Former Republican president Frederick Chiluba has been acquitted by the Lusaka magistrates’ court over corruption charges he was facing involving the theft of US $500,000.

The judgment delivered by Ndola High Court Registrar Johns Chinyama, sitting as a magistrate that took about six hours to deliver however found his co-accused Access Financial Services Limited former directors Aaron Chungu and Faustin Kabwe guilty.

According to the judgment, the acquittal was based on the fact that the prosecution team failed to prove their case beyond reasonable doubt on all counts against the former president.[quote]

“We are satisfied beyond reasonable doubt that the prosecution failed to prove that the accused stole funds,” judge Jones Chinyama said as he read out the verdict in a six-hour hearing.

“I find that the accused is not guilty on all counts,” Chinyama said.

There was wild jubilation as sympathizers chanted pro-Chiluba songs as he left the court buildings. He immediately announced that he would be holding a press conference at his Kabulonga residence.

  24. This is OK. It is better for Zambia. $500,000 is a small amount of money when you are paying the Nchitos $millions. It was not worth it. Zambia will be more peaceful. Someone should have counted the cost and the benefits of this corruption fight. The Nchitos are the only winners in this case. They have got mega rich!!. FTJ has not won anything, there was nothing to win. The political responsibility on the Govt, President RB, the Judiciary, Parliament and the whole nation was too much for FTJ to end up in jail. The small boys will no doubt be encaerated, but a former head of State, in his own country? Such things rarely happen. We were too naive. Perhaps The Post and the Nchito’s were too naive.   53. I was one of those who did think that Dr Chiluba stole public funds. But after following all the evidence that the prosecution brought against him, I too, came to the conclusion that they did not prove the case beyond reasonable doubt. You see, you can only prove theft if there is evidence that something IS ACTUALLY missing! There is no Auditor General’s report that stated that ZAMTROP state funds had been unaccounted for. I am disappointed that he is free, but in the interest of natural justice, I am satisfied that it is so.Millions of dollars spent and all we have to show for it is zeuch! Similarly Regina is also free because she received goods from a NON-thief! The Ndola magistrate should have reserved her judgment! The problem here is not with judges but poor prosecutors!

    Anyways Rupiah Banda wrote that judgement himself no doubt, how do we expect kafupi to be guilty when his eatting with Rupiah Banda.   78. To my knowledge Mwanawasa never said chiluba was a thief. He sanctioned the lifting of immunity so that chiluba could clear his name in the courts. Mwanawasa said that if chiluba accepted to have stolen anything from the state, he should return a certain percentage so that the case could be closed. Chiluba refused that offer and Mwanawasa did a good thing to let Chiluba tell the court his side of story. I remember Mwanawasa saying that his wish was for Chiluba not to be found guilty. So what other bloggers are saying about mwanawasa calling chiluba a thief is lack of memory, mare hallucination and utter nosense. Late the dead man rest he was genius.

Regina recieved goods from Chiluba she was found guilty, the sender (chiluba) not guilty, Xaviour chungu and Faustin kabwe were using the money chiluba gave them and were withdrawing money for Chiluba to use and chiluba sent them used the very money they are found guilty but Chiluba not guilty. The London court Jugement found Chiluba guilty but the Zambian courts found Chiluba not guilty.Too many contradictions.what is the truth and what is justice?

I make no apologies for its explicit context because it is a manifest of my personal deep thoughts and conviction that emotions and appeasements that evidently took precedence in framing up this case against former President Chiluba cannot preserve the Zambia we deserve.

  180. 136 Turning back to the general sequence of disbursements, Mr Sullivan came to the payment on 24 November 2000 of Dr Chiluba’s daughter’s school fees (see paragraph [74] above). Mr Meer accepted that he knew F Chiluba to be the President of Zambia, and that money from the Harptree account was being used for this purpose, though he understood Harptree to be owned beneficially by ZSIS. He said that he did not consider it to be an improper disbursement of public funds.

  181. 157 Having reviewed the various issues of law, the judge turned to deal with each individual defendant, starting with Mr X F Chungu and Dr Chiluba. It is right to refer to some of his opening remarks in this part of his judgment, at paragraph 423:

The Magistrate has stated clearly that the failure of the prosecution to secure Chungu as their witness was what turned this case against them. Chiluba had lots of money. He claimed that the money was his and was deposited into the ZAMTROP account at the advice of Chungu. The Auditor General confirmed that there was private money in the ZAMTROP account but NEVER EVER reported that State money was missing. There is no court in the civilised and just world that can convict on these facts! To me, it is the PROSECUTION that failed us here and not the court. Why were Chungu and Shansonga ‘allowed’ to flee the country by LPM’s administration????

  282. RIP Dr Mwanawasa!!!! People I had a dream – Zambia was prosperous again, no one was going to bed on an empty stomach, no one was surviving on one meal a day. Families were happy because most people had jobs, good paying jobs. Children were ever happy, they all went to school with lunch boxes full of good food and drinks. Children enjoyed school because teachers enjoyed their work, no teacher went on strike, and they were paid on time and handsomely. There was no Anti Corruption Commission because there was no corruption anyway. There was no task force, leaders and public servants didn’t steal public funds, they were content with what they earned, and they had no selfish interests. The roads everywhere were well done- tarred. People had never seen pot holes. There were no power outages.

The fact that there were no measures that Levy put in place that could signal to independent thinking Zambians that they have a president that is committed to fighting corruption. Levy never fought corruption , he was fighting Chiluba. I challenge any body out there to show me anything that Levy put in place that we can today cite as a concrete measure he put in place towards fighting corruption.This is a process that started in futility and has ended in futility.
