Michael Sata dares government to prosecute him over the K1.2 billion.

Patriotic front President Michael Sata has dared government to go ahead and prosecute him over the K1.2 billion 1992 corruption case.

Reacting to a story in today’s Times of Zambia, quoting Lusaka Lawyer Hopeday Kabwe as suggesting that the case in which the Anti-Corruption Commission (ACC) in 1992 probed him for alleged financial misconduct involving K1.2 billion when he served as minister of Local Government and Housing can still be resuscitated for prosecution, Mr Sata accused second republican president Fredrick Chiluba of being behind the whole issue.

He told QFM in an interview that Dr. Chiluba is determined to destroy him politically by using the K1.2 billion case. Mr. Sata however said that Dr Chiluba will not manage to destroy him because he had failed to do so in the past. He added that Former President Chiluba had in the past tried by all means to prevent him from contesting the position of MMD National Secretary, but failed.

The PF leader has since dared the MMD government to go ahead and prosecute him over the K1.2 billion, other than using small organizations to champion the cause.

The Anti Corruption Commission last week acknowledged investigating the matter involving Mr Sata for financial misconduct involving K1.2 billion when he was minister of Local Government and Housing.

Mr. Sata allegedly directed his officers to deposit the funds in a special 45 days investment account at Standard Chartered Bank contrary to financial regulation number 10 of 1992.

  3. I remember this case very well, let’s prosecute Zondwe. But we should also prosecute Chiluba for blocking the prosecution in the first place. I mean, Kafupi confessed at his kangaroo news conference that he spared Sata. Lekeni nomba lunye lwakwa Noah bebele, alah!

It shows how scared everyone is of Sata. Should he win the 2011 election, it will revolutionise Zambian politics and I think for a change the ordinary Zambian on the street will see real benefits.

    A LUSAKA lawyer has said the case in which the Anti-Corruption Commission (ACC) in 1992 probed Patriotic Front (PF) president Michael Sata for alleged financial misconduct involving K1.2 billion when he served as minister of Local Government and Housing can still be resuscitated for prosecution.

    Hopeday Kabwe said in an interview yesterday that despite the number of years that had passed since the matter was investigated by the ACC and forwarded to the Director of Public Prosecutions (DPP) for consent to prosecute, it could still be brought back for further action.

  30. “Under criminal procedure, there is nothing like a case expiring, if a prima facie case can be proved beyond any reasonable doubt the matter is prosecutable.
    “What is important is to know what happened at the time.

    A search can be conducted at the DPP’s chambers to know what stage it was at. If it had remained under consideration it could be restarted,” Mr Kabwe said.

    He explained that at times, for example if a DPP had left office, a case could remain pending, so it would be necessary to know what happened in Mr Sata’s case.

  31. The ACC last week acknowledged investigating the matter involving Mr Sata for financial misconduct involving K1.2 billion when he was minister of Local Government and Housing.

    ACC director-general Godfrey Kayukwa said in response to a Press query, that Mr Sata allegedly directed his officers to deposit the funds in a special 45 days investment account at Standard Chartered Bank contrary to financial regulation number 10 of 1992.

    After investigating the matter, the ACC recommended to the DPP that Mr Sata be prosecuted for abuse of office and for corrupt practices contrary to Statutory Instrument number 210 of 1987 under the Corrupt Practices Act.

  32. Meanwhile, Committee of Citizens executive director Gregory Chifire has challenged the PF leader to explain what happened to the US$27,000 that was confiscated from him by South African authorities.

    Mr Chifire said yesterday in an interview that as a person who was aspiring for the presidency, Mr Sata should be sincere enough and explain what happened to the money.

    He said Mr Sata had told authorities in South Africa that he was paid the money for consultancy services but wondered who could pay such a huge amount in cash.

    Mr Chifire said if Mr Sata failed to explain the source of the $27,000, he should step aside and let others lead the PF.

What is prosecutable and winnable is a case against Thandiwe Banda who was getting paid years after she left the Teaching service.     OVER 100 opposition Patriotic Front (PF) youth have abandoned their party to join the ruling MMD in Kitwe.Welcoming the new members yesterday, Copperbelt MMD chairman Joseph Chilambwe advised MMD leaders in the district to embrace the former PF members.Mr Chilambwe, who was addressing MMD members from Kamfinsa constituency at Ndeke High School yesterday, commended the PF youths for joining the ruling party.“You have come to the right party that has an agenda for all Zambians. Our friends, the opposition leaders, don’t have any agenda for the development process of the country. All they know is insulting President Banda and his government for nothing,” Mr Chilambwe said.

    He said the MMD on the Copperbelt is united and that the party will perform well in next year’s general elections.

    Mr Chilambwe said opposition political parties that are insulting President Banda have also benefited from the government’s policies.

    He said Zambians are rejoining the MMD because the opposition leaders have got nothing to offer to the country. “We don’t want anyone to discriminate our colleagues who are joining us from other political parties.

    And speaking on behalf of the new party members, Richmass Bulaya said over 100 PF youths have resigned from the opposition to join the MMD.

    “There is no empowerment in the opposition. Meetings to find the way forward on the problems facing us cannot be organised. We want to help President Banda win the 2011 elections because he is hard working,” Mr Bulaya said.

  47. And MMD youths in Mazabuka have advised opposition United Party for National Development (UPND) president Hakainde Hichilema to stop his blatant attacks on Chief Mwanachingwala of the Tonga people.

    MMD district vice -chairperson Golden Choompya said in a statement to ZANIS in Mazabuka yesterday that Mr Hichilema and his UPND leadership should immediately stop attacking Chief Mwanachingwala but concentrate on resolving his (Mr Hichilema) party’s internal differences.

    Mr Choompya said that it is sad that the UPND leadership at all levels has chosen to attack the chief for declaring his support for President Banda.

But it took me working for the Lusaka City Council when I found out that actually if you are lazy you will hate Sata for the rest of your encounter with him. He doesn’t like and he’s got no time for lazy people. If you are someone who gets paid for what you do and correctly and hard working, Sata will never bother you. MMD are scared because they know he will come to sweep Zambia clean once in office. And this is what they don wanna face. Expect many laws aimed at Sata as an individual.     The Church and Zambia’s oldest political party have joined various civil society organisations loundly calling for the re-opening of the docket, UNIP have also joined in the calls for upright leadership.

    The MMD said the docket to prosecute Mr Sata was still active going by recommendations of the ACC to prosecute him for abuse of office and corrupt practices and wondered why he had not been prosecuted.

    And Mr Banda has challenged Mr Sata to furnish the nation with full details of a house on Nakatengi Road in Lusaka’s Libala Township.

    His office has declared that they are ready to handle any form of violence that might be planned by the opposition.

  59. Forum for Leadership Search (FLS) and the Committee of Citizens have challenged Transparency International Zambia and the donor community to state their position over allegations that Mr Sata was involved in some malpractices as the ACC had recommended his prosecution.

    FLS executive director Edwin Lifwekelo said the case involving Mr Sata should generate interest from Zambians who he said should know the kind of person vying for high political office.

    He said while other citizens facing similar allegations were being prosecuted, it was surprising that Mr Sata was left free despite the investigations suggesting a recommendation for prosecution.

    Mr Chifire said Zambians who were the owners of these resources demanded to know the truth of the matter.

  63. “We as a non-governmental organisation (NGO) wish to indicate our intention to pursue this matter by taking it to court,” he said.He said as a Committee of Citizens, they intended to sue Mr Sata as first respondent, the attorney-general as second respondent, and the ACC as the third respondent so that justice prevailed.

  64. UNIP acting general secretary Jemima Banda said Mr Sata’s file should be re-opened and urged the ACC not to segregate when prosecuting suspects.

    In an interview yesterday, Ms Banda said those aspiring for higher office must be transparent and in an event that they were found to be involved in criminal activities, the law should visit them as no one was above the law.

    “ACC should go ahead, because Mr Sata has been calling other people thieves, so even him should be prosecuted. If you live in a glass house, don’t throw stones, if found clean then better,” she said

  65. She said this was the best time for the file to be re-opened so that Mr Sata could be prosecuted and the case disposed of before the commencement of next year’s elections to allow people to know the kind of person they were voting for.

    Former United Church of Zambia Copperbelt presbytery bishop Committee Njase urged politicians vying for the Republican presidency and other public offices to ensure that they were associated with integrity and not corruption.

  98. Sata committed no crime over that K1.2bn – Chongwe

    LUSAKA lawyer Rodger Chongwe yesterday said Patriotic Front (PF) leader Michael Sata committed no crime in the matter that was investigated against him by the Anti-Corruption Commission (ACC) in 1992.

    ACC director general Godfrey Kayukwa was last week quoted in the state-controlled Times of Zambia as confirming that when Sata served as local government and housing minister in 1992, he allegedly directed his officers to place K1.2 billion government funds into a special 45 days investment account at Standard Chartered Bank contrary to financial regulation number 10 of 1992.

    But Dr Chongwe, who was justice minister at that time, said yesterday that Sata had only made a technical error.

    “Government always deposits its money…

  99. “Government always deposits its money into the Bank of Zambia (BoZ) and Sata had done that because he wanted that money to earn interest for the ministry,” Dr Chongwe said. “And when it was discovered, the money wasn’t even there up to one month when it was discovered.

    The government told Sata that the money should be returned, so the bank returned the money to the Bank of Zambia.”

    Dr Chongwe said the ACC through its chief investigator at that time investigated the matter.

    “At that time the late justice Robert Kapembwa was the chairman of the Anti-Corruption Commission, Ali Hamir was the Attorney General and I was the Minister of Justice. The matter, after investigations, it was reported to the Attorney General.
