Mr. Kafunda issued the warrant of arrest on Wednesday after Mr. Mmembe failed to appear in court to answer charges of contempt.
Mr. Mmembe and the entire editorial staff of the Post newspaper were summoned on Monday over an article published by the newspaper recently headlined “the Chansa Kabwela case, comedy of errors”.
Post newspaper Editor, Chansa Kabwela, is in court for allegedly circulating a picture of a woman giving birth.
She has been charged with one count of circulating obscene material.
Some Post newspaper editorial staff turned up in court on Wednesday but Mr. Mmembe was missing.
This prompted Magistrate Kafunda to order his arrest.
Mr. Kafunda said although the defence has argued that the summons was not served on Mr. Mmembe, the Post newspaper Editor in Chief was fully aware of the call out.
He said Mr Mmembe’s failure to appear before the court is an attempt to distance himself from an article published in the newspaper last Thursday.

When that Kafunda sent a court clerk to establish if Mmembe was in court even before he came out of the chambers makes everything look suspicious. When he formally sat, he asked if Mmembe was in court and when it was proved that he was absent, he went back into the chambers for 15 minutes. The so called ‘contempt of court’ has been overrated and in some cases abused in this country, particularly when it comes to opinions expressed by individuals in newspapers publication.
I’m no lawyer but I believe that this law bears little effect in the Zambian justice system that does not use a jury system. How can opinions of individuals unfairly influence the outcome of a court case where there are no juries? Are we saying a sitting magistrate or judge is capable to be swayed by opinions expressed by individuals outside the court? I thought these guys were supposed to be above board and be able to pass a judgement based on the evidence being presented in court.
The contempt of court law as applied in the context of public opinions was supposed to preserve and safeguard the independence of the juries because they can easily form opinions – because they are not trained in law, they form perceptions and can easily be influenced by opinions. But even in such cases, this law wasn’t meant to stifle the rights of people and their freedom of speech. People should be allowed to comment free and express their opinions in whatever media, including newspapers. After all people still discuss these issues in private and so banning them from expressing their opinions in newspaper publication is not a solution at all. I think it is about time this contempt of court nonsense is reviewed and probably repealed.
I understand that there are cases where contempt of court is applicable and needed, for example, where an individual excessively disrupts the normal process of a court hearing through poor behavior, showing disrespect for the judge, neglects to obey a subpoena, etc. But I don’t see any real risk that the course of justice in proceedings may be seriously impaired where a newspaper publishes an individual citizen’s opinion; someone who is not related to the case, especially in our system that has no jury to pass a verdict. Unless there’s a court order or notice strictly informing the newspaper with reasons that they should not publish any opinions about the case from any individual – which will be a archaic and a gross violation of people’s rights – but we don’t have a jury…
Fred must begin to account for his selective and biased coverage of issues. The paper is his mouth piece. He amplifies the voices of those who speak his position. The entire news paper is a Fred opinion. This definitely is not the post that was birthed in 1991. There was a time when I looked forward to reading the post, alas not any more. To spice up a nation, we need people like Mmembe, actually it has taken much time to have more media’s in Zambia like the post. People studying Journalism or those in interest of media, please think of media business so as to improve our nation. It takes courage to review the happenings in a country and corrupt minds lessens for fear of being reviewed or be expossed. Let us be transparent and support Mmembe. I feel sorry for Mmembe. If he goes to prison, he should remember that only 2 people, who entered on politically insinuated charges: KK and Sata (ok and half, Nakatindi Wina) have come out of prison healthy. They either die in there or they get out sick. He may think that this is a game but all his friends will abandon him when he is discharged to fade away after a stint in prison. Zambian prisons are a health hazard. here is a list: Shamwana, Mungomba, Solo’s coup mates, Chungu, Kapwepwe, Musakanya, Banda etc. He should run to the magistrate and apologise profusely.
