Vice President had never seen a woman giving birth

vpA WITNESS yesterday told a Lusaka magistrate’s court how Vice-President, George Kunda got annoyed when he was presented with photographs of a woman giving birth.

Kenneth Ngosa, 40, of plot number 7756 Woodlands extension, senior private secretary of the vice-president, testified that Mr Kunda said he was angry to see such pictures because at his age he had not seen a woman giving birth.

This is in a case in which The Post newspaper news editor, Chansa Kabwela pleaded not guilty to one count of circulating obscene materials contrary to Section 177 1(b) Cap 87 of the Penal Code.

It was alleged that between June 1 and 10 this year, Kabwela circulated two obscene photographs tending to corrupt morals of the public contrary to Section 177 of the Penal Code.

Mr Ngosa said this in examinations in chief led by director of prosecutions, Frank Mumbuna when the matter came up for commencement of trial before chief resident magistrate, Charles Kafunda.

Mr Ngosa said on June 11, 2009 around 11:30 hours he was on duty and received Kabwela’s letter of complaint addressed to Mr Kunda.

He said in the letter, Kabwela wanted Mr Kunda to intervene in the strike by health workers in government hospitals and other health centres.

Mr Ngosa said Kabwela said the Post was in possession of some pictures it had difficulties in publishing and that she was sending them to Mr Kunda so that he and his colleagues in Government could be moved in finding a solution to the strike situation.

He said Kabwela enclosed three pictures in the letter, one showing a naked woman lying down with legs open, and a baby coming out of her birth canal.

Mr Ngosa said the other picture was showing a pregnant woman being helped out of a motor vehicle by some people, while another showed a naked woman delivering a child, but that the picture was not very clear.

“Since the letter was addressed to the Vice President, I was supposed to take it with the pictures to him but I was hesitant due to what the pictures contained. I wanted to take them to him but I was at pains to present them to him,” he said.

He said he was moved by the pictures and decided to not show Mr Kunda and opted to just brief him on the photographs he had received from The Post newspaper.

Mr Ngosa said he told Mr Kunda the photographs were not right for him to see but the vice-president insisted that he be shown the letter and the pictures.

He said after he was shown the pictures, Mr Kunda called him back into the office and told him that he was annoyed to see pictures of that nature.

“After his honour saw the letter and the photographs, he called me back into the office and told me that he was very annoyed to see such kind of a picture,” Mr Ngosa said.

He said on June 12 this year, he received a complaint letter from the Non Governmental Organisation Coordinating Council (NGOCC) addressed to Kabwela and copied to Mr Kunda.

Mr Ngosa also said that on June 16 this year he received an apology letter from The Post newspaper apologising to the NGOCC for circulating the pictures.

In cross-examinations led by Remmy Mainza, Mr Ngosa said there were other ways of solving problems than circulating pictures.

He said he was moved by the sight of the pictures saying that it was his wish that a solution was found to bring to an end the strike in hospitals.

Mr Ngosa said to his knowledge , Mr Kunda had not responded to the letters on the circulation of the alleged obscene pictures.

Another witness Chiwale Solochi of house number B 30 State Lodge police camp, said he did not have the chance to see the contents of the letter because his duty was just to receive and take any mail to the secretary.
The matter continues today.

  1. The pictures did not show the Zambian culture and tradition. however, the world is changing, if leaders do not listen to strike actions, reporters will be forced to such situations. However, reporters should equip themselves with the laws of Zambia.

    Anyway do draw all the nation to all smaller and petty issues like this. in developed countries women give birth on Television.
    So court will make a decision and i cannot judge. Lets wait and see

Just typical of Zambian men.They enjoy making babies but are not there to see the pain involved in the birthing process.They just drop of the wife at the door of maternity ward or rather get some relative to take her, then the poor woman has to agonise for 6-18 hrs with no support from anyone. In these days, if i can see a foetus thrown in the rubble, why should it be an issue to see a picture of a woman giving birth?   7. This case is simple then.The issue is not that the pictures were pornographic but rather uncultural. I don’t think the govt has a case its a sheer waste of time and resources.The woman died due to lack of medical attention.No one is saying anything about that. No one has appologised to her family. Instead all focus is on the beautiful Chansa Kabwela.

I lived for a long time in the UK and I never once saw a picture of a woman giving birth in any of the newspapers including the News of the World ( where 3 journalists have been jailed for tapping phones of prominent individuals). Even in the UK the act of giving birth is not a matter of public exposure. For Zambia there are cultural taboos involved and we Zambians should learn to respect our values and culture. As for Chansa, there is no doubt she committed an offence because even though she did not publish the pictures, she in fact circulated them and that is against the law. The real question is whether the end justifies the means and whether in fact the Post newspaper really wanted the strike to end. Those will be the questions for the judge. Let the Post use political pressure.

    It appears to me that this whole issue is mainly a cultural conflict and therefore, I personally feel it should be resolved outside the courts of law. I understand that elderly Zambian people like Mr. Kunda, who adhere to the African traditional values detest the publication of such pictures on moral grounds but I think using republican laws to fight journalism rights is the wrong way to go.

So why don’t you leaders, instead, act to prevent THIS ACTION TO EVER HAPPEN AGAIN “ON STREETS”, instead of trying to get the jounalist punished for having shown you what’s actually happening on streets, where you will only be driven quickly, and you will never notice what’s going on, or even your “guards” will, in advance, clear such a picture, so that you will only see “PARADISE”, where people are actually seriously anguishing.   18. #13, You must have lived in the UK in the 40’s. Male doctors in the UK today assist in child birth. What happens is that first they will ask the woman’s consent regarding being assisted by a male staff, ok. It’s up to the patient. Regarding culture or taboo etc….Is it Zambian culture for an adult woman to dance and show off her innermost in front of men, like that woman who danced for the president? Can you enlighten me #13.

  19. What lying is this? Whoever passed through secondary school has seen a picture (or at least a drawing) of a woman giving birth in Biology text books (or nowadays on video). If a vice president as a legal man is also a lier, where is Zambia heading to in terms of leadership morals and integrity?
    I think Zambian men must be encouraged to be in a maternity ward to go and nurse their spouses throughout labour period. In this way they will have at least an idea of what a woman goes through during labour. Heading to a beer haal during your spouse’s labour time wouldn’t help much in times when real decision-making concerning issues such as the one in hand will just aggrevate poor decisions from men in Zambia.

  20. #14 Chama ofcourse due to understaffing in govt hospitals, and the fact that a labour ward may have 2 – 4 beds they won’t allow men in but in private institutions men are right there.You even get a sleeper couch in the labour room for the husband to rest on. Just take responsibility and support the wives not only when making the babies but also when bringing them into the world.

If a woman in the UK gave birth in that manner cus health workers were striking,the prime minister’s knee been repaired in france yes that scene would have been published and people would have stepped down. But you tell that to the dinosurs we have in government, a lot of zambians do not understand that the same way a garden boy works for you is how the government works for you and should be answerable to the people that put it in power. Until that basic understanding is met we can all talk until we are blue in the face but things will not change. The majority of zambians live in poverty and the government has no plans for them but come election time…

In your own legal fraternity if one happens to kill another person and tells the court he did it because he was angry, he will most likely be convicted with murder. From this simple example we can deduce that your decision to such an important matter was largely influenced by your rage rather than reasoning. Hence, the very poor decision as a matter of subsequent. If the legal system in our country is worth it’s salt you will be pinned with a case to answer for making a poor decision while you were raging.

  25. I think George Kunda was annoyed upon seeing those pictures bcoz he felt pity for the woman and just realised the anguish women go thru when giving birth. I am sure next itme he will be very careful not to let midwives go on strike so that expectant women are not neglected. He was so touched to see the agony women go thru when giving birth. The best way for him now is to tell his boss (RB) to drop the case against Chansa Kabwela Ngilazi and advise his Govt to care for women by buying ambulances to ferry them to maternity wards in good time before delivery, instead of buying mandamandas (hearses) to take their dead foetus to grave yards.

At first I thought it was a joke, but later it got to me that it was the way things happened. I was present and I have never regreted, but to the contrary I feel more close to my kid and since then my respect for women has changed. Just to see how hard it is I WILL ALWAYS RESPECT WOMEN

  43. There is no such a thing as pornography. It is all in the mind. It depends on the mindful intention of the person who takes the picture and the mindful intention of the one who looks. That is what the court will have to establish here. In Psychology, under the subject of s exual variations, anything can be a s exual object, from shoes to materials, from nude adult pictures to explict acts. It is all in the mind. Women and men expose themselves to medical staff all the time. In Papua New Guinea men wear nothing but a cylindrical contraption to cover the male while women wear skirts but leave mammary structures exposed. Decency or indecency has to be interpreted in the context.

  44. Compensate the women photographed… Their photos are being used to fight for better servives while ignoring privance. Only husband and selected relative can have permission to see the naked body and photos NOT Kunda and others. The women in question can not walk heads up in streets. Just imagine if I photograph u urinating in a street and send the photo to city council to ask them to build more toilets, You will go after me and accuse me of not respecting u.. In reply, I say that I am helping u fight for more toilets in the city so that people can not urinate anyhow.

The people of Zambia should be taking the gvt to task over such wastage of funds. The prez upon receiving them decided to forward the file and e-mail to VJ for consultation via bluetooth and e-mail but by a slight mistake the prez selected the ‘Send to All’ on his custom made limited edition chinese mobilephone. Meanwhile, the Post profited from the pictures by selling to other international media houses. Both are guity of circulating obscene material. Let Kabwela do time together with Fred Mmembe. The issue of watching a woman giving birth is a matter of personal choice and if the government says its illegal then so be it (what kabwela did). When I was young were told babies are bought from ZCBC, that store has long been closed and there are more babies now than ever, That is where the problem starts from why do we hide the begin of life and when someone dies, the body is there for viewing-Why don’t we hide the dying part which is even more disturbing .Maybe its time we started to tell the truth about child birth.If your child asks you where babies come from give a collect answer.Don´’t point to heaven point to your bedroom.

Let me humbly ask if Ms Kabwela would be very kind to show us her birth canal if it is such simple and easy thing to do. And if she fails to show us, why then exposse her fellow woman’s private parts to the public? I believe (there are/ were) still better ways of handling crisis of any kind. Even in homes, crisis may be there but still the couple have moral obligations to keep their private issues secret for the sake of the nation and cultural norms of the society.   61. #22 Ba Peter Mpundu, Yes the woman was giving birth in the open. Many terrible things can happen in the open, it does not mean that it is suitable for publication or circulation. But the point any way is that the incident happened during a strike but I think the Post in its zeal wanted to put the blame on Rupiah Banda. Strkes are not easy to prevent. You may recall Justin Nyirongo (the singer) died because there was a strike at UTH. The nurses strike that has just ended is not the first one and it will not be the last one regardless of who is in power. It is simply a manifestation of the fundamental economic problem of “scarcity”. The error is to say it is because of Rupiah Banda. When Sata was Minister of Health, there was a nurses strike and I don’t remember him doing anything…

And trust me I have seen lots of men, white ,black, indian etc being present at their childrens births , and I have never seen any of them aroused. Zambian men, please stop hiding behind culture just to subdue women.

  63. I have always admired the Post but to be fair I think they have been going over board of late. And people please don’t justify that because in developed countries they show women giving birth on TV so there is nothing wrong with it. Every society has it’s own values and norms which they adhere to. Trying to be pick up western values and norms doesn’t make you more human instead just makes you a lost. Thats more like MJ changing the colour of his skin. I think the Post should also address the issue of paying their workers on time instead of always picking on the govt. First of all, i think it is waste of tax payers money to take this woman to court but should have been given elderly advice and proffessional advice as a journalist that if you are in Rome do what the Romans do and not pretend to be on E. Can Kabwela show that picture to her father, if the answer is no, then it should have been sent to the Veep. If she can then maybe her lawyer should start from there as a defense. And lastly, not sure why people even the lawyer expects obscene material to cause arousal. My question is whether this poor grieving woman (who is grieving baby) was ever consulted before taking the shots, or ever asked for her consent to release these demeaning photos. If in fact he did it, then the all thing can be considered political. One other issue is, why did that woman give birth outside of the hospital when in fact she had arrived at UTH? Who took the photos? Why did they send them to the Post? When Kabwela received them, what did she do? Sent them to the people who could in fact effect change. In Zambia, a taboo is not an offense. Giving Birth is not against the law. Having sex publicly is against the law. Do you have a suggestion on how the people in higher offices would have seen the plight of this woman apart from what Kabwela did? Suppose the pics came from Times of Zambia
