President Sata threatens to dissolve parliament

President Michael Sata has threatened to revoke the constitution and dissolve parliament if the opposition members of Parliament (MP) continue shooting down bills government is presenting in the house.

The President said his government will then call for a fresh election and tell the Zambian people that the opposition was not interested in fighting corruption.

He explained that the opposition MPs had given his government a first vote of no confidence by shooting down the motion for the constitution of the Parliamentary Accounts Committee (PAC) stating that his government would not hesitate to dissolve parliament if the MPs continue voting against progressive bills.

Mr. Sata wondered how the opposition Movement for Multi Party Democracy (MMD) and United Party for National Development (UPND) voted against the bill that when most of the proposed names of the committee members were from the opposition.

“How do opposition MPs vote against the motion to constitute members of the Parliamentary Accounts Committee (PAC) when the committee was dominated by themselves with only one MP from the Patriotic Front,” he asked.

He charged that the opposition MPs voted against the motion because they wanted to protect the removal of immunity of former President Rupiah Banda.

He has however explained that that his government is not in a hurry to remove the immunity of the former Republican President Rupiah Banda.

Mr. Sata said this when he swore in Secretary to the Treasurer, Fredson Yamba, Copperbelt Province Permanent Secretary (PS) Christopher Mutembo and Permanent Secretary in Charge of Administration in the Office of the Vice President Annie Sinyangwe at State House today.

The President has meanwhile observed that the civil service in the country has deteriorated.

He said the civil service which should be the hub of government had gone down over the year owing to the appointment of cadres by the former MMD government into the civil service.

Mr. Sata said the civil service was important in running of government adding that countries like Italy did not have political appointments to man government but was using the civil service.

He expressed concern at some District Commissioners (DCs) on the Copperbelt who he said had continued to boast of government’s fertilizer support programme describing them as being of former president Rupiah Banda.

Mr. Sata has since directed the newly appointed Copperbelt PS to ensure that he deals with such DCs.

He has also directed the PS and the Secretary to the Treasurer to ensure that they fight corruption which he said was disadvantaging a lot of people.

“We want to fight corruption in order for us to take the money to the people,” he said.

He advised them to desist from engaging in any corrupt activities either concerning money or any other things.

The Opposition MPs on Tuesday voted against a motion which was tabled in parliament by Finance Minister Alexander Chikwanda to constitute members on the Parliamentary Accounts Committee for the first session of the eleventh national assembly.

  6. Since the issue of Secretary to the Treasurer has been dealt with, take the motion back to the parliament. We just wanted to do things in order because it is our responsibility to see that thins are done in order. We not against the PAC.

  15. If the President dissolves Parliament it means that his Presidency is disssolved as well.

    What the Opposition wanted was for the law to be followed before adopting the PAC members. They had no problem with the proposed members but the fact that the President did not want to appoint the Secretary to the Treasury. The President should just admitted that he was wrong by trying to abolish the position of Secretary to the Treasury. On the PAC being dominated by opposition MPs, that is Parliamentary Ettiquete as the PAC is a watch dog of the executive which is dominated by MPs from the Ruling Party. Even the chair for the PAC is reaserved to the opposition. Charles Milupe was for a long time chair of the PAC whilst he was an Opposition MP. The immediate past Chair E. Hachipuka as well.

  17. Dissolving parliament cannot be closer to the solution. This is what democracy is all about. Just start corruptly buying MPs and have the majority in parliament.   37. Appointing cadres in the service. Nothing has changed. Fredson Yamba is a PF Cadre. He lost to George Kunda in the 2006 Muchinga Parliamentary elections. The President should have elevated someone from within the Ministry of Finance.

  40. Sata has no leadership qualities. One of the foremost qualities in leadership is persuasion i.e the ability to negotiate with others and to be bring them to your point of view. We are still a democracy and democracy must work. In a democracy you muster the art of negotiation. You cannot force your way through.   70. Like i have always maintained, the dictatorial tendancies Mr Sata is showing are likely to cost the nation. This is how many a despot started their reign of terror. Democracy involves respecting everyone’s point of view. I like some of the steps he is taking to clean up some of the corruption but i do feel that his powers should be limited and give parliament and the judiciary more powers. It is always a dangerous thing for 1 man to wield so much authority.   139. Interesting comments and majority of which are shots from the hip without understanding the issue at hand. Firstly, by the President abolishing the Post of Secretary to Treasurer and appointing only one Permanent Secretary for the Finance Ministry was saving the Government coffers serious money as previously we had 2 Permanent Secretaries both reporting to the Secretary of Treasury. Now think of this, Secretary of Treasury is paid at a level of Deputy Secretary to Cabinet ie number 2 in the Civil Service. So what has happened now is the President has elevated the same PS he appointed and given him the title of Secretary to Treasury thereby adding a couple of millions to his salary for doing the same function he was initially appointed for as PS

Follow up … the Secretary to Treasury is now a done deal so moving on to the defeat in Parliament that led to the President issuing his threat to dissolve parliament, which for those that don’t understand means calling for an early General election instead of the normal 5 years – thus suspension of the constitution. This is lawful and practiced when Government don’t have sufficient majority with the hope that by calling for early election the ruling Party may take more seats. Naturally in this world nothing is taken for granted as the President could lose the election and the Party fail to retain majority – that risk however, is calculated as chances are that the President would be retained and the majority MPs obtained. It is an expensive option but not far fetched.

  141. Follow up … Addressing impeachment. For impeachment to be successful 2/3 of parliament, which is 100, must vote for it to be successful. For that to happen you would require some PF members crossing the floor and voting with the opposition – for the simple reason that PF has 65 seats which implies opposition can only get 85 votes. So all those calling for impeachment please speak with facts and be knowledgeable

    • The reason was given. There was no Secretary to the Treasury. Even the Minister of Finance acknowleged this mistake. Thank God the President has now appointed the Secretary to the Treasury.

  148. Wow! I’m loving all of this. I’m lovin it because to me it is a sign of a working democracy where the ruling party is frustrated. I know it can hinder progress (such is a case in America) but in Zambia, I have been dreaming for this for so long. We have had pretty much a rubber stamp parliament for such a long time in Zambia, since that temporal strong parley formed by the opposition of Mazoka – it lasted only a short time before Mwanawasa started poaching opposition MPs. I hope this parliament continues like this; only then can we dream of a working parliament. Let MPs be scared of the voters and not govt. As for Sata dissolving Parley, this is yet another sign of TOO MUCH POWER by the President. How can he dissolve parliament single handedly with MPs voted in by the people of Zambia?

  149. #181 Voice of Reason. Impeachment comes about when a breach of constitution has occured and all well reasoned individuals with democratic beluefs will call for impeachment. This is regardless of partisan politics. It is to uphold good governance in a nation. MMD, PF, UPND. FDD, independent and Milupi will rally behind a correct move to remove an individual or president standing in the way of democracy. Mr Sata is potentially impeacheable at the speed and carelessness he has demonstrated so far. This you know as as I do, so are MPSs#. Fellow Zambians especially PF members ,if you are still doubting about the dictatorial attitude of ba Sata,please check howm many lone descisions he has made.It’a alll on eman show,naminf of airports,hospitals ,stadiums,dissolving boards,contracted Army officers,appointing and firing police commissioners(pity Dr.Malama),appointing family and clan members to government and the list goes on and on.Now dossolving Parliament,mwasamwa sana.The way forward for fellow Zambians is to reduce the powers the Zambian president wields.Give some powers to parliament.A president is a servant of the people and not a slave master.

Its on record and memory of well meaning ZAmbians that Mr Sata was involved in corrupt practices that led to resignation of 1st VP of MMD the late President Mwanawasa. This was confirmed by late president Chiluba later. I do not want to comment on Mezarf housing project saga in Chilenje where Sata was at the centre of corruption. In all these and other issues Mr Sata was involved does not make him a saint or saviour as some ofyou would want us to believe. Just now as head of state has made numerous breaches and ommissions in law. So to claim that he is the innocent man Zambia has waited all these years is folly beyond any real

This Mr Sata has to demonstrate positively and be seen to be so. To begin to hold Zambian people at ransome by threats of dissolution of parliament falls short to the Zambians expectations of him as president. As a matter of fact I would support him if he’s urging us to have as few by-elections as possible because of time wasting and money things that need channeling to developing country.     there and we all knew that his wife is a Kaseba,sisters with Sata’s wife.He did a CABS qualification at HONE,then somehow found himself in UK for some booking keeeping or accounts
