Mpombo fails to show up, High Court enters a judgment in default against him

THE Lusaka High Court has entered a judgment in default in a case in which President Rupiah Banda’s son, James had sued former Defence minister George Mpombo for libel over his allegations that James was involved in the procurement of arms worth US$100 million from South Africa.

High Court deputy registrar Egipiso Mwansa ordered that Mr Banda recovers against Mr Mpombo his claims as prayed in his statement of claim upon assessment of damages.

This was after Mr Mpombo failed to enter appearance before the court and failed to deliver a defence against the claim.

“Upon the defendant not having entered appearance and not having delivered a defence herein, it is this day adjudged that judgment be entered for the plaintiff.

“And that the plaintiff recovers against the defendant his claims as prayed in the statement of claim upon assessment of damages herein,” reads the judgment.

In his statement of claim, Mr Banda was claiming damages for libel contained in The Post edition of April 19, 2011 where Mr Mpombo claimed that he had left the Government because he did not agree with President Banda’s decision to award an arms supply deal to James Banda’s allies based in South Africa.

Mr Banda contended that Mr Mpombo’s allegations had injured his credibility and reputation and brought him into public scandal, ridicule, odium and contempt.

He was also seeking an injunction to restrain Mr Mpombo, his servants or agents from publishing the said words or other similar words and damages, or footing of aggravated or exemplary damages and any other relief the court may deem fit.

  1. A default judgment which can be set-aside tomorrow as long as you can show that you have a Defence on the merit and reasonable grounds fro delay in filing, making this a headline is mere politics.

  2. Sadly PF is suffering a serious brain deficiency. Again this is evidence that there is drought in the house from President Sata, Kabimba, M’membe to George Mpombo suffering chronic impote and katata over consumption one factor underlying alcohol-induced brain damage.Not amused with their hollow hallucinations. Here they are to lose money fund-raised from their Taliban terrorism friends and Homosexual partners in Gay societies. Bravo James for your cool and respect for our independent justice system.

    James thanks and justice has indeed been delivered…. the same will happen to Mmambe and is gang of thieves.., Nchito brothers etc.

  5. PF adoption protests rumbles on

    PROTESTS by Patriotic Front (PF) members on the Copperbelt have continued with those in Lufwanyama rejecting their leader Michael Sata’s preferred candidate, 23-year-old illiterate Christopher Kalenge who they described as immature and incapable of writing or reading Grade 6 school drop-out.

    In Kawambwa, PF members are also not happy with the Parliamentary candidate Mr Sata has allegedly imposed on them, saying he was not the preferred candidate by the grassroots members.

  6. The Lufwanyama PF district executive led by secretary, Prince Shimukunami said in Kitwe yesterday that the grassroots members were opposed to the adoption of Mr Kalenge.
    Mr Shimukunami said PF in the district was disappointed with the party leaders for going against the recommendation of Rodgers Chimena, and alleged that there was no democracy in the party.

    “The party can’t impose somebody (Mr Kalenge) who has no political track record. He is only 23 years old, what can he do for the people in the constituency?” Mr Shimukunami said.
    He accused the PF provincial executive of being corrupt by adopting Mr Kalenge who was not recommended.

  7. Mr Shimukunami said 16 councillors from the 16 wards had since withdrawn from contesting in this year’s elections because of the alleged corrupt tendencies in the opposition party.

    He said when the district executive complained to former Works and Supply minister Mike Mulongoti, who was coordinating the PF adoption process in Lufwanyama, the former minister only advised them not to leak the matter to the media because he did not want the central committee to know about it.

    He said people had lost interest in the PF because of the alleged lack of respect for democracy.

  9. Kwasala Managani and Mulongoti to be left out in the cold by the Post PF vuvuzela when trouble comes. Mmembe claims he is a lawyer but wont be there to represent you. Learn a lesson from Mpombo or is he Mupombo? Be careful as you are enticed by Mmembe, uzadya beans one day.

    He said PF had lost its political clout on the Copperbelt because of the manner in which the adoption process had been handled, adding that Mr Sata should forget about being voted for.

  13. Grow up zambians and debate maturely, reading comments on this blog pricks my heart, do we have people who are there to analyse issues like the likes of senior citizen, i miss him a lot. Your comments of individual hatred and insults shows that there is proper education you got from your schools. One wonders if you just ended in grade seven.

  14. Mpombo is a political houndalum. Blogers, Mmembe can not represent Mpombo beacse Mmembe and Winter are incompetent Lawyers. Mmembe does not know how to draw a summon and in fact he has never won a single case because he has no clinets. Kabimba too has never won a single case. Go and read all zambian law reports, you will never see the name of Winter Kabimab presenting a person. These are dull lawyer. Blogers, what kind of lawyer does not know were to take the case? 2011 will be the worst year for PF. Mark my words. 2011 is the first time PF cadres have demonstrated against the MPs adopted by the party. It has never hapened before in the history of PF.

  15. It’s very worrying when elders of the nation display a deep lack of wisdom in their words and say this that are neither here nor there. Atleast if he ooffered an argument in court we would give him the benefit of doubt. I’d always thought he could have claimed the evidence has been removed when that’s the office he came from. He could have copied the papers befre quiting. Now he’s running like a reall mpombo in the bush. Is this the calibre of leaders PF will offer our great nation kwena? PEOPLE VOTE WISELY.

    I advised the cadres not to report to the press, but to no avail. We are caught pants down. Sata mislead me. Thats why I used to denounce him when I was in GRZ.

Is it that maybe he went to a wrong court or maybe realised he should have put his brain in gear before opening his mouth? I hope he stays in that little hole he has dug himself in and spare us his bombastic words.

I he knows a lot , he needs a good Lawyer to defend him. Knowing these Presidents sons, they are dubious in there dealings. Espeicially James,with these girl friends of his. Listen to Mpombo. not to these thugs. Of course their father has money to pay for lawyers.

  30. #43 The man has been rolling his sleeves in preparedness for this case for months and you see nothing odd with him not turning up to the court case on which his personal reputation rested? In addition, if Mpombo was able to prove his allegations, I doubt he would have missed the opportunity to deal a major blow to RB’s re-election bid especially if you take into account the timing of the hearing.

Mangani was also saying he knows a lot about Dora and Daka, why did he not say when he was in govt? I think Zambians should for the first time take control; change the govt and change the next one if it doesn’t perform. Why should and govt minister (or former) and a President’s son be mentioned in the same breath? Mushota give us a puke bucket love. I expect Zambia to be much better than England which doesn’t have the natural resource that we have. In spite of the riots, their service industry will sort out the mess in no time while chief Mpenzeni and Puta are begging Rupiah to build or grade a road they promised years ago for them to get the people’s votes. This is what Post does to people, it publishes pure slander and (ab)uses its past and long lost legacy to cheat the gullible who take it as gospel truth. When I buy and read the Post I am mindful that Mmembe has an agenda for his business interests and not taht of the people of Zambia, the Post no longer stands for the truth. In fact I buy it just to be alert on what their schemes are. Otherwise it is the most ridiculous paper one can think of.

When millions of people absorb the toxic messages offered on a daily basis through media, movies and other forms of communication, an immense mass of bad feelings and emotions blankets the country.

    If, on the other hand, collective consciousness is positive, integrated, and coherent, then the government will not be influenced by any negativity.

    If the people of any country wish to be protected from corruption in government, then they must create an integrated collective consciousness. Positivity and harmony should be so strong and dense in national consciousness that negative influences cannot penetrate it.

  40. #54 and 56 Kims I understand the theories you are trying to relate and I agree with them but I still think that we Zambians need to take control by assessing situations and make the point that leaders need to serve us. I know of a lot of positives back home which not even the Post Newspaper can influence me negatively about. There are however a lot of short comings that need to be addressed by both govt and opposition. We people need to demand to be served, we have the power to do this. The tendency of just buying people around election time, defections, sham adoptions of candidates with certain people positioning themselves to perpetually be in all govt etc. needs to be guarded against. It breeds mediocrity. There are more issues.

  44. POST have a moral obligation to help pay up because they are responsible for getting him excited and the subsequent spewing of lies to grab headlines. Mpombo sue the POST to share liabilities….

  45. Mpombo has not achieved anything after all, but pain for himself and his family. Mpombo is such a disgrace, look at the suit he is wearing…menshi-menshi…..bust shows what a sucker of a former defence minister he is. I am sure his children are so embarassed.
