
President Rupiah Banda says he has not yet considered restoring the immunity of second republican president Dr. Frederick Chiluba.
Mr Banda was speaking to Journalists in Lusaka today shortly before departure for Kasama in Northern Province for a two-day working visit.
He said Dr. Chiluba is free to seek legal redress just like any other person.
The President said he respects the judiciary, parliament and the executive because the separation of powers makes government and Zambia, a peaceful nation.
“I very much respect the judiciary, parliament and the executive because the separation of powers makes government and Zambia a peaceful nation,” President Banda said.
Ndola High Court Registrar Jones Chinyama acquitted Dr. Chiluba on August 17, 2009 on all counts of embezzling public funds amounting to US$500,000.
And, Vice President, George Kunda said the Director of Public Prosecutions (DPP) will make a decision on whether or not to appeal against Dr. Chiluba’s immunity request.[quote]
Meanwhile President Banda has said he has no intentions of relieving Local Government and Housing Minister Benny Tetamashimba of his duties.
Mr Banda said he is receiving reports that Mr Tetamashimba, who is also MMD Spokesperson, should be maintained because the people of Zambia still need his services.
He urged Zambians to continue praying for the Minister’s quick recovery.
The President was seen off at the Airport by Vice President George Kunda, Cabinet Ministers, Permanent Secretaries, Defense Chiefs, senior MMD party officials and patriotic Zambians.
The President is expected to return to Lusaka soon after completing his official programme in that province.

If Mwanawasa is the one who moved the motion or asked parliament to lift the immunity, may be it goes without saying that the president can have a role. Otherwise why did FTJ copy RB the letter they have sent to the Speaker.
All in all, the right jurisdiction should be Parliament. If we want effective separation of power, then the Executive shouldn’t be involved in this.
But going by the beginnings, the Executive via LPM asked Parliament to lift the immunity, which they did. Then Parliament freed the Judiciary to try FTJ, which they have done.
V Mwanga says there’s currently no process in the constitution for restoring immunity.
Watch out for the grey areas. Dont be surprised if FTJ gets away with his immunity on grounds of legal technicalities. The Dribbler always wins.
The immunity was removed by Parliament and not a President. So how do you restore what you have no power to? It can only be restored by Parliament.

There is no doubt FTJ will get back his immunity will be restored. What the pipo are doing is fly a kite up there and assess our reaction. RB is very diplomatic, its not him to restore the immunity but parliament. He has talked of separation of power, Exective, Parliament and Judicial,read between the lines. In case the situation regarding removal of FTJ’s immunity was susupect. the man was never given any chance to tell part of his story in parliament. The whole issue then was full of emotions. The only sensible voice came from George Kunda and a few other who said let us give this man a chance. So the courts decision to aquit FTJ was based on submission from defence & prosecution teams. The judge makes his own independent decision on arriving at the verdict. Its all politiking.

The political system in Zambia is corrupt and damaged. The President should not be allowed to win in 2011. The electoral commission needs reform, and so does the judiciary. The Chiluba case and Ministry of Health scandal are classic examples of what the current government is all about, and ultimately why Zambia is still in poverty.

The removal of FTJ’z immunity in the first place waz hushed and made the country a laughing stock. Now it’s even more wiered that we may have to go back to restoring the immunity. Like a fantasy movie…
#33 I totaly agree with you coz this country is full jokers. We never get serious no matter how simple things look like. What is the next step. FTJ gave houses in the name on empowering the citizens for mahala. But how many pipo benefited? Those houses should have bin included in the court indicament/court case and asked all those who received them return them to GRZ and local authorities. As usaual all were quiet. I dont think FTJ benefited alone Churchses, NGOs, MPs cadres mention them the list is endless.We never learn we never get proactive when dealing with public affairs. The brothers needs to participate in the 2011 elections so that he can understand how the voting dynamics will be then. I hope the PACT will win the 2011 elections with someone other than Mr MC Sata (Grade 2/6, unknown) as the PACT’s presidential candidate.
As for the request to pray for honourable Mr Tetamashimba, what is he suffering from so I can know exactly how to make a petition to God properly for desired healing.

Let Chiluba get back his immunity. After all, I can assure you all those cases Max is ranting about won’t amount to anything. Its over. Let Chiluba get on with his life. The Task Force was just a Levy strategy to persecute Chiluba. Otherwise why did he fail in all those years to prosecute Chiluba. The man (levy) was so full hate and vengency it contributed to his BP and death. It was not a serious fight against corruption and theft of public funds. Good example was the MOH theft where when the Auditor General tried to probe some PS, he would interven protecting them. What a joke of the fight against corruption. Shame!
Why wait for until Mundia Sikatana goes to the Bahamas to retrieve the $2 billion he said would in 2002? Why wait another 8 years so that Nkole and his handlers can have a another 8 years to pay themselves huge amounts of money? Bringing Chiluba to courts over the US$20 million deal is stupid especially that Nkole and his handlers had 8 years to do that? Should we wait another 8 years for the carrington case to come up for mention? who are the witnesses? Nkole and the his handlers come on don’t insult us, we are not stupid. The task force has misused more money than Kapoko. Wake up and smell the coffee.
If I may ask a simple question, why has the Task force on corrution never been audited? Nkole and his handlers can not create rules and be referees at the same time. Rupiah must not forget the prophetic meaning of his middle name:Bwezani – to restore. This man has come to restore true government(BOMA). Rupiah must regulate NGOs, and newspapers. NGOs as a whole are receiving more money than central government, and this is why they fear regulation. Show me one NGO leader who is thin, they are all fat , come on show us the trick.
