The Good, the Bad and the Ugly in The Kingdom of Sata.

It is now almost two weeks since the Zambian people changed the government to usher in the promised ‘kingdom of Sata.’ ‘Tembenukani abale, ufumu wa Sata wayandikila! (Repent brothers and sisters, the kingdom of Sata is at hand)! Well, going by the final election results, there were not many changes of mind in the Eastern Province where these words are reported to have been uttered, at a rally in Sinda. The dust has settled and now it is time for business. It has been a very busy period for President Sata and at the rate he is going, I do not doubt that he will deliver on his 90 day promise. It is full steam ahead and I only hope that the result will not be the same as what happened to the legendary RMS Titanic in 1912. This marvel of engineering struck an iceberg on its maiden voyage. The iceberg was sighted right ahead of the ship. When the alarm went out; ‘iceberg, right ahead!’ The response was ‘hard-a-starboard’ which means to turn the ship to the left (port) side. It was too late! In less than a minute, the mighty Titanic crashed into the iceberg on the right side and it wasn’t long before the great ship sank to the bottom of the Atlantic.

The enthusiasm and optimism that greeted the new era in Zambian politics can be compared to that which saw off the Titanic as it sailed from Southampton almost 100 years ago. There were good, bad and ugly things that were associated with the Titanic. Similarly, I see good things, bad things and ugly things associated with the new government of the Patriotic Front as led by the warm and charming President Sata.

THE GOOD.

There is a joyous optimism in the mood of the Zambian people. As I wrote earlier about optimism in a nation, this is good. We have been too pessimistic and too negative in the last few years. There are many good things that have happened in Zambia since 1991, but due to the excessive negativity on the part of some leading media houses, Zambians became suspicious of everything and everyone. Thank God now that the very people who saw nothing good in the country are now urging everyone to support the new government, and to will it to succeed. Indeed, the government succeeding is good for all Zambians, though not for the fortunes of opposition parties. We have a beautiful history, Zambia. I agree with the President that we need to remember where we have come from. The renaming of the three main International Airports is a step in the right direction, though the manner in which it was done is arguably un-orthodox.

The alacrity with which the President has gone about with his reforms warms my heart. Ok, he took a while to choose his cabinet and nominate members of Parliament, but that may be a sign that he is not hasty, but cautious. On the other hand some would argue that it is a sign that he was not ready to govern, since a rumoured PF cabinet list was once circulated through the internet, way before the elections were announced and the PF and UPND went on separation. Apparently, there is no divorce certificate! I digress. Could it be that the President deliberately delayed announcing the Cabinet so that he may act as ‘minister without portfolio’ and make changes before the actual ministers take up their posts? Perhaps he did not want to tell us. ‘Donchi kubeba?’

The fight against corruption is well back on the track too. It is not that there is anyone who has been prosecuted and convicted, or that it was ever off track, but the President’s posture and demeanour just scares the living daylights out of anyone who would want to dip his hands in the public pot from hence forth. Those who have already done so, should be quaking in their boots, for the kingdom of Sata’s reservoir hounds are baying for their blood. It is a good thing when just the presence of a police man in the streets makes people feel secure and crime is diminished. No one yet arrested, but there is peace and quiet.

The removal of all cadre District Commissioners is most welcome. I never accepted that office from the time of its inception. It is one dark blot on the late President Dr Chiluba’s legacy and it is a pity that no one else ever saw the problems associated with the appointments to that office. Political stooges and job seekers were given that position simply to prop up the ruling party. It was devilish to appoint party cadres and pay them from tax-payers coffers. I do not believe that the post needs to exist at all. If those in the know of state-craft believe in it, it is ok to be manned by civil servants.

THE BAD.

The Director General of the Anti-Corruption Commission has been dismissed. I do not think that there are many people who would lose sleep over this because there was an appearance of ineptitude on the part of the man. I say ‘appearance’ because there is no evidence that he failed in the performance of his duties. Now, here is what worries me. The President is so popular that the decisions that he has made have just been accepted hook, line and sinker by the public even when they appear to be illegal. The Anti-Corruption Act says clearly that the Director General of the ACC can only be removed at the recommendation of a Tribunal, appointed by the Chief Justice after the National Assembly passes a resolution by not less than 2/3 majority. The National Assembly is in recession at the moment. There may be some secret powers that the President has, which we do not know about, but if we all sing from the same hymn sheet, we would recognise that ‘the rule of law’ has been at the most upended here or in the least ‘bent.’ The other issue, concerns the appointment to Parliament of a person who is registered bankrupt. Once again, we may not be party to the financial circumstances of the person over the years since this case came into public domain, but there must be a very good reason why our laws and indeed in every part of the progressive world, deny a bankrupt person the right to hold public office. While the President was a leader of the PF in opposition, he lamented the fact that the Republican President has too much power. It is not good to see him now exercising the same powers so arbitrarily.

There is no harm in being strong willed and to get on with the job, but everything must follow due process. The men and women who will lose their jobs for alleged offences must have justice. We may not be happy with many men and women who hold public office right now, but there are a few that enjoy security of tenure under our laws and these must be given a hearing before they can be dismissed, otherwise the offices of Director of Public Prosecutions, Auditor General and Director General of ACC as well as Judge will all work in fear of the President and not for the Zambian people. If the President has a very good reason to get rid of anyone of these persons, there would be no problem to table that before Parliament and follow the law to the letter.

It would have been nice for the President to nominate more women to Parliament. The domination of male folk in the affairs of Zambia is a bad thing. According to the statistics, there are slightly more women in Zambia than there are men, and yet they are so poorly represented. I am not advocating appointment of women for the sake of it, but I believe that there are so many who can do better than men.

THE UGLY.

The reported post-election violence was out right ugly. There is no room for vigilantism in a democracy. The fact that even the police stood by and the head of state did not condemn these things while they were happening sends a chill down one’s spine. We cannot go on like this. The victors can celebrate but the vanquished must be respected. After all we are one nation and yet 13 million people. We cannot all agree on everything and when do disagree, we must do so with due respect for one another. We must allow free debate and our fundamental human right of freedom of association must be upheld. It looks as though it is no longer fashionable to belong to the Movement for Multi-party Democracy. There are rumours that some present MMD members of Parliament are being enticed to resign from their party and re-contest their seats under PF. Now, that is ugly. The country cannot afford to waste money on bye elections. Although the ruling party will not have an outright majority in parliament, this can be very good for democracy if people put the interest of the country first. This is a great opportunity for our parliamentarians to enact laws that will advance the nation and repeal those that are just plain silly, like the ‘ndoshi’ Act. This time round we should have a Constitution, as the cliché goes, ‘that will stand the test of time.’

The President has the right to choose his Cabinet and has the power to nominate to parliament anyone whomsoever he wills. It is sad that in this day and age people are still checking the tribal leaning of any appointed person. We should judge people not by the accent of their English but by their ability to deliver. The issue of tribal balancing in so far as posts are concerned should be banished from our minds. Yes, I agree that members of the family should not be given undue advantage, but there should not be anything that should stop one who is highly capable, from being appointed even if he happens to be a close relative. Nearly half a century after independence, it is ugly to see people through tribal lines. If President Sata did hound his predecessors over this issue, it is not right to continue this wrong.

Former Presidents must be respected. For a long time Zambians have been treated to a diet of anarchy and disrespect for those in authority. The person who is elected into office of the President should be respected and not called names just because one disagrees with them. It is ugly to accuse people of offences that they have not been convicted of let alone tried in a court of law. We all remember how an American Senator publicly apologised to the US President when he shouted abuse at him from the floor. We will not like some of the President’s policies and we will not always agree with him, but we should remain respectful of the person.

CONCLUSION.

President Sata has demonstrated admirable qualities. He has fought to be President over a very long time. It means that he has had a clear agenda as to where exactly he wants to take the country. He has shown perseverance and a tenacity to succeed. Used wisely, these qualities will take Zambia forward and to greater heights. Used unwisely, all that we have achieved so far will vanish in the smoke. He has a fine line to tread. Someone said that he is wiser now than he was before. May God help him not just to be sincere in what he does, but to be sincerely right too. Could he be Dr Dambisa Moyo’s ‘benevolent dictator’ that Zambia needs? Benevolence and dictatorship are not words that go together. Dictatorship is to a country what an iceberg is to a ship. As icebergs go, they just show a small tip above the surface of the water. Can we see one? I hope that there is no iceberg ahead, but if there is, may his benevolence be the rudder that will steer the country clear.

  2. Thanks Charles for a well thought article. Zambians must give the new gpvt a chance to settle. Respect for the laws of the land as set out in our republican constitution and human rights by the govt is the corner stone of good governance. We remain hopefull and trust that we are on the right track towards the much needed development. The vast experiance in our new President should give all us hope of better things to come. Off course he needs our support and encouragement. God bless Zambia!!!!

  5. Good view! Good that Civil Service is being streamlined by PF restructuring of DC office.I have never heard the Head talk straight against his cadres’ violence. I am yet to hear the PF propound Agriculture Policy! may I thank Dr. Situmbeko for speaking out against violence when everyone from MMD seemed to be in fear! Institutions! institutions! institutions! good ones is what we need and these should be respected, otherwise no one is good enough not to get drunk with Power!

    Truely we need to respect our former heads of state. We need to celebrate our own before they die! We need to make their life worthwhile even after tenure of office! People will start developing an attitude of not wanting to leave office if all we do is take every one who has been President to jail after their time in officedent to jail after their time in office

  10. I hope we will not throw out dirty water with the Baby! Zambia under MMD scored alot. let us build on that! Bravo RB, Hon Mutati, Hon Dr.Musokotwane, hon Mwale, hon Chituwo, Hon Sibao, Hon Siliya &entire cabinet &civil servants! Scored on food sustenance, built reserves, sustained GDP growth,single digit inflation, increased investor confidence&flow, increased infrastructure development, sustained currency exchange stability, respect for institutions, peace&stability, above all declared Zambia as a Christian Nation! I am happy that PF has promised better in 90 days! Beating this record! We are waiting to see. 

  11. A well written article however, I tend to disagree with respecting past presidents, respect is earned Ngoma not demanded. What did RB do to gain the respect of Zambians? Fill his pockets with money he did not work for? Propagate corruption? Sata has shown you that he can respect for former Presidents, look at KK today. The man RB said had dementia? Even his nemesis and arch enemy Mwanawasa has been honoured post humously. If RB did everything above board, then he has nothing to fear.

  12. This fella wants to keep Zambians busy with useless actions like renaming places and things and dissolving boards so that we do not focus on real issues. Real issues of poverty alleviation, good constitution, proper infrastructure, which he promised to deliver in 90 days.

  13. Nice Thought Dr. I am sure Micheal ata and PF have to uphold the constitution they swore to protect. We do not need to give Sata more time to bulldoze the law in Zambia. Everyone has the constitutional right to be innocent till proved guilt. At this stage i must confess, i never liked nor do i like the former ACC and is it DEC bossed for what I read in the papers about their treatment of non-MMD pipo before the elections. I guess the due process of the law should have been used to investigate, charge and or retire the guys. Firing people because you are president may be actually abusing the constituion. That is the fear some people expressed about Sata’s possible rule. For now get a better lawyer then Winter to advise him and then act in accordance with the law. Mulandu taubola Ba Sata

  15. Some, comments above on perceived corruption by RB, what is your proof? Who are the accusers? Is it Post newspaper? This article is good. Let us respect everybody including past leaders. Most African economies are in very shaky positions eg Malawi since last world economic meltdown but the past leaders helped us sail through. Let’s give credit where its due.

  17. Kasongo, you write like you are not a Reverand. Any person who wants to do better things starts with the cause of the problem,so there is not wrong with what our president is doing. Mind you he is in the driving seat to make reach our destination safely

  18. Excellent viewpoints Dr. Ngoma. I only think you may need to rethink your stancy on tribal balancing. Zambia has a unique historical background based on more than 73 tribal grouping. We cannot be silent when the president of Zambia fills more than 60% of cabinet Minister’s positions from one region. That is not acceptable. It is not only Bembas who are educated who can deliver. KK balanced his cabinet and was successful in uniting the whole country more than anyone will ever do. We need to learn good things from the past. Things like this don’t help keep our friends in Barotseland. This is wrong, it must be corrected.

  21. Gentlemen I need help I doubt the calibre of the new Finance minister one he is too old and out of step with the current trend in international Finance and economics. We really need people with a proven track record for this portifolio. Am afraid please comment.

  22. @15 I agree with Ngoma. Respect is earned but it should not be withdrawn purely on suspicion of wrong doing when there is no evidence adduced and accepted in a court of law. What we keep on hearing that RB stole, we also heard about KK, about Chiluba and even about Levy (although Maureen Mwanawasa was the accused). We cannot carry on like that. Dr Chiluba was NEVER convicted of theft. He was convicted in a civil court of defrauding his country. The porsecutor Nchito and co. failed to prove beyond reasonable doubt that Chiluba was a thief. It is trite law that when something is stolen, it must be missing from somewhere. Nchito failed and it is annoying that he was paid so much money for nothing!

  23. People complain about the 200 billion Kwacha that was spent on hundreds of people in the NCC but to fail to come up with a constitution. What about the other billions of Kwacha spent on a handful of lawyers in the Task force but to fail to bring up any real convictions to recover the alleged stolen money?

  26. Well articulated article. Let me just add that the true power of the nation lies in the people and as citizens when we see wrong, we need to rise and voice out. Am not talking about demonstrations but a mature and strong civil society that will be able to offer the much needed checks and balances to those in political offices. Never again should and will Zambians be taken for granted, never!!!!!!!

Interesting article.  But if I might add something, we should all be careful with what we comment especially where it relates to the law.  I am not sure if Dr Ngoma knows that the ACC Act was amended last year tat removed the necessity of having a tribunal formed to remove the Director General.  Please see the new section 10 of the Act, let us not mislead people.
     

  28. Eloquent but naive article.
    1. Corruption: on one hand sata is firing en-mass in the name cleaning up after an MMD which is corrupt in its entirety. On the other hand he is appointing many MMD MPs. With such glaring contradictions, his fight against corruption will not be believable.
    2. Appointments: the various strata of Zambian society such as gender, ethnicity and age should be considered in appointments. These strata of our society should neither be ignored or wished away. The tribal nature of appointments so far have been acknowledged even by sata’s close friends at the post. Notably, people from southern and north western provinces seem to be deliberately sidelined. This will reflect very badly on sata.

  32. The opinion Ngoma expreses are quite lucid and informative at the same time. Some highlights include illigality action of Mr Sata in dismising some heads of orgns such as ACC or BOZ. Mr Sata has to be schooled by his advisers be it political or economics the powers he has at hand to exercise and Zambians will appreciate. Example, when an enquiry is set up Zambians await for report (30 days) next act based on report. To avoid further damage caused by incumbent put them on suspension chapwa, kwamana, kwatha, kwapela. Law was/has been brocken by the president I hope we will not experience this so often.

  33. what is more appreciated is that SATA keeps mentioning that we need to clean up Zambia for Zambians. He is replacing people that were appointed by RB who he new were thieves and corrupt. Its a good move for me. In the case of firing the DCs, that was a plus 1 move as they will replaced by civil servants and not cadres who suffer for nothing.

  34. Dr Ngoma, don’t mislead the masses: pls take time to read Anti-Corruption Act No.38 of 2010, amended by George Kunda. Take interest on Section 10(2) which talks of removal or dismissal of ACC DG…. The president no longer needs a tribunal and Parliament recommendation, it’s the President alone to decide to remove…Be a good dr by reading….

May be You voted for a govt that will set a side laws and they will only start to apply after 90days!   41. dr charles… your analysis is ok in that it has brought out many sensible errors in the pf gov but also something we can actually like. but now, our comment is that lets exercise maximum patience and see how o this is going to impact on the common man out there. it is a bit too early for nay apprehension. best regds.

    from infirmity of body or mind or from any other cause, or for
    misbehaviour.
    (3) If the President considers that the
    question of removing a person holding the office of Director-
    General from office ought to be investigated, then—
    (a) the President shall appoint a tribunal which shall consist
    of a Chairperson and not less than two other members,
    who hold or have held high judicial office

  43. A well written analysis. I can cheerfully agree with the author on a number of points, especially the conclusion and the part which calls for more women to be appointed in positions of authority. However, I personally would like to see a shift of focus away from articles which analyse point-scoring party politics to more socially oriented viewpoint. In other words, let’s be more on the lookout for the perils (icebergs) out there instead of being obsessed with the Captain or the ship.

  46. It is just better to hope for the best and be positive, so far many positive decisions have been made it is important to positive in whatever we try to achieve in the country. In 1991 people wanted change so much that they ushered into the office of the presidency a man they believed to be a messenger, but to the contrary, FTJ was a thief and so was his cronies. So many bad things have been see in the last 20 years of MMD. This time around it maybe different and we must just support the PF administration positively and wish them anything bad!

Actually, right now the President is consulting LAZ on all legal decisions until he appoints a befitting Attorney General. # 28 Gravity, if you don,t know the calibre of comrade Alexandra Chikwanda, then you are not schooled in our politics and should avoid innuendoes. # 30 & 31, The Saint, the Task Force is over asnd was dissolved by HERB and he refused to appeal Chilubas’ case, so Nchito & Co. didn’t fail, but HERB failed us! The wastage of state resources through the NCC and since we the Zambians have not benefitted, we want our K 200 billion back. Please write factual articles as they can mislead the public and cause resentment of government.

    It is time Politics changed in Zambian from Enriching onseself to Serving the poor in honesty, truth and Love of God. Remember one day you will face seat of Judgement and explain how well (how you showed God’s face to others in word and deed) you lived your life here on earth.

  54. Thank you everyone for your contributions to this topic. I would like to apologise that I quoted the old ACC Act and as has been rightly pointed out by MundiaM @59, this has been amended. Not withstanding, the new Act still requires the President to appoint a tribunal while the ACC DG is suspended. I have written as a watcher. This is not to apportion blame, nor to alarm people but it is to let you all know that it is when a leader is very popular that things go wrong. ‘Love covers a multitude of sins.’ It is hard to see wrong doing in a person you love, but let us keep our eyes skinned so that the earliest signs of disease are picked up and treatment instituted promptly. Let us not sleep walk into another nightmare. Thank you all.

    You have some very good points and you are very correct when speaking about the presidential powers.
    Sata must indeed follow protocol if he wants to set an example of a good time in office
    I also questioned the dismissal of the ACC president. It was very un-orthodox and I think people should be aware that Sata is like a freight train going full steam ahead. It’s only a matter of time before it crashes
