PF petitions 50 seats and call for nullification of election results

More than 50 Patriotic Front (PF) losing Parliamentary candidates in the September 20, 2011 general elections have petitioned the election results in their respective areas.

Out of 68 losing candidates who have questioned the results, the PF has petitioned 51 while the opposition United Party for National Development (UPND) has petitioned 11, with MMD querying five and a losing independent candidate petitioning one.

The losing candidates have asked the court to nullify the election of the incumbent members of Parliament (MPs), saying their election to Parliament was null and void.

They also want the High Court to order for fresh elections, alleging that elections were marred with corrupt practices, intimidation, vote buying, and bribery.

In some cases, the losing candidates have also joined the Electoral Commission of Zambia (ECZ), saying the electoral body neglected its statutory duty of protecting them while in other cases, two losing candidates from different political parties have petitioned the winning candidates.

Those that have petitioned the results are losing PF Nyimba candidate Augustine Mwanza, who has asked the Chipata High Court to nullify the election of MMD’s Forrie Tembo while Ikelenge PF losing candidate Victor Kayekesi has petitioned the election of Elijah Muchima (MMD).

Losing MMD candidate for Kaoma Central Austin Liato and PF’s Enock Kaleka have petitioned the election of Antonio Carlos (UPND) while PF candidate Lameck Mangani (Chipata Central) has petitioned the election of Reuben Phiri, who won under the MMD ticket.

Losing candidate for PF in Lukulu West Eileen Imbwae has asked the court to nullify the election of MMD’s Misheck Mutale, while Emmanuel Chilubanama (PF), who was the losing candidate for Lunte has petitioned the election of MMD’s Felix Mutati.

UPND losing candidate for Solwezi Central Watson Lumba has asked the court to nullify the election of MMD’s MP, Lucky Mulusa.

Losing UPND candidate in Livingstone Frederick Chuunga and Josephs Akafumba of PF have both petitioned the election of MMD’s Lukulo Katombola, while PF losing candidate for Chitambo, Chanda Mutale has petitioned the election of MMD’s Mushili Malama.

Others that have petitioned the elections are UPND losing candidate for Petauke Central Cuthbert Phiri, who is petitioning former MMD spokesperson Dora Siliya, while PF’s Patrick Mwanawasa has petitioned the election of Evans Chishiba (MMD) for the Kafulafuta seat.

UPND losing candidate for Mufumbwe Elliot Kamondo has asked the court to nullify the election of Steven Masumba (UPND), PF’s Christabel Ngimbu has petitioned UPND’s Kakoma Wahuma in the Zambezi West seat.

Losing Chisamba PF candidate Oswald Chulu has petitioned the election of Moses Muteteka (MMD), while PF losing candidate for Feira James Pastor has asked the court to declare the election of MMD’s Levy Ngoma as null and void.

In Kapoche, PF losing candidate Paradious Sakala has petitioned the election of MMD’s Nicholas Banda, while Godfrey Banda (PF) has petitioned the election of independent Joseph Lungu in Msanzala Constituency in Eastern Province.

In Northern Province, Giles Yambayamba, the PF losing candidate for Senga Hill wants the court to cancel the election of MMD’s Kapembwa Simbao, while PF’s losing candidate for Mbala, Evaristo Simfukwe has petitioned the election of Mwalimu Simfukwe of MMD.

The PF losing candidate for Chilanga Geoffrey Chumbwe has asked the court to nullify the election of MMD’s Keith Mukata, while Kaweche Kaunda of the PF who lost the Malambo seat has questioned the election of MMD’s Maxwell Mwale.

PF’s Ingrid Mpande has petitioned MMD MP for Mkushi, Mutale Musonda and ECZ as first and second defendants, respectively.

Maina Wamunyima (PF), the losing candidate for Senanga Central has asked the court to nullify the election of Likando Mufalali (UNIP), Mutomena Mubiana (PF) is petitioning the election of MMD’s Poniso Njeulu (UPND) in Sinjemela Constituency while MMD’s Richard Simbula has petitioned the election of UPND winning candidate for Mangango, Robert Chiseke.

Others are MMD’s Maurice Munembo (Nalikwanda), who has petitioned MMD’s winning candidate Geoffrey Lungwangwa, Truman Simuyuwa (PF), who lost the Liuwa seat and has petitioned the election of MMD’s Situmeko Musokotwane while in Sikongo, losing PF candidate Kufuka Kufuka has questioned the victory of MMD’s Ndalamei Mundia.

The PF petitioners are represented by KBF and Partners, MNB, Dumisani Tembo and Company, Messrs Andrea Masiye and Company, Messrs Ellis and Co, Chola Chama Legal Practitioners, Messrs Fred Jere and Company, and AD Mwansa Mumba and Company, among others.

The UPND petitioners are being represented by Messrs Mwiimbu and Company, while the MMD is represented by George Kunda and Company, among others.

Instead of performing their role of providing checks and balances, they mounted a WAR to FRUSTRATE government programmes, even if the programmes were for the good of Zambians. Because PF loves Zambians, and wants development, they wish to have the majority so that such nonsense of frustration should come to an end.

As a Zambian am proud of my country and it’s diversity…I have more to cherish about my beloved Zambia than I can look for everywhere else in this world! Is this the way we want to spend the hard earned tax payers money who are so underpaid in the first place!   10. this is interesting. but my worry is the cost of holding elections. interms of eastern l would support Lameck magani petition because even the former president promised that he will ensure mangani losses and he lost. five trucks were caught ferrying villagers to vote against him. viva mangani.

    • I understand how you feel about this Mushota woman. she has some serious complex issues. She strikes me as someone who had a very rough childhood, low self esteem, grew up in poverty etc. Now that she lives in a foreign country and is engaged to a white man she thinks she’s arrived. Mushota if you are reading this please get some help from Jesus……it’s not too late to humble yourself. Read the book of proverbs so you can learn one or two things about wisdom and humility.

  13. the only reason we may see such numbers could be that this move is being supported by the highest organs within the party. If this assumption is correct, we must slowly but surely start forgetting about the development agenda promised by these politicians. I know a lot of PF supporters would be happy the the tables are turned in the partey but at what cost….. over 51 by elections at a go? this is mini general elections budget only with a poor voter turnout. PF please stop running away from the main issues i.e. education, infrastructure develop, health, employment creation, housing, fight corruption (though this is now questionable)

  15. With all these PF’s losses at grass roots wonder how Sata managed to scoop the hot seat. I am sure RB is still kicking himself how the MMD licked the dust? As much as Sata won it is a clear indication that PF wasn’t as popular as we think it was. PF knows with this hang parliament anything they do will be blocked so they might as well have re-election to attract defectors and gain outright majority in parly.

Opposition is healthy in any democratic country. I am beginning to think that Zambians messed up by voting out MMD. We are going back to one party dictatorship. I will be very surprised if the courts will grant a hearing to this nonsense. Zambia has more problems: high levels of poverty, no jobs, UTH shutting down the surgical operating room due to no ventilation, Poor health system in general – than wasting money on the so called elections. Is this what you people promised to do in 90 days? Taking more money out of our pockets…Shame!

  20. wow,this is a joke,let us have fresh new elections both presidential and parliamentary,why aren’t the winning canditates petitioning the results?they can also say that i think i won by a larger margin,i want a recount,but no it’s only the losing candidates.i think they are just bad losers.and i agree with all those saying the cost of having these elections would be too much for our economy to handle.we are just from having major elections and the cost was huge.so lets just work and wait for 2016.zed politicians are just selfish.

  21. These guys are living in the past. Zambia is not a one-party state anymore. The PF swept MMD from power purely through the presidential elections. Sata was the factor – not the MPs who genuinely lost. Let us see how this will pan out. But one thing is these guys are selfish and insensitive.

  23. The courts should be aware that these elections were certified free and fair by various local and international observers. The new government is in place and Zambians are expecting delivrely of promises from the new govt. While it is acceptable that the elections were not 100% perfect and no election in the world is 100%, only where serious breaches were commited can be referred to ECZ. Elections will de tract PF govt from delivering the much needed services to Zambians. PF can turn round and claim they are busy with by elections at the expense of development. ECZ and courts need not entertain claims by losing candidates any how as some of these people were not only rejected by the voters whether MMD, PF, UPND etc, but by elections are expensive to the nation.

  24. The MMD has caused all this because of their well known rigging habits and other corrupt practices. Never before in Zambia has a party acquired so much ill-gotten campaign materials and cash ( ‘We never knowingly abused state funds’). It is interesting that Musokotwane is one of those petitioned but I think he is still going to retain the Liuwa seat because he will ensure that every villager gets a bike or two.
    This will be a very costly exercise but let the petitions be heard so that we learn to hold corruption-free elections in the future.

  25. This is a strategy, the opposition are frustrating the govt policies so as claimed. So they need to sort them out through petitions and kick them out. The number is too big, but let us wait and see how the courts will handle this one. The petitioners are just too many, but luckily they have the right to petition the results if they feel cheated. It is just strange even chaps like Patrick Mwanawasa who conceded defeat he can now claim the election was not free and fair :-? ! This whole situation is just a ploy aimed at finishing off the opposition. I wonder how ECZ would fund all these election in an event that the courts ruled in favor of the petitioners!

Sata wants these By-elections so that he can have some numbers in Parliament which will help to remove RB’s immunity. We as Zambians are not interested in this Power consolidation. The Pf Government promised to do everything in 90 days and people are waiting and watching. They should not waste time settling old scores but should realise that they in the Office and need to deliver. The days of MMD is long gone and if they fail, they will not fail as MMD but PF.   44. The pertitioners are free to do so. You cannot rule out rigging by mmd with all those material things which they were bribing eloctorates with. There has never been such a huge budget for an election campaign in the whole of Africa. So the oposition who won it was because people wanted change, meaning that what the mmd won was because of vote buying which is against electoral rules. Therefore pertitioners are right to petition

Even the fuel cost reduction has failed to bring down transportation costs, so groceries are still as expensive as in RB’s time! PF please get to work.   47. Losers have the right to petition the elections and it will be up to the courts to decide. My bet is that these cases will take between 3 to 4 years by the time they are decided by the Supreme Court as the aggrieved parties will surely appeal. This will mean 1 to 2 years before the next general elections. The question is it is worth while to petition elections in our country.

    My instinct is that it’s a waste of time trying to recapture what has already been lost. Anyways, it is their legal right, so let them go ahead and petition. Some of them have good chances to win, others may just fall again… and this time even harder.

  52. I am thinking that the ruling party PF is now losing direction. e.g 1 Patrick Mwanawasa accepted defeat when the results where anounced today he is petitioning. There must be something wrong, 1 could be he himself is confused or there is an influence from the party. Secondly it seems to me PF wants numbers to increase for their memebers of parliament. As they are finding it difficult to make thing work for them easily, this is simply democracy accept the losses and make the next election better. Lastly LT wrong name for Fiera MP it is Patrick Ngoma-he cannot lose that seat when he stands on it as he did because those are his people he worked tirelessly for the people there and brought about lots of development when he was MP there before he was Ambassador.-This is malice.

  61. Ok, fine, its their democratic right to petition, but these petitions suck. They are about being selfish and power-hungry and the ‘me, myself, I’ mentality. Are we saying these people can’t look at the bigger picture? they say 2 wrongs will never make a right. Imagine at the rate of inconsistencies and errors of the new government, and they became the majority in parley, where will we reach as a nation in the eyes of the international community? And to think of it, over 50 seats for petition isn’t that a mini-general election! Money which could have been put to good use will be diverted to these by-elections, in whose selfish interests? Zambia is in serious trouble, at this rate we are going.
