Learn from Mpombo’s arrest – FPP

The Forum for Progressive Politics (FPP) has advised Zambians to learn a lesson from the arrest of former Defence Minister George Mpombo, by police in Ndola, for allegedly issuing a K10 million cheque on an insufficiently funded account.

FPP Secretary General Charles Kafumbo says Mr. Mpombo’s arrest should be an eye opener to many Zambians who are in the habit of issuing cheques on insufficiently funded accounts.

Mr. Kafumbo told ZANIS in an interview in Lusaka today that the arrest of Mr. Mpombo will serve as a deterrent to other would be offenders.

He said it is unfortunate that the former Defence Minister issued a cheque on an insufficiently funded account to Colwyn Limited owned by Ndola businessman Terence Findlay.

In January this year, an accountant from Colwyn Limited reported Mr. Mpombo to Police for issuing a K10 million cheque to the company on an insufficiently funded account.

Mr. Mpombo was arrested on Tuesday and has since been released on police bond with two working sureties. He will appear before Ndola Magistrates Court tomorrow.

  3. This is the case any where in the world, Infact in most countries[Zambia included] you are blacklisted and fined very high charges. The problem i have with the rules in our beloved country is that these regulations are selective. A number of business houses have complained of cheques issued to them that bounced upon being presented, major reason insufficient funds. Unless this rule is applied without prejudice it serves no purpose!

  4. Why did FPP comment. And why go to interview FPP over a bounced cheque. Dont these things happen all the time in Zambia? Is Mpombo the 1st one, for him to be the example for the rest of Zambians?

Why not give a few facts to put the whole issue in perspective, like the number of cheques that bounce in the top 4 banks in Zambia per day, for example vs the number of people arrested per day (or per year) for such offences.

In the Uk it is not a crime to have a cheque bounce.However, most banks will charge a customer a fee of £30.It’s normal to have “unclearde funds” in ones account but should you want your funds cleared by express, there’s a fee of £15.Mpombo’s case is coming from state house via the DPP.Why should the DPP order the police to open the docket when itwas closed?   24. I wonder how many Zambian have issued NSF cheques. This is simply being vindictive. I don’t think this man should have been arrested. If Chiluba can get away with stealing Millions, why go after someone who wrote an NSF cheque for $3000 and which he has paid after all. SHAME SHAME

  29. #33 Bingo you are right on. Instead of making criminals out of hard working citizens, a fee should be sufficient. This is what is done in the West. Only if one is bouncing a cheque deliberately which is difficulty to prove. There would be millions jailed every year in North America if that was the case. I volunteer for a soccer association, and every year we get 10 or so NSF cheques and we just charge them a fee. Banda be reasonable. I refuse to call him RB because this makes sound like he is cool and educated. He has been through formal education by he is still backwards.

  32. I’m not saying it is right to issue fake cheques but is it really tantamount to theft? It could be that there are just not enough funds on the account at the time of issuing the cheque but a few days later. At least in Germany this is not an offence at all and it happens everytime.

  33. #26 a friend who worked in a Zambian Bank for more than 10 years told me that it is a criminal offence to issue a cheque to be drawn from an insuficiently funded account. This is according to the Zambian Law, if it is not a crime in UK it is fine for them but this is Zambia. We should not easily confuse politics and crime. The fact that there have been many cheques bouncing elsewhere as suggested it should not give anybody leverage to turn a criminal case into politics.   36. Your reasoning always amazes me. Not in a good way, by the way!! Don’t you think the “degree of criminality” matters in law? If that wasn’t the case,plenty of Zambians would be doing hard time in prison right now. Not all crimes are punishable by “death”, neither are all killings “muder”!

    Yes people cheat on their spouses and such, and no one is encouraging you, Mr. MMD Chief Bootlicker, to go out and cheat on your wife (if you are married that is,) or bounce a check. But to have the DPP personally issuing orders to arrest someone on a case that the local law enforcement authorities deemed not worth prosecuting and hence closed, should be worrying to everybody, including you, MMD–fimo–fimo!!   41. Latcheting accounts and writing bad checks on a dry account is criminal tantamount to economic sabotage under the banking Act of the laws of Zambia. This a law which Mpombo wittingly sponsored and enacted in the house of legislatures at Manda Hill.With him he had moved 2 proposals in 2006 at the peak of his gloving vocation.

    (1)-His First proposed bill under Mwanawasa in 2006 was the Degree clause for Presidential candidates

    (2)-The second one was this Banking Act which went through into the laws of Zambia now challenging to stop latcheting accounts .He should revisit his bills.The Presidential degree clause is famously called the Mpombo Act.

According to Mpombo’s earlier statement,he issued the cheque and made it clear that they should not deposit it untill a later date when he was sure the account would have had enough money to cover up the issued cheque,it was a post dated cheque,atleast according to Mpombo,,,we are all just speculating about this issue,,,one thing for sure,this is more political than just a case of bouncing a cheque

I dare ask are all Zambian’s regarded equally in terms of justice/ i wonder…Mpombo’s case is a drop in the ocean to other corruption cases…but hey one rule for the elite of Zambia… What a shame.

  46. Thats what happens when the president is too childish. Findley was forced and threatened to report this matter to the police by RB. Its a pity that even after the post released this news that this was nothing more than dirty politics for RB, the president still goes ahead and orders the police to arrest the man. How low can the president sink! When is the president ever going to realize what his job duties are?

However, I admire Mr. Mpombo for his appology. also I admire Mr. Mpombo that despite not being wealthy, he has not kept quite and just EAT as Minister of Defence but chose to condemn the MMD and later relinguished a No.4 position in the Land with all the benefits the office had. I truelly salute him for the caourage to speak out, many Zamabians could have continued to eat well and forget the suffering mases & be No. 4 in the Land. May God make it possible u not jailed. Do you know how many cheques King Cobra issued that were dishonoured whilst serving as a senior cabinet Minister in FTJ’s Regime?How honourable are both Bwezani and Sata when it comes to issuing dishonoured cheques?I am neither MMD nor the PACT.   59. Bouncing a cheque is an offence. Arresting someone for bouncing a cheque after they have made good is Zambian politics. Motivating an arrest from State House when your own personal companies (Allenwest and Robert Hudson) have for decades not paid people their terminal benefits and former employees are dying of hunger is more criminal. It is a question of morality. You cant be throwing stones when you leave in a glass house. It is not about when the law was enacted it is about the moral conscience for someone to celebrate a single opponent’s arrest when there is a multitude out there whose livelihood, or the lack of it, your are solely responsible for. And you appear to have forgotten about them altogether! Zambia and Africa will never move on for as long as we personalise politics.
