Godfrey Miyanda questions the process of Lifting RB’s immunity

Heritage Party President Brigadier General Godfrey Miyanda has question the process used to lift Former President Rupiah Banda’s immunity. In a statement released to the media, citing several flaws, General Miyanda questioned the rationale behind the summoning of the former head of State despite the fact that the Justice Minister Wynter Kabimba telling the nation that the Government was ready to go to trial and the investigating wings had completed their work.

Below is the full statement.

STATEMENT BY BRIGADIER GENERAL GODFREY MIYANDA ON THE PURPORTED LIFTING OF THE IMMUNITY OF FORMER PRESIDENT RUPIAH BWEZANI BANDA

An analyst and human rights activist has urged that in view of the purported lifting of the immunity of former President Rupiah Banda (RB) debate be stopped;

I disagree. It is important to continue debate regarding the process in spite of RB’s new status because this is another assault by the executive on one of the pillars of our democracy: the legislature.

Those proceedings were conducted in bad faith as they were predetermined and the Motion itself is flawed.

Bad faith arises because of the questionable process schemed by the Executive, including bringing this contentious constitutional issue on the last day of seating and holding a caucus to instruct the PF MPs and opposition Deputy Ministers how to vote; the issue is not partisan but constitutional and legal.

Further, some MPs supporting the Motion introduced prejudicial and extraneous matters. Honourable Nkandu Luo gave ‘evidence’ that President Banda spent one million dollars in her Munali constituency. Honourable Panji Kaunda gave ‘evidence’ about his family without formally declaring interest; another MP claimed that for 20 years his constituency has not been developed and that all this time his people had been suffering. These submissions were prejudicial.

These MPs are potential witnesses who should give evidence on oath and be cross examined at the trial. Are these the grounds for lifting RB’s immunity? Was he answerable for what happened 20 years ago? Interestingly why not mention 49 years ago?

The Motion is flawed because it is speculative and inconclusive. It is not for the accused former President to prove his innocence or provide the proof before he is arraigned and prosecuted.

I contend that a motion under Art 43 is like an indictment or a criminal charge in the ordinary courts because the direct outcome of an affirmative resolution is the trial and punishment of the former President. Hence in such proceedings the National Assembly acts as a quasi-court.

I contend that proceedings under Article 43 (3) are akin to a Preliminary Inquiry (PI) in a subordinate court, verifying and determining whether the allegations indicated meet the requirements set in the specific provision under which the Motion has been moved.

I say so because the purpose of a PI in a criminal proceeding is not to try the accused but to establish whether there are sufficient grounds to warrant sending a case to the appropriate court to try the matter because the court conducting the PI has no jurisdiction to try the case but acts as a sieve for another court. The proceedings in a PI are inconclusive, just like the proceedings in the National Assembly, as they do not try the accused but refer him or her to the ordinary courts of the land.

Additionally the ingredients of the Motion were never debated by any of the supporters of the Motion, including the Minister who moved the Motion.

Last but not least the fast-tracking of the GJIT summons to President Banda is suspicious. The Motion was debated on Friday 15th March, 2013 and within hours they had issued their summons that was covered by the media.

Who informed the GJIT of the resolution, when and how? Did the Speaker or his office communicate to the GJIT in the night for them to summon RB based on the proceedings that were concluded on Friday after 19.00 hours?

It is the practice of Parliament to edit the record of proceedings before passing them as a true record. This includes circulating the verbatim record to be corrected by MPs who debated. Has editing been done?

There is no need to summon President Banda to answer questions. The Minister informed the House that the State was ready to proceed to trial because the GJIT had finalized their investigations.

Did he lie to the members? Besides, Article 43 is intended to prosecute a former President after removing his or her shield; that is why the Motion has to disclose in full what the acts are that bring the allegations within the ambit of that Article.

To interview him may amount to badgering and harassing him. Is the State not ready and do they now want to go fishing for evidence?

THE STATE MUST GO TO COURT WITH THE CASE THEY HAVE LAID BEFORE THE NATIONAL ASSEMBLY WHICH THE MPs ENDORSED AND RESOLVED IN THE AFFIRMATIVE, unless they are now not ready! The State should not be allowed to bring other charges that were not determined by the National Assembly.

It is the duty of the accusers to prove their case before he can respond, that is if the court finds him with a case to answer. If there is no case to answer end of story; there are no short cuts in these proceedings.

      On the other hand you need to do more than come up with articles like this. Be on the ground, mobilize, its the only sure way to attract people to join you.

    • The legal and procedural issues raised by the General are indeed valid. If we are going to set a precedent let us do it right and not through shortcuts. The very procedures are put in place to protect the rights of all people. Let us not encourage incompetence and mediocrity by just supporting from a partisan point of view. When the govt makes a move, it must be seen as well thought out, clear and in the best interest of the nation. #We need to raise the standards of our political discourse and institutions#

    • It is govts duty to be seen to be fair in all dealings. Let us not think from a partisan view. RB can be made to pay or even have his immunity removed but let us not rush and do it wrongly. When FTJ lost his immunity the seriousness of the matter made Levy to address the nation through parliament. It should not be about a battle between kabimba & RB but it should be about strengthening and improving our institutions. A vindictive and shallow leadership is headed on a very destructive path. Criticism should bring the best out of us not the opposite. Take on board Miyanda’s concerns, it won’t kill you

    • Reason and logic would lead me to believe that the basis for lifting a former president’s immunity need not be exactly the same as the basis for prosecution. There might be only one case only warranting the lifting of immunity and perhaps more that are worthy of prosecution! But then, I’m not a lawwyer, and you never know with with law!!

He is not as wise as people portray him, otherwise with all the opportnities he was offered, he would have been president by now. But he refused an olive branch from Mwanawasa for him to be vice president and now he’s a one man party all because of his personal and selfish motives.

    • let him answer for whatever,but ba miyanda is just saying follow the procedure to lift imunity. pantu from what i read as the crimes for RB,the case is not so strong,so what will happen is they will need to dig up more vindicating cases against RB which they are not allowed since the imunity lifting is based on the cases they presented to parliament. so they might actually make it easy for RB to go Scott free because they didnt take time to present a powerful case to parliament to lift his immunity. thats all the general is saying.

  12. The General isn’t disputing whether RB stole or not. That’s for the courts to determine. Rather he’s analyzing the process by which parliament deliberated in lifting the immunity. He’s suggesting that it was flawed thereby rendering the motive questionable. The.     • The general is not a lawyer but an administrator. He has very good understanding of Parliamentary and court procedures. He does not hire a lawyer to represent him in court.

Instead of attacking the people that executed that process, attack the constitution and provide alternatives on how the constitution should be other wise you are just making irritating noise!     • Ba Munyelo; you are refusing to appreciate what the General is saying just because he is exposing the short falls of the process adopted. The constitution provides for lifting of immunity and the general isn’t questioning that. Firstly, he cites the interference of the executive by whipping into line of the PF MP’s and poached MP’s to vote in a certain way to suit the desired objective and the cunning way the motion was introduced. At a time when a) it was known that a number of opposition MP’s wouldn’t be around and on the last day of parliament seating so that the motion wouldnt be re-visited. The General has always been consistent and is a more sobre minded individual than alot of the leaders of our political parties. He is as it were, the head corner stone that was rejected.

I have noticed that he always signs off as “GODFREY MIYANDA, BRIGADIER GENERAL”, but does not indicate that he is retired or not, by adding “retired” or “Rtd” after his title as is the accepted practice. But I notice he refers to others as “former” president so and so, “ex” this or that , but never in reference to himself or his status. A question of clinging to past glory, I wonder?

  19. Lifting of RBs immunity was the right thing to do. Infact former Presidents should have their immunity removed at time of leaving office so we do not go through this husle all the time.

  20. One would have thought Zambians learnt a lesson from the dangers of the secrecy that sorrounded the sickness and subsequent passing of Levy Mwanawasa to not make the same mistake again. Just a mere look at Sata’s face & his increasingly erratic conduct in public shows the man is marked for death. Miyanda appears authentic and fit for presidential office and could easily have won the hearts of Zambians had he been a little aggressive in his approach and interested in the welfare of the people. But his lukewarm style and incomprehensible village concepts does not appeal to people who want it now. So the people went for Sata who knew what they wanted to hear. I think Gen Miyanda is one of the few honest politicians in Zambia, but lack of charisma and aggression, a viable and simple message will ensure he doesn’t get the presidency.

Even before the current President Sata came into office, there were insinuations from various quarters that illicit transactions were being perpetuated by his sons using his name and position as President. Please Mr. Banda will be heard in court. Punkt!

    • It is the Accuser rather the Prosecution that has to prove beyond reasonable doubt that RB is guilty as charged. He has not been found guilty for him to prove his innocence.     • Tell them because the corruption and abuse was there for all to see under RB. I was in the country in March of 2011 and within 2 days decided ZNBC was not worthy to watch. If it was not RB, then it was one of his henchmen Shikapwasha or Dora Siliya and black mamba chanda chimba. Ne ule balibepeshafye by the sudden U-turn of some Zambians. HH and others siding with RB now were screaming on top of the voice against RB in 2011. So what has changed now when the law has been followed and applied as per our constitution?

  32. Miranda is just trying to say something but deep down aziba ati alabi azamangiwa. One reason Zambians voted alabi out of state house is rampant stealing. So, nothing is speedy here. The GJIT called Alabi for questioning but he refused because he had immunity. So parliament removed it so that he can ans to his theft charges. Nothing personal with MCS. He is just implementing the campaign promises. Sata is on record that once voted into state house, he wil prosecute all thieves including alabi and sons.
