Former Zambian High Commissioner to Canada Dr Nevers Mumba has sued Zambia Daily Mail and its Managing Editor Anthony Mukwita for defamation of character.

Dr. Mumba is seeking compensation of over five hundred million kwacha following the publication of an article in the newspaper dubbed ‘Nevers in five hundred million kwacha gold scandal’.

Dr Mumba is further seeking an injunction restraining the paper, its servants and agents from publishing, printing distributing same or similar articles about him.

According to the statement of claim filed before the Lusaka High Court, Dr Mumba is claiming for damages including aggravated or exemplary damages for defamatory libel contained in the said article.

Dr Mumba contends that he is a politician and member of the MMD, who has held various positions the last being that of Zambian High Commissioner to Canada.

He said he is also an ordained pastor and founder of Victory Ministries and a television evangelist widely known both in Zambia and internationally.

Dr Mumba stated that Mr. Mukwita is the Managing Editor of the Zambia Daily Mail and was responsible for all articles published in the newspaper.

He said the defendants caused to be published a false and malicious story about him which was widely circulated throughout Zambia and the world both in print and electronically online.

Dr Mumba said the words in the article were false and published out of malice and reckless disregard for the truth.

He said the words in their ordinary and natural meaning were understood to mean that Dr Mumba was a criminal who was connected to an illegal criminal scheme involving five hundred million kwacha.

Constitutionally we have separation of powers in Zambia it becomes a circus if the Executive is the accuser, arresting officer jury, prosecutor etc. We abhor corruption but the anti graft should be institutional and not a scheme of aberration through hatred and malice planted in tabloids before due process of the law. 

  2. Zambians never forfeit your fundamental rights to any regime electable and dismissive with your suffrage rights.

The Democratic society world over know that virtually every government tyrannical ones such as PF included wants to be seen as a democracy, but many as Sata is doing resist allowing the basic tenets of democratic order that would make democracy meaningful because that might jeopardize their grasp on power. Instead, governments use a variety of antiquated subterfuges to manage or undermine the people they know very well they cannot subdue come what may. Mubarrak, Gadaffi, Mobutu, Romanian Dictator Nicolae and Elena ceausescu where too powerful yet people power got them fixed. Beware of your delusions Sata there are no acts of subversion but quest for dignity and a democratic order.

The techniques used by such disillussioned autocrats as Sata recklessly evoking the national Army to mobilize and take on democratic civilians to tame the nettlesome unpredictability of democracy are dangerous filler dictators never learn from those who have failed such as Mubarrak. The task Despots face is to appear to embrace democratic principles while avoiding any risk of succumbing to popular preferences a devolution system can over from North-to-South, East-to-west. Cheap manipulations, political violence, press censorship, repression of opposition, even making reckless military decrees are all being used to curtail the prospect that the proclaimed process of democratization might actually lead to a popular say in government.

I will support Sata the day i will see that his quests become institutionalized and systemic consistent with our Republican constitution.Will never support these haphazard self designed schemes of hatred, malice and myopia which come and go with despots. Zambia is bigger that leaders and their regimes which come and go.

    • Settle in and keep watching like most of us are doing……..three months ain’t enough for any president to institutionalize anything. So for now PF/Sata deserves the benefit of the doubt.

      By the way, I sort of detect a softer and mature attitude towards issues in you sir, at least an attitude that reflects better on what your name (Senior Citizen) entails—–wisdom!

So this guy was also wearing “chi kampompo” to go and mine gold?! Wow, had he dedicated the same amount of time to pastoring, the entire Canada would have been converted to ‘Borne Again fimo fimo”. God have mercy!!

  9. We the Zambians are a great nation, a nation whose birth was at a cost borne by our founding fathers. Over decades, Zambia has been managed by a number of leaders, some with good intent and yet others with selfish motives. We, the Zambians resolved to be a democratic nation where among other things are that every Zambian is entitled to fundamental rights and liberties as enshrined in our republican constitution. These rights are bequenched on us without fear or favour. Today, only a foolish optimist can deny the dark cloud of realities unfolding before us. This great nation will endure, as it has endured, but will revive and defeat fear. “The only thing we have to fear is fear itself”.

It is entirely artificial and self delluding to believe that one group of people can dominate the rest of our nation. We cherish the ideal of a democratic and free society in which all Zambians live in harmony and with equal rights and opportunities. It is an ideal which we hope to live for as handed over to us by our founding fathers and hope to achieve it for postelity. As Nelson Mandela put it, “But if needs be, it is an ideal for which we the Zambians should be prepared to die defending it”.

Sata knows if left unchecked, Nevers is a possible threat to PF. Nevers is more charismatic and can command a huge following and can actually bring MMD back into power in the next elections.

  18. Evidently correct and stipulated procedures of managing public funds were not followed by the former high commissioner, Nevers Mumba. If what is contained in the audit report is correct then the pastor is guilty of financial impropriety. This is not a witch hunt. Mumba took advantage of the thieving culture that MMD practiced and finely tuned by RB and Sons LTD. He firmly believed that his former boss will retain power to continue swindling Zambia. I only hope these investigations will result in mass imprisonments  for the culprits. I sincerely believe that at least 3/4 of those in civil service jobs have had a hand in plundering our resources. If it was up to me I would have fired every body and hired fresh and untainted civil servants.

What has happened to scripture which says , “vengeance is mine I will repay says the Lord” ? now men of God are taking people to court, how shall we deter people from taking vengeance as men of God? The best thing Pst. Mumba should have done is pray for these people and let God vindicate him. If you want to retain dignity just keep quiet no matter the accusation.

    Even in the UK the media get sued when they defame someone and they pay a lot of money. Everyone in the UK feels protected, no one has the right to tarnish the name of another person without cause. Do just hate, do what is right.
