Chief Justice was not obliged to greet Sata — Daka

MMD chairperson for Communications and Transport Peter Daka has said it was not obligatory and a must for Chief Justice Ernest Sakala to have shaken hands with Patriotic Front leader Michael Sata.

Mr Daka who is also Agriculture and Cooperatives Minister said every person by virtue of being a human had rights and Mr Justice Sakala had personal rights whether to shake hands with people or not because it was not compulsory.

In an interview yesterday, Mr Daka said Mr Sata should know that Mr Justice Sakala was obliged to accept his personal choice and his refusal to shake hands with him was a personal decision that should not be politicised.

“Chief Justice Sakala has personal rights whether he should greet people or not because it depends on what he wants based on his individual capacity and why should Mr Sata politicise the whole issue.

“He should stop making politics whenever he goes for funerals and should have respect for everybody,” Mr Daka said.

Mr Sata should know that Mr Justice Sakala was a respectable person in the country because of his high integrity and he should desist from dragging him into cheap politics.

He said it was time Mr Sata thought of retiring from active politics instead of attacking high ranked officials for no apparent reasons and always wanting to gain political mileage whenever he went for a funeral.

And former Patriotic Front (PF) secretary general Edward Mumbi has accused the PF/UPND Pact of conspiring with The Post to instill fear in judges and neutralise the independence of the Judiciary.

Mr Mumbi said in a statement yesterday that it was immoral to attack people who could not defend themselves.

He was also commenting on the story that the chief justice refused to shake hands with Mr Sata.

He said objective people could read through a conspiracy by the pact and The Post to discredit the chief justice because his refusal to greet anyone was not newsworthy.

“People will soon see discredited people who will be used to discredit the judiciary. These criticisms are merely serving selfish political ends for leaders in the PF/UPND Pact,” he said.

He said the PF/UPND Pact was planning to disturb the Judiciary as Zambia approaches elections because there was a plan to defame people and engage in violence, which would attract litigation.

President Banda said to justify the conspiracy, The Post had even gone to an extent of publishing a picture of former president Frederick Chiluba shaking hands with Mr Justice Sakala, which had nothing to do with the case at hand.

He said when former Kasama MP Saviour Chishimba petitioned Mr Sata’s presidential candidature, Mr Justice Sakala was still the chief justice and the courts allowed him to contest.

The PF leader recently won another case in the courts and he praised the courts for their independence but because of his inconsistency he had now changed.

And a Lusaka lawyer Christopher Mundia said the encounter between Mr Justice Sakala and Mr Sata did not warrant political insinuations because the two were traditional cousins.

“I have known the current chief justice for many years having worked with him closely in the national group and do not believe that he intended to offend Mr Sata but purely a light moment between the two cousins as Bembas and Ngonis have always joked at many funerals,” he said.

Mr Mundia said to use the encounter to embarrass the chief justice was unfortunate because political hatred brewing in the country could later explode to unimaginable magnitude.

Although the incident happened at a funeral, the Law Association of Zambia (LAZ) should do everything possible to defend the Judiciary.

He said the chief justice did not mean to offend Mr Sata but it was just a light moment between the two traditional cousins.

  1. The Chief Justice must not be a carder or a thief Justice or Chief Injustice. Can you understand the line between a chief Justice and a carder. This man does not deserve his job. Education and experience has failed to educate him.

Daka has spoken the truth.The behaviour of Sata at the funeral was unacceptable.No cultured person anywhere in the world will go at the funeral and demand to have handshakes to whoever is present,Sata is a disgrace and will humiliate us on international visits cos of his lack of etiquette.Thank God he will just do his Malabishi in Zed and entertain his followers.

    What is so special to shake hands?”hello” is enough without shaking hands.Period.

Though it is not possible to practically greet everyone at the funeral, the Zambian culture demands that when you get to the funeral house or service for that matter, especially of a close relative or important person, it is important to greet people as a sign of expressing your condolences and that you mourning with them. So what Sata did was Zambianly right because the “Thief Justice” was seated in front and in this case was regarded more like THE CHIEF MOURNER since the deceased was a key member of his team in the judiciary. You see!! You sound like those people who just go to funereal to drink tea and eat nshima without showing remorse to mourners.

As Rahm Emanuel, Obama’s chief of staff, said of BP’s CEO Tom Hayward when he said he wanted his life back, the CJ will never get another lesson in PR. A handshake does not hurt baba. In this whole saga, people’s sympathy will favour Sata. The CJ just showed how arrogant he is even towards people of his equal status. Ask yourself how treats the low of the low.

Hate him or love him , Sata is a factor in the Zambian politics.The problem we have is that , we are dealing with a very gifted people who at least cannot not be bought and always stands his ground! He would rather go to court and defend himself than pleading for mercy or becoming gravely ill to avoid justice! We all have rights as human being but people who hold certain positions in society should conduct themselves in a decent way if they are to preserve their integrity and that of the office they hold. In our culture if someone extends a hand to greet you we respond accordingly so Sata was not wrong but the CJ clearly showed how political he is taking things. Just greet him despite the differences. Thats the problem i have with our country when you DIFFER in opinions it means you are enemies, grow up. I think the behavior is childish period. This concept of his hands are dirty or whatever is b-ull-s-h-i-t. Mukazigula ma sanitizer or simply go and wash your hands later.     Defination of etiquette: Rules of acceptable behavior: the rules and conventions governing correct or polite behavior in society in general or in a specific social or professional group or situation

    They dont have to be written but known.Does Sata ha one? the behaviour speaks the opposite and my concern is that he is aspiring for the Presidency of Zambia,so he needs to know.Iam not behaving like I know something like you have put it but simply pointing out the unacceptable behaviour of him at the funeral.

  36. #22 I believe where you come from there are norms and customs that people follow. I doubt whether you have such norms or customs or they are just lost in UK. Whenever, you go to the funeral it a norm to greet those who are there before you as a sign of respect regardless of your differences. If Sata has not greeted CJ it would have been another story. People like Mumbi cannot survive without politics of poverty and if we recall Mumbi was sent to SA to monitor the printing of Ballot papers he never reported anything to PF and all what they saw was Mumbi with a brand new Benz which he can’t afford to buy. Equally he became arrogant. Bembas and Ngonis are tribal cousins and what has happened will not make any difference. Daka needs to show patience and to choose words for his cousin Sata.

There are certain obligations offices impose that their bearers must always fulfil regardless of how they personally feel about it, if they are to execute their functions as expected! At that funeral, Mr. Sakala bore the office of Chief Justice, and it certainly was incumbent upon him to behave civilly and professionally to all those who came to mourn.
    Peter Daka, and all those emotionally and politically supporting Mr. Sakala’s behaviour are missing the vital point, therefore.

  50. The Chief Juastice whereever he is or goes carried the stature of his Office just like a President or any public figure. If he acts a vagabond you cannot say thats his private life. Well the mentioned above want to lead a private life then they should not aspire for public life and be paid tax payers money. Simple logic. If you have a president who marries a toddler, you cannot say thats his personnal life. We shall talk about abuse of a minor. Full stop!!!
