DPP directs Task Force not to proceed with the appeal against FTJ

New State Counsel and Director of Public Prosecutions (DPP) Chalwe Mchenga has advised the Task Force on Corruption not to proceed with the appeal against Dr. Frederick Chiluba’s acquittal until the ruling is scrutinised by his office.

Mr. Mchenga says he will be in a position to indicate whether an appeal should be lodged or not after reading the judgment.

He has advised the Task Force to submit a copy of the ruling to his office for scrutiny.

This is contained in a letter to Task Force executive chairman, Max Nkole, obtained by ZNBC in Lusaka on Monday.

Mr. Mchenga was responding to a letter by Mr. Nkole instructing MNB legal practitioners to prepare and file grounds of appeal against the the acquittal of Dr. Chiluba.

In his letter dated August 21, Mr Nkole admits that he has not yet obtained a copy of the judgement to study the reasons given for the acquittal.

He however says he wanted an appeal because of concerns raised from various sectors of society.

According to the republican constitution the DPP has power to take over and continue any criminal proceedings instituted or undertaken by any other person or authority.[quote]

He is also empowered by law to discontinue at any stage any criminal proceedings instituted or undertaken by himself, any other person or authority.

And MMD National Chairman, Michael Mabenga, has called on Zambians to desist from politicising the acquittal of second republican President, Frederick Chiluba.

Mr. Mabenga said the judiciary must be left to freely dispence justice.

He told ZNBC news that Speaker Amusaa Mwanamwambwa should also be allowed to freely determine whether or not Parliament would consider restoring Dr. Chiluba’s legal immunity.

I strongly feel its not inorder for the DPP .At the sametime i feel him as a professional and an expart it shouldn’t have taking so long to do the study.Please Nkole is very right to appeal within time and let him go ahead with his team.Having listend to him on Muvi T.V yesterday .The man has my personal support to continue with the appeal.May the almight bless him and give him the strength and guidance to continue the legacy from LPM.Amen

  3. Well well well! Especially that Chiluba is now claiming he wants his so called money back and immunity reinstated, its about time the government lodged its appeal against this *****. Chinyama’s ruling is sickening, its high time we presented these facts to a sane judge to adjudicate fairly.

Muntembo Nchito has proved a useless and immature junior lawyer with too much accountability to Mmembe than the DPP office.Even before the DPP studies the matter at hand and sanctions him in delegation of duty to file such an appeal, the chap is already reporting to Mmembe who runs a page that he has filed the appeal. Nchito is a subordinate to DPP and his orders come from the DPP chamber.Here they are embarrassing and exposing themselves that the Chamber has divisions which Nchito acting on external orders against existing DPP office SOP. Its time him and Nkole were replaced and that illegal Task Force absorbed by existing professional statutory entities.

I salute this brave gallant son of the soil and for the record, he shames all tribal bigots out there who sometimes crawl on this site claiming all Bembas are thieves when its not the case. Look at Mabenga, muloshi, his statements seem to be in support of Chiluba and looking at the two’s record, Mabenga is more of a brother to Chiluba than Nkole even if Nkole hails from the same part of Zambia like chi Chiluba. I hope this puts to rest the notion that certain tribes are thieves because it’s not. Though Tongas I think are wedded to that disease curable by Runyoka!

    Max Nkole ha read the judgement, why hasn’t Chalwe Mchanga done the same? Anyway that’s what happens when you become state counsel and DPP at the same time, you cease control of your faculties, it is only the president who matters, not the people. This issue of the independence of the DPP’s office is bu****sh***t, it does not work. DPP is not an angel of God! Lawyers are just people and in Zambia have become very useless…………………..

Get it absorbed now with all mandate its shifted to ACC and DEC.Its a public resource shredding duplicated entity we can progress without.Besides that, its illegal, with very narrow mandate and without time frame yet officials pocketing in excess of US $ 22K monthly in allowances and salary each.What they have brought in is less than 2% of what has been spent on them.It must go.GRZ must instead form a smart rapid response unity within ACC with investigative and prosecuting mandate within shortest possible time.

How can they lie to the nation that Task Force had made the appeal when it is clear that Task Force can’t do it without DPP. Yesterday Mr Chifire of CC clearly stated that it was illegal for Task Force to do so and the POST made us believe Task Force had broken the law and yet they didn’t. Mr Chifire is a man who understands our constitution. Call him all the names you want, and it is clear he was right and today your gutter journalist at the POST have egg on their face. Lets not be emotional here, but follow what the constitutional says. Study a judgement is not like reading your long e-mail from your angry wife. These are serious issues and need closer scrutiny. This hurriedness that has cost billions..

Nkole should do a GAP or benefit/ cost analysis report and debate Zambians publicly why he should be retained after 8 years only recovering 2% of total spent.He should explicate why tax payers’ money should continue being shredded on the Task Force and not DEC or ACC? He should report how much in billions has been wasted on a none economic entity but self exploiting.Task Force must go.

The judgment is a 445 page document which the learned Judge Chinyama must have probably prepared over some weeks.Nkole has not even read the judgment but spewing his masters orders.He worked as prosecutor in Rwanda after he was fired from the police service for misconduct.He should tell us how long it took him to prepare the Rwanda Genocide verdicts he presided on.How long it was taking to reach judgment?

  17. This is a small matter in West Africa. There is enough ground to delay 2011 elections upto 2030 on the pretext of fulfilling the National Development Plan and stumping out corruption. The culprits will pay back on voluntary basis or simply take cover where the money is. The close in the constitution is not static. It can be changed to suite the current environment for every Zambian and not necessarily the rich.

King Cobra and Zukas have also commented on the same appeal and the editorial title is “The Appeal”. If various sectors of society smell something fishy in FTJ’s ruling, this DPP can act in their interests. Please don’t give law abiding citizens false hope.   42. Chiluba will be given his immunity back this is an all planned thing by RB to put Mchenga as DPP and as SC. The whole aim was to make sure chiluba goes free. What is likely to happen is after Chiluba’s immunity is given back to him then the London court would possibly be registered so he cant be touched. Or altenatively they will never even register the London judgement. This is just waste of resources after all the resources came from the West.They fill they have nothing to loose. And other moneis come from taxes so they are just enjoying.

The law stipulates: “In the exercise of the powers conferred on him(DPP) by this Article( Article 56), the Director of Public Prosecutions shall not be subject to the direction or control of any other person or authority: Provided that where the exercises of any such power in any case may, in the judgement of the Director, involves general considerations of public policy, the Director shall bring the case to the notice of the Attorney-General ad shall in the exercise of his powers in relation to that case, act in accordance with any directions of the Attorney-General.” According to this article of the laws of Zambia, it appears this whole case will now rest in the hands of the DPP and the Attorney-General. The Task-Force will have very little power over this case when the DPP…

As for the civil case in the London court, it is not a criminal case per se.

  111. The post has something to lose in all this case. Remember that Meembe and the Nchitos are beneficiaries of the Taskforce through Zambians Airways. The Post will deceive Zambians into thinking that Chiluba has a case to answer in oder to avoid being sued by Chiluba for defamation of character for repeatedly calling him a thief while the the Ncitos would love to continue being on government pay. In addition, Meembe and the Ncitos want to use this as an opportunity to attack the courts over their Zambian Airways saga should they be found with the case to answer. Nkole should pack his bags and let Zambians live their lives. What is surprising is that we seem to believe that justice is only justice when Chiluba is sentenced to jail. What then is the role of the Court?

Nkole erred when he said he had not read the judgement, and he erred when he bypassed the DPP. However, this is not the reason he was fired. We all know that. It appears the DPP have inherited the words from RB so called “STUDYING THE REPORT” RB was also studying DORA Tribunal Report we all know the outcome of his studies which never came to conclusion. In this particular matter Chalwe Nchenga will be studying as if he is preparing for exams until the 14days limit comes to pass from within which they need to appeal. Zambia the Real Animal Farm. Its painfull and disgusting what the government is taking us for fools.

  124. A decision to appeal should be made on its own merits. But if you have someone issuing instructions to appeal before reading the judgement, then it does not matter where you stand on this, it is absolute insanity. You have got to remember, other than the fact that Nchito wants to see Chiluba jailed, he also has an incentive to see that this case continue. Don’t tell me Nchito who makes a minimum of $20K a month would want this case over. Unless I am from a different planet, If I were him, I would want to prolong this case

And so if the person who wants to appeal has an incentive to do so, where is the controls to ensure that this is not abused, the loony Nkole, was one of the control, but hey he does not read the judgement, but he still considers it within his right to prosecute someone. If that is not hate, I don’t know what it is. That is why the constitution requires the DPP to assent to each appeal. To address this potential conflict. The problem now is, if the DPP decides not to go ahead, he will be accused of supporting Chiluba, on account of the unprofessional conduct of one, Nkole.
