Roger Chongwe claim must be registered — LAZ

THE Law Association of Zambia (LAZ) has said the judgment involving Lusaka lawyer Rodger Chongwe’s claim for compensation should have first been registered in the Zambian courts before payment is considered.

LAZ president Steven Lungu said in an interview yesterday that the judgment should have first been registered in Zambia for it to have legal efficacy especially that no Zambian Government official represented the country when Dr Chongwe took the matter to United Nations Human Rights Committee (UNHRC) following the 1997 Kabwe shooting incident.

He said since Dr Chongwe did not exhaust all the local channels before taking the matter to the UNHRC, it was prudent that the matter was registered for it to have legal efficacy.

“One of the conditions for one to take the matter that far is to first exhaust all local channels but in this case, nothing like that was done,” Mr Lungu said.

He said the amount awarded to Dr Chongwe as compensation was too much as compared to what the Zambian courts award as compensation.

And Chief Government Spokesperson Ronnie Shikapwasha echoed the LAZ sentiments saying it was only correct to ensure the matter was registered in Zambia, especially that Dr Chongwe had not given reasons he took the case to UNHRC without first exhausting all the local channels.

Lieutenant General Shikapwasha said the LAZ observation was right because the Zambian Government should not be made to pay even for issues of Dr Chongwe’s alleged self imposed exile.

Gen Shikapwasha said issues of where Dr Chongwe took the matter and why he decided to take the matter to Australia were some of the legal aspects that needed to be heard before the compensation could be effected.

“For example, who forced Dr Chongwe into exile, is it not himself? And why should Government be made to pay for that?

These are some of the issues that need to be heard before even thinking of effecting payment,” he said.
He said it was sad that some opposition leaders speak the loudest on issues they did not have facts about but failed to apologise to the nation when Government presented the correct facts.

When contacted for a comment, Justice Deputy Minister Todd Chilembo referred all queries to the acting Attorney General(AG) Abyudi Shonga.
However, Mr Shonga’s mobile phone was not reachable.
On Monday, State House said President Banda in fact had on November 30, 2009 blocked the payment of US$6.7 million to Dr Chongwe because the amount was too excessive and was going to set a bad precedent.
President Banda’s Special Assistant for Press and Public Relations Dickson Jere said Dr Chongwe’s compensation which initially stood at US$2.5 million had accumulated to US$6.7 million as a result of additional amounts in legal costs and loss of earnings.

Mr Jere explained that President Banda blocked the payment of the compensation which was eventually agreed upon after Dr Chongwe’s meeting with Justice Minister George Kunda who is also Republican Vice-President and later the AG, without the knowledge of the president.

  2. Why didn’t RB consult LAZ before meeting with Chongwo? How can Zambia accept the decion of the foreign court without being there? Ask uncle Bob or TJF for advice. Even if Chongo was in australia, the Australian government would not have given him that money. This is a greedy man who has no regard for the suffering Zambians.

  4. Chongwe should take his case to our Local Judiciary system. Let them determine what is due to him just like the do to the rest of the Zambians. He cannot be a special case. He went into exile on his own accord and as such we cannot be made to pay for him having decided to go and live with his in-laws in Australia.

George Kunda has again advised RB wrongly. We shall see what happens next. GK should resign on moral grounds for misleading the President

    At least I am encouraged to see the Gen/Rev/Minister Shaka do an “about turn” (180 degrees turn) for the benefit of the Nation. A move that should be very familiar to Shikapwasha; he was once a soldier for crying out loud!! And those who are in the habit of condemning the Post Newspaper should realise that without the Post cases like this would never be known and this US$6 million would have been made secretly. There is a long list of scandals and corrupt practices that have been unearthed by The Post and saved our country. There is nothing untoward about Dr Chongwe payment because it was sanctioned by the United Nations and the Government failed to defend itself. Zambian security agencies are the most brutal in Africa and they must begin to pay for their brutality. Unless that payment is made we shall continue to witness Human rights violations by the state. Dr Chongwe is only being denied his money because of petty jealous by some individuals. What the Police committed was a serious firearm incident and if that incident happened a Western country Govt would compensate the victim. Zambia must compensate the Gabon victims. Patrick Chiko Bwalya was paid U$150,000 for torture, that payment was not sanctioned by our courts

  18. My advice to Zambians is to always take the words of each contributor with a pinch of salt.This includes RB, Sata and Fred Mumembe’s Post. They all have interests to serve. The Post has decided to take a side in Zambian politics and refused to remained neutral and objective. This is their right. But we should always be conscious of this. It determines how they break a story. For instance they ignored any good thing about the Jacob Zuma visit to Zambia and what the expansion programme of Nakambala means in terms of exports for Zambia. A sophisticated readership always strives for balance. The Post is not for balance. That is fine, as long as we are aware of it.

  30. London court dismisses Chiluba’s appeal

    London High Court Judge Peter Smith has dismissed former president Fredrick Chiluba’s application for permission to appeal against his judgment. And after several hearings aimed at reconciling figures in the London High Court judgment, Chiluba will now be required to pay a final amount of US$57,441,769.38 in respect of the Zamtrop Conspiracy , the BK conspiracy and for breach of fiduciary duty.

  31. Chiluba and his co-accused had sought leave to apply against the London judgment after it was delivered via video link on May 4, 2007.
    But judge Smith dismissed the applications saying they were not morally right and were absurd.

    Judge Smith dismissed the applications against the court’s findings of dishonest saying one could not appeal on the findings of the court.

  32. Judge Smith said it would be absurd for the law to allow the defendants to have limitations.
    He however said he would ensure that every party wishing to challenge his judgment had the right to go to a higher court of appeal.

  42. in 2006 kasama central a total of 24,575 votes were cast. in 2008 only 15447 so almost 10,000 kasama voters did not bother to come out and vote. Chishimba received 12,201 while kachingwe received MMD 6,853. In 2008 GBM received just over 10,000 votes while mugala received about 4,000 in fact 4184 to be exact and gbm 10,688. From the above it is obvious that only the core voters of each party came out to vote. Now come 2011 when the stakes are high those 10,000 who did not vote will come out and by then new voters will be added to the voters roll. So all MMD needs to do is to convince the apathetic voter to come out and vote and also show people that just like in 2001, 2006 and 2008 sata cannot be trusted. simple mathematics and analysis

However, Mr Sata (recently refered to as Mp3 by Muvi TV commedy show) is an insolent man and he knows the adage in his own language which says something like “ubufumu buchindika ubwine” translated as “the king is respected if he respects himself”. I happen to attend a rally at woodlands stadium in 1990 where Mr. M Sata was one othe people addressing the MMD rally, at that rally Mr Sata hurled insults at the former first republican president. Even though I supported change that was totally un acceptable to me and from that time on the man has continued unabaited to use very bad language at his colleagues. Perhaps I expect too much from him. This agenda of “insults” and use of un palatable language has now characterized even the so called independent media.

What are they saying about him now. In 2001, the Post opposed Mwanawasa, what are they saying about him now. In 2006, the Post reminded the public about Sata’s history, what are they saying about him now. The moral is that we should all read the Post intelligently knowing that they have their own interests to serve. Some times these interests coincide with the best interests of Zambia. Somrtimes they are different. As for me I do not support any political party or leader. I try to seek the truth.

    So what if there has been corruption and illegal payouts since the 70s! Does that mean we can’t have a fresh start and clean up the mess? If Chongwe deserves compensation, yes, he should get it; but he should do it in a right way in accordance with Zambian Law. Let the courts decide the rightful amount commensurate to his injuries—-that is all people are asking for—-not that he shouldn’t get compensated.

  50. Yamba yamba I dont believe that Chongwe used the wrong route. You see law is based on opinions and LAZ have passed an opinion on the best route to be used but no that is not cast in stone. There is what is called out of court settlements, which if what you recall was offered to FTJ by LPM. hE SAID RETURN A certain percentage and I will let you free. Personally I feel this issue has been over sensationalised really. My analysis o events is this—1// Chongwe is shot at 2// Chongwe obtains a judgement after the govt does not represent itself and Chongwe takes the matter to the UNHCR 3// . Chongwe takes the matter up without success with LPM 4// Chongwe meets RB who admits a liability and sends the legal authorities for an opinion. The post comes across the information and publishes

All in all, its good that this has come out and this will probably provide guidance on how to handle such in future. We however all need to understand that there are diffrerent interests at play A – Chongwe wants and rightly so compensation B – The post has an editorial policy that they must fufill (this policy includes their stance towards the MMD government) 3- The post sources also have an interest, we dont know whether their intentions are noble or not and how truthfull they were 4 – The Govermenthave an interest to avoid embarrasment in the issue

  52. $ 6,7 million compensation is just too much for an individual, whether or not this case was registered in the local courts. Dr. Chongwe should have known that such a horrendous figure would stir a lot of emotions amongst the Zambian citizens when he took the case to UNHRC.

  60. We all know Chongwe was together with KK nearly killed at the behest of no other than Chiluba and Miyanda who was then acting president. Sata and Shikapwasha were both in the government on that day, one as Portfolioless Minister (villageless village headman as my brother Dr Sichone would say) while Shikapwasha was Air Commander.   61. It would appear someone has finally put some bollocks on the Law Association of Zambia, they have demanded the resignation of the DPP. The DPP is supposed to serve the interests of Zambians and not those of criminals who have injured this country. His decision to withdraw the appeal against Chiluba’s verdict clearly shows whose side he is on and its right that the LAZ should demand for his immediate removal from office and I hope they will go further by removing his from the BAR.   62. I thought judgement is judgement and can not be challenged outside court. Zambia is a signatory to the court in question and we are oblidged to follow its judgement. Moreover, we know the causer and he is still alive. Why not pay the bills to him and we stop the rubbish so that who ever is president must know that if he boobs, he will be made to account for his or her deeds. I demand Chiluba the Monkey must pay Chongwe and save our money for building schools, roads, etc.

  63. The whole judicially system is now compromised. Chief justice is past his sale by date; Vice Preza is also Justice minister; Attorney General has been shown the door for not following RB`s instruction.What else can RB do to be impeached.?

  64. Give this money to victims of the Gabon disaster and the rest to build more hospitals, schools or at the least repair them. Do not pay Chongwe this kind of money, this is robbery…..never would an Australian govt. pay him that much or any advanced country for that matter. Please RB listen to Zambians!!! If the govt. always complains about not having enough money for developmental projects in our country…where is this money going to come from (donors or your pocktes) ??? We need to know. This is ridiculous….we are killing Zambia everyday. This got to STOP. MMD kuyabebele….! And why should George Kunda have two jobs…..VP and Justice minister…Is there any sense in this….are there no other educated people who can run the show too? In fact better than him?? LAZ speak out again!
