Zambia will next year go to a constitutional making referendum following the failure by the National Constitutional Conference (NCC) delegates to attain two thirds of the vote required to meets make the 50 percent plus one vote threshold be enshrined in the new constitution.

The NCC delegates yesterday voted to determine a final position on the proposed 50 per cent plus one vote threshold clause in the next constitution for a presidential candidate to win an election.

A total of 260 NCC delegates voted in favour of the 50 per cent plus one vote threshold while 184 delegates voted against. This was out of the total 446 voted cast. Four votes were rejected.

For the 50 percent plus one vote threshold to go through and be adopted for enshrining in the constitution, the NCC should have attained at least 297 votes out of the 446, which would have translated into a two third majority.[quote]

Electoral Commission of Zambia Commissioner, Joceline Mubita, who was the Returning Officer in the voting process, announced the results this evening at the Mulungushi International Conference Centre (MICC).

And NCC Chairperson, Chifumu Banda, said the outcome of the vote means that Zambia would go for a referendum to determine what would put in the next constitution in relation to what type of presidential election system.

“The two thirds threshold has not been attained. Therefore Zambia goes to a referendum next year,” he said. Mr. Banda thanked the delegates for voting.

Meanwhile, Chief Government spokesperson, Ronnie Shikapwasha said in an interview that it would be ideal for Zambia to maintain the current voting pattern of the simple majority rule.

Lieutenant General Shikapwasha, who is also Minister of Information and Broadcasting Services, said the 50 per cent plus one vote was not progressive for Zambia. He said this was instead a recipe for anarchy in Zambia, adding that this was the reason why Zimbabwe and Kenya rejected it.

He noted that the referendum was a costly process for Zambia and wondered where the government would source the funds from to conduct this exercise. However, the Patriotic Front (PF)-United Party for National Development (UPND) pact co-leader, Hakainde Hichilema said that the ruling Movement for Multiparty Democracy (MMD) should not use lack of money as an excuse.

Mr. Hichilema said Zambians had been advocating for the 50 percent plus one vote threshold for the past 20 years. He has since accused the MMD of blocking the efforts to have the 50 percent plus one vote threshold in the constitution to their advantage.

After the vote, NCC delegates and none delegates mainly from the opposition political parties went into jubilation saying the way of the referendum would be the best for Zambian to have the 50 percent plus one vote threshold in the new constitution. They said the next constitution will stand the test of time if the 50 percent plus one vote threshold is enshrined in it.

Prior to voting, Sinazongwe UPND MP and NCC commissioner, Raphael Muyanda, raised a point of order on General Shikapwasha for allegedly influenced the direction of voting by distributing a document that contained messages concerning the 50 percent plus one vote threshold issue.

Mr. Muyanda laid the said document on the table in order for NCC Chairperson, Chifumu Banda to rule over and provide guidance to the august house. But dismissed Mr. Banda dismissed the point of order and ruled that all NCC delegate were accorded ample time to campaign.

He further advised that the document would not necessarily influence the vote because it was done under secret ballot. The MICC, where the NCC conducts its business from, was today heavily guarded by armed police.

Currently, Zambia is undergoing a fourth constitutional making process which is discussing for possible adoption the recommendations from the Willa Mung’omba Constitutional Review Commission (CRC) which was constituted about six year ago.

Other constitutional making processes were the Chona Commission in 1973, the Mwanakatwe Commission in 1991 and the Mvunga Commission of 1996. From independence in 1964 to 1991, Zambia had been using a First Past the Post system of electing a president. In 1991, the system was changed to 50 percent plus one vote threshold, which was however changed again in 1996 to revert to old system.

  2. Let me start the day by restating that again, vigilant citizens’s representatives have patriotically refused to subscribe to the agenda of micro-nationalism. This opposition party schism the country has witnessed is not only in the rank and file of PF kaponya party but now also engulfed the UPND political gladiators. Many PF and UPND pro-democracy progressives called rebels by their fascistic party leadership are now saying they cheerfully voted with the people on their people’s behalf. This is evidence enough that progressives will never agree on contending and complex political issues with the anachronistic political junks like Sata in self delusion that Zambia evolve around their insulting mindset.

  3. reason for this noticeable opposition fragmentation is because of Sata’s anachronistic politics of anti-democracy tyrannical leadership full of mental inability to see the big picture and embrace progressive national agenda and members that can take principled stand on issues such as the just unfolded politico-tragedic drama in the polity.     I see that you are a man of letters and words indeed. I know you have had rough encounters with some of our cadres, but please don’t paint all people with one brush. Coming to the issue at hand, I think this is defeat for you camp. We wanted a referendum from the word GO and going there is success for us because we know the people want 50+1. I can see you and your MMD have now invoked plan B not to have a referendum because plan A has failed. You are now bring issues like there is no time, this will cost us money.

    The issue is if you really love Zambia, you can do a noble thing and allow the 50+1 clause enshrined. This has been done before. Zambia needed a referendum to change to Multipatysim, but KK being wise did the right thing. Please do the same too.

  16. 50% +1 Doesnt favour or disadvantage anyone, its simply a waste bof resources and time. majority rule is simply not attainable because the voters themselves are in the minority. 3m registerd voters against 13m people. Assuming 50% are below Voting age then the voting group would be 7m, add voter aparthy and Jehovas witnesses you end up with only about 1.7m voters and 50% +1 of that becomes about 850 thousand votes for the winner. How can that be majority rule ” Gorvenment of the people by the people and for the people” Lets us clarify this cleary, its not majority rule it should be called Majority Voters rule.Why do people want to complicate things for nothing? If you cant win by simple majority how then wouold you win by more than 50%?

  31. I believe that democracy comes with a cost, democracy is very expensive! Holding a referendum in itself is a costly venture, but that is democracy. I support 50%+1 clause because this will make the govt of the day to be more accountable to the electorates. In fact, I am very certain that if this clause is included in our next constitution, we’ll be changing Govts every 5yrs. One would really need to work hard to win a second term. Going by the pattern of voting since 2001 where a combined opposition votes have always been above 50%, opposition will always be carrying the day.

  39. The NCC commissioners have failed us again due to their lack of foresight and meaning we have to go for a referendum in 2011 which will not be possible due to huge amount involved. So the general elections will be held under the current electrol system a president winning by a simple majority. The likes of Ronnie who are comparing the Kenya and Zimbabwe situations are not being sincere and are a danger to democracy. We need to cultivate a system of good governance coz by making comparisons we are going backwards to WAMUYAYAYA Days of super Ken.     Total delegates to NCC is 495 . 446 VOTED SIMPLE MATHS suggests that 49 WERE absent so lets assume the absent 49 wud have voted for 50 +1. u have 184+49=233 against 260 who voted against the proposal.So with or without the pepo who boycotted 50+1 would not have passed.

    This is getting interesting. For a while, I thought the NCC provided the only opportunity for the opposition parties to participate in the process of constitutional review? Now that they have failed to agree, here comes the Referendum. We can only hope that this one goes down more smoothly and does not lead to more tension between the political and the civil society. We need peace and political stability in Zambia – it is our biggest blessing.

    I want to agree with people who are saying that it is morally wrong for Mr Sata to comment on the issues which are discussed in the NCC for simple reason. PF refused to participate in the process with their Mother Church. Now that good things are coming from NCC why should Mr. Sata open his mouth now. He must put a Zip and close his big mouse. This is in order to accomodate not just yourself but 48 other Zambians that are of your opinion out of a total of 100. We shall get 50%+1, with or without MMD! Today your pay master will be Rupiah Banda, tomorrow will be Sata. What should be important is whether these people can be easily removed when they stray!   60. Dont be too excited about the referendum. Many Zambian voters may not understand what this 50+1 is all about. Remember that there are many more people in rural areas than in urban areas. People may end up making the referendum political. And that will change the dynamics.

    In general the 50+1 may not be so good for Zambia. We may end up with coalistion governments which are rarely stable. Look at the PACT, that’s what you may get, now in govt. The UPND and PF rarely agree on anything sensible, other than removing MMD from power.

    Besides a re-run can make voters vote for the party or person they didnt vote for initially. E.g some disgruntled UPND could vote for an MMD and not a PF candidate. Or not vote at all again.

    Also you need a peaceful environment.

    Why have you cursed Zambia and Zambians? We have relatives in Zambia right now. May be the curses should follow you wherever you go so that you can see that they are bad. Know that when you curse something or someone that God has blessed, the curses will come back to you. Check your life.

  62. Until we make corruption illegal in deeds and make politicians aware of the consequences, which should include life in jail, this sort of thing will continue happening. And by us I mean the ordinary people! And be aware that there is a general belief in the west to expect rubbish from African Leaders that is why the donors will never raise a finger when this happens. Have you ever wondered why donor will keep funding a government that steals from its people but threaten to stop funding the minute it attacks gays for example? To disenfranchise a population is equally a human right abuse but that is to be expected (according to the donors) if it is an African leader doing it. Our politicians will never see this!

  63. It would be cheaper for the same ncc delegates to go for a second round of voting, instead of taking the all country to a referendum.Time has already been wasted and nothing still coming out of the ncc.Just go for the second round of voting, the results wont be the same.

  64. mmd do not want 50+1 because the think the can easily stop sata to win. The think the can easily manipulate votes in their favour. They will regret this action.Sata will more likely to win with simple majority than with 50%+1

  65. Imwe, who is correct? LT says:A total of 260 NCC delegates voted in favour of the 50 per cent plus one vote threshold while 184 delegates voted against. This was out of the total 446 voted cast. Times and Post are saying: 186 voted for the clause while 260 voted against. This is really poor reporting pa Zed. Very misleading and confusing.

  66. gentle Zambian, surely if rogue states like Zim, Iran, Afghanistan, Somalia etc are doing 50 + 1, why are we still rejecting it. Lets be fair.

  67. simple majority is only supported by those it has fraudulently helped to get into power. if anything they should just declare interest and exclude themselves from this debate or else we should investigate their dealing in past elections. we need to move a step forward. even the vote on 50% + 1 is not by simple majority but by attainment of at least two thirds majority. wake up.

  68. Few years ago zambians demanded for the Constituent and the MMD government refused to listen to the peoples demand. MMD pushed for CRC.CRC did its work of which the outcome was in favour of us (zambians) not the MMD. the MMD brought in their plan B (NCC) in order to manipulate us. Fellow zambians its hight we worked as one through the pact so that we can remove MMD. it has done more harm than good to the people of zambia.

  69. 50%+1vote will not make the politicians more accountable. That’s the sad fact. With zed’s meager resources, I would prefer a parliamentary elected president in case no candidate manages the 50%+1vote. Think of it this way; you all belong to the working class/middle class bracket right? Imagine all the 50%+1vote comes from the poor folks whose economic contribution to the country is negligible. Would you all be any happier? 🙂
