RB did not authorise compensation to Dr Chongwe

rb-press-conf21State House has dismissed allegations by some sections of the media that President Rupiah Banda has instructed the Ministry of Finance and National Planning to pay US$5.9million as compensation to Dr. Rodger Chongwe for the 1997 shooting incident in Kabwe.

Special Assistant to the President for Press and Public Relations Dickson Jere said in a statement made available to ZANIS in Lusaka yesterday that President Banda did meet Dr. Chongwe in the company of Solicitor General where Dr. Chongwe informed the President of the pending compensation following his successful complaint before the United Human Rights Committee (UNHRC).

Mr. Jere however maintained that President Banda instructed the Minister of Justice and the Attorney General to meet with Dr. Chongwe and agree on a reasonable compensation.

He stressed that at no time did President Banda instruct the Ministry of Finance and National Planning or the Attorney General’s office to pay Dr. Chongwe the reported sum of US$5.9million as claimed by the media.

Meanwhile, President Banda has reiterated his stance not to answer to the constant malicious and unfounded attacks by the media and his political enemies at the expense of providing leadership to the nation.

    First it was he never did; blah, blah, blah! Now, he only had a discussion with the Plaintiff & the Attorney General. I am sure the truth lies somewhere in the middle. If the media didn’t blow the cover on this one, $5.9 million of public funds would have changed hands. They are backing off now because they have been caught with their fingers in the deep in the “cookie jar.”

    If RB & company think they are LAW to themselves, they certainly should expect some rough media coverage to follow; that is just how it works!!

    There it is! They have accepted to pay him but haven’t decided how much. And how are they going to determine what’s reasonable?
    And with all the goings on, they haven’t even dealt with the issue of registration of that Australian judgement in the High Court in Zambia. Surely a precedent has been set – we are still waiting for Chiluba’s case to be registered. Aint no way Chongwe’s case can be resolved before Chiluba’s.

The initial amount agreed upon by the commision was $2.5M, now that RB agreed that he was entitled to the money with interest,its only common sense that the payout amount would be more than $5M depending on the interest rate they are using, apparently nobody knows what sort of rate they used to come up with $5.9M, who is lying POST,RB or JERE,,,ofcourse not Chongwe,but again if the post are lying,why cant the state take them to court,i think they have gone too far,they have told humongous lies about the President who deserves all all the respect

Rodger Chongwe has his own interpration of events and in his letter does not actually refer to the figure and what the statement from state house says is actually very much in line with what Chongwe said. But now State House is telling us that he instructed Malila to stop the payment. This doesn’t make sense how can Rupiah seek guidance from the same person he is instructing to halt the payment? No Mwiinga forgive my poor analytical skills but the presidents said he sought advice, that is legal advise, but he remains the head with Executive power so he can direct after he has sought an opinion. It says that he halted the payment when he saw the amount. And note that the original compensation ordered is US$2.5 but the final setllement was US6.7 so this difference could have caused intervention. Read through all the statements carefully without a pre- determined belief and you might see that there is no real scandal here

They don’t know how to use the media which is at their disposal. The Post has tactic and strategy whilst the state media is just reactive making RB look so shallow and vulnerable. If the US$ 5.9m The Post talked about was a lie why didn’t Dr Chongwe dispute? he couldn’t probably coz The Post had even under courted the agreed claim with RB.   26. This is a case of Chongwe’s word(which the post gets as gospel truth) against the States. RB is said to have instructed the AG to look intob this. What has not come out even from Chongwe article is what did the Solicitor General who attended that meeting says. Who advised RB that the state has an obligating to pay or recognise the ruling of the Ausie court? Mind you the AG is the President’s legal advisor so if that was his advice then pay him but as RB says lets negotiate the amount.

Why i bring the post in is simple!! the press sensationalises things in order to sell and i must add that the post are clearly anti RB. they will never use any opportunity to scandalise him. which is indeed their right.   32. Please note that NO Aussie court determined this case. Instead there is a UNHRC Report and two issues are clear from the report:

    1. Under Section 3 of the report, Dr Chongwe is the one who submitted that an amount of US$2.5 million in damages would be reasonable compensation. The Committee never commented on or supported this position. Accordingly, the figure remains just that – i.e. it is just Dr Chongwe`s submission. THERE IS NO JUDGEMENT THAT AWARDED HIM US$2.5 million COMPENSATION.

    2. Under Section 7 of the report “The Committee urges the State party to carry out independent investigations of the shooting incident, and to expedite criminal proceedings against the persons responsible for the shooting.     To me this is the course of action that Dr Chongwe is supposed to be pursuing right now – ie getting the State to carry out independent investigations of the shooting incident. The issue of his compensation is supposed to be determined by the outcome of the criminal proceedings.

The AG is like the Presidents personal lawyer so he needs someone he has total faith in and someone very loyal. In America this is usually the first position picked and remember JFK picked his brother while LPM here picked his old friend Kunda. I am the first to admit that the Govt’s media machine was faulty and mismanaged the situation. But i cant see where RB expressly said go and pay Rodger US 6.7m .     FACT 4. AG’s chambers met with Dr Chongwe

At the rate we are going, our Head of State will have no freedom to act according to the leverage the constitution gives him until The Post newspaper ‘sanctions.’ These ‘leakages’ to The Post are meant to undermine Executive decision making and cause opprobrium in the eyes of the citizens against the President. This issue is one example. First, an alarmist headline and then next an editorial to support compensation, the same which is condemned, because the President is Banda.   49. The Presidential term is only 10 years max. It is in the interest of every Zambian that the President does a good job and succeeds. We do not have a ‘wamuyayaya’ at State House so that we fear that he will be in power forever if he succeeds. Pres Banda has very small children and I believe that he would like to see his children grow up in a prosperous Zambia, with unlimited opportunities to better their lives. Pres Banda is not corrupt as so many have insinuated, but like it or not, our constitution gives so much power to the President to determine directly or indirectly the affairs of the state.   51. Simply by word of mouth, Dr Mwanawasa stopped Chipata council taxing bicycles. The Zambian President has a say on every little thing in the country! That is not how it should be. I was once involved in reviewing an Act of Parliament some time ago. I was totally against phrases like ‘the Minister shall appoint…’ ‘the President shall…this and that.’ But my misgivings fell on deaf ears. This act has now been passed and contains all those detestable phrases. When law is made, there should be no room for subjectiveness but cold and hard factual objectiveness. No law should empower a person to act well based on his personal goodness. The degrees of freedom of interpretation should be as narrow as possible.

Chiluba was talking about the democratic right of every citizen to support the party or person who promises him something. In every democracy, people lobby political parties. You vote for the party that will give you want you want. If I was gay, for example, it would be in my interest to vote into power a party that promises to uphold the human right to free association. The President has promised legislation that will protect whistleblowers in the fight against corruption. The 2nd Republic mentality stops people from talking to the authorities to report corrupt practices. One should not go to a newspaper to report corruption. Trial by media is undemocratic.

I hold my country above money. I refused to be youth chairman in Unip, I refused to be coopted in MMD in my consitituency because I was not happy with the chareter of the Presidents – abusing their authority all the time when it suits them.

    I am in similar position. I have never voted in any election in Zambia except in 1984 or there about when I actually voted for one Michael Sata in Kabwata!!! They have ALL been a disappointment, but somehow, I see Pres Banda’s as the best opportunity Zambia has ever had and in one way I am happy that he is kept on his toes by all the scrutiny he is getting, but I reject the diminishing of this high office by the insults that are published each day. They just leave a bad taste in the mouth. The government of the day MUST be held to account indeed and where there is wrongdoing, the law must take its course and where the politicians do not work, they should be voted out. But we do not do so through rhetorics of evil. Two wrongs to not make a right.

    THE SAINT: Yes the Office must be respected by all of us including the holder him/herself. Mr. R Banda has also used uprintables against his perceived enemies. He must stop this and also must look at which people can ably represent him as ministers.     positivist pa zed : Great to hear from you. I also dont say the POST is 100% perfect. It is run by people who may also have their agendas, which is not good but unavoidable. You see in the early 1990s I came to hate the POST for their attacks on FTJ(we are from the same area and happen to have attended the same school at different times). I came to hate them so much that I came to suspect that Mmembe was Lozi and was campaining for Aka and Arthur Wina. Along the way after mixing with certain people I came to realise that after all the post had some truth on their allegations against FTJ’s government. Ok they go out of the way, but at least we are knowing things we would other wise have missed.

  70. Deja Vu and all the others. It is not The Post that outed Chiluba or any of the plunderers. The Post published news that was given to them by people as well as the evidence ‘leaked.’ Now, every newspaper should be able to do this. In the days of Dr Kaunda, news was controlled by the government through their own outlets. Since 1991, this has been liberalised so anyone can print this and it just so happened that The Post had a head start. Zambia was a highly indebted country and donors would have been unhappy if anything had happened to Membe &co. The result is that Membe took courage to print what he wanted. These stories come from chit chats. At UNZA in the 70s and 80s we had similar students papers which were anti-government. The Post is a glorified ‘Scribe.’

  72. Zimbabwe’s Mugabe is tyranical but there are papers there that publish the truth inspite of real harrassment from the authorities including arson. They are the real heroes and they are doing this in real dictatorship. What have The Post editorials ever suffered except a stint in Remand? In the 1980s a young Times of Zambia reporter reported about a missing army truck load of weapons from Arakan barracks. He was sued for false alarm, and yet he got that information from a senior government official who attended his church! This official denied this. Zambians are now free to speak, but like negro slaves after the emancipation, they are still psychologically not free. You can report corruption and it will be investigated. Don’t try people through the media.

    I would defend the freedom of speech and the right to publish what they will for The Post even if they wrote about me. What I cannot accept is trying to alter the public perception of an individual by spoon feeding people with distortions of the truth. The Post do not publish lies, but they put a spin to the truth so that if read by the unwary it gives a poor impression of the President. Let me give you an example. RB was portrayed as Zimbabwean first. He went to Eastern Province and said that he belonged there and he was one of theirs. That was spun out as tribalism. In every culture, there are ways of saying things in jest without ill-will. An African American may call his friend ‘nigger.’ Put in another context, it would be an insult!

  74. Many of you bloggers who think that the post lies are full of wishful thinking. I am an associate som eof the reporters of the post and i can tell you this
    -The Post will not publish a story if there is no evidence
    -The Post always takes time to investigate before they publish a story
    -The Post always makes sure they cover hemselves before they publish a story
    -Any reporter who writes stories that can not be substantiated and give to the editor will be shown the door
    -The Post has legal counsels who go through their stories and make sure they are covered legally
    -The post never pays anything to a news source. You have to provide information voluntarily. One James Lukuku will atest to this.

    Ask yourselves, from the time of inception, how many people have sued the post successfully?

  75. As far as I can see, President Banda has made onlt 3 mistakes in his Presidency. 1. Perhaps he allowed The Post’s support for Magande to cloud his judgment on Zambian Airways. I know the shareholders of Zambian Airways personally and they are good people. Their association with the Post, cost them government support. The President may have come to the right decision, but it was marred by this tiff. 2. The way he defended Dora was unwise. He could have put out a press statement saying ‘Hon Siliya has my confidence.’ He should not have become so personal as to call her ‘smart.’ He needs good advisors to coach him on how to speak and to anticipate issues. He seems to be playing catch up all the time. 3. He does not need Chiluba. Even if he is a friend, he should not parade him.

    How many scandals has the Post revealed and we find out almost always that it is true? I can tell you that a reporter at the Post who presents an inacurate story, is fired instantly!
    Dickson Jere failed to make the grade at the Post.
    The Post does not accept to have its reporters paid per diem by GRZ officials when they are covering them. If a reporter gets the money, he is fired.

    I can assure you that in Zambia you can not run a newspaper based on lies for 18 years and survive. No way! The Post has survived because of the support of the Zambian people who read the paper.

    You are right and I agree with you. But there is a way of reporting the truth that can mislead people. Take the Chongwe issue for example. Suppose the President asked the AG to look into the case, and the AG decided to pay. Would you report that ‘Pres has authorised payment,’ ‘AG has authorised payment’ or ‘Government has authorised payment?’ The immediate authority is the AG. Similarly, the Chief Justice is appointed by the President, if he acquits someone would you say it is the President? The ONLY reason you put the President in the story is to cause him opprobrium.

  79. On the same case of Chongwe, The Post accepts that he must be compensated, but they drew un-necessary attention to the President on the basis of the sum that was quoted. In law reparations vary widely across the board. In USA some people are paid millions for a botched operation while others got thousands for exactly the same injury! Then you say that RB hates The Post. RB was attacked by the Post even before he opened his mouth. The Post started when RB was appointed VP. They published the leak with a photo of RB in a car driven by Ms Agnes Ngoma. From that point onwards, he was on the Post black-list. He is human. He is bound to have ill-feelings to the incessant, unprovoked and frenzied attacks on his character and his family.

  83. I believe that Dr Roger Chongwe is a reasonable man. It is not for the money that he sued. It is for admission that he was offended by the most popular but reckless government in Zambia’s history. A government elected by the people! It goes to show that demo-cracy can be crazy. Pluto and others did not advocate universal sufferage but merito-cracy. Only those in the know should vote. Anyway, that is beside the point.The principle is that no government should kill people willy nilly. Next time a policeman raises a gun to his shoulder to fire at innocent people he should think twice. If Chiluba did not authorise the shooting, he should have disciplined the officers who fired. Zambia needs an independent police complaints commission to stop this. Otherwise we ALL pay!

Dr. Chongwe clearly stated in his comment that it was agreed by all the parties you have identified in your contribution on #50 above that he ought to be paid US$5.9million. Now, when the Post broke the story, Kanitundila got scared and backpeddled like he did over the saga between Aka and the Litunga.   88. All president Bwezani Banda’s advisors and ministers know that he is a character prone to two things, saying some blue lies and then peddling in embarrassing lies to cover up lies. He is lazy and likes travelling a lot addressing useless meetings, half the time sleeping. Especially these days, one day on the Zambian political drama trail without some Bwezani cringe-inducing gaffe or blue lie is a rare blessing. Look at the Chongwe saga swirling around him and how he is fueling it with one lie after another while trying to extinguish the resultant inferno?
