Veteran Politician Vernon Mwaanga has sued Patriotic Front Vice President Guy Scott and the Post Newspaper for defamation.

This follows the alleged defamatory utterances on Mr Mwaanga by Dr Scott.

The utterances were carried in The Post Newspaper of 17th August 2011.

The Post Newspapers reported that Dr Scott told PF supporters in Katuba to be alert against possible malpractice by the MMD because Mr Mwaanga was sitting in Lusaka with plenty of computers playing games.

Mr Mwaanga has argued that the innuendo implies that he engages in criminal practices of vote rigging.

He has lamented that The Post has before covered election petitions of 1996 and 2001 with no allegations linking him to rigging of elections.

Mr Mwaanga has sought an injunction to restrain the Post Newspaper from publishing libelous materials on him.

Mr Mwaanga has also demanded an unqualified withdrawal of the defamatory statement in the Post Newspaper.

He has demanded that the apology should be broadcast on ZNBC on both radio and Television for a week twice daily at the defendants cost.

Mr Mwaanga has also demanded that the same should be published on the front page of the Zambia Daily Mail and The Post Newspaper once.

  10. VJ is a shrewed politician whose intellectual capacity has been moderated by his diplomatic profession thru interactions with a host of eminent world leaders. Students and intellectuals respect for VJ because he has opened his mind to the public by writing honest accounts of his life and political issues related to Zambia. The opposite is true of Guy Scott whose intentions for staying in Zambia are dubious. Scott has thrown all tenets of democracy by his association with an organisation that plots evil to the peril of Zambia, and this has baffled the British community in Zambia. The Post used to be a fine tabloid in the days when the eminent journalist Matsauso Phiri presented informative articles. Mmembe’s mindset has killed the Post. VJ’s his action will restore sanity in journalism.

There are many examples we can give of how Rupiah is in control of our judiciary and indeed the entire judicial process of this country.”
    Lawyers at the Post cannot distinguish between The Executive (DPP) and the Judiciary (courts). RB is head of Executive and DPP not of the Judiciary. If the DPP, in the name of the President refuses to take a case to court, how can you blame the judiciary?

  25. I thought that the Post should be restrained the same way that Chanda Chimba’s Stand Up for Zambia was restrained when comrade Sata complained to court. Alternatively the ban on Chanda Chimba III should be lifted until the full hearing after the elections. Otherwise we are having two laws, one for Mmembe and another for Chanda Chimba III. My little understanding of law is that courts work on precedence, or don’t they?

    • the difference between the post and Chanda Chimba is that his show was on ZNBC which is national media as opposed to the post which is a private media. read the entire judgment on the injuction and you will understand why the courts came to that decision. the courts do work on precedence but precedence does not mean the decision that was made rather it makes reference to the ratio decidendi (i.e the principle of law on which the decision was based).

  26. Latest, the PF strategy has moved to the next phase as planned. Now Kabimba wants to be arrested, he has told PF supporters to be violent in their campaigns. Kabimba reckons that if he is arrested then they can throw the elections into disarray. But then one wonders who is in charge of PF now. Isn’t it the party president Mr Sata himself who only last week directed his cadres to conduct peaceful campaigns? So is it true that there is confusion in PF, that it is like a headless chicken now, that Mr Sata is too ill to control the party?

  31. The best thing VJ can do is to retire peacefully and conserve energy for his dear family. He was rejected by RB and recalled for reasons best known to both of them. Taking the post to court usually ends up in revelations that will damage you forever. Ask FTJ (MHSRIP) and Bwezani. Do you wonder why the case of defamation has suddenly become quite.   32. What is VJ carrying in the brief case through the streets of Kasama? We need a ‘stop and search policy’ for suspicious politicians especially those who don t seem to want to give politics a rest. I am not a fun of him, but it actually makes Katele Kalumba more Honorable in spite of his on going legal problems. At some point one has to hang up the gloves. VJ was Zambia’s UN representative to the UN as a teenager, most of us weren’t born or were toddlers at the time and he is still going.   33. I’m really not surprised that the Post and Guy Scot think that VJ loves to sit on computers playing games. He actually might be carrying a lot of discs of ‘computer games’, a laptop, high-tech printer and a mobile satellite (‘quick-to-assemble-type’) in case he needs to link up with the RSA printing company. And I believe it’s a coincidence that his appetite for these computer games grows every five years especially during this exciting time for the country.

  41. No 16. I can prove to you that elections in Zambia can be rigged clean, though it requires ingenuity, hard work and swift thinking. Ever thought of blotting a figure for registered voters for some areas? Don’t know a formula to increase the tallies on the preferred candidate in a computer? Ever heard of staffing extra ballot papers in the box? Ever heard of voting on behalf of an eligible voter who cant do the writing by themselves? You have never heard of exchanging of ballot boxes for the one with preferred candidate carrying the day? There are so many ways an election can be rigged in Zambia.

  50. Analysis, people like you never cease to amaze. So you want VJ’s rights of association curtailed while you enjoy yours purely on account of age. That is absolute nonsense and double standards on your part. Take your swipe at the man if you must, but there has to be a reason why MMD continue to look up to VJ and why they fete him. INTELLECT. Yes, he’s not perfect, but he does have something to contribute to his party otherwise they would have discarded him.

    With respect to the POST I think we are seeing its end. Mmembe has lost it competely. Just look at the way he behaved at the ACC. A child throwing his toys out of the pram. And “lessons learned” that you don’t fabricate stories and get away with it lost by the wayside.

  51. It’s said that “when you are in a hole you should stop digging”. Mmembe is incapable of understanding, let alone taking heed of this simple advice. And therein lies his problem. He has made such a mess of the POST that it’s going to take some doing to restore its reputation. A shame really considering the absence of private media in Zambia.

    Guy Scott is not worth talking about. Something went awry with this Muzungu at the time of birth. One should be forgiven for thinking he would hold some British democractic values. Alas! His association with PF has put paid to that thesis.

  52. @48 Why not count at each polling station and results collated by each agent. The polling officer simply take the tallies to the next level. That way there will be no movement of ballot boxes and waiting for non existing ballots papers and fake tallies

  54. The other issue is that Political parties must have copies of registers or number of registered voters per polling station. This can be easily cross checked with the tallies coming in

Computers and games can not be the basis of judgement. Innuendos dont work in court just like it failed with kalaki.

It will be very difficult to see how the court will be able to deduce that “playing with a lot of computer games” insinuates that one is preparing to, or is in the process of rigging the 2011 Zambian general elections. Looks far fetched to me, unless the judiciary does itself a disservice by deciding in favour of Mwanga on grounds that I can only perceive will have no co-relation to defamation laws.
