FTJ writes to the Speaker requesting restoration of his immunity

FORMER Republican president, Frederick Chiluba has written to Speaker of the National Assembly, Amusaa Mwanamwambwa to restore his legal immunity following his acquittal in the case of alleged theft.

Dr Chiluba’s spokesperson, Emmanuel Mwamba said in an interview yesterday that the former president had written to the Speaker through his lawyers requesting Parliament to restore his immunity following his acquittal.

Dr Chiluba argued that the removal of his immunity seven years ago was not infinite and added that the scope was limited to prosecution for offences alleged by his predecessor, Levy Mwanawasa in his address to the National Assembly on July 16, 2002.

Dr Chiluba said now that he had been cleared of criminal allegations brought against him by the courts of law, there was need to restore his immunity.

He has further asked the Speaker of the National Assembly to immediately convene a special session of the National Assembly to table the matter.

The session should consider restoring his legal immunity as the purpose for which it was lifted has been fulfilled by his acquittal.

He requested that should the Speaker find it difficult to call the session at short notice, the matter should be tabled before the standing orders committee.

The committee would in-turn report its decision to the National Assembly for ratification.

Simeza, Sangwa and Associates said in a letter to the Speaker that since Dr Chiluba had been cleared of all allegations following the acquittal, there were no criminal charges pending against their client in any courts of law in Zambia.

“Our reading of the National Assembly resolution together with Article 43 of the Constitution would appear to suggest that the removal of our clients immunity was not infinite,” the letter says.[quote]

Ndola High Court registrar, Jones Chinyama, sitting as magistrate in Lusaka, on Monday cleared Dr Chiluba of all six counts of theft involving about US$500,000.

Parliament in 2002 lifted Dr Chiluba’s immunity for offences alleged to have been committed in his 10-year reign.

Former Mineworkers Union of Zambia (MUZ) general secretary, Ernest Mutale separately described the acquittal of Chiluba as a great relief and urged Zambians to respect the judgment.

Mr Mutale said it was surprising that some people were against the acquittal and wondered why they should be questioning the judiciary.

A local non-governmental organisation, Authentic Advocates for Justice and democracy praised Dr Chiluba’s acquittal and called for expeditious restoration of his immunity.

Mwense Member of Parliament, Brighton Chongo congratulated Dr Chiluba on his acquittal, saying the court’s decision was well deserved.

He said the people of Mwense where the former president hailed were happy that he had been cleared and urged all sectors of society to accept and respect the court’s ruling.

  1. BaChiluba, even if you invoke the name of God and Israel, you know deep down your heart what you did in the 10 years you were in power. You may have your immunity restored, but don’t cheat our poor citizens.

    IF YOU ARE INNOCENT FTJ AS YOU CLAIM, WHY DO YOU NEED IMMUNITY AND FOR WHAT?

    I think the State still have time to appear the judgment and also there is that enforcement of the London Court case in the High Court. What happens if he gets back his immunity? Do all those cases fall away? Lawyers please educate us.

    I also see a pattern here in Dora Siliya’s case. When she was cleared RB rashed to bring her back into govt even when it was clear the case was appealable. Maybe RB pushed in a quick word of advise to MR FTJ on how to beat our useless system. No wonder we swear in Presidents FASTELE, FASTELE before anybody questions things ..this is true MMD…

  3. All this was expected. Money was spent on this well known aquittal. Even the late LPM said that he would be very happy if FTJ was to be aquitted. So LPM knew that money was being spent on no convictions cases. Wait for the Katale Kalumba case, he will be aquitted but the co-accused will definetely get lengthy sentences

  4. Why should he be crying for the restoration of immunity before the London judgment is registered and how is he so sure that the Attorney General will not appeal?
    Mr Speaker, Sir, we are watching what all of you our supposed representatives are doing. We know Bwezani is pulling the stirngs but have all of you parliamentarians lost all sense of shame?
    If FJT Chiluba is an innocent and clean person, then there is no need for immunity unless there are issues he wants to run away from.
    We all have no immunity and go about with out lives as normal so whats the fuss with him.
    Well, LP Mwanawasa went to Parliament to have the immunity removed and now its a matter of time before Bwezani does the reverse even though there is a possobility of an appeal by the Zambian people.

  5. He is in a hurry to block any case that may come up against him. Being acquitted on a technicalic does not mean one did not commit the felony he has been accused of. After all there was a prima face case and FTJ was put on his defence. Talking of smoke without a fire

Among other things we need to know the intention of DPP chambers. will they appeal or not ? its only only question as at now. if yes then Simeza’s application is futile and vice versa.

  10. I wish Chiluba could stop using the name of the Lord in vain. He may have been acquitted in the eyes of the Zambian public, but has he been acquitted by the Almighty God.   11. Here we need serious guidance from our learned lawyers accross the country, but one thing is for sure, Chiluba is already up to his usual master dribbler tricks. It doesn’t require rocket science to figure out that Banda is being out-maneuvered by this trickster and his pack of henchmen, while being showered with cheap flattery for releasing the midget. He will find out rather too late that he was taken for a ride. Jones Chinyama had nothing to do with the verdict, which was obviously engineered from State House.   13. Zambians . Why cry over spilt milk? You Know that this immunity will be given back like it or not. Our courts of law are weak, corrupt, discriminatory and useless. Remember the Dora saga and how it turned out, Mazoka’s 2001 election petition, the kashiwa bulaya nolle and many more. The real scenerio behind this Zambian Democracy is heartaching indeed.
    You people will be made to fight whilst in the background politicians will be smiling and toasting. They will jail some people whilst in actual sense chaps are as free as an eagle. Its a heartaching facade you will learn to live with. It appears to me that RB does not care about what you will say. Chiluba has already gotten his immunity, simple.   14. For many years to come, this will be the status quo. That’s what happens when the people get used to the system that is prone to manipulation. Even if you changed the Govt today with the Satas or HHs of this world, Bwana nothing will change. The systems are so worn out. They are characterized by corrupt dealings. Zambia today is like a bus driven by an unruly conductor whose passengers have no say about their destination. They don’t have a right to ask him to regulate the speed. This conductor could be RB.
    Since Zambian democracy is copyrighted, an effort to make real Zambian has been a real disaster. The Real and flawless Constitution and the willingness to uphold remains paramount. Yes we can, we can come up with a conducive Zambia for all.

  15. Gentlemen. Does anyone know why Chinyama failed to deliver judgement on the 14/08/09 as scheduled and moved it to 17/08/09? When I head this I knew we were in for a rude shock and indeed it fell on us on that day, 19/08/09 when the misjudgement was read. Just monitor Chinyama’s life style from now onwards. You will see signs of him having benefitted from all over his face. This is Zambia gents. I know of one case in which one magistrate was bribed such that even the judgement was written by the lawyer of the defendant. This true and very sad indeed.

  16. I am simple. This man was accused to have stolen millions, but he was only tried for 1/2 a million between 3 people. So what has happened to the millions? Why did the Zambian prosecutors bring a civil case against him in London (Again with several other firms and individuals) but not in Zambia? Was this ‘lawyer wa ma lawyer’s’ advice before he died? Where is Chungu in all this? Where is Shansonga? Chiluba has been acquited on some charges but there should be plenty more to get at him. His immunity should not be restored until there is not the slightest whif of evil in him.

  17. It may sound silly for Chiluba to seek the restoration of his immunity, but he needs it not because he is a thief but it could open a floodgate of lawsuits against him. KK could now sue him for wrongful imprisonement. Chongwe for attempted assassination. Kaundas for Major Wezi’ death etc. These, by reason of the fact that he was the man at the helm. The constitution provides for this immunity so that Presidents are not liable in their personal capacities for the decisions of the executive. But, Mr Chiluba, slow down because we the people of Zambia have not been satisfied that you are clean. ‘We shall be satisfied! Let us be satisfied!’ (Shakespeare, ‘Julius Caesar’)

  20. All of us who are believers in God we believe any thing to happen their is a purpose. As humans we want things to happen as we want but things can happen different and we complain. Its only God knows about Dr. FTJ for us is to accept what has happen 7 years its not a joke and the court have given us their views. For immunity no doubt he should be given it was removed because of this case. I want to see our former heads of states participating on the internation duties like we just seeing other former heads of state like South Africa, Mozabique, Nigeria, Tanzania please lets show the world that our former PRESIDENTs can do it us well not just pushing them every time

    He officially earned about $100,000 while in power from 1991-2001 and yet he paid an exclusive boutique shop in Switzerland $1.2m.

    “This was at a time when the vast majority of Zambians were struggling to live on $1 a day and many could not afford more than one meal a day.

    Two years ago, he was furious when hundreds of his designer suits, shirts and shoes were seized from a warehouse where he had stored them.

  27. It’s a sad day when Foreign courts can finish a case so expeditiously while zambian courts despite a mountain of evidence take years and fail to convict. How does a man like #35 says whose honest income comes to less than $100000 have £23 million in hidden bank accounts. If he is so innocent how come he cannot account for the moneys origin. This sham to acquit a guilty man will have far bearinh consequences because right now Zambia is a laughing stock to the world. A thief asking for his spoils back is unimaginable , but only in zambia.

  29. Chiluba is the greatest manipulator of all time and should never ever have the immunity restored. Despite the ‘acquittal’ engineered by his accomplice Rupiah, there are many questions left unanswered. As many people have observed it raises a lot of suspicion as to why Chiluba seems in a hurry about the restoring of the immunity. Zambians may be trampled upon but they are not fools.

According to me, immunity is nothing and I urge NCC to include a motion in our upcoming Constitution to always remove the immunity of any former Zambian President once his/er term of office(s) come to an end. Such a move will force all Zambian leaders to be careful in their dealing when they are in presidential office so that they wont be humiliated after they leave that office.

  33. B loggers / twitters are so many now and we are really sad abt what is happening in our judicial system. This can be told from the comments. Pipo, remeber what happened when the idea of lifting Chiluba’s imunity was at hand. Pipo put pressure on M.P’s and it was done.
    If we can do the same and put presure of judial systems and powers that be the same way we did for the removal of his immunity, Kafupi teti atambe bwino nafonse abosha na Chi Banda chine.
    Remember how we also were hutting our car horns at 17 hours when kafupi wanted to have 3rd term. he did not succed – pressure yalimwikata.     Yeah you are right. There’s no difference between Sata and MMD. Sata is MMD, he only left the party because FTJ did not anoint him for presidency. There was no ideological difference. If anything he was the darker side of MMD. Remember the 3rd Term saga, the Chawama hatchets etc.

    Anyone hoping to replace MMD with Sata need to think again.

    As for HH, unless the PACT works, he has no political future.

    Zambia needs change, but most likely it will not come from Sata or HH.

  47. Most us on this blog kind of predicted this development!! Chiluba was not going to see the prison walls at all. The problem is our judicial system and going by the ruling, nothing is going to come out that will be worthy. The biggest loser in this saga is us the Zambian people and I doubt if there’s anything significant we can do about it. I personally blame the media for giving him space/time to rub it in our faces. The only thing we can do is simply to bite the bullet and move on. This case proves that some people are really above the law…..!!

  55. What ever the case FTJ needs his immunity the man went thru all sorts bad experience. The court has made its ruling in his favour. What else does the Task Force and others questioning. The only case remaining in the hands of Task Force is that involving Stela Chibanda, Bende Mpande, Dr. Mtonga and Katele Kalumba. Looking at the way things are happening these too will not be found guilty.Its lesson to those who ascende to positions of authority to stop digging each others past regime. Let the Task Force be disbanded and strengethen existing Investing Wings such as ACC and DEC and these should be mde to report to a Parliamentary Select Committee and not the Executive wing of ZRA. We also nid to know how much has bin spend on Task Force operations. They did much taling and ve achieved lito.

  56. One or two bloggers have raised a very very important question and I’m sure it is in the minds of all who have the love of Zambia at heart. The question is, Chiluba’s judgment was set for Friday, 14 August but for unexplained reason Judge Chinyama put it off for the followin Monday, why? Unless this judge explains why, his actions are very suspect and people will be forgiven to conclude that Rupiah was involved. Mr Chinyama we shall not leave you alone until you explain otherwise you are not fit to be a judge.

  57. Foreign Courts have no jurisdiction on Zambia. Judgment in error by an overzealous Colonial Dog called a British Administrator or Judge is a waste of our time and happiness. That Judge should have spent time prosecuting his fellow British for the damage done on Africa and Zambia in particular. How much was taken from our land to UK? In fact that Judge and Mwanawasa must be tried for meddling with our sovereignty. Those who are supporting the findings of that Kangaroo Court are still wallowing in the swallow waters of colonial malaise. When did Zambia try the British leadership for the crimes committed in Britain and on the British? Chiluba never went to England to do those transactions. A British in the name of Shansonga did, why not try Shansonga? Chiluba deserves his immunity. He won.

  58. About why the judge’s deferred dates of passing judgment, I think we all know that judges have the prerogative to do whatever they want. He could have been consulting or reading other case laws concerning the same. I know it created some suspicions in some, but as the judge, he did what he thought was right.   66. # 84, Yes I understand that Zed Presidents have too much power, but it is not up to them to shed off some powers, the people and the constitution must say so. Who doesn’t want to have a lot of power? You give it to them, they take it. Influencing and jurisdiction are two different animals. According to our constitution in Zed, the President has jurisdiction over the courts. If the judges allows themselves to be compromised, we should take it up with judges, not the victims or victors. That is how it should be. If RB had a hand in the Dora issue, it is up the judges to be proven wrong. In fact thats why the American system of the jury is better than the Zambian or the British system. The jury cannot be compromised but a single judge, well it is easy. We are reaping fruits of our mistakes.

    Mr Chiluba FTJ has been acquitted and the law will take its course on the remaining things over him and so there is no need for you to start insulting others over something that is straight forward to understand. Mr Chiluba FTJ does not need to panic about immunity but actually must challenge the task force to bring more charges on him so that he can be cleared beyond any reasonable doubt.
