The Movement for Multiparty Democracy (MMD) Lusaka Province has petitioned Home Affairs Minister Lameck Mangani to ensure that opposition Patriotic Front (PF) President Michael Sata is investigated and prosecuted for alleged diverting public funds amounting to K1.2billion into a 45 day special investment account at Standard Chartered Bank.
In November 1992 Mr. Sata during his tenure as Local Government and Housing Minister, was investigated by the Anti- Corruption Commission (ACC) for allegedly diverting public funds amounting to K1.2billion into a 45 day special investment account at Standard Chartered Bank contrary to the Ministry of Finance circular number 10of 1992.
Speaking at a press briefing in Lusaka today MMD Lusaka Province Chairperson William Banda said the Ministry of Home Affairs should investigate because to date the docket to prosecute Mr. Sata is still active.
Mr. Banda said the docket is still active notwithstanding the recommendations by the ACC that Mr. Sata be prosecuted for abuse of office and corrupt practices.
He said the MMD in Lusaka would not rest until Mr. Sata is investigated and prosecuted for abuse of office and corrupt practices.
Meanwhile, Mr. Banda further petitioned Mr. Mangani to investigate who owns the Luxury buses ABG 6159 and ZB 4 at Intercity bus stations and whose licence they are operating on.
He said the buses are allegedly owned by Mr. Sata adding that the PF Leader should explain to the Zambians as to why he is running his businesses and owning property in other people’s names.
Mr. Banda questioned if it was a deliberate ploy to avoid paying taxes adding that Mr. Sata cannot be trusted to run the affairs of the country.
And about 50 Forum for Democracy and Development (FDD) Members have since defected to the ruling MMD.
Representative of the defectors William Khosa said the members have decided to defect to the ruling MMD because the FDD is a dead party with no vision.
And in welcoming the defectors Mr. Banda said people have now started realizing that the MMD is the only party with vision for the people of Zambia.

This case just reflects the failure of Chiluba’s presidency where he shielded corrupt elements. Chiluba should at that time have sanctioned the prosecution of Sata regardless of what office he held in government. Prosecuting Sata now would just diminish HERB’s government’s standing.

Do you understand the law of statue of limitation you are alluding to? Revisit your constitutional law lectures if ever you took one in college. Sata was found with a case and turned in for prosecution by the DPP. He was never cleared which makes his case not qualifying for statue of limitation or double jeopardy as i know it in the US legal system. Time does not limit reactivating this case concerted by the DPP. Look at at the time it too Bosnian Serb war crimes suspect Radovan Karadzic who evaded prosecution during the years he practiced alternative medicine under false ID and lived freely in the Serb capital, Belgrade.Its constitutionally right that the embattled polygamous Sata’s record is cleared or prosecuted by the justice system.

Chiluba has been cleared by the courts after undergoing dual process of the law only to find his innocence. Out of the 40 counts his immunity was stripped on, before the death of Mwanawasa the prosecution dropped all remaining with 3 which the court found them as frivolous and in legal default.Sata was found guilty and submitted for prosecution by the DPP.Is there record of clearance?
What ever goes on in that country is a shame. The problem is that you are dealing with a country that is so poor. 90% of the politicians are uneducated, so what do you expect? 90% of the people who are in business are people who have stolen or stealing from the government. Educated people who are supposed to participate in the political environment do not see the sense in it because the system is controlled by the same old folks with simple minds. MMD – the Giant is Re-Awakening
THE MMD has continued to be Zambia’s ruling and dominant political party for close to two decades.
For 10 years (1991-2001), this dominance was total and overwhelming, with the MMD obtaining more than 60 per cent of the national vote and dominating the legislature with more than 80 per cent of the seats.
The MMD has also continuously controlled the presidency, which means that it has had power to initiate and direct policy and legislation.
However, the MMD, like most parties that stay long in power, is vulnerable to internal and external forces, resulting in institutional paralysis and poor electoral performance, especially in recent years.
This article discusses how the MMD leadership has started to address the challenge of institutional paralysis in the party and how this is now re-awakening the giant within the MMD.
The MMD was founded after 17 years of a one-party system and 26 years of the United National Independence Party (UNIP) as the ruling party.
The MMD was established as a principled, self-sacrificing and national service-minded organisation for the re-introduction of a multi-party State Constitution.

Electoral performance
A useful entry point in understanding the decline in mass support for the MMD is to look at the electoral performance of the party. Although the MMD has successfully held on to political power since 1991, recent election results suggest that the party has been ceding some political space to opposition parties.
The first MMD administration lasted 10 years, up to January 2002, under the leadership of President Frederick Chiluba.
In the 1991 elections, Dr Chiluba resoundingly beat Kenneth Kaunda with 81 per cent of the vote.
Mr Chiluba was re-elected in 1996. In the 2001 elections, the MMD’s presidential candidate Levy Mwanawasa received 29.1 per cent of the vote and was declared the victor by a narrow margin.
Since 2001, the MMD has faced formidable political opposition and its hold on power threatened. In the 2001 elections, support for the MMD plummeted by 40 per cent.
Since then, the party’s share of the national vote has continued to fall. A number of factors account for this.
While the MMD enjoyed euphoric support in its first five years in power, internal factionalism and dissension, by and large, undermined the broad coalition that had been established in the 1990-91 period, and the glue on which the social contract was based.
In 2006, the late Dr Mwanawasa was re-elected with 43.0 per cent of the vote. In the 2008 presidential election held following the death of president Mwanawasa, the ruling party’s candidate, Rupiah Banda, narrowly beat the PF’s Michael Sata.
President Mwanawasa’s illness precipitated power struggles within the party and his death left a power vacuum. The late president did not groom a successor!
Consequently, the party lost some national appeal and became electorally weak in four provinces (Copperbelt, Luapula, Lusaka and Southern), with very few or no parliamentary representation.
There were also fears that at the rate things were going, Central, Northern and Western provinces might also defect from the MMD.
Rupiah Banda and the MMD
Mr Banda took over a factionalised and fragmented MMD. As the President took over the leadership of MMD, the party was showing signs of a major organisational and institutional stress.
The party seemed to be deeply entangled in institutional and leadership divisions right across its various organisational levels. There were also concerns of mistrust and betrayal within the ranks of the party membership as well as a sheer sense of failure to perform.
Some senior MMD officials launched personal attacks on Mr Banda. These officials, principally former Defence minister George Mpombo and, to some extent, former Ffinance minister N’gandu Magande sought to exploit the situation by portraying Mr Banda as a weak leader and an outsider.
Slowly, these dissenting voices are being silenced by the growing support for Mr Banda both within the MMD and across the country.
The institutional paralysis in the MMD was compounded by the acrimonious and confrontational political climate in the country. The sense of disarray in the party deepened following its loss in the Kasama and Solwezi by-elections.
A coalition of hate against Rupiah Banda
Mr Banda’s legitimacy as Republican president was systematically undermined by the opposition. Soon after the president took office, a coalition of the disaffected was formed comprising sections of the media leading opposition figures, civil society groups and some church leaders.
The coalition launched a calculated smear campaign to incessantly and constantly attack and ridicule Mr Banda’s leadership in order to de-legitimise him in the eyes of the Zambian people.
The president has been portrayed as a weak and intolerant leader who is bent on holding onto power at all costs.
Consequently, the political atmosphere in the country has been dominated by hate speech and confrontational language, depicting the Government and ruling party in very bad light.
The MMD has been on the defensive and, until now, has struggled to fight off opposition attacks. Relations with the church, especially the Catholic Church, have also been strained.
An issue, which the coalition has sought to exploit, has been the question of fighting corruption. The coalition has attempted to create a public perception that the current MMD government is very tolerant to corruption.
Tied to corruption allegations has been a deliberate attempt to portray Mr Banda and his Government as failing to uphold the legacy of the late president Mwanawasa.
The Renaissance in the MMD
President Banda has used his diplomatic skills to assert his leadership over the MMD. He is now firmly in charge and leading the rennaisance within the party. Fully aware that a new strategic direction is pertinent to the MMD’s survival and preparation for 2011, the president has encouraged the party to engage in honest self-criticism and self-revival to make itself battle-fit for the 2011 election.
To its credit, the MMD has performed so well in managing the economy in the last one year that no opposition party can fault the policies. With the rebound in copper prices, coupled with prudent economic management, the Zambian economy has not only proved resilient during the global financial crisis but also grown beyond expectations.
The MMD has now started building on this good record and local people are seeing and appreciating schools, hospitals and health centres being built in their areas.
The recent presidential trips to Luapula Province, Ndola and Mazabuka to inspect development projects, and where the MMD was electorally weak, bear testimony to the growing groundswell support for the governing MMD.
In Luapula Province, which the MMD lost to the PF in the 2006 elections, ever growing huge crowds turned up to welcome and greet President Banda at the airport and in Mansa, Chiengi, Mwansabombwe, Samfya, Kawambwa, and Mwense.
The PF leadership, which had previously warned that the people of Luapula would not welcome President Banda, recoiled in shame and embarrassment.
In Ndola, the same spirit prevailed. A huge cheering crowd waving the MMD symbol gathered at the airport to welcome Mr Banda. The president did not disappoint.
As soon as he disembarked from his plane, he gave an impromptu speech promising that his Government would ensure that they received quality public services.
The president further directed the minister of Local Government and Housing to ensure that non-performing PF-controlled councils on the Copperbelt were immediately audited.
In Mazabuka, the supposedly UPND stronghold, a huge crowd turned up at Chief Mwanachingwala’s palace to welcome President Banda.
There is no doubt that the recent prresidential visits have given impetus to the MMD leadership to revive the giant within the party.
A re-awakening MMD is taking advantage of one of the major weaknesses of the opposition. For instance, the PF and UPND leadership’s failure to articulate a clear vision for Zambia’s development.
Apart from their stated intention of removing the MMD from power and their addiction to insults, the PF-UPND Pact has failed to state publicly what it will do to improve the welfare of Zambians. This leaves the MMD as the only party with a clearly articulated vision on how to move Zambia forward.
Although it was initially thought that the MMD might face a formidable opposition in the 2011 elections, this is not likely to be the case.
The recent presidential visits to Luapula Province, Ndola and Mazabuka show that the tide is quickly turning against the opposition.
The MMD should seize this moment to explain to the people of Zambia what the Government is doing across the whole country.

There is nowhere on this blog or in the Kafupi press lies were it has been mentioned that Sata money. Putting in another or new account to accrue interest does not mean that someone stole the money. The money was sent back to the Ministry and as far as I can remember this issue was mentioned by people in the MMD circles and hushed down because the money was in the hands of the Ministry even at that time. I have not heard anyone mention Thandiwe’ GHOST WORKER issue as theft. The only link Sata had was that he was a shareholder at Standard Chartered Bank. Kafupi wanted to exploit this link to punish Sata. Tha is why the DPP could not proceed with the case. It was the ACC that recommended Sata to be prosecuted. ONCE AGAIN – THE DPP DID NOT – NEVER GAVE THAT AUTHORITY TO PROSECUTE. If the said money was deposited in an Investment Account belonging to the Council it shows sound financial management – in my view. Why should you keep such a large amount in a non-interest bearing account when you can earn interest by putting it in an investment account? In 1992, assuming that the interest rate was 15% per annum, investing K1.2bn in a 45 day investment account earned the council K22,191,780.82. Any Finance person would say this was prudent financial management – that it came from a politician would did not have a first degree – marvelous.

Musonda Mwansa #96, Chiluba kept Sata in MMD because he needed him as an attack dog against Chiluba’s perceived opponents – and it worked for him — Levy ended up quitting out of frusatration over this issue. This is also the reason why Chiluba is so convinced that one Michael Chilufya Sata should not be allowed to run Zambia. He is good at following orders without question. Now, if you want to take Chiluba to Court for failure to prosecute Sata, that is your business and you are free to do so. Unfortunately, what they have smelled is mere water … Rodger Chongwe, who was Minister of Justice then, has just said that him and other government leaders did not find any case against Sata. Chiluba knew about this. I am not surprised why William Banda was once deported to Malawi; he is one kind of old man who can cause political conflict in the country. I do not think the Malawian government would tolerate this behavior.
