The Drug Enforcement Commission- DEC – has seized two motor vehicles belonging to Patriotic Front leader Michael Sata ‘s wife Christine Kaseba.
This is in connection with the on-going investigations involving the 100 thousand United States Dollars transactions at Finance Bank.
The Commission has seized a Chevrolet and an Isuzu double Cab, both valued at 100 thousand United States Dollars.
DEC Spokesperson John Nyawali confirmed this to ZNBC News in Lusaka today.
Mr. Nyawali said the vehicles were taken to the D.E.C headquarters this morning by Mr. Sata’s drivers and lawyers.
He said that Mr. Sata, through his lawyers was asked to surrender the two motor vehicles which are a subject of investigations to the Commission after recording a second statement from him.

We are the self same people who keep complaining that corruption and crime are rife in Zambia, so when these agencies make a high profile arrest we cry ‘foul!’ Gladys Nyirongo is in prison. Dr Musonda is in court. Former military generals are in prison. This is unprecedented in Zambia. Even under Kaunda, who tolerated no nonsense, we never had people tried or imprisoned like this. The fight against graft is on, and let it be known that there are no sacred cows. If there is no offence committed, Mr Sata will be freed by the courts of law. It is the duty of the executive to investigate and adduce evidence which the judiciary will look at and decide whether there is a case to answer. Let them do their job without fear or favour.

1. The money laundering Act was not enacted during Chiluba’s regime when Mr Sata was part of the government. During that time, all the politicians laundered money. It is against the rules of natural justice to apply the law retrospectively.
2. Dr Chiluba has already been tried for theft (a criminal offence) and acquitted.
3. Dr Chiluba has been convicted of a civil offence of defrauding his country in the British High Court but not for theft.
4. The money that Dr Chiluba ‘claims to be his’ is in a government account. No court has ruled that the money be returned to him.
Every citizen has to be probed if his/her acquisition of property or money is dubious and every right thinking Zambian can support that. But the problem in Zambia these investigations have always been selective and the DEC is simply told when to arrest and investigate people. This has simply gone out of order that now DEC can be influenced by cadres. If only such unstitutions were professional and autonomous maybe things would have been different. FTJ still claims the $8 million in the Zamtroop account is still his yet he has not explained how he acquired that money, for others it is different because they are not in good books with the Govt.. I usually respect your arguments, but here you are showing a naievity that borders on callousness and senseless partisan loyalty. The cmplainant wrote to DEC alleging that Mr Sata paid Bwalya $100k. DEC interviewed Mr Sata who claims that the $100k was for the 2 vehicles for his wife. As investigators, the vehicles will be seized so that they can be verified as the same vehicles that were bought with the said sum of the said monies. It is called ‘collecting evidence’ my friend. The VIN, Engine no. etc all have to be verified. By its very nature, money laundering involves passing illegitimate money through many ‘washing machines’ to get it ‘clean’ on the other end.

At THIS time, Mr Sata has not been charged or arrested for any crime. The DEC are investigating because there has been a complainant. Similarly, if any of you guys thought that someone had stollen your TV set, you went to the Police to complain, how would you feel if the police said that they cannot investigate because the suspect is a ‘high profile personage’ and ‘it would look like persecution? No. It is the duty of the law enforcement agencies to investigate. If there is no offence, so be it but if there is, then justice must be done regardless.
It’s okay to have billions of kwacha in your bank account and nobody will be bothered, but dare to change that into US dollars it becomes money laundering and DEC will be swarming all over you.

Here is how money laundering goes. Suppose one sells drugs and receives $25k in profit. This person cannot put this money into the Bank because the Bank can report suspicious deposits to the authorities. He gives this money to someone with a legitimate business to ‘invest’ in the business, say a Milling company. The miller purchases $25k worth of maize and deposits $30k into his business account. The business man draws a cheque for $25k in the name of the dealer either as ‘a gift’ or ‘consultation fees’ (now that is the most popular!). Now the trail of the money is clear and clean! The dealer ‘buys a car,’ for $15k but the receipt shows $25k and resells it. Now he has money which is obviously HIS own. The drug money has been laundered!

In the UK, The Proceeds of crime Act, covers a wider definition for money laundering and that includes non-cash assets and tax evasion. I suspect that Zambia has modelled its laws after this. This means that Mrs Sata may have to declare the ‘gift’ from her husband, for tax purposes and if she doesn’t she also could be charged under money laundering laws if the source of the money to buy the vehicles was illegal or if legal, under revenue laws. That is how easy it is for a State to fix anyone whom they want to fix. When a State acquires so much power, it is necessary to protect the rights of the citizens through Human rights law, and that should include the presumption of innocence until proven guilty. It SHOULD be incumbent upon the State to ‘prove’ the source of the money!

After DEC returns the vehicles to MC Sata after checking that these are the same vehicles bought from ACTION AUTO, Mumbi should be sued by us the PF supporters for slander and damages to liquidate him. On second thought, the case will be thrown out in protection of a very useful MMD propagandist. So all PF sympathisers, we should donate money into a legally registered account monitored by a group of trustees and buy new vehicles for MC Sata and PF.

More laundered money in PF’s torn pockets! What about the USD27,000 which was impounded from Sata by the authorities at O.R.Tambo airport in South Africa? He claimed it was consultation fee but why hasn’t he gone back to claim it? In almost all countries, including Zambia, one can not legally import or export cash of more than the equivalent of USD5,000. Let the law take its course.

If you have a bank account in Zambia now you know you’re required by law to disclose, among other things, your source of income. If the opposition’s aim is to remove the current government chiefly because it’s perceived as corrupt, does it not follow then that they show transparency? There is no doubt that prosecutions are selective and that is the case in ANY country in the world. The reason is simple. If you expose yourself in any way whatsoever, you are bound to be scrutinised and more so if you aspire to become the President of a country. Indeed, it must be so, because if Mr Sata is money laundering while he is out of office, what would stop him from doing so when he is in power? The case of Chiluba’s money has been exhausted ad nauseum. Dr Chilub will never get ‘his’ money back because no court has ruled that the money should be returned to him, on the contrary it has been proved that he defrauded the government so it is not his money. Those of us who are in Europe know that all the assets from the plunderers have been recovered by GRZ.

As I stated earlier, Mr Sata was once the subject of investigation by ACC. This went on quietly and nobody cried foul. Mr Sata was arrested on allegation of motor vehicle theft by Mwanawasa, under the same ‘un bailable’ offence laws that Sata and Chiluba had enacted. Mr Sata was never investigated for the Mezaf flats scandal. In THIS particular case, a private citizen has complained to the DEC, which if you look at the recent ammendments to the law, DEC now covers money laundering issues and not just drugs, as some ignorantly think. DEC is bound to investigate and get to the bottom of things. If anyone suspects that a crime has been commited, let them write to the right organ to investigate and not to LT, ZW or The Post! Kabimba wrote to DEC about Chiluba’s money and DEC replied.

Are people suggesting that we should have a law for Mr Sata and another law for others like me?
The law for Mr Sata would spare him from investigations by DEC and other organs because he is president of PF and an aspiring presidential candidate. Please read the constitution of Zambia and you will see that Mr Sata is a common man like you and me, and not exempt from the provisions of the law. He cannot have immunities that are not provided for under Zambian laws.
If Mr Sata’s supporters are so sure about him winning 2011, please wait patiently, it’s not too long before he too can enjoy Presidential immunities, not too long before the DEC stops investigating him. Pang’ono chabe just wait, but until then, for the few months remaining before Mr Sata becomes State President he is subject to the full force of the law.
In the meantime just caution your president to behave himself like a Presidential candidate and avoid exposing himself as he is a public figure.
