CHIEF Government spokesperson Ronnie Shikapwasha says former Task Force on Corruption executive chairperson Maxwell Nkole should not accuse President Banda’s government of having interfered in former President Frederick Chiluba’s case because Zambia has an independent judiciary.

Lieutenant-General Shikapwasha said in Lusaka yesterday that it is wrong for Mr Nkole to ask Government, as reported in The Post newspaper of yesterday Dec 28th, to reflect on the consequences of blocking the due process of the law to restore confidence in the office of the Director of Public Prosecutions (DPP).

Mr Nkole wants Government to restore Dr Chiluba’s appeal to the court “if the impasse surrounding the acquittal and office of the DPP are to be resolved”.

“The position of Government regarding the acquittal of former President Chiluba is that whatever decisions were made by the judiciary were independent and no other wing of Government had anything to do with the case,” Gen Shikapwasha said.

He said Mr Nkole as well as all those attacking the DPP, Chalwe Mchenga, by accusing him of having been compromised should stop because none of them have come up with any evidence to prove their claims.

Gen Shikapwasha, who is also Minister of Information and Broadcasting Services, said the DPP has been vindicated and should be left alone to concentrate on his work.

And Law Association of Zambia (LAZ) president Stephen Lungu says he is consulting with his members over the challenge by Lusaka lawyer John Sangwa that the association should take the matter to court if it has enough evidence that the DPP was influenced to quash the appeal against Dr Chiluba.

Mr Lungu said he has seen the media report where LAZ has been challenged by Mr Sangwa but that he can only make a comment once he meets with his colleagues.

Mr Sangwa was quoted yesterday as saying it is lawlessness for LAZ to champion the resignation of the DPP, knowing that it has no constitutional powers to do so.

He said what LAZ is doing is sad because instead of strengthening the law, it is actually weakening it.

Mr Sangwa said the DPP is supposed to operate independently and that if people had questions about certain decisions, they should state the basis of the wrongs that the office-holder has done and later follow the correct channels.

  4. Okay chi Sangwa, who is to listen to the 11 million plus Zambian voices loudly, silently and at times painfully crying for justice? LAZ is strengthening the LAW by being a voice for the unheard, rich or poor, young, old all need protecting from philandering mobs disguised as the MMD government. I was there in 91′ when Zambia’s hope for a flourishing future were handed to MMD to steer. Look at Botswana, Namibia, even the Island of seychelles excels past us. Shikas should shut his mouth and one nostril because I think the perceived money making global warning carbon gases are affecting his grey matter.

  5. No beating about the bush here ladies and gentlemen. RB has publicly said that it was going to be too expensive to put a former head of state in prison. Also one Mabenga, MMD National Chairman/Deputy minister of defence went to Mansa to celebrate Chilubas acquital when we expected GRZ to feel sad for losing a case. Examples abound on how we have come to accept that FTJs acquital was immaculate misconception

  8. Gen. Shikapwasya is so bent on reminding us of his ignorane on important national issues! We all know that what Nkole and others are asking for is the exhaustion of the process of clearing Chiluba’s name! This will not just vindicate the magistrate in the subordinate court but pave way for Chiluba to reclaim his position as free citizen and former Head of State. Chiluba will be free to travel to countries like Switzerland,the UK, France and the USA not just on holiday but to give lectures, preach and mingle with the likes of Bill Clinton! and so on. Some lectures will be at a fee of course! The problemm with some leaders is that they only see one outcome of the coin/debate. Shame.

  9. Doesnt Shikapwasha remind us all of one Comical Ali?! We should just never expect anything that is a result of a normal thought process to come out of this guy’s mouth! If political interference/consideration was not at play in Chiluba’s acquital, the outcome of the case will not be changed at any level of appeal! Time and cost are not a factor unless Sangawa comes up with as many requests for adjournment as he did in the subordinate court! Bishop FTJ may also find this as an opportunity to make us all see that God really had a hand in his acquital! Otherwise Shikapwasha better shuts his mouth up and allow for informed debate of important national issues while he goes back to school and learn the importance of deabtes himself! We are a learning young nation after all.

  10. The thing the surprises me is that LAZ do not see it fit to bring misconduct charges against DPP. This would make him accountable for bringing the profession under disrepute and possible de-registration. Is this too difficult?

    My question is why the &el* is the DPP quiet!!! Isn’t he a public servant who is answerable to the people??? If he made the decision he should come out and defend it.

  14. As the first few comments can show, very few people are still interested in this affair. From my view of things, it is only a matter of time before all the noise about FTJ’s acquittal is forgotten and people regain their confidence in the DPP & Judiciary altogether. Like the Germans would say: “Neues Jahr, Neues Kapitel” meaning “A New Year brings a New Chapter…”

  17. H.E RnB is quoted as having said he stopped the appeal of the aquital of Chiluba’s plunder case, and many other pronouncements by his ministers including Mulongoti atest to this fact. Remember, even Newspaper articles are admissible as evidence in Zambian courts. If we are serouis this is a mighty breach of the Constitiution, and the govt should be impeached by parliament, we are not just serious! They are suppose to uphoad the law(Constitiution). As for Sangwa, may be he’s promised AG, remember its vacant, and he’s been losing cases, his law firm is down on its knees and no wonder he hit out at the bench! He’s become a political stooge like the rest of them. Sangwa you are a joker!

  18. As for Shikapwasha, i have always said he should learn to shut up, those nostrils are just trumpeting, making noise for everyone. We will not leave the judiciary alone, aloft, these are public offices and as long their morality, proffessional intergrity as enshrined in the Law is questionable, we will not stop talking! They should instead leave public office! Dont start telling us what to do as if you Kings of unquesationable character? We demand high moral and proffersional integrity for public officers.

  19. Sangwa is a criminal lawyer defending criminals like Chiluba. He knows very well that any appeal of the chiluba case would be another loss, and a shame to his young career.
