HH appears for contempt

UNITED Party for National Development (UPND) president Hakainde Hichilema yesterday appeared in the High Court for contempt of court following allegations that he sold plots that had been contested through a court injunction.

Mr Hichilema appeared together with Lusaka lawyer Mubambe Muchende for allegedly selling the plots before the injunction filed by a Lusaka business executive was passed.

This is in a case in which Zlatko Vidmar has sued the two for allegedly selling land against a court injunction that restrained them from doing so until the matter was rested.

When the case came up before Judge Florence Lengalenga for continued cross examination, Mr Vidmar’s lawyer Mambwe Chipanzhya applied to the court to allow the plaintiff produce recently discovered evidence, which he said would have a material effect on the court’s decision.

Mr Mambwe said on November 3, 2010 his client filed in a notice to produce the documents that was duly served and acknowledged by the defendants.

He said no prejudice would be occasioned to Mr Hichilema and Mr Muchende because Mr Vidmar will still be cross-examined on the same documents he intended to produce.

But the defendants’ lawyer Noah Dindi objected to the application and argued that it was not tenable at law for the plaintiff to have a second bite after having given his evidence-in-chief.

He said the best option for the plaintiff was to call a separate witness who would refer to the same documents he had referred to. He implored the court to reject the application and allow cross-examination.

In response, Mr Mambwe insisted that no prejudice would be occasioned to the defendants if the court allowed the plaintiff to produce the documents.

Ms Justice Lengalenga reserved ruling to next week but adjourned the case to January 11 and February 1, 2010 on grounds that she would soon start handling criminal sessions.

So in essence what some people are saying is that if anybody related to the opposition is found wanting in regards to the law, the govt should not do anything about it because they will be accused of persecuting their political opponents. This means that any of us should just profess to be either a member of PF or UPND and go on crime spree.

    If HH stole from privatisation,why is is walking freely yet Govt claims to have evidence.Just how did he grab the said land? usual PHD pa Zed.Zambians will stop investing in Zambia with such pettiness.

    Am I the only one missing the trick here?? I thought it is for the courts to decide whether HH was in contempt of the court or not.

    But the excitement by the Times of Zambia and some bloggers on this site clearly demonstrate the now familiar MMD and usual selective, biased Jungle Justice. Pronouncing HH as Guilty until proven Innocent.

    MMD Cadrism has really destroyed any semblance of sanity or Justice in Zambia

  16. The question is why Zambian’s should be giving land away to the Indian’s and Chinese. I support HH on this, because it doesn’t make sense that all the prime land in Lusaka should belong to Indians. Even the issue of who should own land in Zambia needs to be looked at next year. This has gone out of hand, and needs to be put into perspective. HH welldone, do it again if chance arises.

  17. I hate to support HH but I think pls bakolwe na banabo, separate life from politics. HH is just found himself in such a situation. These things are normal in business. It has nothing to do with MMD. He will probably come out and if u have read well, he’s probably implicated on a technicality. 2011 kwisa!! Elyo even if Sata came to power, ba kolwe u will remain a kolwe mu street. He wouldn’t want *****s like u to start terrorising voters. Get real. Ba kaponya will remain ba kaponya. How u even think u will have ministerial positions is amazing!!!

    Those who work 4 mainline GRZ will still be there so there’s still no job 4 u. Only top PF cadres will benefit and if the PACT works, only half of them will even be in GRZ. Wake up!!

On “Ms Justice Lengalenga reserved ruling to next week but adjourned the case to January 11 and February 1, 2010 on grounds that she would soon start handling criminal sessions,” it is sad that the date indicated does not inspire confidence in the conclusion of this matter but I hope there was a typo on the 2010 so that the correct dates read as January 11 and February 1, 2011 in time for next year’s elections.

    It will be interesting to take note of the outcome of this matter just in case HH manages to become Zambian President before the case is brought to a logical conclusion.

  21. If HH sold the plots in contest, let the law take its course, however, if not let him continue preparing for next year. In the quest to support each other as Zambians let us not blind ourselves to some ills that Zambians do and yet if this guy has been paid to defame and detract HH, let us once determined as usch by the courts raise up to condem him and his sponsors. Otherwise, wrong doing should be condemned iregardless of who commits it. Thank you.
