NDOLA businessperson Terence Findlay yesterday told a magistrate’s court that he reluctantly lent K10 million to former Defence minister George Mpombo.
He told chief resident magistrate Kelvin Limbani that on December 11 last year, Mpombo asked him for K10 million.
Mr Findlay, of number 5 Mulombwa Close in Northrise, Ndola, said after allegedly dodging Mpombo for a while, he finally instructed the cashier at Colwyn Limited, Clementina Mubanga to give him K10 million in his presence.
He said he gave Mpombo the money on condition that Mpombo left a post-dated cheque in the same amount for December 18.
It was alleged that on December 18, with intent to defraud, Mpombo, of number 5 Katonde farm, issued cheque number 000014 to Colwyn Limited for K10 million on an insufficiently funded account drawn on Standard Chartered Bank account number 0100120696200.
On December 17, Mr Findlay said Mpombo phoned and asked him not to take the cheque because he would take the money to him in cash on Saturday.
Mr Findlay said he refused and advised Mpombo to deposit the money in his account so that the bank could honour the cheque.
He said he was eventually informed that the cheque had bounced and that he instructed his workers to take the matter to the police.
The matter was taken to the police on January 5 this year after which somebody called that Mpombo had delivered K10 million which he refused as the matter was at that time before the police.
Colywn marketing and sales manager Sydney Makwaza eventually got the K10 million from the police station.

Mr Mpombo said he was surprised that Mr Findlay reported him to the police for issuing a cheque which had not been honoured.
He said he had promised to pay back the money as agreed with Mr Findlay, but experienced some hitches in his bank account.
“First of all, I am surprised that a person I have known for some time can do that to me. I did not refuse to pay the money. I borrowed the money to repair my two tractors. It’s only that I had a bit of a problem in my account,” Mr Mpombo said.
He said he had taken long to pay the K10 million because the people who bought his animals only paid him on Monday afternoon.

Mr Kapeso confirmed the case was withdrawn after Mr Mpombo paid Mr Findlay the K10 million.

I had problems extracting money from Findlay years ago. He was known as the guy who would run away even though he had the money and he was loud mouth and brutish. What goes around, eh?
Findlay was unnecessarily cruel and harsh to someone he knew, a public figure and I think he was all out to embarrass and hurt him. Let’s be honest, we all have people we trust as friends and acquaintances who we go to for help and sometimes things don’t work out like in this case, do we rush to the police? There is more to this than meet the eye.
Countrymen, is this prosecution in the public interest? I only ask this because to me, the case does not signify the spirit of the law. My limited understanding is that the law was meant to stop people from issuing ‘rubber’ cheques for goods and services supplied. As taxpayers, are Zambians happy for their money to be used in prosecuting this case?
This is all about soe politicans out to get each other over some stupid transaction!
Why take the matter to police but still get the cash from the guy. What point is he trying to prove here when he has got his money back already? What financial gains would Findlay get by spending time and money prosecuting Mpombo when he already has got his bloody K10M back?

Dont condemn Findlay.The story isclear he reluctantly released the money.There must be a history of Mpombo having defaulted,it is the only reason he must have deposited the cheque.Now this Mpombo all those years he was in Govt all he has to show for it is dictionary English?Very foolish
This case is a non starter, even i can win this case with the little skills remaining in me. George the duicker told Terence not to deposit the cheque but he did any way. So you cant blame George as he made an effort to warn This Findlay
Was there a contract signed? and where there any taxes paid?
The Magistrate should quash this case out and charge Findlay for wasting the court’s time. He himself has testified that Mpombo told him before the due date that he should not deposit the cheque. How can there be an intent to defraud when you tell someone not to deposit the cheque? isn’t that an intent NOT to defraud? No wonder the man was shaging young girls, his thinking is quite shallow.
Looks like we will be seeing a deformation of character case. Since Mpombo told him earlier even before the date arrived that he will give him cash. He didnt refuse or delay no. MPombo is wining this case unless there is justice denied.
Anyhow what is justice? will see what the courts will determine.
The Fact that Mr Terence Findlay eventually accepted the money really nullifies the fraud aspect. Then again taking into account that Mr George Mpombo informed Mr Findlay of the change in the earlier agreement which Mr Findlay agreed to but later ignored, that should be sufficient evidence to acknowledge the intent of not wanting to defraud Mr Findlay. This case is more of a breach of contract than a criminal offence
The most important thing here is that Mr Mpombo informed Mr Findlay a day before the payment was due not to cash the cheque instead he will pay Findlay cash. What is wrong with that mmm? making mountains out of anthills. MMD’s dirty politics always playing dirty.
The case is there, and George will have to defend himself well. There is no constitency in Mpombo’ s defence that he phoned Findlay, so that he does not deposit the cheque which was due on December 18. All Mpombo should have done was to deposit the money in the account on the morning of DEC 18 or phone the bank to hold on to the cheque. And then he says ,he istructed his manager to withdrawl the money for onward delivery to Findlay. From which account did he withdrawl because the account in question had no money ,the reason the cheque bounced. One person in this matter is a liar.

When she went to the high school she changed her name to Jane Hardy. There was also Dennis Banda who did the same- he became Dennis Brown.Why did they have to do that? Racism, they did not want associate with black people.

Kelvin -By the way I have few colored nephews and nieces through my sisters marriages to white men so Iam not a racist. Just as we the Luundas of Luapula are not keen on marrying Ngumbos fro Bangweulu. It is not tribalism, its just that we dont agree with some of their MISANGOS.
