A Solwezi high court has sentenced a 38 year old man to 20 years imprisonment with hard labour for defiling his step daughter aged less than 16 years,contrary to section 138 (1) Cap. 87 of the Laws of Zambia.
Before Kitwe based Judge in-charge Mrs. Justice Royda Kaoma was Paul Samangolwa of Sikambotwe village in Mufumbwe district in North-western Province who was committed to the high court by Mufumbwe subordinate court.
Particulars of the offence are that Simangolwa on 25th February 2009 had carnal knowledge of his step daughter under the age of 16 years.
Simangolwa lured the minor to his bedroom where he defiled her when his wife was away in the hospital.
In passing judgment, Justice Kaoma said defilement case carries a statutory sentence of minimum 15 years imprisonment.
She said the accused was the child’s guardian and took advantage of the child when his wife was in the hospital.
Mrs. Justice Kaoma stated that defilement warrants the court to pass a sentence more than the minimum sentence of 15 years as to deter would be offenders.
She said the court would not deal leniently with offenders even if they are first offenders hence his 20 years imprisonment with hard labour.
In mitigation, Samangolwa who was represented by a defense counsel from the legal aid Board said he was a first offender and that he was a married man with a wife.

In passing judgment the judge observed that the layers prosecuting him could not prove their case against him and noted that it will set bad precedent to jail him. I thought this sort of behaviour is confined to Southern Province. This Chokwe man should have bin sentenced to 60yrs to serve as a warning to other would be offenders. What type of lust is that. Justice Kaoma should have slapped a more longer custodial sentence. In any case justice has bin done. The courts should subject that chief from Mazabuka who wants to marry off his daughter to a teacher yet she is still a school attending pupil. WFC and other NGo’s wheere are you. this is common in rural area .the problem is that these cases are not reported .this is the civic education the N.G.O s must circulate in mufumbwe ,the problems is they are all in lusaka seeking the attention of R.B. Well done that women of mufumbwe.small girls in rural area have the evidence of statutory rape -the small babies on their back -and all you hear in the campaigns like the chitambo one is that the govt will supply cellphones.the govt will win the women vote if they sincerely strengthened the law enforcement on rape.
