    My profession is a lucrative industry in the development of countries which Zambia country is already benefiting from. You give me time you will see how many flaws the current AG reporting will be there atleast by the year ending 2009. I don’t need kantemba but expanding my current lines of interests.

    It would be very immoral of me to enter in the tuntemba business line knowing very well that your types earn a living from that. The haves should not enter every small business interest ideal for the under privileged to survive on.

    Just humble yourself and visit me come 2008 I could slaughter you a cow or Goat from my Lusaka West and Chisamba (landless Corner) Farms. Ask Peter Machungwa and Dan Pule who are my immediate Neighbors in Lusaka west or UPND’s Jack Mwimbu in Chisamba. Ask them who owns the biggest farms in their neighborhoods and what machineries, farm products and livestock. Put all your efforts together and see if you will manage to come up with a single pair of either a John Deere or Massey Ferguson farm machine.

    That will educate you a lot that in times of economic crisis as it where in Zambia then or as it is now in Zimbabwe, smart futuristic entrepreneurs start their walk to unparalleled economic freedom that will stun you should you dig deeper. Houses were cheap; farms were being given up cheaply while machines became monuments in farms. Go ask I Sonny Mulenga who bought the many properties he was selling and almost bought him out at his Chinama Hotel. Resource mobilization is a key in challenging times. That is exactly what those foreigners are doing in Zambia. But you with your Katemba think you will be any better than where you are if you pursue that isolationist strategy. Good lucky to you as time teaches in whose hands the economic pendulum will rest.

Some siblings are sent in the Diapora to further up their studies before returning. Do you know that most of KK’s Grand Children are in California and Michigan? Chuchu’s son among cowboys, late Mazoka’s siblings in Atlanta, Former CJ Silungwe in the Gulf Coast states and Pule’s Florida? Those are reach Zambians yet they have sent their families in the Diaspora. Most them when they are done, they return home with opportunities waiting for them. That is the inequality of this world. We have extremely rich and poor people with a few in the middle. Unless we work it out and sacrifice the temporal Diaspora comfort, we risk leaving it all in the hands of the same few returning their siblings from studies overseas.

    PARLEY PASSES NCC BILL
    PARLIAMENT yesterday overwhelmingly passed the National Constitutional Conference (NCC) Bill with support from opposition members except for the Patriotic Front.
    The Bill that goes to committee stage today, was supported by ministers and MMD back-benchers, the United Party for National Development (UPND), United Liberal Party (ULP) and an independent MP.
    But PF members wanted the Bill deferred to allow for more consultations. Supporters of the Bill said adequate consultations had already taken place.
    and that people were in a hurry to see a new constitution enacted.
    Chasefu MP, Chifumu Banda (FDD), said the NCC Bill was progressive and therefore he did not see any reason why it should be delayed especially that Minister of Justice, George Kunda, had made most of the amendments following submissions from stakeholders.
    “The Bill is a step in the right direction because the NCC will debate recommendations contained in the Mung’omba Constitution Review Commission report,” Mr Banda said.
    He advised MPs against engaging in irrelevant debate on matters of constitution making. He urged them to exercise maturity as political leaders who represented people.
    Luena MP, Charles Milupi (independent), said for a long time, Zambians had yearned for a good constitution and because amendments had already been made to the NCC Bill, there should be no need to waste people’s time any further.
    Mr Milupi said what was good about the NNC Bill was that it addressed specific contents of the current constitution and not the process it would take to enact a new one.
    Livingstone MP, Sakwiba Sikota (ULP), said the Bill should not be delayed just because some political parties had solemnly agreed to abide by what certain civil society groupings wanted.
    But Lusaka Central MP, Guy Scott (PF), said the Bill was only going to be legitimate if it had the blessings of majority stakeholders who included those from the civil society.
    Dr Scot suggested that the Bill be deferred so that Mr Kunda could widely consult.
    Kasama MP, Dr Savour Chishimba (PF), said the Bill should be deferred to allow for more consultations.
    Zambezi West MP, Charles Kakoma (UPND), said his party wanted to see a new constitution before the 2011 general elections but that President Mwanawasa should not be given powers to dissolve the NCC at a time of his choice.
    But Mbabala MP, Emmanuel Hachipuka (UPND), said in every game, there should be a captain and Zambians entrusted that in President Mwanawasa as head of state and therefore should retain such powers to avoid loss of funds through allowances due to unnecessary prolonging of the NCC sittings.
    Chienge MP, Katele Kalumba (MMD), said there were no stakeholders who were left out in the consultation process and urged MPs to be therapists by helping people to get out of the frustrations of rage and tension created by politicians over a long period.
    Dr Kalumba said it was impossible for the Bill to contain 100 per cent views from everybody because this was against the principles of politics in a democratic society.
    Minister of Local Government and Housing, Silvia Masebo, said there was no need to defer the Bill because most of the views from civil society like the Oasis Forum and the PF itself had been included in the amendment process.
    And Vice-President, Rupiah Banda, in winding up the debate, assured all MPs and other stakeholders that their views would continue to be looked into even at the national conference stage.
    And Mr Kunda circulated amendments to the NCC Bill, stating that Government had no intention to undermine the will of the people.
    The amendments include the election of the chairperson and deputies by members of the NCC and the removal of any references to recommendations to be made to the Minister of Justice.
    Mr Kunda stated that the composition of the NCC would also be adjusted to take into account some of the recommendations by the committee on legal affairs.
    “As a listening Government, we wish to remedy the growing misconception that if a draft bill is submitted to my office, we will undermine the will of the people and so appropriate amendments will be made to reassure our people of the good will and intentions of the Government,” he said.
    Government was responding to the recommendations of the Constitutional Review Commission (CRC) and submissions of the people that a popular body be established to adopt the constitution.
    “In any case, it is now generally accepted by various stakeholders who submitted to the parliamentary committee on legal affairs that the name National Constitutional Conference could be used for the body that will adopt the constitution.
    All that is required is for the body to be broadly representative,” he said.
    And chairperson of the committee on legal affairs, Jack Mwiimbu, said his committee recommended, among other issues, that the NCC should have authority to add to what was recommended to the CRC.
    He commended the Minister of Justice for adopting some of the recommendations by the committee.
    Mr Mwiimbu implored stakeholders to cherish President Mwanawasa’s calls for dialogue on the constitution-making process.
    “Constitution-making is not a partisan issue. Posterity will judge us if we fail the Zambian people,” he said.
