The Task Force on Corruption has said it has sufficient information indicating that the travel document which former Intelligence Director General Xavier Chungu used on his return to Zambia on 3rd December, 2008 is false.

In a press release signed by the Task Force on Corruption  Executive Chairman Maxwell Nkole and availed to the media, it has been stated that the investigations carried out so far has prompted the Task Force to prefer charges of forgery and uttering and possession of false documents in accordance with the provisions of the Penal Code.

The statement further says Mr. Chungu was today formerly arrested at Woodlands Police Station in Lusaka on two counts of forgery and uttering false information, contrary to Sections 342 and 352 of the Penal Code Cap 87 of the laws of Zambia and will appear in court soon.

The Press release further states that it likely that the Prosecutors will prefer more charges on the indictment.

He should have been tried while still on the run, and given a life sentence with hard labour. Sometimes you have to look at the demoenor of the suspect and decide.   6. He has been charged and arrested for a crime, what more do you want? The task force is obviously waiting on instructions from the DPP on the Zamtrop/Chiluba charges, but this is a good move on their part; if he were to pay the K500m he won’t be able to flee again. They want to ensure they have custody of him. By the way, Chungu’s refugee status application in Mozambique was denied, instead of staying there illegally and facing deportation, he decided to return and make believe he came on his own accord. He was also ready to come back after LPM’s death, I doubt RB is in any deal with him.

  8. No 14, thats’ the truth, remember what was happening to Chungu, Sakala andMichael Sata. They were being given charges every minute so that they are kept inside. Iam not saying there could be a trick, but that doesnt mean all other charges will be dropped if convicted on this passport issue. The man has just accumulated one more charge and will have to answer to all of them, period.

Is it an illness by fellow Zambians to jump the gun & make all sorts of ridiculous conclusions whenever we have high profile cases like this.You may think the government or rather prosecutors are daft but you’re are mistaken,no charges will be dropped against Chungu infact he will face even more charges as time goes,this time around he will not go anywhere as he knows he can run but cannot hide.Everything changed when Katanga province governor Moise Katumbi owned up,he was probably his sponsor,this is the same reason Chiluba could have become vocal of late,he knows time is up now,just watch as things unfold.

  12. Just jail these thieves and teach them a lesson. They killed a lot of innocent people. Please do all that is humanely possible to ensure Chungu and his thieving boss Chiluba learn to respect Zambians and the laws of Zambia. They abused women and created conditions that killed our children’s hopes of any prosperous life. They must be jailed and if possible castrated so that they cannot multiply and leave behind another generation of thieves.

  14. If you jump bail, there can be no option of a fine but a compulsory custodial sentence. Chungu must be given that mandatory six(6) months in jail and within that six months, all the other cases must be completed and impose the minimum expected life sentences for his other crimes. As for Chiluba, he deserves four or five life sentences to run consecutively and not concurrently. He has been such a drain on our resources that I almost vomit at the sight of his photograph or comment.

  15. Sata used to cut cabbages at rallies desparaging Mwanawasa but what happened? Who was the real cabbage between Sata and Mwanawasa? Empty tins make a lot of noise but they don’t have the capacity to listen to their noise. Sata, Chungu, Chiluba don’t deserve any respect and must be castrated at all costs.

  17. #38, using a forged passport is a corrupt act. How can you ask such a question? If the immigration officers detected it but let him enter the country and reported the matter to ACC then that is the right channel. He will now need to explain how he got the passport and then those issued it will also be taken to book.

The difficulty I seem to have is I really don’t know which of our many law enforcement agencies in Zambia – the ACC, Task Force, the Police, the DEC even – is supposed to be responssible for what and who makes that determination. Right name it appears they each just wake up and decide which ever case seems to be in the news and claim ownership of it. That’s the clarifcation I was seeking; not that thtere was no crime committed. But I thank you just the same.

  19. #39 you are wrong, #38 you are right. The passport issue is beyond the mandate of the Task force. They should have reported him to the immigration department (who of course saw it) or police and ACC.

    For your information, if you steal money today from the government the task force is not authorised to arrest you or try you. The Task force act (approved by Parliament) is specifically for crimes committed during the Chiluba term, not before or after.

To the best of my knowledge, the task force incorporates the police, the ACC, the DEC and some members of the wider zambian society. The Chairman of the tesk force is a mere coordinator of all the activities of these forces. How can the task force arrest and charge someone without the help of the police. God guide us, this level of ignorance worries me. Do you think the task force was setup just for Chiluba and his tandem of thieves. Please learn to explore the rich picture and don’t reason like Sata.

    So #42, the Task force Chair is not like the Joint Chiefs Chairman in the US. He is not the the collaboration of the existing wings but head of an agency tasked to deal with specific crimes commited under Chiluba. Not present day forgery or fraud.

    The word “formerly” in the above statement should be replaced with “formally”.

    Passport forgery is beyond the jurisdiction of the task force, but falls under ACC. The mandate of TF is investigate FTJ’s orchestrated corruption cases between 1991-2001. Any case outside this time limit must be investigated by other relevant bodies

  27. Chungu’s return is very suspicious & if I were Nyama Choma, i’d be very cautious. This chap was allowed to run by LPM but why sneak back all of a sudden? Has his buddy Katebe Katoto lost his patience with taking care of him for free?? If not out of desperation, the only other reason this chap would come back is to plot to destabilise the sitting Govt. Fellow Zambians, we are just embarrassing and making fun of our selves and the special branch. how can we open our intelligence system to ridicule like this. the CIA, KGB or the M15 spend money on security projects and no one questions them. And yet, under the pretext of fighting corruption, we are revealing how our op operates. This is a mistake that Zambia will leave to regret for a long time. Even a person remanded or serving a sentence in prison can be arrested.Simple DEF: Arrest is where a law enforcement officer confines you by touching you on the shoulder and reads the charge for you.Asks you whether you understand the charge, makes you sign for whatever the reply. Later asks you if you accept the charge or not.Thereafter you sign for accepting or denying the charge.

  46. TF do not really know what their mandate is. Defence lawyers are just waiting to see how TF will answer the question of whether they have any mandate and if so what kind of manadate? I believe this is simply beyond their mandate. If they insist, we see a situation where cases of KK reign and LPM reign will be lamped together and it will be an open mandate since the precident will have been set. Going beyond their mandate will be dangerous for LPM group and even for KK and surving group. The truth is some of the things questioned could be similar to decisions made during the KK time and LPM time. E,g not following tender procedures; remember the no tender for maize production under irrigation

  47. # 42 You are very correct, the Task Force on corruption is a composition of law enforcement officers from Zambia Police, DEC,ACC and other law enforcement wings meaning they can arrest following Task Force mandate but they still have powers vested in them by the State to effect arrests in any other crimes that maybe committed within their jurisdiction. The law does not confine the officers to deal with TF cases only. Hope some bloggers will now understand.

  48. #90, you see the Task Force is for cases committed by the Chiluba and others during a specific time frame. You see the Dutch (Nertherlands) pulled out of supporting the Task Force earlier this year because govt refused to extend the “mandate” of this body, in terms of case coverage to include cases committed outside the defined period. Govt only agreed to “extend” this mandate by give more time to the Task force to deal with Chiluba cases only. So including any case not commited during that time is ultravires to the TF mandate. But would give TF legitimacy to dig cases that may have been committed during other regimes as observed by others

    U need to look at the bigger pic dude. The intelligence system of Zambia like any intelligence system is broad and wide. It involves very complex transactions and movements such that if viewed from a layman’s stand point can be seen as fraudulent and criminal.

    Chuungu is an outstanding intelligence officer with atmost interigty and loyalty to his country. He has asked the govt to lift is oath of silence so that he can tell his side of the story. But he knows as well as the govt that his side of the story will compromise the sececurity of this country. Why do you think the most critical person Sata is quiet? Lets not be trivial. We dont know the real story

  51. May I ask if Auditor General’s report includes the resources used by the Task Force. If not who is auditing the Task force over all these years? AG need to be allowed to audit the task force for the sake of transparency. I have heard that she is not empowered to do this since the TF is a special body. This would be a deadly excuse, especially that they have somehow openned up the books of ZSIS, which in my view should be above the task force in terms of state secrecy than themselves. Can someone educate the likes of me.

  59. #103 In all I am not saying that these people should be let free, what I am saying is that let these pipo charged with the responsibility of handling the plunder case be given a time frame and there should be someone to strictly supervise them. In goal setting we always talk about a word “SMART” S-specific, M- measurable, A-archieveable, R- realistic and T- time bound.   62. The real reason you want to see these people in jail and suffering is because deep down you feel, you do not have the caliber nor the charisma to achieve even half what they achieved.

    The sad part is you actually do have all it takes, but you would rather look to the negative side of things rather than choose to grow yourselves.

    These cases have cost far more than %58 million, lets look at the best case scenario: we get back $58 million, where will it go? more cars for ministers or other non-value added activities. even if it is distributed to every Zambian that only gives us all $4.80….
