Chipata man gets 20 years for incest

The Chipata High Court has sentenced a 29 year old man of Lundazi to 20 years imprisonment with hard labour after convicting him of incest.

High Court Judge, Phillip Musonda, sentenced James Ngulube, of Kamangamukuta village in chief Mwase’s area after he was found guilty of unlawfully having canal knowledge of his niece.

Facts before the court are that on unknown dates but between June 10 and 30 last year, Ngulube’s wife left their home leaving the niece at home.
Ngulube took advantage of the time when his wife was not home and dragged the named girl into the house and forced himself on her.
It was later discovered that the girl was pregnant and when she was asked who was responsible she named Ngulube.

In mitigation, Ngulube pleaded for lenience saying that he was a first offender who readily pleaded guilty to the charge.

But Judge Musonda however said that he had taken into consideration Ngulube’s mitigation but noted that his hands were tied looking at the offence commited.

“I sympathize with you because you think when you are in a traditional box you can sleep with any woman. The courts are so tough on such offences and I sentence you to 20 years imprisonment,’’ Judge Musonda said.

In the same court, Judge Musonda sentenced a Petauke businessman to 15 years imprisonment with hard labour for indecently assaulting a woman.

Facts before the court are that on April 29 this year, George Phiri, 24, of Kalele village in chief Kalindawalo’s area attempted to have canal knowledge of a woman without her consent.

On the said date, the woman was coming from her field when she saw the convict going in the opposite direction but when they met, he grabbed her and forced her to the ground with intent to rape her.

The woman managed to escape and reported Phiri who was later apprehended by villagers and taken to the police.

JUSTICE PA ZED, Incest is wrong so is raping the resources of the nation, one gets 20years for having sex with a relative, Chiluba, Chungu and others walks to freedom after making themselves rich with our money,can someone tell me why i should be proud of my country or even think of coming back? so so sad

Another fool sure why not put up a strong manifesto that trying to force him self on a woman they havent even agree that will accept his intweno. Learn to control sex feelings.

  4. Thats Zambia for you guys. The courts find it easy to quickly dispose of such cases saying they are becoming too prevalent and corruption in their eyes is not yet prevalent. BA MWANKOLE!!!

  6. our judicial system is a disgrace to the entire world. what a circus 9 months imprisonment plus scort free on corruption cases vs 20 yrs imprisonment incest. I think Its hurts to be a Zambian

  7. Am shocked that you people bring Chiluba’s verdict in this. The prosecuters in Chiluba’s case did not prove beyond reasonable doubt that Chiluba was guilty. On the other hand, you have a man who rape* his neice and pleads guilty himself and you dare cry foul? Give me a break!

  8. The law works very well against the poor. If you have no contacts in government you can get 25 years trespassing on your own property.

  11. The law only applies to the poor. I think 15 years is too harsh for indecent assault compared to lighter sentences for corruption cases

  12. YES THE COURTS ARE VERY SERIOUS ABOUT SUCH OFFENSES BUT NOT EMBEZZLEMENT OF STATE FUNDS. WHEN IS KAPOKO GOING TO BE ACQUITTED MR JUSTICE FIMO FIMO????????

You Zambians should be thankful to god that in Zambia you have a dynamic judiciary that does not spare anyone caught with incest, child abuse or assault but in Nigeria the monster corruption has completely eaten our fibric life so much that none of the three arms of government is spared ie the Executive, Legislature and Judiaciary in Nigeria only the low is expected to abide by the law of the land but the mighty is untouchable in Nigeria the hands of the law reaches only the common man but to the mighty its un-reachable in Nigeria prisons are only built to serve as home for the common man while the mighty is given the prillage of freedom and ensured the security of his and to enjoy the luxery of his home he built and heavily fortified it with tax payers money.
