Court discharges Regina, but…

The State has entered a nolle prosequi in the case in which former President Frederick Chiluba’s wife, Regina, was charged with nine counts of receiving and obtaining stolen State property.

The Ndola Magistrates Court allowed the State’s application and also awarded costs to the accused.
Principal Resident Magistrate, Chilombo Phiri, also ordered the State to hand back all the property used as exhibits in the case.

Mrs Phiri said in her ruling that the court had no right to question the Director of Public Prosecutions (DPP) on the nolle prosequi entered.

“Having seen the nolle entered on all nine counts, I hereby discharge the accused on all the charges, and since the case proceedings have come to an end, all the exhibits must be reinstalled to the owner,” she said.

Senior Anti-Corruption Commission (ACC) prosecutor who is attached to the Task Force on Corruption, Dennis Simwinga, applied that the case be discontinued.
Earlier, Mr Simwinga told the court that the DPP had decided to discontinue the matter.

“My instructions this morning from the DPP are to discontinue the matter by entering a nolle prosequi,” he said.

Later, Mr Simwinga opposed the release of property to Mrs Chiluba.

He said the court should not allow that the State hand back the property because Mrs Chiluba had not been acquitted.

Mr Simwinga said the accused could be re-arrested on fresh evidence.

He said the court should also not award costs because the accused was taken to court through normal procedures.

But defence lawyer, Robert Simeza, opposed the application, stating that it was not competent for the DPP to enter a nolle at this late hour after the case had been closed and the court was about to deliver a ruling.

Mr Simeza said the State should have considered discontinuing the case earlier instead of wasting the court’s time.

He said the application by the State was a clear case of abuse of the court process and malicious prosecution, which should not be allowed.

Mr Simeza later applied that since the State had entered a nolle prosequi, the court should award costs to the accused as well as return her property, which was seized and used in court as exhibits.

The exhibits include four vehicles, three buildings, a Toshiba television set and her frozen bank accounts.

He argued that even if the State decided to resume the case, there should be fresh evidence to be used in the proceedings because the court had discharged the matter.

Before the magistrate walked out of the courtroom, Mrs Chiluba’s sympathisers started singing songs of praise as police officers ushered them out.

When an excited Mrs Chiluba walked out of the courtroom, she was welcomed by Patriotic Front (PF) sympathisers who waved their party symbol in solidarity with her.

Police clad in riot gear dispersed the sympathisers from the court premises, but the happy crowd went onto Independence Avenue and continued with their celebrations.

In the same court, MMD Copperbelt chairman, Terence Findlay, gave a fresh plea to in the possession of obscene materials count.

Earlier, Findlay was charged with rape and occasioning actual bodily harm on dates unknown but between May 1 and June 3, 2007.

Mr Findlay pleaded not guilty to all charges.
Particulars of the offence are that in the first count, Findlay allegedly had carnal knowledge of a girl.

In the second count, the accused is charged with being in possession of obscene materials after he was found with a DVD containing pornographic images.

On the third count, it is alleged that Findlay assaulted a named girl, occasioning actual bodily harm.
Deputy Copperbelt prosecutor, Christopher Kanema, applied to substitute the previous indictment with a fresh one to allow fresh pleas to be taken.

The matter has been adjourned to September 24, 2207, for mention and October 17 and 18, 2007 for commencement of trial.

  1. These lawyers are wasting state our money. Why start work only to enter a nolle prosequi and then tell us that she will be re-arrested. Why didn’t they wait till they had the information in place.

    This is being irresponsible with tax payers money. Why draw the case so long? So as to keep lawyers on the payroll? An now Mr Simeza is even rightly asking the courts to transfer Mrs Chiluba’s costs to the state!. This is being irresponsible with state funds!!! Maybe we just abandon this incometant Task Force nonsense that just fattens the lawyers at the Tax payer’s expense. I wish the could disclose how much they make on thses cases.   2. What next?would it be the same with ftj in the coming days?Therefore after analysing this matter,i hope the govnt would not look foolish over the case also against ftj.
    Please i would edge the task force to pay back tax payers money if case for ftj is also going no where.Because the money in the hands of task force is too much to be wasted just like that.People are still suffering you know.

    Politics is supposed to be a very noble undertaking where only the most honest, the most principled, the most trusted, the most humble and the most competent are allowed to serve.

    Politics is not supposed to be a profession for all sorts of crooks, thieves and jackals. We say this because politics deals with the lives of people, the future and destinies of nations. How can such a very important undertaking be left to the scum, to crooks?

    For all the years he has spent in politics, old Daniel Munkombwe should know better and be the last person to defend those who fall short of such standards to take up public office. But probably it’s understandable that old Munkombwe’s politics have not been very much about principles, about values – they have been much more based on expedience and sometimes outright opportunism. And it’s very difficult to understand why a political party that wants to part company with poor political standards would make old Munkombwe a provincial chairman. What are things coming to? In the same breath, the MMD is fighting corruption while defending the vice! It requires little intelligence – if a little is all one has – to realise that application of such a policy upon someone who is believed to have flouted the required standards of political leadership throws the whole system of values of a political party in confusion.

    Anyway, this is what happens in a nation when values are lost, when ideas are lost.
    As we have stated before, virtue must be nourished but vice springs out spontaneously like weeds and grows by itself. We must bear that in mind. If we do otherwise, while nourishing virtue we are simultaneously paving way for vice. That’s a reality we must not lose sight of. For if good ideas foster other good ideas, bad things, on the other hand, can foster other bad things.

    This country – and even the MMD – is not short of men and women of integrity to take up political leadership positions. Zambia is not short of people of integrity for us to cling to Katele Kalumba and Michael Mabenga. There are a lot of other things these two gentlemen can do. Politics doesn’t need the likes of Katele and Mabenga; it needs men and women of high integrity. And political leadership shouldn’t be seen as just like any other career which one can take up to fulfil a personal ambition or pleasure.

    In politics one should be out to fulfil a duty; it requires a spirit of sacrifice. Politics is about serving our people whole-heartedly and never for a moment divorcing oneself from the masses. It requires one to proceed in all cases from the interests of the people and not from one’s self-interest or from the interests of a small group. In politics, one is always supposed to be a servant of the people and whatever one does should be to serve the people. This being the case, how can we allow people who have shown or demonstrated very high tendencies for selfishness, how can we allow those with sticky fingers to be political leaders and occupy public office? The duty of every politician or indeed anyone holding public office should be to hold himself or herself responsibly to the people. Every word, every act and every policy that they come up with must conform to the people’s interests, and if mistakes occur, they must be corrected – that is what being responsible to the people means.

    It is not right for old Munkombwe to defend and justify corruption in the way he is doing. No strong nation, or indeed even a political party, can be built on the shifting sands of evasions and opportunism.

    We admit that corruption has taken root in our country, it has almost become a way of life and will be very difficult to uproot. But this does not mean we should resign ourselves to it. This would be to renounce all hope for progress in our country and resign ourselves to misery and backwardness. No matter how enormous the difficulties, no matter how complex the task, there can be no room for pessimism. We can change things for the better, we can build a better and more honest, just, fair and humane nation. Moreover, belief in the possibility of change and renewal is perhaps one of the defining characteristics of politics.

    Our country can only progress if there’s discipline, and where there’s no discipline, there can be no real progress. It will be extremely irresponsible of us as a nation to allow people who have abused their offices and public resources to continue to be our political leaders and hold high public offices. There is need for discipline in the nation and in whatever we do. Impunity should not be allowed. Yes, we acknowledge the fact that in a democracy people should feel free to stand for whatever positions they want and the electorate should be the final deciders. This can be said to be so where there’s no corruption because where there’s corruption the electorate is manipulated and does not make free choices. Moreover, democracy is not only about forming political parties and contesting presidential and other elections, but also living in a way that respects and enhances the lives of others.

    Corruption is a plague that must be erased from the face of our country because it stands in the way of progress. The important thing is to give happiness to our people and this cannot be done under corruption or where corruption dominates.
    If we are proud of our country, we will not allow elements like Katele and Mabenga to run for high political office.

    Pride in our country should be a common bond between us all. It should be the essence of our new patriotism, the patriotism of the 21st century. The onus is on us, through hard work, honesty and integrity, to reach for the stars.

    As we have already stated, Zambia is not short of men and women of integrity. There’s nothing special about Katele or Mabenga. In fact, if one had an opportunity to come into close contact with history and analyse these matters, one would realise that humans tend to make fools of themselves if they think too much about themselves and their self-importance. It would be wiser to aspire to a modest, simple, even anonymous place in life, because, if one has a true measure of the power of people as individuals, one will realise that it is so fragile and such a small thing that it really doesn’t make sense to magnify the role of any individual, no matter how intelligent, brilliant or able they may be. There have been many able, intelligent, meritorious figures in the course of history. Therefore, we should be unassuming and limit ourselves to doing our duty to the best of our extremely limited possibilities.

    If you are honest, truly honest, you won’t be corrupted. If you are unassuming and have a clear understanding of the worth of people and of yourself, you won’t be corrupted.

  5. KUKU… You see why i have been calling these prosecutors inept. You cant start the prosecution without proper evidence. Part of the job or a prosecutor is to asses the evidence and determine if they can get a conviction. How many Nulls are we going to go through at the tax payers expense with these incompetent prosecutors? Look at what is going on with Malila. You could say the whole prosecutorial system starting from the DPP all the way to malila are incompetent.

  7. In law school, the first thing we are told is “prosecutions borne out of emotions always have bizarre results”. The woman should have been charged with receiving stolen property!

    FTJ should have been tried in Zambia and then the judgement registered in foreign countries, not the other way around. That’s why Malila was ambushed by Sangwa who made the application to the High court to disallow the registration as being illegal! All Malila can do is continue asking for adjournments!

  17. Mwanawasa has some intelligency, average, but certainly not lawyer wama lawyer. At the University he was an average student, his professional performance not above average either. His presidency nothing to write home about. To some extent he comes out as unsophisticated to deal with the complex problems of the country. Infact, in the lawyer circles, they know how he managed to win some cases he collaborated with the judges. So to some degree it is kind of cynical that he should be blowing a whistle about zero tolerance on corruption, which by the way is necessary. But certainly mwanawasa is ill qualified to champion the fight. He should legitimise it by empowering the relevant arms of government. Not making the Nchito’s rich! Lawyer wama lawyer- my foot!!!

  19. If Nchito’s fees are insane the fees the government paid to the London lawyers are simply crazy, the GRZ paid over $20 million to four lawyers for a civil suit which could have been tried in Zambia by the DPP!

Also, where is the LAZ which regulates and monitors the fees and conduct of lawyers in Zambia?I just have a feeling that if his name was John James there would not be any problem about the money he receives.

    On the protracted trials you can not blame him entirely;
    1) Cases are investigated by the Task Force and charges approved by the DPP, Nchito is then given the evidence and instructions to present in court.
    2) FTJ has constantly avoided the courtroom for over a year.
    3) Charges had to be reframed after two high profile accused fled.
    4) Sakala was found guilty and lost his appeal in the Supreme court too.

    Let’s also look at the big picture.

    While not defending Nchito, there was need to buffer the prosecutor from the kind of dollars the accused have. EG. Kabwe asked judge Smith to avail 8000 pounds a month from his seized accounts as living allowance, Smith asked him to detail his monthly expenditure – he couldn’t. Also note that Nchito bought a substantial part of the Post and owns Zambian Airways well before this Zamtrop trial.

    Thousands of fans have taken to the streets of the Democratic Republic of Congo’s capital to mourn Madilu System, known as “Congo’s King of Rumba”.
    Police controlled the crowds as they accompanied the singer’s coffin from Kinshasa’s main stadium, where it had lain for three days, to the cemetery.

    Madilu played with the famous TP OK Jazz band led by the late Franco Luambo Makiadi in the 1980s.

    Congolese music is world renowned and has an important place in life there.

    Since his death at the age of 57, the country’s radio stations have been playing Madilu’s music for hours on end in tribute to him.

    ‘Congo’s greatest composer’

    The BBC’s Arnaud Zajtman in Kinshasa says many thousands turned out to pay their respects at the stadium in one of the country’s best attended funerals in many years.

    “Since you are gone, we do not live, we do not eat,” sang some leading Congolese musicians as they surrounded Madilu’s coffin.

    He says the old, young, star musicians and minsters all attended.

    “I’ve been attending Madilu’s funeral for two days while the body was exposed. I don’t know when there will be another Madilu,” one woman said as the coffin was moved from the stadium to its last resting place.

    The rich and famous were allowed into the cemetery; the fans were kept at a distance from where they tried to get a glimpse of the ceremony, our correspondent says.

    Madilu, born Jean De Dieu Bilau, died in a Kinshasa hospital on 11 August; he had suffered from diabetes.

    I wish to comment on the statement by President Mwanawasa that it’s wrong for people to bear children they cannot afford to support.

    Although as usual the sentiment came from the wrong person – the father of the nation, it actually makes a lot of sense.

    I say this because of certain beliefs and practices by some sections of society concerning bearing children. I believe the President said this in good faith and was not trying to place the responsibility to bring up children solely on the family. I believe that the President was refering not only to school fees but children’s welfare in general.

    The reality on the ground in Zambia today is that many people plan their families unwisely around their desire for sex.

    Why should a man on the streets without enough money to feed even himself, produce children he is not able to adequately provide for? Although the government has a hand in bringing up the children of the nation, it’s not up to the government to plan families. Parents must work tirelessly to ensure that the welfare of their children is maximised.

    We cannot deny the fact that there is need to plan our families. This is why so much is said about child spacing or family planning. The reason is that we want families to have the number of children they can afford to look after, and this includes sending children to school.

    However, the sentiment would have been better received had it come from a social scientist, say, a demographer or an economist

  35. OPPOSITION LEADERS SHOULD BE ASHAMED -MWANAWASA

    PRESIDENT Mwanawasa yesterday said opposition leaders should be ashamed that their members of parliament supported his government on the Constitution Conference Bill.

    Speaking soon after his arrival at Chipata Airport, ahead of the Kalumba traditional ceremony of the Chewa people of Malawi, Mozambique and Zambia’s Eastern Province, President Mwanawasa said he was certain that he had provided 100 per cent good leadership over the constitution-making process.

    “I am 100 per cent certain that I have provided good leadership over the constitution review process.

    Now my colleagues would like to demonise me even though they destroyed the constitution and made it difficult to amend…even though they are responsible of the problems we are facing to amend the constitution… they are now trying to play as champions of democracy and accusing me of being wrong.

    They are describing me and my ministers as people who should be voted out. Now people of Zambia voted for me twice now. So nilekeni nisebenze nchito, so leave me to work,” President Mwanawasa said.

    “All Honourable members of parliament yesterday passed the initial constitutional Bill. There was a lot of debate. Both members of parliament from the opposition and MMD were speaking in favour of government.

    Their political party presidents must be ashamed of themselves at the fact that their MPs don’t obey their directives.”
    He commended the members of parliament for performing their national duty.

    President Mwanawasa said the country had only time left for development.

    “It is not time for fantasy and it is not for people to display how ignorant they are. It is time for constructive ideas which can make a difference for our country. My government has shown that it is worth it to support the government of the day,” he said.

    President Mwanawasa said his presidency had been flawed with malicious allegations, a lot of lies and name calling.
    He thanked the people of Eastern Province for turning out in large numbers to vote for him and MMD.

    “So I am kept wondering what is it that can I do that I am not doing. So when you people in Eastern turn out in large numbers to vote for Levy Mwanawasa and MMD, it made a difference,” he said.

    He said the people of Eastern Province were better placed to tell the nation what he had done and what they had experienced under his presidency.

    “I regret that most of our compatriots take things for granted. They always think that Levy Mwanawasa will always be there. I would not be there. I only have four years to go.

    I appeal to all the people of Zambia to take advantage of the four years, so that we can work together and deliver,” he said.

    President Mwanawasa disclosed that he would take time, while in Chipata, to inspect the Chipata Muchinji rail project.
    “We want to see the Chipata Muchinji rail project to be completed before the end of the year or mid next year,” he said.

    He said the government was constructing a new campus, Chipata Trades Training Institute along Malawi road and that the contractor was already on site.

    President Mwanawasa said it was important for the country to provide tertiary education for its children after secondary school.

    He disclosed that on Thursday, he met a chairman of a bank who said that his bank was ready to offer K200 billion loan to the Food Reserve Agency for maize purchase.

    Earlier, President Mwanawasa, who was accompanied by foreign affairs minister Kabinga Pande, local government minister Sylvia Masebo and science and technology minister Peter Daka, introduced his newly appointed foreign affairs deputy minister Professor Fashion Phiri.

    Despite an economy in turmoil, four-figure inflation and the exodus of millions to neighbouring countries, Zimbabwe’s president can rely on the support of his African peers. Peter Biles spoke to one of them in a bid to discover Robert Mugabe’s secret.
    The photographers and cameramen had been waiting patiently outside the Mulungushi conference centre in Lusaka.
    Southern African leaders were arriving thick and fast but the man everyone was waiting to see was Mr Mugabe.
    He may be a pariah in the capital cities of the European Union but here in the heart of southern Africa he knows he can count on a fair degree of undying loyalty.
    When the Mugabe motorcade eventually swept in there was a noticeable tightening of security.
    A small pick-up truck bore three heavily armed soldiers in the back, and bodyguards surrounded the black limousine as the 83-year-old president emerged.
    He smiled and stepped forward with his wife, Grace, to meet his Zambian hosts.
    There was certainly no hint that this was a head of state under intense domestic pressure.
    Liberation generation
    Zambia is a place that all the southern African leaders know pretty well.
    On this occasion, they had come for a routine summit but, for some, Lusaka is like a home from home.
    President Thabo Mbeki of South Africa lived here for years when he was an exiled member of the ANC.
    Zambia has always offered a hand of friendship to refugees, especially during the days of the liberation struggle in South Africa and what was Rhodesia, now Zimbabwe.
    Robert Mugabe spent his time in Mozambique during the bush war but a warm welcome is still assured when he meets his fellow leaders.
    He is the longest-serving head of state in the region – bar one – and he clearly relishes his position as one of the elder statesmen.
    You have to appreciate the bonds of loyalty that defined the struggle for independence in post-colonial Africa to understand why it is that Robert Mugabe is still treated with so much respect, even when his country is collapsing around him and he is largely to blame.
    African tradition dictates that he should not be criticised in public whatever private thoughts his peers might harbour.
    Kenneth and Robert
    In Lusaka, I ran across Kenneth Kaunda – independent Zambia’s first president. We first met 20 years ago when he occupied State House. Having been the nation’s founding father, he had led the country since 1964.
    Not unlike Zimbabwe, Zambia’s post-colonial era was characterised by optimism to begin with, but then came economic mismanagement, social unrest, and the emergence of political opposition.
    But Kenneth Kaunda did something unusual. He fought an election in 1991, lost and stepped aside gracefully after 27 years in power.
    That is exactly how long Robert Mugabe has been around.
    Mr Kaunda was never the greatest leader but he was – and still is – a well-meaning man with real charisma.
    As we sat talking the other afternoon, there seemed to be no better person to shed light on Robert Mugabe. Kenneth Kaunda is near enough the same age, just two months younger. They were both born in 1924.
    These days, KK – as he has always been known – enjoys his retirement with dignity and seems to command genuine respect.
    As we chatted a stream of passers-by – most of them young enough to be his grandchildren – lined up to greet him and shake his hand.
    I tried to picture Robert Mugabe in a similar situation but, to my mind, he and Kenneth Kaunda were poles apart – the despot clinging to power and the happily retired politician, once renowned for his national ideology of humanism.
    An improved spirit?
    So I asked Dr Kaunda if he could help explain Robert Mugabe’s popularity in the region.
    It’s no good demonising Robert Mugabe

    “I’m glad you noticed it,” he replied.
    He was referring to the huge round of applause for President Mugabe during the opening session of the leaders’ summit.
    “People see him as a hero,” he said.
    “Not just in Zimbabwe or here in Zambia but across the whole of southern Africa.”
    And Kenneth Kaunda speaks for many in the region in blaming not Mugabe for Zimbabwe’s troubles but successive British governments.
    “It’s no good demonising Robert Mugabe,” he says.
    “We should all put our heads together, talk to him, and work with him on a solution.”
    But that is not to say that even those closest to the Zimbabwean president want him to seek another term in office in his 84th year. Because by all accounts they do not.
    My last glimpse of President Mugabe during his brief visit to Lusaka was on a wind-swept parade ground at the city’s military airport.
    He and the other southern African leaders had come to inaugurate a regional brigade – a key component in a new African standby peacekeeping force.
    As the presidents stood shoulder to shoulder they released a bunch of green, blue, and white balloons.
    It was a symbol of what this region aspires to – an improved spirit of togetherness and closer integration designed to stimulate economic growth and development.
    But because of Zimbabwe, southern Africa is facing its most serious crisis in years. And love him or loath him, it is Robert Mugabe who holds centre stage.

    Politics is supposed to be a very noble undertaking where only the most honest, the most principled, the most trusted, the most humble and the most competent are allowed to serve.

    Politics is not supposed to be a profession for all sorts of crooks, thieves and jackals. We say this because politics deals with the lives of people, the future and destinies of nations. How can such a very important undertaking be left to the scum, to crooks?

    For all the years he has spent in politics, old Daniel Munkombwe should know better and be the last person to defend those who fall short of such standards to take up public office. But probably it’s understandable that old Munkombwe’s politics have not been very much about principles, about values – they have been much more based on expedience and sometimes outright opportunism. And it’s very difficult to understand why a political party that wants to part company with poor political standards would make old Munkombwe a provincial chairman. What are things coming to? In the same breath, the MMD is fighting corruption while defending the vice! It requires little intelligence – if a little is all one has – to realise that application of such a policy upon someone who is believed to have flouted the required standards of political leadership throws the whole system of values of a political party in confusion.

    Anyway, this is what happens in a nation when values are lost, when ideas are lost.
    As we have stated before, virtue must be nourished but vice springs out spontaneously like weeds and grows by itself. We must bear that in mind. If we do otherwise, while nourishing virtue we are simultaneously paving way for vice. That’s a reality we must not lose sight of. For if good ideas foster other good ideas, bad things, on the other hand, can foster other bad things.

    This country – and even the MMD – is not short of men and women of integrity to take up political leadership positions. Zambia is not short of people of integrity for us to cling to Katele Kalumba and Michael Mabenga. There are a lot of other things these two gentlemen can do. Politics doesn’t need the likes of Katele and Mabenga; it needs men and women of high integrity. And political leadership shouldn’t be seen as just like any other career which one can take up to fulfil a personal ambition or pleasure.

    In politics one should be out to fulfil a duty; it requires a spirit of sacrifice. Politics is about serving our people whole-heartedly and never for a moment divorcing oneself from the masses. It requires one to proceed in all cases from the interests of the people and not from one’s self-interest or from the interests of a small group. In politics, one is always supposed to be a servant of the people and whatever one does should be to serve the people. This being the case, how can we allow people who have shown or demonstrated very high tendencies for selfishness, how can we allow those with sticky fingers to be political leaders and occupy public office? The duty of every politician or indeed anyone holding public office should be to hold himself or herself responsibly to the people. Every word, every act and every policy that they come up with must conform to the people’s interests, and if mistakes occur, they must be corrected – that is what being responsible to the people means.

    It is not right for old Munkombwe to defend and justify corruption in the way he is doing. No strong nation, or indeed even a political party, can be built on the shifting sands of evasions and opportunism.

    We admit that corruption has taken root in our country, it has almost become a way of life and will be very difficult to uproot. But this does not mean we should resign ourselves to it. This would be to renounce all hope for progress in our country and resign ourselves to misery and backwardness. No matter how enormous the difficulties, no matter how complex the task, there can be no room for pessimism. We can change things for the better, we can build a better and more honest, just, fair and humane nation. Moreover, belief in the possibility of change and renewal is perhaps one of the defining characteristics of politics.

    Our country can only progress if there’s discipline, and where there’s no discipline, there can be no real progress. It will be extremely irresponsible of us as a nation to allow people who have abused their offices and public resources to continue to be our political leaders and hold high public offices. There is need for discipline in the nation and in whatever we do. Impunity should not be allowed. Yes, we acknowledge the fact that in a democracy people should feel free to stand for whatever positions they want and the electorate should be the final deciders. This can be said to be so where there’s no corruption because where there’s corruption the electorate is manipulated and does not make free choices. Moreover, democracy is not only about forming political parties and contesting presidential and other elections, but also living in a way that respects and enhances the lives of others.

    Corruption is a plague that must be erased from the face of our country because it stands in the way of progress. The important thing is to give happiness to our people and this cannot be done under corruption or where corruption dominates.
    If we are proud of our country, we will not allow elements like Katele and Mabenga to run for high political office.

    Pride in our country should be a common bond between us all. It should be the essence of our new patriotism, the patriotism of the 21st century. The onus is on us, through hard work, honesty and integrity, to reach for the stars.

    As we have already stated, Zambia is not short of men and women of integrity. There’s nothing special about Katele or Mabenga. In fact, if one had an opportunity to come into close contact with history and analyse these matters, one would realise that humans tend to make fools of themselves if they think too much about themselves and their self-importance. It would be wiser to aspire to a modest, simple, even anonymous place in life, because, if one has a true measure of the power of people as individuals, one will realise that it is so fragile and such a small thing that it really doesn’t make sense to magnify the role of any individual, no matter how intelligent, brilliant or able they may be. There have been many able, intelligent, meritorious figures in the course of history. Therefore, we should be unassuming and limit ourselves to doing our duty to the best of our extremely limited possibilities.

    If you are honest, truly honest, you won’t be corrupted. If you are unassuming and have a clear understanding of the worth of people and of yourself, you won’t be corrupted.

    BANK of Zambia senior inspector Maulu Hamunjele yesterday testified that some of the money deposited in the Zamtrop Account was mixed with other money, which came from third party sources.

    And acting deputy registrar of the High Court Jones Chinyama ordered that a cell phone be grabbed from a journalist from Al Jazeera who was using it to film the court proceedings.

    During cross-examination by defence lawyer Robert Simeza in a case where former president Frederick Chiluba, Access Financial Services directors Faustin Kabwe and Aaron Chungu are charged with theft of about US$500,000, Hamunjele explained that there was previously some money in the Zamtrop account from third party sources, which was mixed up with the rest of the money.

    VICE-President Rupiah Banda has said public perception that his wife is of the same age as his granddaughter would not stop him from appreciating her youthfulness and beauty.

    And Lusaka Province Likumbi Lya Mize Committee chairman Marx Mbunji said the people of Zambezi and tourists at this year’s ceremony noted that Vice-President Banda was very proud of his 28-year-old wife, Thandiwe.

    Speaking on arriv al at Zambezi Airstrip where he has gone to officiate at this year’s Likumbi Lya Mize ceremony of the Luv al e people, Vice-President Banda, 70, said he was happy that he married such a beautiful and understanding young lady, who is a teacher by profession.

    “I am happy that at this age I can have such a beautiful wife, wangu, wangu,” he said. “When people see my wife they think it is my granddaughter but I am happy that at this age I can have such a beautiful and young wife.”

    At this point, Vice-President Banda c al led his wife to the podium in order to introduce her to the crowd.

    “Many of you might be wondering who my wife is among these ladies standing behind me. So let me introduce my wife,” Vice-President Banda said, as he gestured his wife to step forward.

    He explained that he decided to go to Zambezi with his wife after she saw how beautiful the other tradition al ceremony, Lunda Lubanza of the Lunda people in Zambezi where he officiated a few weeks ago, was.
    Vice-President Banda is al so expected to tour development al projects in Chavuma and Zambezi before officiating at this year’s Likumbi Lya Mize ceremony today.

    And Mbunji said in an interview from Zambezi that people welcomed Vice-President Banda’s sentiments about his young wife with a thunderous response.

    “The Vice-President has arrived here and we have received him,” Mbunji said. “He has come with his wife and it is clear that he is proud of his young wife and he introduced his wife to the people. The people welcomed that thunderously.”

    Mbunji said this year’s ceremony would surpass last year’s.
    “Preparations have been fantastic and this year’s ceremony will be much better than last year’s,” he said. “Participation has been broad and there is a lot of participation from North-Western Province and other provinces.”

    He said activities prepared for this year’s ceremony were al ready in progress and so far makishi dancers from North-Western Province had kicked-off the entertainment aspect.

    “Security is in place and there is no cause for any al arm,” Mbunji assured. “At this year’s ceremony it is basic al ly the Lundas and Luv al es enjoying themselves. There is no problem.”

    Unfortunately the answer is NO, the constitution provides for a prosecutor to enter a nolle without an explanation just like an accused does not have to take the stand. LAZ is fully aware of this. What I think here is Malila and Max Nkole have noticed the damage done by the predecessors, Kunda and Chona, and are not comfortable with some of the cases.

  103. The point I’m driving home to the open minded is that you are all opinionated bootlickers to your respective political interests. No one here takes a stand to obliterate his own party but the other one. In politics any one with membership in a social grouping who toils the line of his party causes is a bootlicker to that cause. There is none here that is not tied to his social grouping causes. I have not seen a single post detaching itself from a pattern of political bias.
    Therefore zeroing on that one is a lack of strategy and message to drive to the target audience.
    There is no secret that bad seeds of a confusing situation for a timed seasoned have been deliberately sown for the ruling party advantage. MMD is using its zealots to reinforce a self sanitization process while UDA the then only hope has succumbed to the machinations of managed systematic destruction. It is dead and no more a factor on the scene. PF is facing a landmine crisis of worst scenario internal rivalry. No secret a lot seen to have been compromised and by default switched their loyalty from Sata whom they will challenge at the convention itself UDA has crumbled. Saki is fooled by the MMD while Nawakwi and Nervers have too many personal problems at hand. The labor union exists but on paper only. The whole ground situation is confusing especially for voters if time and resources will not be used wisely from now onwards.

  108. ZAMBIAN GOVERNMENT TO REARREST AND RETRY FORMER FIRST LADY
    The Zambian government says it intends to re-arrest and re-try Mrs. Regina Chiluba, wife of former President Frederick Chiluba on charges of receiving and obtaining stolen state property. The decision comes after a judge granted the government’s request to drop its prosecution of Mrs. Chiluba on all charges for the time being because the government could not find witnesses to testify against her.
    Meanwhile, the judge has ordered the government to pay damages to Mrs. Chiluba and return all property seized from her.
    Maxwell Nkole is chairman of Zambia’s Anti-Corruption Task Force responsible for investigating corruption during the 10 years of Chiluba’s presidency. He has said the government intends to re-arrest and retry Mrs. Chiluba because it believes it has a strong case.
    “We have a very strong evidence against Mrs. Chiluba for possession of property suspected stolen or unlawfully obtained for which even during the investigation stage under question she failed she failed to explain how she got it. The statement she gave us was that her husband used to give her money from which she bought the properties in question. So obviously the husband is involved in this corruption trial and the judgment against him in London for money that he used to help himself from the government coffers. And we believe that Mrs. Chiluba’s case is a bi-product of the husband’s misconduct,” he said.
    Nkole said the government would not honor the judge’s ordered to pay damages to Mrs. Chiluba.
    “I don’t see how the government can be ordered to pay damages when in fact we haven’t concluded and prosecuted the case. As I said, these were our fears that the court was not being partial in this matter. When you enter nolle prosequi, it is expected that the case would be or may not be brought up again in court, and in this case the ceased items for Mrs. Chiluba are part and parcel of the exhibit list. And I think that it is premature for a court to rule that the exhibits be returned to her as assets. It shows that there is a prejudicial intent on the part of that decision,” Nkole said.
    He reiterated the government’s intension to re-arrest and re-try Mrs.Chiluba.
    “Yes, we are going to re-arrest her, take her before another court and then go through the whole process of trial,” he said.
    Nkole denied the Zambian government has been engaged in political vendetta against the Chiluba family.
    “No not at all. An independent court in London found her husband liable, and we have overwhelming evidence here at home of her husband’s criminal misconduct as well as misconduct on her part. So we are not prosecuting out of political vendetta. These are cases that have gone ahead with consultation with the director of public prosecutions, and all of us agreeed that there is a prima facie case against her for which she should answer,” Nkole said.
    The government seized from Mrs. Chiluba four vehicles, three buildings, a television set and her bank accounts, which it used as exhibits during the trial.
    But Nkole said the government does not intend to return the items despite the judge’s order they be returned to the former first lady.
    “No we cannot do that. We can only return those things back to Mrs. Chiluba after a full trial. We intend to effect a re-arrest as soon as possible. It could be next week or the week after. I don’t know. It’s up to the handling officer to do so,” Nkole said.

    Cool the old “Dear Mr. President” on Zambia online is indeed back. ZOL should have long abandoned the new Discussion Forum version they switched too. That trial version was too vulnerable and a failure to serve any purpose. Spammers took over the show. Now that the old and secured version has been brought back I’m geared for more smart debates with any MMD diehards online.

    Zambia online carries a national name and is the pioneer of smart online discussions. It has served democracy in Zambia with unbeatable tolerance. I wish LT could one day learn from them and establish rules of the game. ZOL has rules hence membership of intellectuals freely engaging.

  114. Once again, it is not surprising that “Regina is free to go” until she is charged again for other crimes. Levy and State house, please stop wasting government resourses by starting cases that end without any tangible results i.e recovery of property to the state that has been perceived as stolen. The investigators used are very raw,as can be seen by the outcome of most these “corruption cases” driven by Mwanawasa. Corruption is still high in government and at state house as well. Cut on costs of unnecessary convoys escorting Levy to the airport and all over the country. The savings in this are far more than trying to pursue people who have complicated transactions which our freinds at ZP or DEC can not understand.What has happened to the helicopter you bought at a high price. People in Zambia, lets get serious and make these people in government to be accountable. In addtion, Levy flies in a new jet, the list of misuse of public funds is endless? Hospitals lack essential medicines?

    Fellow compatriots,
    Allow me to categorically dispel the lies and unfounded outbursts of Ba Joze in # (89) that I have been chased out of this blog. Let me put records straight by saying “No one has chased me out of the LT blog”. My decision is personal after some deep reflection on the standard of this blog that has sunk so low with insults becoming the standard of Ba Joze’s contribution style.
    I may disagree with some political parties, Levy and his support base but have the conscious and morals not to align with this madness. Fortunately I have had someone who knows everything about LT has confided in me with evidence at hand that Ba Joze is the custodian of this blog. But if the custodian is that insane I don’t think there remains hope for smart and free debates. I do not find his verbatim on leaders and fellow debaters acceptable to swim in or carpet.

    We all know here that this blog has been addressing Levy as Chuchu. Now look at Post # 89 & 92 I cite below. I neither see peace, dignity or constructive end in such debates driven on madness. Levy is a father, President, husband and elderly man very wrong to insult him like that. I do not think Ba Joze would take it kind if his Father and mother instead took those insults from any of the bloggers here.

    Look at two posts in contention and tell if the source is okey in his head:

  117. Lifa, #125,I agree with you. The blog should be used to provide one another with reasonable debates rather than use it as a platform to assult people in a messless fashion. As true Zambians, our parents have always told us to respect others, people should not “grow wings” and utter offending words. Even if people on the debate take negative stand on issues, it would be good to use polite language. This will show how mature all of us looking at issues are rather than display narrow minds. The blog is on the internet and is seen by so many people, hence we need to guard our integrity.
    Am not old on this blog but if I see the same language highlighted by Lifa, I will definately stop my participation.

I’m almost done with mine potentially meeting international discusion forum standards.You cannot run a public debating blog without rules, controls or with oversears that are such opinionated and delogatory against those in opposite side. You should learn from the Smart Chanda Chisala at ZOL who articulates his mind but without insults on those that come out mentally challenging him. Ba Joze is a failure, has communications problems and is too emotion with his insulting tongue.
