Sata linked to abrogation of Barotse Agreement

Three government documents have surfaced linking Patriotic Front Leaders Michael Sata to the abrogation of the Barotse Agreement of 1964 and de-recognizing of the Litunga as paramount chief of the Lozi people.

The documents are alleged to have been written by eight full cabinet ministers in the former second Republican President Dr. Chiluba’s administration on behalf of the government.

A committee is said to have been constituted to negotiate with the Barotse Royal Establishment (BRE ) representatives on the agreement.

Mr. Sata, who was then Minister of Local government and housing, was among the eight Ministers who recommended to government that based on the enquiry the Barotse land agreement was stale and no longer legal as it was overtaken by event.

Former Patriotic Front ( PF ) Secretary General Edward Mumbi revealed the development to journalists during a briefing in Lusaka today.

Mr. Mumbi availed to the official documents, one of which was written in 1992 when the eight ministers met a delegation led by the Ngambela and members the BRE.

The second document revealed that it was written in 1993 and bared recommendations of the findings to Government and a letter which was written in 1996 requesting then President Chiluba to derecognize the Litunga as paramount chief.

Mr. Mumbi explained that Mr. Sata’s committee of eight full cabinet Ministers slowed government’s attention to the Barotse Land Agreement and was further killed by a letter dated 18th August 1993 which said that the inquiry showed that no judicial process was commenced by the BRE or any other party aggrieved by the proposed amendments in reasonable time.

Mr. Mumbi wondered how Mr. Sata can now claim to support the agreement when he was among the eight Ministers who recommended that the agreement be disbanded as it was stale.

The former PF secretary general challenged Mr. Sata to explain to the Lozi people and all Zambian how the agreement he considered illegal has turned to be legal now that he is not in government.

He urged the people of Western province to seek an explanation from Mr. Sata to task for skimming to dethrone the Litunga in January 1996 by writing a letter to President Chiluba so that the Litunga’s Chieftainship recognition be dropped which Chiluba refused.

Mr. Mumbi has since warned Zambians to be cautious of the PF leader who he described as a popularist politician and danger to the country as he is not decent and honest.

He said will do anything including risking his life to enter state house and asked Mr. Sata to leave issues such as the Barotse agreement to intellectuals and decent people to debate.

He noted that President Banda and his vice President was not in government at the time of the agreement but are trying hard to dialogue over the issue which he said should be commended and supported.

  8. Edward Mumbi is referring to an MMD to events that took place between 1992 and 1993. This is nearly twenty years ago when Michael Sata was in the MMD Government and bound by collective responsibility with respect to government policy then. This happened ten years before the PF was formed. The PF is a different party from the MMD and has a different policy stance on the Barotseland Agreement. So what is Mumbi’s and the MMD’s problem?

  10. Yes ! It is 100% true this document is there. I had just joined the cabinet office during that period. We drafted and printed this document and handed it to the then committe. I am now in the private sector but remember very well.

    This even led to one lozi Senior Cabinet Administrator resign because Sata had called the people of Western Province all sorts of names for waisting government time and money.

    I know sometimes Mumbi is there in for Sata. However, on this one he is correct in Black & White. Sata needs to explain why he has changed his mind.

    This thing of “who said what or did what when…” will not solve the BRE problem.

    Our leadership needs to see the dangers that loom if this conflict remains unresolved. The politicians, whichever party they belong, should put aside self-interests and work collectively to find a solution to this problem instead of polarising each other.

    If all political parties were to embrace and practise the great concept of “One Zambia, One Nation”, we would see a lot more development and prosperity in Zambia instead of the malaise that affects so many of our people today.

I can imagine this document was classified highly confidential, just how did it land on the laps of Mumbi. What I also know is that when this matter was raised at the NEC, it was Aka who quit in disgust and both Ben Mwila and Sikota Wina advised against the idea. Nevertheless, now that its out in the open Sata wanted the Litunga overthrown, he must explain his sudden change of stance. He should also explain why he told Chiluba Chief Inyambo Yeta was part of the bogus coup plot which led to his illegal and malicious incarceration.

He must be foolish if he thinks that his current stand on the BA agreement will win him Lozi votes. Even the most foolish of his followers know that he is not being genuine on this issue. He might have won Luapula votes in 2006 by promising to end Chiluba’s cases, the man he is vilifying today but not Lozi votes. And with that he should never even dream of being the Zambian Presidency. Luckily for all of us in this country.

The f00l in this case is Rupiah Banda who has failed to protect state documents to gain some lost political mileage even when he knows that these cannot only lead to unwarranted violence, he still takes documents that are state house and gives to Mumbi, a person of a lot questionable background as documented that he is a phony who does not even know his real name, let alone what is talks about.

    Its just interesting that Mr Sata recent pronouncement are pro barotse when he annoyed Aka when he was anti. When did he change and why? And i dont think Chiluba can explain that on his behalf.

They are in crips and record audio statements. One of them was Sata’s opposition to any appointment or retention of lozis in the public service after 1991. KK should be tried for treason, it was his government that amended the constitution for selfish reasons. So what if Sata was against it back then, he has obviously realised that he was wrong. Whether Sata abrogated it or not, the fact remains the same, that document was illegal because it covered other areas which are not Barotseland, and the owners of that land never consented to it. What that Litunga and the Lozis did was not good, to include what did not belong to them. Lozis in that document called BA64 included parts of North-western, copperbelt, central and even Southern on pretext that they fought and conqured those tribes to grab land from them. I am not saying whatever was in that document was bad, the only problem I have is Lozis claiming what did not belong to them and even including it in their document, shame on them anyway. No wonder it never worked because it was dubious, done behind other people’s backs.

  62. If that document covered only western province, I would have blamed someone for abrogating it, but as an enlightened person with laws, I say it was for a purpose. Lozis claim that they included territories beyond western province because they conqured those tribes and grabed land from them, but according to UN charter on land issues, you cannot acquire land through fighting others and as such Isreal had to surrender the Sinai Peninsular which they grabed from Egypt through fighting. Secondly humans demands that people are free to choose where they should belong and not one chief or leader to choose for them. SO I CAN SAY THAT DOCUMENT WAS ABROGATED FOR A PURPOSE BECAUSE CERTAIN ISSUES WERE ILLEGAL, DONE BEHIND OTHER PEOPLE’S BACKS. Lozis we are watching you closely.

Being Namwanga, I would say Bembas know the law so well because they fought Ngonis but they never intended to grab land from them and even never bothered to influence them to speak Bemba language. Bemba and Ngonis live in peace sis by side. Secondly, there are so many Bembas on the copperbelt, but you never hear them say they are the owners of the Copperbelt, they really accept that it is for Lambas despite the influence they have. As for Lozis, they wanted to share the country in between by even including people who never consented to be part of them.   67. 1.The BRE agreement issue has come up so let the govt sort it out in a way they deem fit because it’s their responsibility.

  70. A. The source of this documents is known. The question is what level of confidentiality it was given and if it was a Secret document then Mumbi and whoever gave him the document should be cited for abrogatingthe official secrets Act.
    B. Sata was definitely part of this meeting thatrepresented Govt, therefore, the same MMD has just shot itself in the foot for abrogating the BRE Agreement and not one person that sat on it. What if a vote was held, what evidence is there that Sata voted for, against or abstained ?

  75. In the West, leaders seek advice before they comment on issues. Sata should have done the same. He should not have capitalized on the Barotse issue.

    He should have just said “this issue needs to be dealt with by government once and for all. if RB and MMD are failing to deal with it, then they should surrender and leave it to Sata and PF to sort it out.”

    But instead, Sata decided to comment extensively over something which is both a waste of campaign time and post newspaper headlines.

    Sata needs to appreciate the importance of organization and stop parading as a one man show!

    Should the Zambian government allow the smaller tribes (Nkoya’s, Ila, Kaonde, Chokwe, Lunda, etc…) to be oppressed by the Litunga through the Barotse Agreement?

    Should these other tribes not be free and independent to pick their own leaders and support their own development?

This is the reason why whoever comes into power wants to do away with almost everything that the predecessors did. Its not healthy for national developmenet. It is not, any decision made by cabinet has the mark of collective responsibility and therefore the 8 cabinet ministers acted together, including Sata. What is of interest for the Lozis is to find out what the government intends to do about the Lozi separatists?   103. #100 – If MMD is scared of Sata, then this is bad because they already know their enemy and will work to beat him. In 1991, KK did not think MMD would win and he lost. In 2006, Sata was a non contender and he came 2nd. The enemy you know is easier to beat than the one you dont know!

    #104 – If you read the story correctly you will see than this MMD position was a culmination of the Sata led cabinet office committee. Sata and his cabinet crew decided the MMD position. Later on, FTJ rejected their position and refused to derecognize the Litunga. Therefore, Sata was not acting on MMD insutuction. He was part of the architects of the anti-Litunga policy.

Never-the-less, always remember that it is not you who the MMD is targeting. They know you have already made up your mind so you are useless to them.     Even in the USA, Obama never targeted the Arian Brothers or the Texas Red Necks. He targeted areas where people were ready to listen and this is how he won.

    MMD know their enemy and they know how to deal with him and his supporters. Their strategy is to work on the areas that will give them the vote they need to win and this does not mean trying to convince you to vote for them. To them, you are already ruined.

  106. Its very sad that a government has resorted to use classified documents to fight one man SATA! I mean how did Mumbi get hold of such documents, thats a crime under the laws of Zambia. He should not be surprised if in future he is arrested and brought to answer how he came in possession of such documents.

  107. Just to share with all fellow bloggers- one thing that many Zambians have failed to realise is the resolve and decisiveness of the Lozi people. Many times, our patience and tolerance is mistaken for foolishness (or kushishita as you often say). But watch individual Lozis and you will see my point. When we decide to do something and we are convinced as we are now, we go for it. We just don’t sway from one side to another. Lozis know exactly how MC Sata looked at lozis not too long ago. He may have changed but you see, we are not fools. We are also contemplating not to participate in this year’s election if this will make govt realise that we know what we are talking about. I urge you all to go to UK parliamentary debates of 1960s and see it all for yourselves.

  108. There might have been wrongs in the geographical split- and look we are taking of 1900s. I don’t think Lozis would press on having other regions. Barotseland is still potentially rich even in its current form. It is a pity that we are emotionally debating this issue and govt is blind to the conflict engulfing that region. I am an MA holder and still very passionate about this issue- contrary to what the state thinks that it is the tujilijili boys. It is all across classes. May God bless our land!

  110. Zambians there is some truth in this story. Mr.Sata can not avoid being part of the group that sought to destroy the Barotse Agreement and the Litungaship. Remember its during Chiluba’s goverment that the divide and rule tatics of creating hatred between Lozi and Nkoya were introduced and Mr.Sata was Chiluba’s most dependable minister. We need open debate at all levels without criminalizing or threatening citizens on this issue if justice is to prevail. If we disagree on modalities to restore the agreement, then courts of law should help and us Barotse People should not be victimised for seeking justice. All we are saying is let Zambia be honest and restore the Barotse Agreement as well as Heritage period.

  111. No one should seek to destroy the Litungaship and Lozi culture. RB and the Litunga please ensure justice prevails and we close this debate forever.
