Speaker reprimands Kambwili for voting twice

SPEAKER of the National Assembly Amusaa Mwanamwambwa on March 17 reprimanded Patriotic Front (PF) Roan member of Parliament (MP) Chishimba Kambwili for voting on behalf of Livingstone MP Sakwiba Sikota on the amended Anti-Corruption Commission Bill No. 41 of 2010.

 

Mr Mwanamwambwa, who made a ruling on the matter for close to 30 minutes, said he is discontented with the conduct of Mr Kambwili by breaching the Parliamentary etiquette by voting on behalf of Mr Sikota.

The punishment meted out on Mr Kambwili was for him to stand behind the Parliament bar for 30 minutes.

“I order you to go and stand behind the Bar of the House. I also instruct the Sergeant-At-Arms to take the Speaker’s mace and stand behind you.

“This is not the first time you are being punished for breaching the rules and procedures of this honourable house.

You have been reprimanded and admonished several times before, which should be embarrassing for any honourable member. I want to believe that disciplinary measures are intended to create positive change in an individual. This doesn’t seem to be happening to you, which is very sad. This is the last time the House will have to mete out disciplinary action against you,” Mr Mwanamwambwa told Mr Kambwili.

He said the MP’s conduct misled the House and the public as the results of the voting were not a true reflection of the actual votes cast.

He said voting is one of the mechanisms used by the House to arrive at its decisions and it is gross misconduct and a serious breach of the rules and procedures of the House for any member to attempt to exercise it on behalf of another member whose constituents he does not represent.

Mr Mwanamwambwa said it is wrong for Mr Kambwili to vote on behalf of Mr Sikota because the rules do not provide for proxy voting.

Mr Mwanamwambwa said Mr Kambwili’s conduct caused grave embarrassment to Mr Sikota and brought the integrity of the House into question.

He said Mr Kambwili has lowered the decorum and standards of the House by breaching the rules and procedures the House has put in place to ensure that MPs perform their functions in a dignified and unimpeded manner.

Mr Mwanamwambwa said it is depressing that Mr Kambwili has continued to breach the rules and procedures of the Housedespite him being guided several times to desist from conducting himself in a manner that can lower the standards of the House.

He said the National Assembly Standing Orders of 2005 regulate the proceedings of the house to promote decorum and dignity in the conduct of business in parliament.

During the sitting of the House on March 16, November 3, 2010, Mr Kambwili voted twice when the amendment to the Anti-Corruption Commission Bill No.41 of 2010 proposed by UPND Itezhi-Tezhi MP Godfrey Beene, was put to the vote.

  2. Totally despicable behavior and a total embarrassment to the title “Honourable” .

    Politics aside, I think as political parties , we really need to be serious about people we field as candidates in elections. Lets pick people with self dignity and honour than just pick anybody. I know the minimum requirements to be an MP are really low but why pick the worst from the pack when you can pick the best. We should not just go for people that meet the minimum requirements.

    Obviously Mr Kambwili does not value the significance of a vote and in his mind this is just like a game he used to play at bus stations.

    This is serious business and and MPs need to give this process the honour it deserves. I think this rigging alibi is just being taking too far by our friends in opposition.

  10. I think an appropriate punishmanet would have been suspension or expulsion from parliament. If you vote twice in a general election and discovered you can be jailed, why not doing it on him? The problem with Kambwili is that he has failed to live with his wife, he wants play boy type of life. He has no adult to advise him in the bedroom at night because wife has been in the UK for more than ten years. Be with your wife or soon you will be punctured Mr Kambwili. If your wife was there you would not be doing stupid things in parliament and at night.

  24. Kambwili’s actions show gross disrespect for Zambia and the Zambian people who voted for their parliamentarians. If “Hon” Kambwili did not want corruption and could not stand the sight of MPs voting for a useless bill (as our so-called academic friend would have us believe) then Kambwili should not rig the way parliament votes – this is like staging a personal coup so is not only atrocious behaviour for a lawmaker but actually corrupt in and of itself.

    Still, I can’t help but giggle at his punishment – to stand behind the Parliament bar for 30 minutes. Sorry, but I just get the picture of Kambwili taking drinks orders from MPs while the Sargent at Arms keeps watch to make sure he doesn’t steal the money. Frankly, I think they should have tied a carrot to his nose too.

The already corrupt Govt want to pass this bill promptly when most of paliamentarians who would otherwise vote against are out of parliament. Out of desperation and love for Zambia he casted the vote for Mr. Sikota who had previously told him how he would vote. This man is trying hard to fight corruption and all you do is lambast him.

  57. Ladies and Gentlemen, let us be on the look out for these Kaponyas in the name of PF during this year’s elections. These are master riggers and Kambwili has confirmed to be one. The other precidence is when a PF Parliamentary Candidate in Luanshya was declared winner disadvantaging the real winner in the name of Simon Kachimba who is now Deputy Minister of Labour. The other example is when their Master, King Cobra was in MMD as National Secretary when he took a ballot box with pre-marked ballot papers to Twatashya and Kuku Welfare Hall when he instructed the Cadobis of Kulima Tower. This is the so called Chawama Saga. Therefore, the mighty UPND should equally be on the look out as PF is the first enermy who are specialised in rigging and Kambili has even taken the rigging to Parliament.

  58. #62, RB’s issue is being presented transparently, that is not the same as kambwili’s case which is pure rigging. PF cadres, do you really know what you are talking about? And if it was Chilufya who had won the 2008 presidential bye elections, you would have done exactly the same. The only difference is that because PF people do not like reading they would not have picked up this anomaly, and then if it came to paying time they would have been advised that it was not possible. But of course they would pay without regard to the law.
    We would not know about it in Chilufya’s regime because PF has no systems, no procedures, no regard for law, everything starts and ends with Chilufya’s word.

    Would like to comment on the reaction Number 16 made on Number 4’s comment on Kambwili’s behaviour. Firstly I agree with No.16 that Parly is not K/Tower, i believe he was talking of the morality that has to be upheld in the House. Secondly lets not just slap No.4 in the face for he may have a valid point to his statement. Standards in Parly mighty not be as high as you may think. Hence No.4’s questioning about the stds that have been lowered (there may be no standards to write home about).

With all due respect to sentiments of No.98, i feel before u totally agree with No.4, it would be better for No. 4 to realy elaborate and explain in detail why he feels there are no standards in parliament. which standards does he think the speaker is talking about. Does No.4 know anything about parliamentary standards? has he ever been inside parliament, is he familiar with the operations of parliament? only when No.4 elaborate on what he implied, can we be able to see sense in what he espoused. i think thats the best way to look at No.4’s concerns about standards in parliament, and not just making wild allegations just becoz he can blog.

And i dont subscribe to the thinking that Kambwili did that becoz he has the heart for miners, the poor in society and doesnt want that nasty bill to pass thru.For arguments sake, he may have these poor people’s sufferings at heart. Granted, but does that make him do what he did, vote twice? in other words righting a wrong. surely people, when there is hunger in a home and your children want to feed,do you go to Shoprite and steal and when you are arrested you say the intention was good becoz you had your family’s situation at home in mind? no ways, thats crime. why couldnt you lobby from neighbours or whoever you think can bail you out in your hour of need? similarly, Kambwili should have lobbied harder from other parliamentarians, who knows, some would have voted with him in the end.
