Silya Tribunal submits its findings and recommendations to RB

The Tribunal constituted to investigate alleged corruption and abuse of office involving Transport and Communication Minister Dora Siliya has concluded its work.

The tribunal has submitted the summarized findings and observations of the report to President Rupiah Banda.

President Banda has paid tribute to the Tribunal for its hard work it has done in investigating the Transport and Communications alleged abuse of office.

Mr Banda said it was gratifying to have a judiciary that is dedicated to work for the people of Zambia for justice unity and peace in the country.

The President was speaking when the Tribunal Chairperson Dennis Chirwa presented the summarized report at State House today.

Mr Banda told the tribunal that he will study the documents and will soon issue the statements to the nation as soon as possible .

And Justice Chirwa says it was a challenge to come up with a comprehensive report because of the many transcripts on the case.

Judge Chirwa said despite the challenges, the tribunal has managed to submit on time the report to the Head of State.

The tribunal was investigating allegations that Ms. Siliya cancelled a tender awarded to Thales Air Services of France to install radar equipment at Livingstone and Lusaka International airports.

Ms. Siliya was also accused of disregarding the legal opinion of the Attorney General prior to signing the MOU between Government and RP capital partners of Cayman Islands.

RP capital partners have signed an MOU with government to evaluate ZAMTEL assets before it is partially privatised.

  4. I have a question for some lawyers out there for my personal clarity on this matter:
    Isn’t the Chief Justice not the one intitled to have receive the tribunal’s report before the President? The way it is In now, what can stop the president from using the report as a compendium to influence the verdict of the jury? How does Seperation of Powers serve it’s purpose then?
    Please answer me before I retire to bed in the next 2 hrs.

  5. Woman or not, Dora’s actions were illegal and she needs to be held accountable. While there may be truth to what you have observed my dear friend from Mikomfwa, there is need for all Zambians to take a stand and hold these public servants accountable…. male or female!

  11. OK Ive just done some references and I have learnt that the tribunal is actually higher in instance than the jury so there’s no interference between the two. In this case the tribunal can submit it’s findings, which is actually is the verdict itself, to the president . I think were already there.

  13. I am not a lawyer , and I seek the guidance of learned brothers/ sisters in law pertaining to the Zambian law . What has been the precedence on such issues ? Where does the report go? well all have been going to the head of state. Perhaps NCC can change this …..blessing in disguise , the scandal ……

  15. #9, I am not a lawyer or anything but I would think the reason the president gets the tribunal report is because ministers are appointed by the president and, therefore, under his authority (executive branch). He is the one who “hires” and “fires” ministers. If I am not mistaken, the tribunal carries the same weight as a criminal “court case” only as far as evidentiary procedures are concerned, and does not go as far as rendering judgment. Tribunals are very unique occurrences in law/constitution and should be treated as such. That is why, constitutionally, only the president (and I think Parliament) can empanel a tribunal. The tribunal only recommends criminal prosecution if the evidence so warrants. And the only thing the president can do is fire his/her erring minister. Am I…

Dora and RB have something to hide and that is why RB never suspended Dora pending investigations. LPM was very honest showed you how leadership is provided and see the results – Nyirongo in jail, Chiluba by now should have been, Katele should have been but with RB, I can only say justice delayed is justice denied.   54. The Judiciary (Tribunal ) were expected to give detailed information of their findings to the people of Zambia and not the President. This also shows that RB will have a final say on the fate of Dora which is not supposed to be the case. The tribunal was expected to advance court proceedings or drop the case in case of insufficient evidence . Conclusion : Zambian Judiciary is for the president and not the people.

    THE judge Dennis Chirwa chaired tribunal has found that communications and transport minister Dora Siliya breached Article 54 sub Article 3 of the Constitution when she selected RP Capital Partners Limited
    to valuate the assets of Zamtel without following legal advice from the Attorney-General.

    And the tribunal stated that “if a sitting President breaches the Constitution he is liable to impeachment under Article 37 of the Constitution. In this case by ignoring the legal advice of the Attorney-General, Hon Dora Siliya breached Article 54 sub Article 3 of the Constitution”.

    The RP Capital allegation was the allegation against Siliya that was heavily defended by President Rupiah Banda and Vice-President George Kunda.

    In defending Siliya, President Banda said she was smart and more intelligent than those criticising her on this matter. President Banda said Siliya was right in this matter and she knew what she was doing and she should be given the opportunity to finish what she was doing.

    THE Tribunal probing Minister of Communications and Transport Dora Siliya’s alleged abuse of office and corruption has cleared her of two of the three allegations.

  96. I am keenly waiting for the final verdict by President RB Banda as well under the help of the Minister of Justice, Vice President, George Kunda. What impresses me is that the Minister of Justice already mentioned that Minister DORA did not do wrong and he will try to stick to his earlier judgement I believe as he will be making recommendations to the President who is also on record saying that Minister Dora is smart than her haters.

    In all, let us wait and see.

Just yesterday, a white lady I am with here was telling me how she feels like nothing is good any more around her including herself just because she broke up with her boyfriend last weekend.     When a minister or someone well known dies, the whole country comes to a standstill, yet there are Zambians dying everyday from lack of medicine.
