
Heritage Party (HP) president Godfrey Miyanda has said Chief Justice Ernest Sakala is not obliged to shake hands with Patriotic Front leader Michael Sata because greeting is a personal choice.
Brigadier General Miyanda also said that claims that the refusal by Justice Sakala to greet Mr Sata implied that the chief justice will scuttle Mr Sata’s 2011 presidential ambitions were off the mark.
The general also wondered why eminent people like Michelo Hansungule and John Mambo had joined the melee to add credibility to an otherwise empty noise at a funeral.

He said to accept or not accept a greeting was a personal matter and that there was no need for Chief Justice Sakala to apologise to anyone.
General Miyanda was commenting on the greeting row that erupted after Chief Justice Sakala allegedly refused to shake hands with Mr Sata at the funeral of justice Peter Chitengi.
“What has happened to Zambia? Why should a mere greeting become a serious political issue and be turned into a national debate?
“There is no need for the chief justice to apologise to anyone unless he wants to. Since when did greeting become a duty?” he asked.
He said several opposition leaders had been rejecting President Rupiah Banda’s invitations to State functions because it was their right and that no one must make an issue out of it or make it a duty.
Gen Miyanda said Mr Sata’s statement that the chief justice would scuttle his 2011 dream was divisive and based on speculation.
“How can a refusal of a greeting interfere with ballots? Is it the chief justice who votes in all constituencies or does he carry ballots in his pockets? President Sata must provide cogent evidence or else withdraw this divisive statement,” said Gen Miyanda
He said Zambians must reject Professor Hansungule’s new definition of multi-party politics.
He said the idea of forming many parties suggests that people see matters differently and that they might reject even a greeting that they perceived not genuine.
He said Prof Hansungule was wrong to suggest that funerals were gatherings for reconciliation.
“We have several contentious issues facing our country, including the constitution-making process, the electoral process, security, tribalism, regionalism, poverty etc. Does the professor suggest seriously that we should all go to funerals to resolve these issues and for SACCORD to move its headquarters to Leopards Hill Cemetery?
If the 50 per cent plus one issue was tabled to be resolved at a funeral, there will be no reconciliation but fist fights and gnashing of teeth,” he said.
Gen Miyanda was also surprised that Bishop Mambo supported Prof Hansungule and added that a greeting might just be an act to dupe a naïve person into believing that one had found a friend.
“The bishop and most likely the professor know of one Judas Iscariot who hugged Jesus Christ just before he sent him to the gallows!” he said.
He said Zambians must remember the purported reconciliation between President Sata and late president Levy Mwanawasa.
“A lot of fanfare was made after the secret get-together. President Sata has declared that the reconciliation was a “gimmick”. Was Mr Sata’s greeting at St Ignatius also a gimmick?” he wondered.
He recalled that when Mr Sata went to greet him outside St Ignatius Church, he extended his hand voluntarily because he accepted the greeting.
“No one forced me that is how it should be although I did not like to be hugged,” he said.
He has called upon lawyers and Zambians to roundly condemn what he termed pettiness.

We know that to capture attention, Sata went nemafi in his nails and on the jacket to smear the CJ. Who would tolerate that nonsense and uncultural behavior? It is not true that the majority are always right. In addition, there is also what is called “the dictatorship of the majority over the minority”. Gen Miyanda has previously impressed me with his sober and deep thinking. On this matter, however, I think he has missed it. Mr. Sakala, as a private person had every right to reject anyone’s handshake. But I firmly believe that Mr. Sakala, as Chief Justice, did not have that luxury. when the body of late judge arrived and was placed at the back of the church in readiness for service sata walked in with lubinda. the church was seated sata headed to the front seats but was restrained by ushers who showed him were his seat was he refused then went to were women were seated and asked them to give him and his officails space. there was small drama as the women didnt want to move since the church was full to capacity. sata began his comedy going round the benches esp those occupied by judiciary and lawyers clearly he had mistimed his greetings. sata started to prounce about asking for laz presido and AG there were murmurs everywere about this misconduct. he started asking for chalwe farai mchenga calling for DPP that he needs to know him that he is the only lawyer he doesnt

I am rather surprised at the twisted reports relating to the encounter between the Chief justice, His Lordship Ernest Sakala and Patriotic Front (PF) leader Mr. Michael Sata.
I am also shocked that an encounter between two parishioners has been blown out of context and is now a dirty excuse and evil plot to scandalize and remove Chief Justice Ernest Sakala.
Following the valedictory service at the Supreme Court for the late Supreme Court Justice, His Lordship Peter Chitengi, we all rushed to Catholic Church at St. Ignatius, where the requiem service was to be held at 10:30hrs. This was on 23rd June 2010.
When we arrived we all took our seats with the Chief Justice, Ernest Sakala taking the first sit on the front pew with his fellow Supreme Court Justices and some government officials such as Minister of Defence, Dr. Kalombo Mwansa
I agree with Miyanda infact the ministry of health had issued Cholera alerts prior to the funeral effectively burning or unneccessary greetings including those Sata is fond of
The entire rows behind were taken up by mostly, High Court judges, members of the Judiciary, and members from the Attorney General and Director of Public Prosecution (DPP) chambers. Some ministers such as Mike Mulongoti and Kenneth Konga sat on the benches with family members.
When the body arrived and was placed at back of the Church in readiness for the service, Mr. Michael Sata walked in accompanied by Given Lubinda and other PF officials.
At this stage, the entire church was seated and almost silent. Mr. Sata headed straight to the front seats but was quickly restrained by ushers who showed where his seat and that of his officials were.
He refused. He then went where some women were seated and asked them to give him and his officials space. There was some small drama as the women appeared reluctant to leave their seats as the church at this stage was full to capacity. This situation was only rescued by the ushers who insisted that Mr. Sata and his officials had his seats allotted to them. He was led to these seats.
It’s at this stage that Mr. Sata began his drama. He began to go around the benches especially those occupied by the Judiciary and lawyers. Clearly he had mistimed his greetings. Usually at a funeral service, such open interaction is left for outside after the body viewing which is after the service. Mr. Sata ignored this decorum and appeared desperate to be recognized by everybody and to establish his presence.
Mr. Sata began to prance about asking for Law Association of Zambia (LAZ) President Stephen Lungu. Lungu was seated with Attorney General Abyud Shonga.
There were audible murmurs about this conduct.
Probably as a Chief Mourner, the Chief Justice was disgusted with this conduct which does not fit with the status of Mr. Sata and showed his disapproval by not extending his hand to greet this excited politician.
It is not up to me to justify the open disdain shown by the Chief Justice against Mr. Sata, but my guess would be that the disapproval was not to Mr. Sata but his open misconduct at a funeral of dear colleague.
But the mummers were heard everywhere. Many were wondering. How could a leader seeking the highest office in the land disregard the mourning environment and traditions of a somber gathering like a funeral and preoccupy himself with selfish activities designed to give him cheap publicity?
Even when he was not greeted by several people or some chose to ignore him totally, Mr. Sata went about repeatedly visiting these benches. At one time, he came to these benches loudly calling and asking “where is Chalwe Farai Mchenga?” he kept on calling for the DPP demanding that he needs to know Mchenga as he is the only lawyer he doesn’t know personally.
Please Zambia motherland, lets talk about real issues at hand, Sata / CJ are personal issues! This nation will never progress if we have pipo with such minute way of reasoning, who cares if Sata was hurt when the CJ refused to greet him, this country does not belongs Sata alone but to Zambians. By the way SATA wont be here in the next 50 years, can we concentrate on building a new zambia please napapata! 😕
Clearly the post tabloid deliberately ignored all these matters and fished out facts out of context for their own selfish reasons. It is not surprising that this has now formed the basis of a dirty campaign designed to hound out office a constitutional office holder.
But now The Post is known to make an issue national, when in fact it is a private agenda. This Chief Justice Ernest Sakala is a man they worked well with. His entire Supreme Court Bench once attended a gala night hosted by The Post. The fall-out has been steep and the empire was partially dismantled with Sakala’s loyalties lying with the State and with Justice and not with private individuals.
It’s up to you to be ensnared to a private agenda or make a stop to what “the Post wants the Post gets philosophy”.
It’s incumbent upon LAZ to speak against these open plots and evils against constitutional officers or institutions such as the Judiciary will fall prey to the evil influences and manipulations and will continuously be held hostage by The Post.
We might not like Chief Justice Sakala, but to allow The Post hound out office or willfully participate in schemes selfishly designed to scandalize officials is not acceptable. They have been campaigning for the removal of Vice-President George Kunda, the DPP Chalwe Mchenga, Inspector General of Police Kabonde and that has been resisted and ignored. This scheme falls in that category and is best ignored.

What is our nation turning into? The General has clearly misdirected himself! While greeting or not greeting is a matter of personal choice, in this case the choice was an indication of how petty and vindictive Sakala is. Both not very good qualities in a man holding the Office of CJ. It’s like owning the biggest pub in town when you are the Chief Bishop of the biggest Pentecostal Church in the same town!

#35 I totally agree with you. Sata/CJ issue is a personal one. let us talk about real issues, issues that will help take our nation forward. Can you imagine, 45 years after independence, some people still go about without meals, without clothes, without shoes? Some children can not afford to be in school because their parents cannot afford to pay the fees? These are some of the issues we need to discuss and find a way to improve the situation on – a way to empower all the Zambian citizens. CJ’s refusal to greet Ba Sata is a petty issue. There are so many problems that our minds need to focus on such as poverty, unemployment, water and sanitation, falling educational standards, health etc. For me finding solutions to these problems is what will help Zambia move forward. I also wish to point out that it is very unnecessary to insult one another through such medium. It is better to objectively make a contribution that will build others and not destroy.

I love Gen. Miyanda as a christian and a political leader, however I totally disagree with his view. Is it okay for the CJ to be wining and dining with Chilubas wife, who was convicted and show hatred to Sata who is a major political player. Nowonder the rebel PF members are so protected. The picture tells it all and I am surprised that the Post did not see its implications on their colleague. The man is desperate for cheap publicity. If I were the Chief Justice, I would do exactly the same and more: look the other way. Now if Mr Sata was indeed serious presidential material he would have dignified himself and taken his seat, and waited for the Chief Justice to offer his hand, not the other way round. Rather than vilify the Chief Justice, surely the villain here is “President” Mr Sata, unless your mind is cock eye.
For humble, mature and wise people, a hand shake is a very important gesture. And for a man of the stature of a Chief Justice in particular, it should go without mention that refusing a hand shake in public is scandalous. By virtue of being the CJ, this man is expected not to be petty and to treat all citizens equal regardless of their status, political affiliations or orientation. Failure to do so diminishes the image of the entire judiciary in the public’s eyes; it simply implies that the CJ and his entire subordinates are selective in their way of dispensing justice. Even when he was not greeted by several people or some chose to ignore him totally, Mr. Sata went about repeatedly visiting these benches. At one time, he came to these benches loudly calling and asking “where is Chalwe Mchenga?” he kept on calling for the DPP demanding that he needs to know Mchenga as he is the only lawyer he doesn’t know personally.Sata wanted to settle his political scores with the LAW FRATERNITY at a wrong gathering.Period.
After reading careful MIyanda’s story. I personal agree with him on the point that shaking hands is a personal matter. There is nothing wrong in refusing or accepting handshaking. Even here we don’t usually shake hands. Knodding or waving hands is much appreciated and more hygienically.
Mr Sata might have come to realise that Mr Sakala hates him But he should not fear that the CJ will ignore Mr Sata on national duties like his fear of election malpractice where as voting is in the hands of the voters NOT the CJ.

Surely General Miyanda, are you seriously justifying the Chief Justice’s behaviour in public? Sakala is Chief Justice of Zambia and therefore he is expected to behave in a particular manner. The general started well in his argument but went outside the point when he mentioned about Prof Hansungule said. Hansungule was right when he said during funerals some disagreements become resolved, these are between people not between political parties. He talked about Leopards hill cemetery in a very uninformed, irrelevant context. The general is very confused on this matter. I hope he was misquoted. The chief Justice made an error and Sata has a reason to get worried about how his cases in courts will be handled. Miyanda will die a loner, let him come down to earth.

Can we pause for a moment and ask ourselves a simple question. When we are in court do we go around to greet and shake the hands of the judges before the hearing starts? Of course we don’t because that is against court decorum and every profession has its rules. Now some might say this is a bad example, but you see wherever he is the Chief Justice is a dignified person and carries himself accordingly. He is not gonna condone horseplay, that is simply the stature of his high office. Sata should learn some etiquette otherwise “when” he becomes president he will attempt to hug the Queen of England or even President Obama, which is not accepted practice.
Looks like this Professor Hansungule fellow is only known in Post circles. How come we do not hear about him in academic circles? He doesn’t seem to write research papers like other professors do. When he writes something it is a naughty article in the Post, even landing Mmembe in the coolers for a stupid article which he should have known would land his colleague in trouble. I have not heard about him being selected by the UN, EU etc to sit on a panel of eminent legal persons. How successful is he in the acedemia? Is he one of those acedemic refugees who end up being teaching assistants at some obscure university, while posing for the Post as an eminent professor?

However, most of the other things Gen Miyanda mentioned above are good reflections of what must obtain in our Zambian Society.
I would like to add that let some NGO be formed to help teach political party leaders like Mr PF/Sata MC how to behave in public gatherings.

I have googled him several times on Google Scholar – nothing much, no new publications, a few old presentations. That’s it. I remember this man from the UNZA days.
For once, I agree with Miyanda. Sata is a crook, its in his blood and he cannot help himself. The story of the reconciliation with Levy is a very good example of the serpent nature of this vile character and for one I support Sakala for refusing to shake the hand of a character who will pretend to be your friend in church and be the first to spit vernon in your eyes once you step outside. Besides, doctors found five contegious diseases in Sata and one shouldn’t blame Sakala for being on the precautionary side.

I have gone to the top 25 in the World – I started from UNZA. By the way, it does not matter whether your Prof Hansu teaches at University of Pretoria or wherever – send me titles of his latest publications in peer-reviewed journals. Professors publish in peer-reviewed journals – if they don’t, we do not know them. My area is engineering but I follow other disciplines closely.
