Zambia’s problems due to the absence of a good constitution-Chitala

Zambians gave the PF government the mandate to rule in return for good governance and development as they promised during campaigns and any efforts aimed at taking the country backwards should be rejected by every Zambian.

Former ambassador to Libya and Zambian academician Dr Mbita Chitala pointed out that the only way forward for the PF government was through good governance which can only be provided by a constitution that will stand the test of time.

Dr Chitala said all the problems Zambia was currently facing were due to the absence of a good constitution.

He said until the constitution issue was resolved, Zambians will never cease to face the problems they are currently going through.

Dr Chitala said a good constitution will address all the power imbalances, wage issues and some undemocratic tendencies that surface from time to time.

Dr Chitala urged the PF government to quickly come up with a roadmap on when the referendum should take place so as to end the constitutional making crisis once and for all.

He was speaking over the weekend on a program called “Democracy Now” on Zambia Blog Talk Radio.

Dr Chitala called on the Zambian Diaspora community to give every support to ensure that Zambia comes up with a constitution that represents the will of the people.

Meanwhile, over the weekend, Justice Annel Silungwe said the Technical Committee has made it a point to consult extensively on the constitutional making process in order to achieve an inclusive and people-driven constitution

Justice Silungwe, who is the chairperson of the technical committee on drafting the Zambian constitution said the committee wants the constitution to derive its legitimacy from the people.

“We have consulted with the blind, the youth, children, church organisations, trade unions, professional bodies, the judiciary, Electoral Commission of Zambia, civil servants, Public Service Commission and Members of Parliament,” he said.

Justice Silungwe also said that the comments that have been received during the first phase of the consultation process, indicate that members of the public have an interest in the constitution making process.

He said interesting issues have emerged from members of the public in the media with some comments showing that the people understood the proposed clauses in the draft constitution; while in some cases more explanations are needed on certain clauses.

We have talked enough, its time the ACTION MAN DELIVERED the constitution as PROMISED…..Chitala 100% correct- most of Zambia’s governance problems, the shattered dreams&hopes are bcoz of the barbaric constitution, it has no place in a modern democracy. It’s sad tho for people like chitala,who had chance in govt but failed to change this Sir Roy Welensky constitution that was crafted to oppress the zambian majority….It’s time zambians arose enmass to  Zambian a better DEMOCRATIC constitution whose governance structures truly reflects govt of the people,by the people ,for the people

  3. A constitution is only as good as its leaders and people. We could have a great constitution, but if the leaders are mental retards or imbeciles, then expect typical performance from them. What we need including a good constitution, is a system that ensures that brain-dead individuals do not get voted into offices of public interest. There is no substitute to good, well geared individuals whose sole aim is to serve the nation at large. We need a good constitution PLUS good individuals with goals and objectives to serve all citizens of Zambia regardless of tribe, religion, or colour. Their goal must be to serve Zambia and not foreign or tribal interests.

  4. the key is to educate many zambians so that they can not be cheated of slogans like the 90 day development program.to make their brains deal with realities of life not theories,weigh between truth and campaign slogans.unfortunately many zedians vote based on campaign slogans ,its high time to vote on truth and realities and this can only be achieved if majority of zedians have attained aleast G12.we can deal with the constitution but if the majority of us do not understand then we will still fall prey to the same fate.the consti is vital but lets not make a mistake that it will solve the problems but it is just a first step in the right direction.i strongly believe that we ought to change our mentality and our cultural trend.the tonga and lozi(not tribal issue but the truth &real)are cons

  5. conservative ,the easterners and bembas are liberals.the n/westerners ,lusaka,cb are other main towns are independents.so as a country we need to embrace the culture of centrist idealogy,same applies to our economic approach we can not be wholly capitalist as this blends alot of tax evasion and manupilation of the rope holes in the tax system,so we shud embrace public and private enterprenuership but we need to make public business very independent from political appoitments of which the PF govt have failed to do-kabimba board member on zamtel.private demagogoes like the post news paper which will soon go like unip .the biggest problem in PF govt is the YES boss sydrome by sata s advisers and the bembalism in a nation that has enjoyed peace since its creation,its time 4 the 70 and up mps

  6. to take the country to an economic indepedence,i do salute the old generation for whe for their courage to liberate zedians but we need a leader who can liberate us from the colonial mental slavery and he is from the 1965 and up generation,who should understand global business and above all selfless.but do we have that kind of leader from the current political parties.the answer is NO ,hh was embroided in the privatisation of our companies and he capitilised on the weakness of the privatisation codes and earned himself billions of kwacha,so he is still not a clean person and also his culture trend is conservative that means he is only covering tongas and lozis,so he can not govern but they are many lozis and tongas who are centrist and those are what we are looking for,otherwise its cry 4

  7. my beloved country.china,india and brazil a decade ago were not a threat in terms of economy but today usa signs alot of trade agreements with these countries becoz they have promoted private and public business to a world level standard,zamtel,zesco,mines and the agriculter sector is were govt can/is actively involved politically ,these public business should be very indepent like the FEDERAL RESERVE BANK IN THE USA,created by congress but not answereable to them,raises its own money and loans it to the federal govt who in turn pays back in form of bonds,ok not many zambians will understand this but some will.

  9. Great observation ba Chitala. But if Mwanawasa was worth the salt that is attributed to him, he would have given us a people driven constitution. How can we now expect a born dictator and bemba supremacist like Sata to give us a people driven constitution? Never. We have to dream for another savior to do that. sata can never do that. reduce his powers and be answerable to the people that voted for him? He would nt want to do that. He wants to be in total control denying the nation development and ruining it until he hands over power to his relative to also continue the same and so on and so forth. That is an african leader’s mentality.
