UPND to appeal against Mufumbwe by-election ruling

United Party for National Development (UPND) has said it will appeal against the Lusaka High Court’s decision to throw out an appeal filed by Mufumbwe Member of Parliament (MP) Elliot Kamondo.

UPND Spokesperson Charles Kakoma said his party was shocked and disappointed by the court’s decision but would continue fighting up to the Supreme Court.

He said it was the constitutional right of every person to appeal against any judgment.

Mr. Kakoma also stated that the party would confer with Patriotic Front to decide on the Mporokoso seat.
The Mporokoso seat fell vacant after the resignation of Maynard Misapa from the ruling MMD to join the opposition PF.

The Mufumbwe seat has not yet been declared vacant after the Lusaka High Court threw out an appeal against its ruling.

Meanwhile the Movement for Multi-Party Democracy (MMD) has welcomed the decision by Speaker of the National Assembly Amusaa Mwanamwamba to declare Mporokoso Parliamentary seat vacant.

MMD Acting National Secretary Chembe Nyangu said the ruling party was also ready for the by-election in Mufumbwe that might arise after the Lusaka High Court threw out an appeal against its ruling nullifying the election of Elliot Kamondo as area Member of Parliament.

Mr. Nyangu said the party was prepared to go into the constituencies to defend and win back the parliamentary seats.

He said the party would soon start the process of identifying potential candidates to stand on its ticket in the by-election in Mporokoso, Northern Province while it would wait for a go ahead to identify a credible candidate for the Mufumbwe seat in North western Province.

Mr. Nyangu said this in a telephone interview with ZANIS from Mongu, Western Province.

He said the party had gone back to the drawing board and had embarked on a membership mobilisation drive at grassroots.

And Mr. Nyangu said his party would focus on issue based campaigns and avoid personal and violent campaigns.

  1. Another expediciously trashable suit. Its like HH didn’t hear that Learned Judge said he is free to appeal but ECZ must immediately hold a bye-election in Mfumbwe becase the appeal will be trashed again. Lets just give PACT to Fr.Bwalya if we have to avert a historic defeat which will leave our presido Sata enter into his final heart attack if he wont keep his word of seeking asylum in Taiwan.

  2. LT, I have completely lost faith and interest in all of my friends. Things have happened that allowed me to make such deductions but honestly i feel completely lonely.
    I used to make lots of friends and had a number of so called ‘best friends’ but now the interest is not there. I just keep in touch with them for the sake of it.
    I feel like as time goes by, i become more and more cynical and pessimistic. Anyone feels like me?Best friends?

    As for “… also stated that the party would confer with Patriotic Front to decide on the Mporokoso seat… Mporokoso seat fell vacant after the resignation of Maynard Misapa from the ruling MMD to join the opposition PF” I am overjoyed that the UPND PACT is alive and is here to stay and will continue even if the PF runs away from the marriage.

    This spirit of discussing any MP by-election party-fielding is good to show PACT seriousness.

  5. Our learned Judge is mis/behaving like real Kaponya. What,then, is the purpose of having a SUPREME COURT?
    Is Judge Musonda going to fund the By-election? What a shame upon the Judiciary!

  6. And what kind of lawyers does UPND have? If it is the legal opinion of Mr Hikainde forced down the throats of the lawyers, no wonder they have not fought the case spiritedly.

  7. UPND and its leasdership should not worst time on appealing but go down to Mufumbwe and kick start the by-election campaigns. The courts won’t help matters, they are all under the directive of the MMD so its highly doubtiful anything positive will come out it. Even the Supreme Court will probably throw the appeal out.

    We have been told the PACT is intact by Kakoma and we would like this to be demostrated by practical acts-in the forth coming elections we would like to see comrade Sata goes to campaign for the UPND candidte in Mufumbwe and HH reciprocates for PF in Mporokoso.

  8. I just wonder what type of judges we have in Zambia. Most of them luck basic common sense. Why should you encourage bye elections that can be avoided when we are remaining with less than a year before we go for general elections.

  10. Judge Phillip Musonda is the worst judicial mercenary to have sat on the benck in Zambia. My word of advise to him is this, please read about former Ghanian president Flt. Lt. J.J. Rawlings and the events of the night of June 30, 1982 when three high court judges and a retired army major were abducted from their homes. Their maggot-infested, charred bodies were later found at Bundase, 30 kilometers east of Accra, Ghana’s capital. If you honestly think that the Chiluba judgement and this Mufumbwe one will go unpunished, you better brace to spend the rest of your life in exile as a refugee when we come to power. Free advise, take it or leave it.

  11. #11 HH sata upnd lawyers are jack mwiimbu and cornelius mwiitwa who is employed by sakwiba sikota. mwitwa still uses minibuses as means of movement and even sits pa bondix. mwiimbu was lusaka town clerk and doesnt even know how a courtroom looks like. these aer the type of lawyers who even fail to secure bail for a client on a bailable offence. good luck as you go to supreme court. kakoma just let PF stand in mporokoso wht talks do you want to hold with pf

If you work odd, long, akward hours and do shifts I just do 8 hours in a day monday to friday and have weekend to myself and family.
